Supreme Court Keeps, Mostly Punts, Temporary Block on Deportation of Terrorist Aliens Using ‘Alien Enemies Act’

The Supreme Court attempted to split the baby between executive “national security” power and the dynamic use of the “Alien Enemies Act” today with a ruling that temporarily blocks the Trump administration from deporting criminal alien gang members under the UEA until the criminals are afforded some undefined amount of time to appeal their repatriation status.  Essentially, this is a stall and punt routine. [READ RULING HERE]

From the Ruling, “To be clear, we decide today only that the detainees are entitled to more notice than was given on April 18, and we grant temporary injunctive relief to preserve our jurisdiction while the question of what notice is due is adjudicated. [See post, at 13 (ALITO, J., dissenting).] We did not on April 19 —and do not now— address the underlying merits of the parties’ claims regarding the legality of removals under the AEA. We recognize the significance of the Government’s national security interests as well as the necessity that such interests be pursued in a manner consistent with the Constitution. In light of the foregoing, lower courts should address AEA cases expeditiously.”

The 7-2 ruling was unsigned. Justices Alito and Thomas dissented. The main opinion issued by the court was labeled “per curiam” — a term meaning that it was issued by the court as a body, rather than any individual justice. However, Justice Brett Kavanaugh wrote a separate opinion concurring in the decision. But Kavanaugh wrote that he’d prefer to have the Supreme Court dig into the legality of Trump’s Alien Enemies Act invocation right away, without waiting for the issue to be hashed out by lower courts.

Wisconsin Judge Indicted for Assisting Illegal Alien Avoid ICE Agents in Court

Milwaukee County Circuit Judge Hannah Dugan was indicted today by a grand jury on charges of obstruction and concealing an individual from arrest.

These are the same charges originally outlined in the criminal complaint. (1) obstructing a criminal illegal alien capture; and (2) concealing the illegal alien to avoid apprehension and arrest.

The criminal complaint against Judge Hannah Dugan reveals the judge purposefully demanded the ICE agents and FBI officials go to another part of the building to speak with the chief justice, while she guided the criminal illegal alien through the jury room to an outside exit facilitating his release.

VIA CNN – A Milwaukee County Circuit judge was indicted in federal court Wednesday following accusations that she helped an undocumented immigrant evade federal agents last month.

Judge Hannah Dugan was indicted on charges of obstruction and concealing an individual from arrest, the same charges she was originally arrested and charged with.  CNN has reached out to her attorney for comment.

Dugan is accused of helping a defendant in her courtroom evade immigration officials stationed to arrest him in the hallway outside. (read more)

Newark New Jersey Mayor Arrested for Criminal Trespass During Political ‘Resistance’ Stunt at ICE Detention Facility

Newark, New Jersey, Mayor Ras Baraka and three congressional representatives, Bonnie Watson Coleman, Rob Menendez and LaMonica McIver attempted a political stunt at a local ICE detention facility in Newark.  Mayor Ras Baraka was arrested.

The intention of the group was to shut down deportation operations at Delaney Hall, a 1,000-bed detention facility used by Immigration and Customs Enforcement (ICE) as part of the removal process for illegal aliens. Baraka, Coleman, Menendez and McIver created a public disturbance as part of their stunt and trespassed on federal facilities.

As an outcome, Mayor Ras Baraka was handcuffed and led away by federal authorities as the agitated crowd tried to fight the police and federal officials. WATCH:

NEW JERSEY – […] The arrest followed a chaotic scene in the facility’s parking lot involving protestors, federal law enforcement officers and the three members — Reps. Bonnie Watson Coleman, Rob Menendez and LaMonica McIver — at Delaney Hall. The Trump administration reopened the 1,00-bed facility this month to house migrants amid a lawsuit from the city against the private operator, GEO Group, alleging it does not have the proper inspections and permits. GEO group has denied that allegation.

