The Democrats Have a “Dossier” Problem, and It Will Not Go Away…

Journalist Kimberley A. Strassel is one of the few mainstream journalists writing about the collaborative 2016 DOJ/FBI “Trump Operation” with a sense of what is to come.  Strassel likely understands where the story is going, and appears to have a solid grasp on the evidence trail, yet necessarily writes cautiously – the stakes are indeed quite high.

Today Strassel writes about the need for the Democrats to rehabilitate the Steele Dossier because the alternative origin, the truthful origin to the counterintelligence operation over the campaign of candidate Donald Trump, is a stunning political risk.

Two weeks ago the New York Times narrative said the Steele Dossier was nothing, irrelevant, and had nothing to do with the FBI beginning “Operation Trump”.  Today, mysteriously, Democrats embrace the Steele Dossier as they justify the DOJ/FBI counterintelligence and surveillance operation over an opposing political candidate.

The motive is transparent. If Democrats do not embrace the Steele Dossier as a national security origin for the entire DOJ/FBI operation, the real motive is subject to exposure.  That real motive is political. That real motive cannot be justified. That real motive presents a legal risk that must be avoided.

However, while Strassel’s outlook is almost guaranteed to be correct, there’s an angle that Democrats have likely not considered; and/or they will not easily be prepared for.

Let me put it this way, in the form of a question:

The Steele Dossier is the “least bad” option to justify the origin of the DOJ/FBI “Trump Operation”.  However, what if the Steele Dossier is the finished product of the DOJ/FBI “Trump Operation”,  not the beginning of an investigation?

What I mean by that is… our research indicates the “dossier” information is likely a fabricated story woven from loosely connected factual evidence derived from DOJ/FBI unlawful FISA-702 query use, and not vice-versa.

That is to say… The information within the dossier came from early 2016 FISA-702 abuses by contractors working for the FBI. It appears from the fact pattern that elements from the FISA-702 queries generated intelligence bytes that were later laundered by Christopher Steele and became elements within his completed intelligence ‘dossier’.

The “Dossier” did not precede the FBI’s FISA-702(16)(17) surveillance applications to the FISA Court; the Dossier was actually constructed from previous unauthorized FISA-702 queries.  A self-fulfilling intelligence prophecy per se’.

As a consequence, if the Democrats embrace the Dossier, and congress exposes the origin of the material within the Dossier, the Democrats end up embracing the conspiracy within the origin of the Dossier.

Funny that.

I wonder if they’ve thought that through?

Let me take a prudent moment to clear some things up for those who are following this story closely.

First, the MSM is about two-weeks behind understanding the researched evidence you have read in our ongoing analysis of this story-line. They are currently debating “FISA Warrants”, without even beginning to fathom that FISA-702 queries don’t require FISA Warrants.

Additionally, the FISA Court doesn’t give FISA-702 “Warrants”, they give FISA-702 search or surveillance approvals.

Secondly, the conservative media are still scared of this story.  The ramifications are almost too large to fathom.  A sitting president (Obama) knowingly involved in the weaponization of the FBI and DOJ to target a political opponent?  That’s a story that scares the hell out of the financial media.  One of the reasons it scares them is they are still suffering from the long-term side effects of “Battered Birther Syndrome“.

Those who are willing to engage in this story are petrified of being called a “Conspiracy Theorist” (etc. and writ large).   In a weird way now you know why this little political research website is called “The Last Refuge”.  We discuss the evidence and downstream facts that others are frightened to mention.  No big deal. Those tender voices read here to figure out where the story is going….  we leave the trail… they follow.

When the financial media arrive at the destination, they shout “look what we found”. Meanwhile we’re chilling on the perimeter up ahead, resharpening the machetes, watching them celebrate their discovery in the rear view.  No biggie. I digress…. moving on.

Let’s explain FISA because the media is taking too long to understand complex facts within the story.

We’ll break down the term: “ FISA-702(16)(17) ” into the elements that will help you make sense of this story in the future.

  • FISA – Foreign Intelligence Surveillance Act
  • 702 – An American caught up in the process of Foreign Surveillance
  • (16) – A search query based on “TO” and/or “FROM”
  • (17) – A search query based on “ABOUT”

Again, to repeat, there are differing FISA rules for use of the NSA or FBI database depending on the originating intelligence compartment.

