Watch Out: 2026 FISA 702 Reauthorization

The authority for the United States government to capture the electronic records of all Americans without warrant falls under the auspices of FISA-702.  The current authority expires in April of 2026.

Some administrative state defenders will argue this issue with me. However, having researched almost every aspect to the construct, and the argument, I am confident FISA-702 authority underpins the much bigger, quasi-constitutional justification for the wholesale collection of U.S. citizen metadata.  Without the 702 authority, the legal justification for the apparatus of surveillance no longer exists.  It really is that simple.

That said, there remains ZERO justification for the wholesale capture of U.S. citizen data by the government. It is not the searching of the database that presents the issue; the capture itself violates the Fourth Amendment.

The only way the government can justify the capture of U.S. Citizen data is if there is some quasi-constitutional or national security reason for it.  That’s where FISA-702 comes in.

Take away “702” search authority, and the data collection argument collapses; ANY “incidental” search of the database then loses any plausible legal justification.  702 is the camel’s nose under the tent that forms the baseline for all data records to be intercepted, stored and ultimately available for review.

This is a very key component to fully understand.  Most practical applications of surveillance are contingent upon the capture of electronic records for tracking.  Ex. – if domestic travel records are considered private papers (never argued yet), then government agencies have no right to exploit them without a valid search warrant underpinned by a national security justification.  The government, not private sector – government, tracking people becomes more difficult if privacy rules are applied.

The legal aspect runs through the 4th Amendment, which -while historically undefined in the modern era- likely stirs in the background of the recent TSA decision to provide a $45 opt-out, for the use of REAL ID in domestic transit (interstate commerce application notwithstanding).

The Fourth Amendment aspect to the ‘warrantless’ government capture of American citizen records has never been fully argued in court; the modern definitions are opaque, and the govt has a vested interest in retaining the untested status quo.

Vice President JD Vance Discusses the Challenges with the Ukraine-Russia Conflict

Vice President JD Vance appears for a lengthy interview with Miranda Devine to discuss a variety of current issues that have presented themselves to the Trump administration. [Full Video Here]

In the segment below, Vice President Vance talks about the Ukraine-Russia conflict, and the significant challenges dealing with Ukraine President Volodymyr Zelenskyy.  As noted, Zelenskyy was used to getting everything he demanded from the former Biden administration; however, no end to the conflict was present in the prior policy.

President Trump is seeking to end the conflict, and has aligned policy toward that end.  Both President Putin and President Zelenskyy must be willing to engage with each other diplomatically to resolve the issues.  There is no current intention between both of the leaders toward a negotiated settlement.

President Trump has no intention to push U.S. policy into the middle of the conflict between Zelenskyy and Putin. WATCH:

Vice President JD Vance Delivers Remarks at TPUSA Conference and Answers Questions – Full Video and Transcript

A few days ago, Florida Governor Ron DeSantis took up lead position toward enlisting the TPUSA political movement for his future aspirations.  Vice President JD Vance quickly responds by attending a TPUSA at the University of Mississippi.  This is JD Vance’s first campaign rally for 2028.

The full remarks as well as the question-and-answer period are transcribed below the video.

[Transcript] – JD Vance (00:14): “Ole Miss, I got a question. Are you ready? Wow, that was impressive. They told me that would be impressive and they were exactly right. So, let me say a few words of thank you first to my dear friend and the widow of my dear friend Charlie Kirk. Erika, you have been such an amazing inspiration to the entire country. How much do we love Erika Kirk? She’s done a hell of a job. We have a couple of Mississippi senators here. We have both Senator Roger Wicker and Senator Cindy Hyde-Smith. Thank you guys for being here. We have the governor of Mississippi with us. We got an all star crowd here. Governor, thank you for being here. And most importantly, we have got over 10,000 students from across Mississippi.

