Attorneys For President Trump Meet with Special Counsel Inquisitors

Boiling down the core of what media were focused on today, essentially it looks like this:

(VIA ABC) Trump attorneys John Lauro and Todd Blanche met with Smith’s team following the receipt of a target letter alerting Trump he is a target of the special counsel’s investigation into efforts to overturn the 2020 election. Trump’s lawyers were there to make the case for why they believed Trump shouldn’t be indicted. Smith was present for the meeting, sources said. The meeting ended after an hour; sources told ABC News.

The pattern of what appears to be distraction from the DOJ, organized by DAG Lisa Monaco, continues.

Any time there is very bad information in the media cycle, related to the ongoing sunlight upon Joe Biden and his crime family syndicate, the Joe Biden DOJ rolls out an indictment against Donald Trump.

At this point the transparency is so obvious, even Democrats admit it.

Why Would NBC Be Stalking Members of Special Counsel Jack Smith’s Grand Jury?

Just a small detail, apparently of no consequence for those who seemingly overlook such things; however, NBC is admitting to not only knowing the identity of the DC grand jury, but actually following them around and noting their activity. [SOURCE LINK]

Nothing like a little spotlight pressure to keep all the DC participants on the right path.  Nudge-Nudge, Wink-Wink, Say-no-More.

Worth noting Valerie Jarrett’s daughter, Laura Jarrett, is a member of the NBC surveillance team [link here], reporting her findings to NBC headquarters.

Lest we forget, it was NBC who ended up getting caught for tracking and conducting surveillance on jury members in the Kyle Rittenhouse case [link here], eventually leading to the judge needing to ban them from the courthouse.  Just saying.

Details of Now Collapsed Federal Plea Deal with Hunter Biden Leaked to Politico

UPDATED – To add court transcript for context.

First things first, it’s Politico!  When the Dept of Justice or FBI need to frame a narrative particular to their interests they use Politico and the New York Times. Keep this in mind.  When Main Justice needs to position themselves, they leak to NYT and Politico. All leaks are purposeful.

Politico has received a copy of what is claimed to be the original Hunter Biden plea agreement between the USAO in Delaware and the Biden defense team.  This is the plea agreement that was challenged by U.S. District Court Judge Maryellen Noreika, who was concerned the structure of the deal appeared to be creating immunity from prosecution for crimes that might come out of a now admitted, ongoing investigation of Hunter Biden; those crimes may include FARA violations.

The core issue centers around what appears to be clear coordination between the USAO, likely with the approvals of Main Justice (Monaco, Garland) and the Biden defense team, to structure the wording and placement of legal mechanisms inside the plea agreement to not only excuse the current criminal infractions, but also protect Hunter Biden from future criminal liability.

Essentially, all previous activities by Hunter Biden would be immune from prosecution, up to the date of his signing of the plea agreement.  A blank slate retroactively, with all exposure for criminal conduct removed.   The conduct surrounding the immunity is outlined in “Exhibit 1” and the “Attachment A” which was filed under seal.

DOJ Plea Deal With Hunter Biden Falls Apart as Federal Judge Infers DOJ Motive to Structure Immunity for Future Charges as DOJ Admits Ongoing Investigation

There was a lot going on in the Delaware federal court today.  One of the topline issues was an admission by federal prosecutors that an additional investigation of Hunter Biden is ongoing, as the tax evasion and federal gun charge deal was brokered.

At the core, we see U.S. District Court Judge Maryellen Noreika noting the terms of the current DOJ plea deal appeared structured to provide immunity to Hunter Biden for any future crimes identified in the ongoing investigation on other matters; so, Noreika asked the DOJ directly.  In essence, Judge Noreika called out the DOJ and directly asked them if this was their intent.

When Judge Noreika questioned the prosecution about this immunity implication, the US attorneys said future immunity was not part of this agreement.  At that point the Hunter Biden defense team then acted surprised, saying if this is the accurate position of the DOJ then any plea deal is “null and void.

After those statements, Judge Noreika seemingly dispatched the deal, telling both the DOJ and Biden defense, “I think having you guys talk more makes sense.”

Here’s the non-pretending version.  The corrupt U.S. attorney’s office organized, coordinated and colluded with the Hunter Biden team to structure a deal that would provide cover for Hunter Biden for any further crimes.  This is corrupt as hell.  The judge sniffed this motive and asked the DOJ directly.  The DOJ could not make that admission for obvious reasons and denied this intent. Thus, the Hunter defense team then had to say without the previously agreed future immunity, the deal was off.

Hunter Biden Business Associate to Testify as Witness that VP Joe Biden Was on Phone Calls Organizing Influence Needs

Devon Archer was a good friend and business associate of Hunter Biden. According to reports from the New York Post, Archer is now scheduled to deliver witness testimony that he was present during approximately two dozen phone calls where Joe Biden was organizing business operations with his son Hunter Biden.

Joe Biden has previously denied any involvement with the business affairs of Hunter Biden. The business of Hunter Biden essentially boils down to Hunter selling various business executives on the ability of his father to use his political position to influence government action. Devon Archer was part of the conversations and a witness to the phone calls between various executives, Hunter and Joe.

(Via New York Post) – […] Hunter Biden would dial in his father, then-Vice President Joe Biden, on speakerphone into meetings with his overseas business partners, according to testimony expected before Congress this week from Devon Archer, the first son’s former best friend.