If a search is conducted from an intelligence agency of the U.S. government whose objective is to ensure “National Security” there are different FISA rules than a search from an intelligence agency not engaged in “National Security”.

The DOJ has a National Security Division.  Their compartment rules on FISA searches and reviews are different from the DOJ Civil Rights Division.  There are 30 DOJ divisions.

The FBI (a department within the DOJ) has a Counterintelligence Division that focuses on terrorism threats etc.  A FISA search from within the Counterintelligence Division has different rules than a FISA search from the Science and Technology Division.

When a FISA-702 search is conducted based on the need for “national security” no approval from the FISA court is needed.  Search away.  If the FISA search is because of a “vital national security interest” the resulting search data can be opened without seeking permission from the FISA court.

♦A “FISA-702(16)” Search Result – would be a search result of the FBI (counter terrorism) database or NSA database that returns an American person as a result of a “To” or “From” (16) type data search.

EXAMPLE: Querying phone data (phone number)  TO: Mohammed BadGuy or FROM: Mohammed BadGuy  – might return a list of phone numbers that also contains an American persons phone number.  That American person is protected by the fourth amendment.  To look at the “upstream” connections of the American Person to other people, likely Americans, the search operator would need to ask permission of the FISA Court to review the upstream results.

[NOTE: *Exception* – the search was vital to national security. If so, the upstream phone numbers could be reviewed without asking FISA permission.]

♦A “FISA-702(17)” Search Result – would be a search result of the FBI (counter terrorism) database or NSA database that returns an American person (702) as a result of an “ABOUT” (17) type data search.

EXAMPLE: Querying everything in email ABOUT: Mohammed BadGuy – might return communication of an American who wrote a letter about Mohammed BadGuy or maybe he told a friend in a text to check out a media story about Mohammed BadGuy.  To look at the email or text of the American, the search operator would need to ask permission of the FISA Court to see the email/text content.

[NOTE:  *Exception* – the search was vital to national security?. If So, the email and text could be looked at without asking permission]

It was the 2016 FISA-702(17) “About Queries”, returns from searches, that were identified in 2016, by NSA Director Admiral Mike Rogers, as being conducted by the intelligence community (FBI), by “contractors” and “individuals”, for reasons that were unauthorized; had nothing to do with National Security; and did not request FISA Court Approval.

Mike Rogers discovered FBI contractors doing FISA-702 “About Searches” that resulted in returns providing information on Americans.  Those results were passed on to people outside government.

Pg 83. “FBI gave raw Section 702–acquired information to a private entity that was not a federal agency and whose personnel were not sufficiently supervised by a federal agency for compliance minimization procedures.”

(2017 FISA Court Opinion – 99 Page Brief)

Someone inside the FBI was giving FISA-702 search results on U.S. individuals to a private entity that had nothing to do with government.   Those 702 (American Citizen) results were not “minimized” and exposed the private data of the American citizen(s).

In addition, NSA Director Mike Rogers, who is also in charge of Cyber Command, discovered people within the intelligence community were doing “searches” of the NSA and FBI database that were returning information that had nothing to do with “Foreign Individuals”.

Rogers requested a full FISA-702 Compliance Review.

As an outcome of that review, the DOJ/FBI compliance officer noted FISA violations. Again, the FISA Court (page 84):

We do not know how many FISA-702 violations took place prior to NSA Mike Rogers initiating the full FISA-702 review in April 2016.  Nor do we know who the insider FBI individuals were; or what results were passed on; or what was done with the results.

However, given the nature of what was taking place at the time (March, April, May, 2016) it appears likely this was part of the DOJ/FBI/Fusion-GPS collision to gather information on the candidacy of Donald Trump.

CTH received a tip that Fusion GPS (either ‘individuals’ or the company) were one of the “contractors” mentioned, additionally the “private entity” could also be inside the Fusion GPS network.  Another “contractor” could possibly be CrowdStrike.  From all appearances there were multiple people involved.