(01:35) We are proud to have you and we know that you are the future of Charlie Kirk’s legacy, so thank you for being here. I got this whole speech written and I’m not going to deliver any of what I had written. I’m just going to speak from the heart, because that’s what Charlie would so often do. When I think about what we lost six weeks ago, it feels like forever ago when I was in a meeting in the West Wing, and one of my staff members came in and said that Charlie had been shot. And then I looked at my phone, and I saw all the text messages and realized that my dear friend had been very seriously injured. Now, in the West Wing at that time, we actually thought that Charlie had a chance. We didn’t know that he was eventually going to pass away.

[Transcript] MARGARET BRENNAN: Good morning and welcome to Face The Nation. We begin today with Vice President JD Vance, who joins us from Cincinnati, this morning. Good morning to you, Mr. Vice President.

VICE PRESIDENT JD VANCE: Good morning, Margaret, thanks for having me.

MARGARET BRENNAN: We are getting very close to that 72 hour deadline for the hostage release. I think the world is holding its breath here. Is the administration seeing signs that Hamas and Israel are complying with everything they need to and that this will go ahead?

VICE PRESIDENT VANCE: Yes, Margaret, so knock on wood, but we feel very confident the hostages will be released, and that the President is actually traveling to the Middle East, likely this evening, in order to meet them and greet them in person. It’s a big day for their families, but I think more importantly, it’s a big day for the entire world.

The President of the United States said to his entire diplomatic team, especially Marco Rubio, Steve Witkoff and Jared Kushner, to go and get a deal done, to stop the war in Gaza, to begin to rebuild Gaza so the population could live there in peace and prosperity, to actually eliminate the threat of terrorism to our friends in Israel- which is very, very important, and also to bring the hostages home alive. It was a very tall task. He pursued a very non traditional diplomacy with people who were not 40 year diplomats, but people who brought a fresh perspective to it. And of course, the President was criticized for it. The diplomatic team was criticized for it. But I think that because he chose a different pathway, he didn’t just do what everybody else in the past had done. We are now on the cusp of a sustainable peace in the Middle East. It’s a great moment.

Sunday Talks – Vice President JD Vance Outlines Gaza Peace Deal, U.S. Troops to Middle East and Qatari Base in Idaho

Vice President JD Vance appears on Fox News with Maria Bartiromo to discuss the Israel/Hamas peace agreement over Gaza and other regional issues.

As noted by Vance, the Gulf Arab states are willing to provide boots on the ground to establish the security parameters for the Gaza area, as well as the vast majority of the funding to rebuild Gaza and monitor the stability therein.  Additionally, Vice President Vance discussed the government shutdown and the ways President Trump and OMB Director Russ Vought are working through the process of funding priority.  Tariff revenue will be a significant offset.

The conversation then goes to the Chinese trade actions and the new tariffs against Beijing.  WATCH:

Sunday Talks – JD Vance Discusses Comey, Gaza and Russia

Vice President JD Vance appears on Fox News Sunday to discuss the indictment of former FBI Director James Comey, the “deal” that seems close at hand in the Israeli-Hamas war, and the ongoing Russian conflict with Ukraine.

As to the Russia-Ukraine conflict, there appears to be a race afoot.  NATO and the EU team are funneling more lethal and long-range weapons into Ukraine in order to escalate the attacks deeper into Russia.  Alarmingly, it does not seem as if JD Vance is ¹aware of that shift.

Even more concerningly, this weapons escalation in Ukraine is happening simultaneous with the same Intelligence Community team controlling the election outcome in ²Moldova, specifically to increase the likelihood of direct NATO conflict against Russia.  Again, both President Trump and Vice President Vance seem unaware of it.

The bottom line is that direct military conflict between NATO allies and Russia is almost a foregone conclusion now, while Trump and Vance ponder the unwillingness of Russia to negotiate with Ukraine or the United States.  WATCH:

[¹,² I know this sounds crazy but…. I’m beginning to wonder if the White House is being intentionally kept in the dark by the National Security Council, or by other professionals (Ratcliffe) who should be normally briefing them on significant changes in day-to-day events.  There are a lot of unknowns looking from the outside; however, the recent comments from Vance/Trump do not align with demonstrable realities on the ground.]
