How Quickly Ye Forget…

Many people are understandably tentative about the Department of Justice Office of Inspector General Michael Horowitz.  How can this IG, or any IG, really be trusted to root out the rot that lies at the heart of the DC corruption?

Can we trust the IG to target the politicization of the FBI and DOJ, and do so with the righteous indignation necessary to tear out the corruptocrats? After all, what would motivate Inspector General Horowitz to participate in such a righteous endeavor?

How quickly some have forgotten:  DATELINE July, 2015:

WASHINGTON DC – The Obama administration formally announced that inspectors general will have to get permission from their agency heads to gain access to grand jury, wiretap and fair credit information — an action that severely limits the watchdogs’ oversight capabilities, independence and power to uncover fraud.

An opinion, issued by the Department of Justice’s Office of Legal Counsel, says the Inspector General Act of 1978 — which was written by Congress to create the government watchdogs in order to help maintain integrity within their agencies — does not have the authority to override nondisclosure provisions in other laws, most notably in regard to grand jury, wiretap or fair credit information.

“In reaching these conclusions, our Office’s role has not been to decide what access [inspectors general] should receive as a matter of policy. Rather, we have endeavored to determine as a matter of law, using established tools of statutory construction, how best to reconcile the strong privacy protections … with the interest in access reflected in … the IG Act,” states the legal counsel’s opinion, which was dated Monday and released Thursday.

“I strongly disagree with the OLC opinion,” Michael Horowitz, the Justice Department’s inspector general, said in a statement.Congress meant what it said when it authorized Inspectors General to independently access ‘all’ documents necessary to conduct effective oversight. Without such access, our Office’s ability to conduct its work will be significantly impaired, and it will be more difficult for us to detect and deter waste, fraud, and abuse, and to protect taxpayer dollars.”  (read more)

        It is obvious that some biased attorney in the DOJ has made up their own interpretation of what congress passed. Sounds like liberal activist judges. The “opinion” that this Office of legal opinion, is just that an opinion. Sessions should have a new opinion released ASAP which negates thsi Obama shill’s opinion. Opinions of the DOJ are not laws. They are merely opinions.

        I think we’re just being reminded that Horowitz was impeded in doing his duty by the Obama administration. He fought back, and under Trump those same restrictions won’t be a “thing” any more. If you read Horowitz’s 2015 statement, it’ll help…especially the Challenges part of it (Caveat, this is my interpretation of SD’s post)

          This wasn’t an opinion, in my mind. This was an In-your-face threat to any IG, maybe solely this one, not to go snooping around any wire-tapping initiative or FISA request. Goodness knows what the repercussions would have been if Horowitz had started his investigation then?

          The DOJ had just been denied the original warrant, and maybe the judge advised them on what items they needed to make their next campaign successful. This was probably just one item on the To Do List.

        Mr. Horowitz has had to seek former Attorney General Eric H. Holder Jr.’s permission, and now Loretta E. Lynch’s, to gain access to such material. The approval process in obtaining the materials delayed review of Operation Fast and Furious — the failed Mexican drug cartel sting that lost track of more than 1,000 government-issued guns, one of which later was used to kill a U.S. Border Patrol agent — and has delayed other reports the inspector general is set to publish.

        As the chairman of the inspectors general council, Mr. Horowitz has been pressing for resolution from either Congress or the OLC in clarifying his and other IGs’ authority in gaining access to agency records — repeatedly saying agencies have proactively tried to stonewall certain investigations by questioning the IG’s power.

        In congressional testimony in February, Mr. Horowitz complained the FBI had failed to turn over key records in several whistleblower cases by the deadlines, saying that other laws involving national security and privacy took precedence over his investigation.

I do not know much about the weight of an IG internal investigation and how it can be applied externally and by whom, in what manner. Is it admissible evidence in a court of law? Call me confused about it.

            IG reports are presented to Congress, and to the agency(ies) involved. b. Criminal and Civil referrals are addressed to the Department of Justice, U.S. Attorney offices, or State or local prosecutors. These referrals are for criminal prosecution or civil litigation.

            I stole the second bit from the GSA IG webpage, as it was the first to come up. But the AG can act on IG findings.

              Thanks a lot. So, he can actually use his findings to make a referral of evidence that is admissible.Then the DOJ can take them and run with them? That could counter grand jury findings or parallel construction evidence that is being used improperly?? Do I have that right? His findings could show Brady Violations of the First magnitude? That would bring the judicial branch in to the ball game?