These ‘passed-along’ FISA-702 search results appear to be the seeds which were fertilized by Glenn Simpson, Mary Jacobs, Nellie Ohr; “unmasked” by Obama administration officials; and enhanced/laundered by Christopher Steele – to end with a “Steele Dossier” returned to the FBI via Counterintelligence Agent Peter Strzok, DOJ Deputy Bruce Ohr, and DOJ/FBI lawyer Lisa Page, for their “insurance policy”.

The DOJ and FBI then took the dossier, full circle, back to the FISA Court to gain 702 surveillance authority and approval (media says ‘warrant’), upon the Trump Campaign (October 2016), and President-Elect (after November 8th, 2016).

In October 2016, immediately after the DOJ lawyers formatted the FBI information (Steele Dossier etc.) for a valid FISC application, the head of the NSD, Asst. Attorney General John P Carlin, left his job.  Carlin’s exit came as the NSD and Admiral Rogers informed the FISC that frequent unauthorized FISA-702 searches had been conducted. Read Here.

All research indicates the intelligence information the DOJ and FBI collected via their FISA-702 queries, combined with the intelligence Fusion GPS created in their earlier use of contractor access to FISA-702(17) “about queries”, was the intelligence data delivered to Christopher Steele for use in creating “The Russian Dossier”.


IG Stimulated Releases of Information:

♦Release #1 was the FBI Agent Strzok and Attorney Lisa Page story; and the repercussions from discovering their politically motivated bias in the 2015/2016 Clinton email investigation and 2016/2017 Russian Election investigation.

♦Release #2 outlined the depth of FBI Agent Strzok and FBI Attorney Page’s specific history in the 2016 investigation into Hillary Clinton to include the changing of the wording [“grossly negligent” to “extremely careless”] of the probe outcome delivered by FBI Director James Comey.

♦Release #3 was the information about DOJ Deputy Bruce Ohr being in contact with Fusion GPS at the same time as the FISA application was submitted and granted by the FISA court; which authorized surveillance and wiretapping of candidate Donald Trump; that release also attached Bruce Ohr and Agent Strzok directly to the Steele Dossier.

♦Release #4 was information that Deputy Bruce Ohr’s wife, Nellie Ohr, was an actual contract employee of Fusion GPS, and was hired by F-GPS specifically to work on opposition research against candidate Donald Trump. Both Bruce Ohr and Nellie Ohr are attached to the origin of the Christopher Steele Russian Dossier.

♦Release #5 was the specific communication between FBI Agent Strzok and FBI Attorney Page. The 10,000 text messages that included evidence of them both meeting with Asst. FBI Director Andrew McCabe to discuss the “insurance policy” against candidate Donald Trump in August of 2016.

      Lets remember the surveillance on Trump was started by CIA John Brennan.He testified that he gathered the FBI/DOJ and four other agencies in April/March to Congress. Sally Yates was also present. so this whole Trump Project is a Brennan operation

      Trump most likely was under intense surveillance when he started making those comments about Obama. They started monitoring his family from there and continued since he had aspirations to run for the presidency. When there was talk in 2014-2015 that he was thinking about it seriously, they started complying info on him. Remember the DNC Paper Tiger Strategy?

      Also about the 702 quieres, Sundance is dead on. Remember the mix-up with Trumps’ lawyer?They got the wrong Michael Cohen. The dates were right giving credibility and added the disfino with colluding with Russia spin.Same angle with Carter Page and the whole golden showers while watching anime dis-info. They all fell for it.

      What is missing from this entire convo is the company Steele was working for was a State Department contractor. Orbis Intelligence, after Steele name became public, his name was taken off the site. Its most likely them and not Fushion that had access to the FBI database.

        GCHQ information and intelligence was feed to CIA(Brennan) and others. But they wanted a legal version (i.e., the FBI version via FISA). If we find something, then we can not say how we got the information, because it came from GCHQ. How do you go about getting it. We need to create a cover story “Russia Collusion”. And, we will use it to get FISA approval. Who will create the “Russia Collusion” Dossier. We can use out CIA subcontractor Fusion GPS. Who will pay for the work on the “Russia Collusion” Dossier, Hillary Clinton/DNC and the FBI.

        According to one account, GCHQ’s then head, Robert Hannigan, passed material in summer 2016 to the CIA chief, John Brennan. The matter was deemed so sensitive it was handled at “director level”. After an initially slow start, Brennan used GCHQ information and intelligence from other partners to launch a major inter-agency investigation.

