ODNI Releases 2023 FISA Court Compliance Audit, Opinion and FISC Reauthorization – 117 Page PDF

If anyone else wants to climb in here and read this report [pdf DATA HERE], drop your review notes in the comments.  It’s going to take me a day or two to finish making all my notes.

The Office of the Director of National Intelligence [ODNI] has released a 117-page April 2023 order/opinion by the Foreign Intelligence Surveillance Court [FISC] about the compliance audit conducted by internal review as the U.S. intelligence agencies seek reauthorization.   Everything FISC happens in secret, and the report is heavily redacted; however, some interesting information can be obtained if you read the report carefully.

Here’s an example.  The FISC is now agreeing with the NSA and FBI that all search logs and audit trails should be erased after 10 years from query.  That means every audit trail from the period up to August 2013 is about to be erased.  That means almost all of the Obama era search queries will disappear before the next administration takes office.

They are not erasing our data; they are erasing the logs of their search inquiries into our data.  FU!

Readers here know my position.  I do not believe the FISA court is needed; nor do I believe the NSA, FBI, NCTC or CIA should have any search access to the metadata [full scope electronic records] of American Citizens without a court order.

The DOJ and FBI should go to the ordinary federal courts for search warrants.  The CIA and National Counterterrorism Center (NCTC) both have foreign service missions, so they do not need access to American citizen metadata (702 acquired).  Why would the CIA and NCTC need to snoop into the private data of American citizens when their legislative authority forbids them from conducting domestic surveillance?    Additionally, the NSA should not contain a lifetime repository for all electronic records of American citizens.  That’s my opinion.

The war in Ukraine ends the moment Trump is elected. Russia keeps the eastern part where the U.S. was provoking unrest.  The U.S. stops trying to use Ukraine as a proxy provocation against Russia.  Ukraine stops doing stupid stuff, becomes independent of the USA, and takes care of its own people.  And with Trump’s assurance to Russia – Ukraine will not join NATO. Everything stops. Done.

Twitter Court Filing Cites Alarming FTC Conduct Pressuring Consent Decree Arbiter to Target Elon Musk and Company

Prior to Elon Musk taking control of Twitter, the social media company entered a consent decree with the Federal Trade Commission putting a neutral arbiter from Ernst & Young in an oversight position for the company’s privacy, data collection and information security protocols.  Given what we know about DHS and FBI control and influence over Twitter content, there is a certain irony in the prior position of the FTC regarding user privacy.

That said, Twitter’s new parent company X Corp filed a court motion Thursday [PDF HERE] asking a federal court overseeing the settlement to either throw out the consent decree entirely, or put it on hold until the FTC turns over documents to Twitter showing historic bias against the company. Twitter is also seeking to bar the FTC from deposing CEO Elon Musk over issues that preceded his arrival.

Within the filing, Twitter presents some alarming information as shared by Ernst and Young about the FTC pressure applied to them.

Potentially, I may be a pro-bono plaintiff in a process to gain insightful discovery. We have long said that if you follow either side of the illusion of choice you end up arriving at the same corporate destination. The spiders may have inadvertently paved the path for sunlight upon the Vanguard/Blackrock launch process. Stay tuned.

In related matters, the billionaires who fund both sides of the two private corporations known as the DNC and RNC are nervous about underwhelming results for one of their preferred options.

The Murdoch family, led by conservative Fox Corp. and News Corp. mogul Rupert Murdoch, reportedly is souring on DeSantis. And as concerns for DeSantis mount across the board, several donors have told fundraisers about their worries, according to people familiar with the matter.

Some donors are worried the polls indicate DeSantis has to climb a potentially insurmountable hill to overtake Trump, these people said. They’re also worried that Trump has a huge lead over DeSantis when it comes to Republican congressional endorsements. DeSantis represented Florida in the House before he won the governor’s office.

Artificial Intelligence Positioned to Define Terms of Reality

There has been a great deal of increased discussion surrounding the issues of automated Artificial Intelligence, colloquially called “AI.”

At the central core of the AI issues in communication; you inevitably enter a discussion on the issue of definitions and terms.  Who is determining the definitions of what constitutes valid information? Who is determining what types of information are not valid, not approved for communication networks and how are their definitions being applied?

The topic of AI in general is a very large conversation.  The topic of AI specific to communication is equally large and perhaps even more significant.

AI applied to communication must first establish a need for it to exist.  Within that discussion, government interests and corporate interests take large seats at the table.  Social media platforms, communication outlets, almost the entire technology sector and various special interest groups are also stakeholders in the discussion of how AI can be applied to the filtering of information – or what I would more appropriately call the CONTROL of information.

The predicate of the conversation jumps around a little, but the issue of defining reality is throughout the discussion.  This is where my prior warnings about defining information must be emphasized.  I am losing the current argument, but I retain optimism that eventually the control mechanisms will need to be destroyed by a generation that falls under its influence.

“There is no such thing as “disinformation” or “misinformation” or “malinformation”.  There is only information.  There is information you accept and information you do not accept.  You were not born with a requirement to believe everything you are told; rather, you were born with a brain that allows you to process the information you receive and make independent decisions.”