Archer, 48, who is facing jail for his role in a $60 million bond fraud, is scheduled to testify to the House Oversight Committee about meetings he witnessed that were attended by Joe Biden either in person or via speakerphone when Hunter would call his father and introduce him to foreign business partners or prospective investors.

“We are looking forward very much to hearing from Devon Archer about all the times he has witnessed Joe Biden meeting with Hunter Biden’s overseas business partners when he was vice president, including on speakerphone,” said Rep. James Comer (R-Ky.), the committee chairman.

One such meeting was in Dubai late in the evening of Friday, Dec. 4, 2015, after a board meeting of the Ukrainian energy company Burisma, which was paying Hunter $83,000 a month as a director.

Action Alert – ODNI Release of FISA Court Review Reveals Alarming Disconnect That Must Be Discussed Before FISA-702 Reauthorization

There is a major issue within the use of the FISA-702 authority that must be immediately understood.  A silo problem that is not being discussed within Congress as the potential for FISA-702 reauthorization is looming.

I’m setting aside my opinion of the entire process in order to just outline the facts as they appear.  I am not in support of any of this FISA process; nor do I support the baseline premise of the NSA database capturing the private electronic communication of Americans, which I do not believe is legislatively authorized to exist.

The Office of the Director of National Intelligence (ODNI) recently released the 2023 FISC opinion on FISA-702 activity as reported by the NSA, FBI and to a lesser extent CIA and NCTC [REPORT HERE].

In this report, the Foreign Intelligence Surveillance Court (FISC) is reviewing legal compliance by the NSA and FBI in accessing the NSA database that houses the private electronic records, metadata, of every American.  This is the core of the FISA-702 authorization, where 702 indicates an American citizen protected from illegal searches and seizures by the Fourth Amendment.

The NSA database contains the private electronic data (metadata) of every single American – including emails, text messages, social media posts, instant messages, direct messages, phone calls, geolocation identifiers, purchases by electronic funds, banking records and any keystroke any American person puts into any electronic device for any reason. [A big issue here is the use of Two-Factor Authentication (2FA) but that’s for a different article.]

The 2023 FISC report reviews the action of the FBI and NSA to ensure compliance with rules and restrictions in the search of this database.

The NSA and FBI report violations of the process to the FISA Court; this is somewhat of an honor system.  You may have heard FBI Director Christopher Wray recently saying they have reduced the number of unauthorized searches of this database by 80%.  The FBI has presumably tightened up the rules and restrictions on who and how this database can be searched.

The ODNI release only covers the compliance of the NSA and FBI (and the CIA and NCTC) to the FISA-702 rules.  The CIA and NCTC are foreign mission authority only, therefore they should never even be involved in searching American citizens.

ODNI Releases 2023 FISA Court Compliance Audit, Opinion and FISC Reauthorization – 117 Page PDF

If anyone else wants to climb in here and read this report [pdf DATA HERE], drop your review notes in the comments.  It’s going to take me a day or two to finish making all my notes.

The Office of the Director of National Intelligence [ODNI] has released a 117-page April 2023 order/opinion by the Foreign Intelligence Surveillance Court [FISC] about the compliance audit conducted by internal review as the U.S. intelligence agencies seek reauthorization.   Everything FISC happens in secret, and the report is heavily redacted; however, some interesting information can be obtained if you read the report carefully.

Here’s an example.  The FISC is now agreeing with the NSA and FBI that all search logs and audit trails should be erased after 10 years from query.  That means every audit trail from the period up to August 2013 is about to be erased.  That means almost all of the Obama era search queries will disappear before the next administration takes office.

They are not erasing our data; they are erasing the logs of their search inquiries into our data.  FU!

Readers here know my position.  I do not believe the FISA court is needed; nor do I believe the NSA, FBI, NCTC or CIA should have any search access to the metadata [full scope electronic records] of American Citizens without a court order.

The DOJ and FBI should go to the ordinary federal courts for search warrants.  The CIA and National Counterterrorism Center (NCTC) both have foreign service missions, so they do not need access to American citizen metadata (702 acquired).  Why would the CIA and NCTC need to snoop into the private data of American citizens when their legislative authority forbids them from conducting domestic surveillance?    Additionally, the NSA should not contain a lifetime repository for all electronic records of American citizens.  That’s my opinion.

Judge Aileen Cannon Sets DOJ Trial Date -vs- Donald Trump for May 20, 2024

There are buckets and buckets of legal contingencies in the fabricated case created by Special Counsel Jack Smith, acting on behalf of Andrew Weissmann, Barry Berke, Norm Eisen and Mary McCord, and the DOJ case against Donald J. Trump.

So many contingencies, there is almost no reason to look at any procedural process with any inclination the date will have consequence.  However, that said, Judge Aileen Cannon has smartly delayed the trial portion of the case until May 20, 2024.  [Full Legal Outline pdf]

I say smartly, because by Mid-May 2024, President Trump will likely have wrapped up the GOP nomination, and that structural reality itself will punt the rest of the gibberish into a time ever more distant.   Smart base-covering and no room for appeal move by Judge Cannon.

Some may see this as a loss or a gain for either side.  Personally, I view this as a structural and procedural win for President Trump, a wrongly targeted American citizen within a process weaponized by a comprehensively corrupt government.

Judge Cannon is no dummy. She knows the stakes, sees the transparency of the effort, and is not an ideologue.  Her earlier rulings, in the document side of the FBI raid, reflected her awareness the system was being manipulated by agents of Lawfare intent.  May 20th, which will never happen, is a good target all things considered.