      They didn’t! Peter Strzok and Lisa Page tweeted about everything. We only got to see 400 of 10,000 texts between the two of them. From what we have seen, there was absolutely no filter between the two of them. They didn’t have a worry in the world. There is a reason that the IG and hopefully Rep Devin Nunes keeps all those emails quiet when they receive them next week. Have these bastards come in behind close doors and have them either tell the truth, lie or take the 5th.

      Patience from us is critical. I want them all electrocuted yesterday but I see the big picture and realize in the near future, I will get everything I want and much more.

Now, how to scramble and clean up the mess… but the ” mess” was to deep and wide to cover.

      It reminds me when I was a kid and my Mom left us home alone, the house gets messed up and everyone is having a grand ol time until you see the headlights of your Mom’s car pulling in the drive- then panic sets in, and you are running around trying to clean up and you end up putting your my little pony in the freezer……

      Yes. Parallel construction. But this time, they used it not to fake out criminals, by hiding assets, but to fake out the public.

      Like I say – everything about the Obama regime was FAKE.

      My take is that they NEEDED real raw “upstream” intelligence to engage in parallel construction (in other words, FRAMING) using slander, innuendo, and anything else they could use to link Trump to the Russians. They ABUSED an already very debatable law enforcement technique to go after Trump.

      They needed real spying on Trump so that they would know where he and his people were, when they met people, who they talked to, etc., etc. Then find the stuff as close to the needed stories as possible. Then mix in BS accusations and make it all look fairly legitimate.

      They ALREADY DO THIS. I repeat. They ALREADY CONSTRUCT FALSE SCENARIOS to avoid exposing REAL assets. So they’re skilled at this. Communist-influenced law enforcement (a very subtle process over decades) has made framing a part of established methods. I despise the idea, but this is what they’ve done to us. In fact, I wonder if Nellie Ohr was chosen specifically because she had done this kind of thing before – if she had constructed “likely stories” for the CIA or FBI.

      Think of it. Guys like Eric Holder in charge of law enforcement. No WONDER it’s corrupt.

    SD, I now understand more about FISA-702 queries thanks to how you break it down in smaller chunks to digest. The criminals (Fake44 and HRC, Comey, Holder, and others on down the line) are putting on a brave face acting non chalant and as arrogant as ever but I think they have to be scared.

    I get the feeling that the dam is about to burst wide open on this mess. Conservatives on Twitter are getting restless! Thank God for you SD, and others like Imperator Rex, Dave/TrumpSoldier who carefully construct tweets and articles so that we can understand what the H is going on.

              All prayers do matter, Piper, they really do. Also I truly believe that the people of all Western countries suffering under the push for globalism – those truly seeing it for what it is – are looking to the USA for not only leadership but for inspiration. And they are finding it.

              My only fear is that the governments of those other countries, Australia included, having witnessed the Monster Vote of the US will up their own voter fraud to counter it happening anywhere else. But that too will be dealt with in time, I’m sure.

    I believe this activity was already taking place prior to Trump. Obama’s “Team” starting with Holder were doing 702 searches from the start of his administration.

    At this point I truly believe they weren’t just doing this on our President but they were doing it on Bernie Sanders who was making life a living hell on HRC. It wouldn’t shock me if they had one on Ted Cruz in case he gained momentum after the Wisconsin primary. HRC had to win at all cost. They couldn’t have anyone other than her as the next President. They were set to make billions off of the Paris Accord by creating a Carbon market out of Chicago.

    SD I am not sure if there is any coincidence of our President’s tweet about the previous administration paying Fusion GPS and the fact it occurred in April of 2016.

    The president was referring to a report by The Federalist on Sunday which alleged that former President Obama’s official campaign organization directed nearly one million dollars to Perkins Coie–the same law firm that sent money to Fusion GPS for the research leading to the now-infamous dossier.

    According to records filed with the Federal Election Commission, Obama for America paid Perkins Coie more than $972,000 after April of 2016. The first round of payments were classified as “Legal Services” and were made in April 2016, totaling $98,047. A second batch of payments, also classified as “Legal Services,” were sent to the firm in September 2016, totaling nearly $700,000. The Obama for America organization also sent payments totaling $174,725 through August 2017, according to the report.

