Biden Administration Outlines Six Executive Actions They Will Initiate for Unilateral Gun Control Efforts Without Legislative Branch

The White House has released some details of the six executive actions the JoeBama team has put together for Joe Biden to sign.

(1)  The Justice Department, within 30 days, will issue a proposed rule to help stop the proliferation of “ghost guns.” We are experiencing a growing problem: criminals are buying kits containing nearly all of the components and directions for finishing a firearm within as little as 30 minutes and using these firearms to commit crimes. When these firearms turn up at crime scenes, they often cannot be traced by law enforcement due to the lack of a serial number. The Justice Department will issue a proposed rule to help stop the proliferation of these firearms.

(2) The Justice Department, within 60 days, will issue a proposed rule to make clear when a device marketed as a stabilizing brace effectively turns a pistol into a short-barreled rifle subject to the requirements of the National Firearms Act. The alleged shooter in the Boulder tragedy last month appears to have used a pistol with an arm brace, which can make a firearm more stable and accurate while still being concealable.

President Trump Signs Memorandum To Regulate “Bump Fire Stocks”…

While speaking during a White House ceremony earlier today President Trump announced he has directed Attorney General Jeff Sessions to develop regulations surrounding “bump fire stocks”, noting the intended regulation would be an actionable step to help prevent future mass shootings.

During his remarks President Trump noted: “We cannot merely take actions that make us feel like we are making a difference, we must actually make a difference.” The decision to eliminate ‘bump-fire stocks’ is smart policy and politically.

On the policy side the regulatory move is in line with already existing rules on firearms that ban auto-fire weapons. On the political side the memorandum stops opposition from saying the President is not taking action; the regulatory memorandum reflects action taken by President Trump that was not taken by President Obama.

(From the memorandum) After the deadly mass murder in Las Vegas, Nevada, on October 1, 2017, I asked my Administration to fully review how the Bureau of Alcohol, Tobacco, Firearms and Explosives regulates bump fire stocks and similar devices.

Although the Obama Administration repeatedly concluded that particular bump stock type devices were lawful to purchase and possess, I sought further clarification of the law restricting fully automatic machineguns.

State Of The Union and GOP Rebuttal – Open Discussion Thread…

President Obama will be delivering his final State of the Union Speech tonight at 9:00pm.  While he is anticipated to praise the Iran nuclear deal, the White House communication team are stating he will avoid the current Iran hostage crisis which erupted this afternoon.

The professional republican politicians (GOPe) have selected South Carolina Governor Nikki Haley to deliver the post-SOTU rebuttal.   According to early releases Governor Haley has been given a script to attack both President Obama and GOP frontrunner Donald Trump on behalf of the UniParty.  Apparently, her not so hidden-agenda secondary goal is to support a more preferable and palatable candidate than the vulgarian Trump.

President Obama’s Action on New Federal Gun Restrictions To Be Announced Tomorrow…

Pay close attention to the official wording tomorrow from the White House.  Will it be an “Executive Order“, or will it be called an “Executive Action“, there is a profound difference.

♦ “Executive orders” are those dictatorial fiats from the White House that contain an origin, at least as regarded by the Office of Legal Counsel (OLC), founded in law.

♦ “Executive actions” are the term-two preferences of President Obama and constitute dictatorial fiats that are not constitutionally based, not legal, not supported by the OLC, and will not eventually hold up under legal challenge.  The key word is “eventually”.

If called an executive order, that means the office of legal counsel (OLC) has affirmed to President Obama his intended activity is legally within his authority.  However, if the White House repeatedly calls it an executive action, that means it’s purely a political decision without OLC approval, regarding constitutional authority, and will likely not pass legal challenge.

The details are currently sketchy but here’s a few early reports of what to expect:

White House Leaks Obama Intents For “Executive Action” Firearm Restrictions…

As we review the current media report for President Obama’s intentions, regarding executive office restrictions on firearms, we must remember the second term distinction between “executive orders” and “executive action“.

The Obama “executive actions” are political decisions intentionally constructed and designed to advance an ideology while creating legal conflict.  They successfully advance ‘change’ until they are overruled by state and federal courts.

An example of an “executive action” was the Deferred Action for Parents of Americans, or DAPA, amnesty program Obama rolled out in November of 2014.   DAPA was an Executive Action, not an Executive Order.

Executive Actions open barn doors.  They are never designed/intended to pass legal challenge.  They create mostly irreversible consequences.

To the best of our knowledge the entire MSM and professional punditry have yet to recognize the strategic and intentional use of executive action – and explain it to everyone. (more…)

No longer willing to play second fiddle to Chicago, New York has re-entered the race to sit atop the infamous list of most dangerous cities.

While it is still too early to tell how successful Mayor De Blasio will be in his quest to retake the mantle from Chicago’s Mayor Rahm Emanuel, it appears his policies to remove law and order are unleashing the strongest villains amid his societal construct.

The rise in violence comes as Mayor de Blasio ends ‘stop and frisk’ practices, others blame warmer weather.
According to CBS New York, Saturday’s shootings wounded eight people in the Bronx, three in Brooklyn and one in Manhattan. (link)

While in Aspen Colorado, Bloomberg advocated for a position to make it illegal for young black males to own firearms.

Father of California Victim From Eliot Rodger’s Shooting Spree Says “We Are All To Blame” For Not Passing Tougher Gun Laws…

GOLETA, Calif. — The father of a young man gunned down Friday during the rampage in Santa Barbara said he is asking members of Congress to stop calling him to offer condolences but nothing more for the death of his only child, Christopher Michaels-Martinez.

“I don’t care about your sympathy. I don’t give a s— that you feel sorry for me,” Richard Martinez said during an extensive interview, his face flushed as tears rolled down his face. “Get to work and do something. I’ll tell the president the same thing if he calls me. Getting a call from a politician doesn’t impress me.”

Saying “we are all to blame” for the death of his 20-year-old son, Martinez urged the public join him in demanding “immediate action” from members of Congress and President Obama to curb gun violence by passing stricter gun-control laws. (more…)