Biden Administration Appeals Court Ruling That Blocks Govt from Censoring Free Speech on Social Media

In a previous ruling in the case of The State of Missouri v Joe Biden, Judge Terry Doughty agreed with the state position that evidence had clearly shown agencies of the U.S. government had infringed upon First Amendment free speech in targeting social media companies with demands for content removal. The social media companies outlined in the state lawsuit include Facebook, Instagram, Meta Platforms Inc, Twitter, Google and YouTube.  Evidence provided by the states showed clear and convincing evidence the government was unlawfully monitoring social media and telling the platforms to remove content adverse to their interests.

The judge outlined an emergency injunction barring government agencies such as the Department of Health and Human Services and the FBI from talking to social media companies for “the purpose of urging, encouraging, pressuring, or inducing in any manner the removal, deletion, suppression, or reduction of content containing protected free speech” under the First Amendment of the U.S. Constitution.  The ruling provided narrow exceptions.

Obviously, given the scale of government involved censorship of speech within social media, the injunction was a major loss to the Biden regime, who operate -in part- with the benefit of controlling public opinion and information.  The judicial ruling disrupts the ability of the Biden administration to censor the online speech of Americans.

As a result of the injunction, the DOJ is now asking Judge Doughty to stay or pause his injunction while the government files a full appeal to the 5th circuit court of appeals.

(Reuters) –  The Biden administration on Thursday asked a federal judge to put on hold his earlier order barring some government agencies and officials from meeting and communicating with social media companies about moderating their content.

Interesting Court Ruling Against Govt and Biden Administration Prohibiting Federal Agencies from Contact with Social Media on First Amendment Protected Speech

A federal judge chose the 4th of July to deliver a key ruling blocking Biden administration agencies and officials from meeting and communicating with social media companies.  [Read 7-page Injunction HERE]

The temporary injunction targets an ongoing legal battle brought by the state of Louisiana and Missouri against federal agencies for collaborating with social media to censor speech content against the interests of the federal government.  The final ruling on govt involved censorship could have profound effects on the First Amendment.

Judge Terry A. Doughty, has not made a final ruling in the case, but he wrote that the Republican attorneys general “have produced evidence of a massive effort by Defendants, from the White House to federal agencies, to suppress speech based on its content.”  The ruling may have implications for tech companies, which have been exposed in recent months/years for regular communication with government officials.

This Preliminary Injunction also precludes said named Defendants, their agents, officers, employees, and contractors from acting in concert with others who are engaged in said conduct.” (link)

Obviously, trying to stop the government from coordinating with social media groups to suppress information adverse to both their interests is a little like squeezing Jello in a closed fist; they will find an angle out of the limitations.

Team DeSantis Starting to Feel the Pressure of Unrealized Billionaire Expectations

Despite numerous pontifications to the contrary, it was always going to go this way.  Florida Governor Ron DeSantis and the idiot professional political consultants, those enlisted by the Sea Island billionaires to try and drag the $100 bill on a fishing string through the MAGA hood, were only going to fool the first few blocks of voters; after that, people wised up.

The problems are too numerous to encapsulate; however, for the sake of brevity they can be argued into three main buckets: (1) Fakery – the entire dishonest operation from the outset (triggered visibly in ’21, originating back in ’18) was based on deception, astroturf and false pretenses.  (2) The candidate just isn’t that good, is inauthentic in the extreme, zero private sector understanding, and is dependent on #1.  (3) Transparently a Big Club operation, surrounded by the most expensive deceptions the GOPe can muster.

I said last summer the DeSantis campaign would collapse upon itself as sunlight poured in.  That’s exactly what has been happening.  Despite their initial trust deposits, Florida Republican voters are now a case study in ‘not going to be fooled again’.  Once you see the strings on the marionettes, you can never return to that moment in the performance when you did not see them.  It doesn’t matter how good the stage presentation; the strings are visible, and continued pretending only makes it worse.

(Politico) – A top spokesperson for Ron DeSantis’ super PAC is sounding a decidedly dour note on the Florida governor’s presidential prospects, saying his campaign is facing an “uphill battle” and is trailing badly in the key nominating states.

[…] “Right now in national polling we are way behind, I’ll be the first to admit that,” [Steve] Cortes said in a Twitter spaces event that was recorded on Sunday night. “I believe in being blunt and honest. It’s an uphill battle but clearly Donald Trump is the runaway frontrunner.”

Beware France – Macron Moves to Shut Down Internet Communication to Block Rebellious Uprisings

I added a NOTE about Musk’s nonsense justification.

If the lessons of COVID-19 have taught us anything, it should be that each step the totalitarian dictatorships take -under the guise of protecting new democratic norms- must be viewed through the prism of future targeting.

We should pay attention, lest we find ourselves on the alternate side of populist uprisings under state targeting.

I sent the prior warning message around the collaboration between private industry and western government surrounding financial restrictions placed on Russia. When VISA, Mastercard and other payment mechanisms willingly and willfully supported the intentions of the Western Government coalition, few people thought about the Rubicon this new merge and partnership was establishing. {SEE HERE} In essence, private industry determining the lifestyle of Russian citizens in an effort to target their political leadership. Few people were paying attention, fewer still think long term.

With France now pledging to shut down internet communication in an effort to control organizing through social media, there is a bigger picture that must be considered.

Let me take you back to 2010 and 2011 when the U.S. State Department, Hillary Clinton, Samantha Power, Susan Rice, CIA Director Leon Panetta and French President Nicholas Sarkozy wanted to support the Islamist Spring uprisings in Tunis, Libya, Egypt and Yemen.

What happened then is very much related to what we are seeing right now in Europe, specifically France; only this time we are seeing the inverse of the government interests regarding social media on display.