    I really can’t wait for all of this to come out and watch the Left, MSM, Democrats start to die of a heart attack.

    On my particular monitor, in the redacted form, the letters “FBI” are exactly 10mm wide.

    Several of the redacted areas could contain exactly three capitol letters, 10mm wide.

    Therefore this dumb hard-hat wonders if any 10mm wide blacked out areas might also contain the letters “GPS”

    I have always heard detectives hate coincidences.

    NSA has to report quarterly to Intelligence Oversight Board on if there are any unlawful uses of the system. It includes number of instances , but of course they would be redacted. Last quarter released for public was 2Q 2013. Submitting so we (or those interested) can see form and terminology as what to expect. (Would of been great to know trend numbers and if those increased 10 fold during campaign)

    So they violated the 4th amendment. In order to weaponized the intelligence, they enhanced it with scandalous lies and laundered the intelligence through Steele creating the dossier. Then they took the “cleaned” intelligence/dossier back to the FBI in order to get a FISA warrant as an insurance policy against revelations that they violated the 4th amendment.

      • The Uranium one Deal has much to do with the figures from the Bundy Trial. Explains why they locked them up in solitaire. Not per se the first Bundy Standoff. It is the second one, at the Park. go look at where the park is, where the land used by the ranchers living nest to and around the park and location of the mines. BLM was working to kick the ranchers off and take property.

        Look at the Uranium one land mining location. Then go look at Rules for mining that product. note the locations and regulations for how close people can live next to such a mining operation and who had water.

    Why would anyone attempt the 5-curb bank with a funky spin when they could easily sink a direct shot? If Trump were dirty, the dossier is the stupidest approach to nailing him. However, if he’s squeaky clean even after penetrating surveillance by the best in the word, well, then they have nothing. So, it points to fabrication followed by laundering.

    I got 50 cents that says the ‘contractors’ had no contractual relationship nor were employees of a company with a contractual relationship.
    If they were gov employees or military that would have been verified before given access (it’s easy to keep tabs on the people who are supposed to be there, so they do). The only other way to get a pass is to be a ‘contractor’ and to verify that the see that the box ‘contractor’ is checked.

    Thinking about Hannity’s and Carter’s statements about someone submitting lies to the FISA court and being in Clinton’s circle I think that must be McCabe due to him getting paid off by the Clinton connections. I dont think they say that about any of the other FBI people. McCabe probably signed off as the Deputy Director for the FBI.

    The oversight of NSD had been blocked since 2010. The Yates interference from oversight was in 2015. When were the contractors given remote query access? What was the volume of queries that the contractors performed? If the remote outside access existed prior to 2016 and was discovered and shut down on April 16-18, 2016, could the April 19 meeting with Obama be a coverup strategy session. What is the likelihood that the 702 query system was open for business through these contractors for years? Was it 20 about queries or 2000? If it’s the latter then I suspect someone was selling access to the 702 system and created the dossier/story as a cover to distract and partially justify the irregularities. It is a bush league cover up, but this is the administration that couldn’t successfully cover up fast n furious, SSI/DHS orgies, IRS abuse, Iran… ad nauseum.

    Good work Sundance. I also noticed, around page 45-50 that all data prior to Jan 2016 are to be sequestered pending further decisions. This order supercede any regulation concerning aged-out destruction of records.

    My translation of the legalese is to take them offline from any usage, except for national security, and locked away for special data mining before destruction. As in connecting the deep state to any other unknown acts of treason and or sedition.

    Probably will explain why Justice Roberts did what he did on OboobieCare. Explain how certain conservatives got ran out of office on what they claim was bogus allegations and or entrapments disquised as stings. The deep state is at least as old as Mr Smith goes to Washington.

    This is what I wrote last night after reading Sundance’s stellar report. I would even go so far to say that a Ben Rhodes-like figure already had concocted the basic outline of the dossier and put info out there to be found and laundered.

    Ben Rhodes, of course, was famous for concocting the narrative that a video was responsible for the Benghazi uprising and the entire Iran saga. This would be right up his alley.