                Grand jury could see the IG report if the prosecutor presents it to them. Brady doesn’t come into play until the prosecutor decides to prosecute based on the grand jury. Even for a plea deal the Brady apllies. But in a grand jury the prosecutor just shows evidence to prosecute. The prosecutor is supposed to be ethically bound to seeking justice. Parallel construction is done when mueller obtained information improperly or thru spy agencies and can’t use them in court. So knowing the information they get the same info thru legitimate process like subpoena. Notice a PTrump sc mission never cited any crime. You are supposed to have probable cause to get a warrant. Mueller know fruit of the poison tree. He won’t use anything he obtained that way. Instead he does a parallel construction. Then it’s not considered to be the poisoned fruit.

            IG investigations when done proper reveal wrong doing that can then be further investigated for criminal charges on the law enforcement end and brought to public attention via Congressional investigation on the Political end.

            It would seem that thanks to President Trump the proper systems of checks and balances is being restored to the Bureaucracy.

            As to who unleashed the IG that would be the President, Attorney General, and DoJ office of Legal Policy.

            Also yes if the IG finds evidence of criminal wrong doing it is admissible in court.

              His findings are evidentiary. They are not equivalent to indictments. They are solid pieces to use to get indictments. His reports go up to the top of the agency or department or bureau and to Congress. Only the DOJ can turn them into indictments.

        I highly doubt the IG for the DOJ has any ability to investigate U1.
        Dont forget, the 20% of US Uranium, was not actually US uranium, although it makes good talking points.
        Uranium One is a Canadian company, and they owned those assets, including the land and the Uranium. This was simply a regulatory approval to approve to sale to Rosatom…but it appears the Clinton cabal extorted large payouts to actually approve the Corporate sale.
        Its similar to tye DOJ blocking the Time Warner sale unless they dump CNN. Telecom is considered a straregic asset by most governments and sales are monitored and regulated accordingly.
        Clinton demanded money…Sessions is demanding the sale of CNN….

          You can’t negotiate with liars, and there are still lots of liars involved in this process.

          Stop taking responsibility for having it add up. Just watch. And wait.

          The outcome is not dependent on me figuring it out and knowing that lowers the stress. And leaves me free of the need to call anybody names or offer to shoot people dead, as some are offering in the threads these days. I’m not in charge of the outcomes.

          Knowing that law-oriented people are now asserting rightful authority is a great blessing, as is knowing that I’m not in charge and don’t have to figure it all out. I’m like the IG in the obama reign: don’t have access to the stuff that would help me figure it out.

However, I’ve learned to be patient when my mind goes *tilt* because at some point more pieces will come together to explain the whole. …And this ugly quagmire of corruption and conspiracy of ruination is all linked and eventually makes sense, even the elements that appear unrelated at first glance.     • Hmm. I’m thinking Mueller will be using “look squirrel” leaks from the emails to try to get ahead of any IG information that is coming out. IMO Mueller is protecting himself. As long as his investigation continues he is protected. Once his investigation is over then it’s U1 and he’s up to his eyeballs in that. I think Mueller realizes that if he doesn’t take down PDJT no one will, and he is still highly invested in making that happen. Everyone on his “team” is highly invested in taking down PDJT. They know they’ve committed treason and they’re going to keep fighting this to the bitter end. Crooked knew all about this. It’s the reason for her “if he’s elected we’ll all hang” outburst.

        Yes, and although he’d love to take Trump down, he doesn’t need to. He has two other options.
        1) weaken Trump in the public opinion arena with constant drip drip drip leaks of potential criminality, and get him defeated in 2020.
        2)Trump gets re-elected in spite of that, but just keep up the same techniques for another 4 years to minimize his power and make it politically difficult for Trump to do anything with the DOJ/FBI mess. Then if Trump is replaced with a more typical uniparty type (dem or repub, doesn’t matter), it’s smooth sailing.

        I don’t think he will prevail with either of those, but I’d be surprised if he doesn’t try.

    The DOJ was holder’s baby. He set this up to be a legacy piece in the obongo fundamentally tranforming (or shall we say blatantly stealing) America project. Hence his tweets trying desparately to rally the troops he put in place. They are his firewall. As long as they were the ones running the investigations, what could go wrong? They forgot the IG. This is Trump stuff at his best. I’ve been stumped for a long time by the Sessions DOJ. But Horowitz is starting to draw blood. Will Mueller have enough leverage to keep his buddies out of prison? I seriously doubt that. And I seriously hope not. Holder is the guy I most want to see go down. All of them really, but him especially. Do you feel MY people yet, Eric?