DNI Tulsi Gabbard Discusses Ongoing Internal Investigations into Intel Community Leaks to Media Allies

One of the least understood dynamics about how the DC silos operate, pertains to review and investigative work done by government officials into government misconduct.  In essence, special counsels, special investigators and appointed special prosecutors do not look at government activity if that activity can be framed as political.  The silos protect themselves from external review.

As a consequence, the only administrative review of government misconduct happens when the silos look internally at their own agency.  In this short video below Director of National Intelligence Tulsi Gabbard outlines that 11 internal investigations are ongoing to target Intelligence Community officials, staff and employees who are leaking classified information to the media.

After the internal review, the DNI then sends (criminal) referrals to Main Justice and the FBI if warranted.  Currently three criminal referrals have been sent to the FBI/DOJ as eleven investigations continue.  WATCH:

TRANSCRIPT … […] “as I said, the politicization of our intelligence community needs to end—to even begin to start to earn the trust of the American people. The actions that we’ve taken—unfortunately—there continue to be significant leaks coming out of the intelligence community. Not only my organization, but the CIA and others—again, by those who are very directly trying to undermine the agenda and actions of President Trump. Once again, the President who was elected by the American people with an overwhelming mandate.

Republican Senators Defeat Nomination of Ed Martin, President Trump will Replace

Unfortunately, there is a toxic stew in Washington DC that too few understand.  The events today transpire just as many Trump supporters begin to realize the unfortunate outcomes of nominating unserious people like Pam Bondi, Kash Patel and Dan Bongino.

President Trump reluctantly stated earlier today that he will nominate a different person as U.S. Attorney for the critically important Washington DC office, as the collective republican opposition to Ed Martin has proven to be strong.

Ed Martin was what President Trump needed; a very serious, deliberate and qualified person to confront the Deep State UniParty.  Those core skillsets are why the Republicans did not support him.  However, on the optimistic side, if there is ever a special counsel to be appointed, I suspect Ed Martin will be leading candidate.

WASHINGTON DC – President Donald Trump said Thursday he will withdraw the nomination of Ed Martin, a longtime champion of Jan. 6 defendants, to be the District of Columbia’s top federal prosecutor.

“We have somebody else that will be great,” Trump told reporters. “We have somebody else who we’ll be announcing.”

Support for Martin among Capitol Hill Republicans has faltered in recent days, particularly after Sen. Thom Tillis (R-N.C.) signaled his opposition to the nominee over his past comments downplaying the Jan. 6 attack on the Capitol.

President Trump Proposes Reopening Alcatraz Prison in San Francisco

In a rather remarkable message via Truth Social, President Trump proposes the reopening of Alcatraz prison.

PRESIDENT TRUMP“REBUILD, AND OPEN ALCATRAZ! For too long, America has been plagued by vicious, violent, and repeat Criminal Offenders, the dregs of society, who will never contribute anything other than Misery and Suffering. When we were a more serious Nation, in times past, we did not hesitate to lock up the most dangerous criminals, and keep them far away from anyone they could harm. That’s the way it’s supposed to be. No longer will we tolerate these Serial Offenders who spread filth, bloodshed, and mayhem on our streets.”

“That is why, today, I am directing the Bureau of Prisons, together with the Department of Justice, FBI, and Homeland Security, to reopen a substantially enlarged and rebuilt ALCATRAZ, to house America’s most ruthless and violent Offenders. We will no longer be held hostage to criminals, thugs, and Judges that are afraid to do their job and allow us to remove criminals, who came into our Country illegally. The reopening of ALCATRAZ will serve as a symbol of Law, Order, and JUSTICE. We will, MAKE AMERICA GREAT AGAIN!” (link)

CIA to Cut 1,200 (5%) Jobs Within Spy Agency – Director Ratcliffe Shifts Focus to “Human Intelligence”

The Washington Post (but of course, CIA outlet) is reporting on a downsizing effort within the CIA to eliminate approximately 1,200 jobs.  The number represents approximately 5% of the workforce although the actual number of CIA employees is classified (national security, dontchaknow).