        What I’ve read is Jacoby’s FB statement that, ““Let’s be clear. Glenn conducted the investigation. Glenn hired Chris Steele. Chris Steele worked for Glenn.” That’s very different than coming up with the Muh Russia narrative, approving the narrative (it had to have somebody very high up who gave the go ahead), and everything that followed.

        I understand that Simpson is a sleaze, but he lived and worked in NYC and I just don’t believe that anybody who did would think of something so ridiculous as p*ssgate about Donald Trump. Trump was a known quantity in NYC. Never a single whisper of drugs, alcohol, or kinky sex. And he never did anything to tarnish the reputation of any of his brands.

Sorry I hadn’t read this one yet, because it explains the pertinence of the adjective “political” being denied by Rob Joyce, but doesn’t explain much about somebody who’s in Trump’s WH saying it. Trump was the victim of this political abuse of FISA, so why is “his” guy covering for the perps? As it turns out, Joyce was appointed by Trump, but praised by his predecessor in the Obama administration. Not that it automatically makes him a black hat, but … He has a history at NSA as a “hacking chief,” whatever that means. I was astounded to read his statement that there have been no incidents of FISA being used politically. Now it makes sense if they decide to cover by turning “political use” into “national security.” Are the facts being suppressed until they get the reauthorization? Is a deal being made to cover up in return for reauthorization? I hope not. We need to KNOW that the treasonous are going to get their just deserts.

    It should be their strength.

    Breitbart a supposedly conservative site grounded in a constitutional US theme is missing possibly the story about the greatest threat to our constitutional country ever.

    Same for National Review. Total miss on this whole subject.

    You have got CTH, Hannity, President Trump and a few smaller independents working and nobody else working. Everybody else scared or lazy?

    They all should at least be introducing stories about the unfolding possibilities.
    Maybe that will come in 1-2 weeks depending…

    They rush on the fake “sh*t” wagon and have missed this wagon circling them all the time.

      I think it has to do with something SD said about not wanting to acknowledge the real story because of the sheer magnitude of it all. There’s also the fact that NO ONE else is reporting it outside of CTH, so some of these outlets don’t want to be “first” and risk being labeled conspiracy theorists. Sad. Especially when you look at the reporting here and realize there’s little “theory” and almost all verifiable fact.

      They should all be tripping over one another to get this story.

        Once I began checking Twitter, just a few months ago, I saw how many others are reporting the same information, often citing CTH. There must be hundreds of thousands of people being exposed to this information via Imperator_Rex, Thomas Wictor and others who comment in the CTH Twitter timeline or re-tweet CTH Twitter posts.

        And since Twitter only allows 140 or 280 characters, they break down the story into small chunks, number them consecutively, and then they can make it available in a self-contained ‘thread’, so even if it’s 40 posts long, you can read the whole thing pretty much like you would read it on a website or blog, like the article above.

        I don’t know how many people read this website directly, but however many there are, there are a whole lot MORE people in addition, who are getting Sundance’s reporting via re-tweets and independent (supporting) analysis by a host of commentators with large ‘followings’.

        I think Sundance is once again spot-on… viz., that the magnitude of the corruption just strains the brain! I can’t remember how many times I’ve thought to myself “all of these people cannot possibly be without conscience or moral compass” yet that is the case. It’s just unbelievable to me that not a single one has stepped forward and said “my God, what have I done?” How sad for our country – thank the Good Lord for President Trump, Sundance and all of the other white hats that will allow good to prevail over evil.

      Whatever Breitbart may once have been, it has devolved into a pure click-bait, blood-pressure jacking, fight-starting headline machine whose main purpose seems to be starting a free-for-all in the comments section.

      The free-for-all in the comments section is fun for a while, and it’s a great place to learn ‘word-to-word combat’. But after you become proficient at that game, there’s no where else to go from there. Then it gets old, and there’s no reason to go there anymore.

      Unless you just like reading headlines designed to make you angry.

      What really struck me though, is how much great analysis and good information I was getting here at CTH, and how little I was getting at Breitbart, even though Breitbart has dozens of writers and a multi-million dollar budget and claims to be ‘the website’ for conservatives.

      And the more obvious that disparity became (i.e., why can’t Breitbart do what CTH does? Can you imagine the reach and influence Breitbart would have, if they were HALF as informative as CTH?), the more I realized what a waste of potential (and time) Breitbart had become.