PTrump might not know the details of their battle plan but he knew it. When PTrump gave a speech in front of the cia memorial he referred to building a building with no columns. In the intelligence world the 5th column refers to the deep state. That was essentially saying to the cia- bring it on.

    “inspectors general will have to get permission from their agency heads to gain access to grand jury, wiretap and fair credit information”

    It isn’t clear to me, just how such a restriction would be enforced (or not enforced) and by whom. .

He fired IG Gerald Walpin, CNCS for pointing out fraud and spending on AmeriCare in 2009. It seems to me firing Walpin just opened the flood gates and gave the ok, to waste, fraud, and spending. Keeping in mind all of the missing money from various departments of the government.

    Remember, Obama fired an IG for digging into corruption at AmeriCorp.

    IG Walpin was fired in June 2009 for his investigation of the misuse of money in AmeriCorps, the service organization that was part of the Corporation for National and Community Service, where Walpin served as inspector general. The investigation focused on Kevin Johnson, the former NBA star who became mayor of Sacramento, Calif., and was a prominent Obama supporter.

      Yes it did. Sundance posted the OIG’s letter announcing they were launching the investigation. It was in January, like Jan. 12 or 17, something like that. In the letter it said it was in response to numerous complaints from the public and from Congress about the DOJ/FBI being very political or something along those lines.

      Democrats, including Brian Fallon, cheered long, loudly, and lustily over this investigation because Comey cost Hillary the election and he needed to be probed!

        Yup. The Dems released the Kraken.

        I certainly recall, but it seems many don’t, many comments made in late 2016 that the Dems would CHEER if President Trump fired Comey on his first day in office. He was on their doggy-doo list for the re-opening of the e-mails ‘matter’ when they were found on the Weiner laptop. The Dems at that point blamed Comey for the HRC loss.

        The IG was the Dems insurance policy in case Comey wasn’t swept out by the incoming Administration, which is not unusual.

        They didn’t count on a POd IG who resented his hands being tied by the previous Administration.

      Yes, the Dims have already begun to attack. Thursday or Friday they woke up and started complaining about the IG looking into private texts of DOJ staff.

      Talking points about this and the Republicans using the IG as a tool to hammer the Mueller investigation with. One of the lefties out spewing such wisdom was Diane Feinstein, and a couple of Congress Dim Wits who were part of the group voting to impeach PDJT last week.

      I think Sundance did a whole piece on this yesterday? So much has come out so quickly I can’t remember it all clearly.

All of the big boys and girls knew that they were operating with the consent of the Pres. – President Obama . At the highest levels of government nobody tries to get away with stuff like this without some kind of direction coming down from the top . It is just too risky to keep the President out of the loop , unless you really do want to fall on your sword for him .     But I did know Obama was a DICTATOR. I could never have imagined it would be this bad.
    Think back on election night and why Hillary didn’t show up. They were all in deep shock. They knew the repercussions with a Trump administration.
    IG Horowitz is an intelligent individual. Prolonging the agony is the best payback.

        While I was in the USMC…I was known to be able to fix big problems…some things / places were so screwed up…I went in and literally said: Stop, throw everything in the middle of the floor….everything….did it for an entire motorpool…had everything..vehicles..tools…paperwork..all of it…put in the middle of a parking lot…then separated the garbage from the good stuff
        Stop it all, fire em all, put it all out there..everything…except things pertaining to “real” national security….we are Americans…show us the money…get rid of em all then start over with a “CLEAN” slate.

    Think of an IGs office as the police- they gather evidence. If the evidence shows violations of either Agency policies or Federal regulations, the IG presents their findings to the authority able to take disciplinary action. If they find evidence of violations of law, they present their findings to the FBI and DOJ, if it’s a Federal law broken, or to state or local authorities if it’s those laws that are broken. An IG is supposed to be independent from the Agency’s leadership, so he/she can investigate that leadership. Obama made IGs be subject to the leaders, who could deny the IG access to the data. They couldn’t appeal to anyone who cared. Now, President Trump puts in people who know they’d better cooperate. The IGs are independent again, and they’re collecting what they can as fast as they can. Investigations take time, particularly if you’re trying to keep the point of your investigation a secret.

    Oh, and IGs have a lot more power to collect data from actively employed Federal employees. If you fire them or they quit, you have to treat them as private citizens again and get warrants. Many here have criticized President Trump for not firing everyone on day one. Well, some people you can fire easily, but others require cause. But in most cases, I think he was advised by the IGs or by people who understand the system, to leave many of them in place while evidence was collected.

    This is the Storm. This is the Big Ugly. It’s just getting started. In a year, you’ll be able to look back and see it all clear as day.