Within the report, Director John Ratcliffe is noted as shifting the focus of America’s leading spy agency to use more “human intelligence.”  That phrase, “human intelligence,” is IC silo code speak for shifting away from “analysts” (political operatives) and engaging in more ¹factual intelligence information.

According to the report, DNI Tulsi Gabbard has also reduced the employment level within the Director of National Intelligence office by approximately 25% (current payroll estimate of 2,000 employees).  The general narrative within the WaPo reporting is that “national security” is being compromised by large downsizing of spy agency employment.

Additionally, to bolster the positions of the current political operatives within the CIA, the WaPo waxes concerningly about China and other mysterious foreign adversaries recruiting the CIA employees who are now becoming increasingly concerned about their paychecks.

WASHINGTON POST – “The Trump administration is planning significant personnel cuts at the Central Intelligence Agency and other major U.S. spy units, downsizing the government’s most sensitive national security agencies, according to people familiar with the plans.

The administration recently informed lawmakers on Capitol Hill that it intends to reduce the CIA’s workforce by about 1,200 personnel over several years and cut thousands more from other parts of the U.S. intelligence community, including at the National Security Agency, a highly secretive service that specializes in cryptology and global electronic espionage, a person familiar with the matter said. The person, like others interviewed, spoke on the condition of anonymity to discuss sensitive matters.

REPORT: Stephen Miller a Top Contender for National Security Advisor Role

The report is coming from Axios, so take it with a grain of salt.  It could also be the White House testing the waters for DC reaction to the possibility.  The outlet is saying White House Deputy Chief of Staff, Stephen Miller is a top candidate for consideration to fill the National Security Advisor role to President Trump [SEE HERE].

Stephen Miller already runs the White House Homeland Security group, inside the executive office.  He has been an excellent organizer and spokesperson for DHS deportation operations, and the Homeland Security Council runs very smooth under his direction.

That said, from my perspective, the key qualification for Stephen Miller is that he DOES NOT carry the infection of time spent inside the Intelligence Community silos.  Miller’s autonomic outlook is not contextualized to believe everything the IC says. This is critical.

An effective National Security Advisor in the modern era (post Patriot Act) needs to look at all intelligence with cynicism, accepting that weaponized political perspective permeates the entire silo that might be providing the information.  The NSA cannot trust anyone in the IC, yet the NSA must be trustworthy to President Trump.

Remember, the Director of National Intelligence (Tulsi Gabbard) is an assembler of pre-existing intelligence, the DNI does not create intelligence.  The Director of the National Security Agency is under the DNI and operates as the librarian for data, from which other silos gather intelligence.  The Director of the NSA does not create intelligence.

It is the Pentagon, the State Dept., the FBI, the DOJ-NSD and the CIA who create most of the intelligence that flows to the President.  The National Security Advisor needs to be the filter between manipulated DoD, DoS, FBI and CIA information.

A Remarkable Seven Minutes with Director of National Intelligence, Tulsi Gabbard – Why Anthony Fauci Wanted a Pardon

In this segment of a remarkable interview by MeAgain Kelly, DNI Tulsi Gabbard discusses the current intelligence community research into the origin of the SARS-CoV-2 pandemic (aka COVID-19).   Gabbard talks about the U.S. government funding of ‘gain of function’ research which is a soft sounding phrase to describe the weaponization of biological agents.

Gabbard notes the gain of function research taking place in the Wuhan lab, was coordinated and funded by the United States Government, and the Intelligence Community is close to making a direct link between the research and the release of the COVID-19 virus.  Additionally, DNI Gabbard explains the concern of other biolabs around the world and then gets very close to the line of admitting the IC itself is politically weaponized (which it is but would be stunning to admit).  WATCH:
