In his own words, Senator James Lankford says if President Trump was president today the border crisis would not exist, because the existing law would be enforced. Simultaneous to this, the same Senator Lankford says the new law he proposes will create significant border enforcement.
If the executive branch can ignore the current border enforcement law (they can and do), what makes Lankford believe new legislation will not be ignored by the same executive branch (they will)? This non-pretending reality frames the essential point: the element of “enforcement” is not within the legislative branch, so the entire effort is a moot exercise. WATCH:

[Transcript] – MARGARET BRENNAN: And we’re joined now by Oklahoma Republican James Lankford. He’s in Oklahoma City this morning. Good morning to you, sir, it has taken you two months to get this bipartisan deal. Do you have the support of your fellow Republicans to actually vote this through?
SEN. JAMES LANKFORD: Well, actually, I wish it would have taken only two months. It’s taken about four months to be able to go through this, we started in October. Everyone’s looking to be able to read the bill at this point. That’s the key aspect, we’re working on the final aspects of it to try to be able to get it out. So everyone can get a chance to read it. Right now, they’re all functioning off of internet rumors of what’s in the bill, and many of them are false. So people want to be able to just see it, read it and go through it. And to be able to see the dramatic change that this really makes and how we handle our immigration system, and how we work to be able to secure our border completely. That’s been the simple request of Americans, whether you’re Republican, Democrat, or independent, people just want a secure border, where we have legal immigration, but we’re not promoting illegal immigration. And that’s what we’ve seen in the last three years.
MARGARET BRENNAN: So you don’t have a vote count yet?
SEN. LANKFORD: Do not have a vote count yet on this because everybody’s got to be able to read it to be able to go through. But I do feel very positive about it because even the initial feedback has been good.
MARGARET BRENNAN: So you just heard the details laid out there by our immigration correspondent, how do you balance the shutdown power that would be in these new authorities versus the right to claim asylum?
SEN. LANKFORD: Yeah, this is similar to what we had to under Title 42, during the pandemic time period, where we reach a crisis point to say we can’t actually operate. So we don’t have that authority. Right now, as the United States, we’ve reached crisis points. For instance, when we got four or 5,000 people crossing the border, we can no longer process those individuals. So right now, the Biden administration is just releasing them into the country. That’s what’s driving the mayors in Denver, in Chicago, in New York City and other places around the country crazy to say, when the border gets crowded, you just release them to our cities, and it causes all the chaos in these cities. This is a new authority to say, when we can no longer detain and deport, when we can’t process the people and actually make a decision right there at the border, then we’ll actually turn those folks back around to Mexico and say, “We can no longer do this.” That gives the authority to the United States into law enforcement, rather than the authority, just the criminal cartels. Right now. The cartels can just rush our border, they’ll get through as many people as they want to be able to get through. We can not have criminal organizations running our southern border, we have to be able to run our southern border.
MARGARET BRENNAN: So parole authority has been a sticking point for Republicans throughout. I know the administration has used it in a novel way to resettle 1 million people. So how are you changing that authority?
SEN. LANKFORD: Yeah, humanitarian parole is still- is still an issue for us. But it’s been an authority that every President has had to have basic humanitarian parole, but as you mentioned, this administration has used humanitarian parole in a way no other administration has. They’ve said, if you’ll just tell us in advance that you’re coming, come to a port of entry, the first day you get here, we’ll hand you a work permit, and we’ll release you into the country under parole. Well, that’s actually attracting more people, of course, people from around the world are going to want an American work permit to show up. So instead of deterring immigration, they’re literally incentivizing illegal immigration,. They’re handing people a parole and a work permit day one. That has to stop, we can’t just have a system where we have that. In between the ports of entries, when it gets crowded, they’ll just release them under a parole authority there. And they’re just released in the country. We don’t know if they qualify for asylum. We don’t know where they are. By the hundreds of thousands people are just being released in the country. And we have no tracking on them at all. That has to stop. This is a national security issue for us. May I remind you that we’ve had 50 people come across our border that we’ve interdicted, that are on the terror watch list. Just in the past four months, we’ve had tens of thousands of people that came across our border that were identified as a national security risk. Those individuals should not just be waived into the country.
MARGARET BRENNAN: So the conservative Wall Street Journal editorial board called this the best chance in years to fix asylum law and parole loophole. But Donald Trump, who is the front runner to be your party’s nominee in 2024 is telling Republicans not to support this. Here’s what he said last night in Las Vegas.

FORMER PRESIDENT DONALD TRUMP: A lot of the senators are trying to say respectfully they’re blaming going to me– I said that’s okay. Please blame it on me, please, because they were getting ready to pass a very bad bill. And I’ll tell you what a bad bill is– I’d rather have no bill than a bad bill.

MARGARET BRENNAN: Can you get this passed without Donald Trump’s approval?
SEN. LANKFORD: Well, I’m looking forward to President Trump having the opportunity to be able to read it like everybody else. There’s a lot of misinformation out there right now that I hear this comment that it waives in 5,000 people, it hands out work permits that- all those things are not true. There’s just a lot of internet rumors that are running around on this right now. We’re looking forward to getting the information out and I can say, there is no question no matter what your political persuasion is, we would not have had the immigration crisis we’re experiencing right now, if President Trump would have been president the last three years. There’s no way we would have had 8 million people illegally cross our border, because he would enforce those different authorities and would have made sure that we actually secure a border. But even while he was president, he was specifically asking Congress to change the standard on asylum to be able to tighten up, to be able to give them additional funds for deportation. All of those things are in this bill. So if he were to be president, this would be new authorities that he had actually asked for when he was president before.
MARGARET BRENNAN: Right. And I just- you just said that he has not read this bill. He doesn’t essentially know what he’s talking about. So this deal–
Sen. Lankford: — Well, I’m not saying that. I’m just saying there’s just a lot of rumors that are out there about the bill. And I want to make sure everyone has a chance to be able to read it before they make a final judgment.
MARGARET BRENNAN: Right. So the deal you just said would give any future president and the current one new authorities. So on the trail, Trump has vowed to block legal immigrants based on their beliefs to end birthright citizenship, to carry out mass deportations, and he has not ruled out separating kids from their parents. Would you trust Donald Trump with these new authorities?
SEN. LANKFORD: I would actually because these are not only new authorities that had been asked for by multiple presidents, whether it be President Trump, President Obama, President Bush before that, this is a basic thing that we have to have for our national security. When we talk about asylum, right now you cross the border, and you literally say, I have fear in my country, and you’re released into the United States and await a 10-year hearing. No one thinks that actually makes sense to have a 10-year backlog for just saying the magic words. I have fear in my country. We don’t really know if they qualify for asylum. We don’t know their criminal record. We don’t know anything else about it. That absolutely has to change. That’s been an issue for a very long time that changes this in law.
MARGARET BRENNAN: Well, we will have to see where we are on the vote count. But I want to ask you, back in 2022, Donald Trump endorsed your reelection. And in that endorsement, he said, “James Lankford is strong on the border.” Has anything changed with your thoughts about endorsing Donald Trump for president?
SEN. LANKFORD: No, it hasn’t at all. Obviously, he’s been very engaged, as I’ve mentioned already on it, none of the things that are happening in the last three years in the border would have happened if Donald Trump was actually president. He knows I’ve been very passionate about the border. This is an issue I’ve worked on for a very long time. He and I worked together when he was in the White House on some of his border policies. And when he did his big proposal, that was a legislative proposal, because again, President Trump proposed new laws and new issues on this, because we know that we have gaps in the system. So if you want to be able to secure the border, you can have President Trump to be able to come in to actually secure the border, because he’s going to focus in on that. But if he comes in and is elected by the American people to come this November, he’s going to want these additional authorities in this because it will help every president from here on out.
MARGARET BRENNAN: Yeah, but you’re not endorsing him?
SEN. LANKFORD: I actually haven’t endorsed anyone on it. But he’d be a much better president than what we’re dealing with right now, definitely on national security.
MARGARET BRENNAN: Okay. Before I let you go, I want to get your reaction to the news that he was ordered to pay $83 million to a person that a jury found he defamed after a separate jury found that he had sexually assaulted her. Does it give you any pause about him returning to office?
SEN. LANKFORD: It doesn’t. Obviously, these are legal cases. I don’t want to jump in the middle of a legal case. It’s been interesting the number of legal cases that have come up against President Trump and then have failed and had been dropped or had been kicked out of the courts on it. This one’s actually went through. He’s already said he’s going to challenge it. So let the courts actually make their decisions and let the American people make their decisions. We got states like Colorado that are trying to be able to block the people of Colorado from being able to choose who they vote for. Let the American people decide this in November.
MARGARET BRENNAN: Well, the Supreme Court might decide on that one. We will have to leave it there for today, James Lankford. We will be focusing on what progress you were able to make. We’ll be back in just one minute.
I think the Texas governor’s actions, feeble and fake as they might be, are the first steps toward restoring constitutional government, and forcing the feds to act lawfully. Other states are at least mouthing the words. This is good.
And challenging a rogue Supreme Ct decision is an important part of this.
We the People have to challenge the lawbreakers, assembling at the local and state levels, using government bodies and public assembly. There are more of us than them. They succeed only through money and authoritarianism. We succeed through truth and sunlight and assembly. The Senate Select Committee on Intelligence (SSCI) created the systems that permit intelligence weaponization. The SSCI is the organizational institution that supports the Fourth Branch of Government, the intelligence branch. Keep in mind, the SSCI previously created a bipartisan “Restrict Act,” to deal with what they deemed dangerous information on the internet (under auspices of TikTok ban). SSCI Chairman Mark Warner is the current enabler of the continued weaponized intel operations.

There has never been effective oversight of the NSA’s bulk collections programs, or indeed, intelligence agencies in general. There’s been a lot of noise made about this vaunted oversight in defense of programs revealed by leaked documents, but this is nothing more than a talking point.
At The Big Picture, a clip of Sen. John D. Rockefeller (then Chairman of the Senate Select Committee on Intelligence) discussing how oversight actually works has been posted. It’s from an interview given in 2007, about the time the FISA Amendments Act was being put together to replace the expiring Protect America Act. The amendments act, among other things, extended the length of warrantless surveillance and gave telecoms retroactive immunity for their participation in the NSA’s bulk collections.
Here’s Sen. John D. Rockefeller explaining why, even back in 2007, intelligence agency oversight was a joke.
DAVIS: Reports quote administration officials as saying this is going on and it’s being done in a way to avoid oversight of the Intelligence Committee. Is there any way—

Barely two weeks after Donald Trump took office, Eric Ciaramella – the CIA analyst whose name was recently linked in a tweet by the president and mentioned by lawmakers as the anonymous “whistleblower” who touched off Trump’s impeachment – was overheard in the White House discussing with another staffer how to remove the newly elected president from office, according to former colleagues.
Sources told RealClearInvestigations the staffer with whom Ciaramella was speaking was Sean Misko. Both were Obama administration holdovers working in the Trump White House on foreign policy and national security issues. And both expressed anger over Trump’s new “America First” foreign policy, a sea change from President Obama’s approach to international affairs.
At a meeting of National Security Council employees two weeks into the Trump administration, the unidentified military staffer, who was seated directly in front of Ciaramella and Misko, confirmed hearing them talk about toppling Trump.
“After Flynn briefed [the staff] about what ‘America First’ foreign policy means, Ciaramella turned to Misko and commented, ‘We need to take him out,’ ” the staffer recalled. “And Misko replied, ‘Yeah, we need to do everything we can to take out the president.’”
Added the military detailee, who spoke on condition of anonymity: “By ‘taking him out,’ they meant removing him from office by any means necessary. They were triggered by Trump’s and Flynn’s vision for the world. This was the first ‘all hands’ [staff meeting] where they got to see Trump’s national security team, and they were huffing and puffing throughout the briefing any time Flynn said something they didn’t like about ‘America First.’”
He said he also overheard Ciaramella telling Misko, referring to Trump, “We can’t let him enact this foreign policy.”
Alarmed by their conversation, the military staffer immediately reported what he heard to his superiors.
“It was so shocking that they were so blatant and outspoken about their opinion,” he recalled. “They weren’t shouting it, but they didn’t seem to feel the need to hide it.”
“The intelligence community targeted Trump for removal for daring to question Biden family corruption and election interference tied to Ukraine and Burisma,” Judicial Watch President Tom Fitton said. “The Biden Defense Department’s sitting for over a year on a simple FOIA request on the Deep State targeting of Trump is a cover-up plain and simple.”
Well, Obama said that he had a phone and a pen. Trump will have the same things.

Or saying f you to all of the suburban moderates who think compassion should guide policy? Or harassing open borders politicians and their families whenever they set foot in public?

So…..I wonder how quickly this mess could get resolved if a bill was passed to close the border and then cut all government employees’ paycheck by 5% until the border was closed tight and all current asylum cases were adjudicated and those not awarded asylum were deported. Sorry, no new migrants of any type until the dockets are clear.

Gonna have to come up with a more sophisticated, targeted plan for achieving preferred outcomes. Otherwise, one ends up labelled no differently from the rogues who currently have their hands on the ship-of-state rudder.
Prune the workforce – the deadweight. Shed DEI/woke policies (and associated management manpower) while ensuring strong resistance to actual discrimination defined in policy that has existed for decades. Enforce standard efficiency metrics IAW well defined annual performance reviews connected to organizational mission and budget. Define and enforce “fair” hiring practices at the HR level – cut out most of the political turnstile BS that operates tacitly between Congress and Federal executive agencies; actually monitor and enforce (at least somewhat) the influence of lobbyist and big corporate funders (tough nut to crack…I know).
Get the ****ing media to do its job with unbiased, apolitical investigative reporting – same for internal IG functions. While the persistent bankruptcy of media organizations is satisfying on a level – this is somewhat a shoot-self-in-foot outcome. The goal should be to restore traditional institutional responsibilities and accountability.
Get Congress to do it’s ***n job appropriating and allocating the federal budget instead of this joke coverall continuous/baseline budgeting scam.

When an official fails to uphold their oath to defend the US Constitution, it is the province of WE THE PEOPLE to fulfill this obligation. The US Constitution remedies the grievances you outlined.

My point was directed at the posts arguing for universal penalties for anyone working civl service (i.e., gov’t). I’ve been there. I left after five years cuz I couldn’t stand the politics and had options. That said, there were plenty people who approached their jobs professionally, competently and in the best interests of the country. You can’t rescue an un-tethered system by screwing over other people – that is just a variant of reparations logic if you think about it.
The point is to resurrect a system that has been corrupted by political (Congress; Executive personnel policies) and big business operatives – not to crush everyone in the system. That just leads to more strife and injustice. Double dippers or not, you think the retired military so lauded by many on this site are all corrupt agents in the system? There are people working to a higher standard in the gov’t. Don’t punish them along with the miscreants.
Fix the core “prime movers”. That’s a key problem in all of this. Everyone wants satisfaction. It’s well past time for accountability. But the right people and processes have to be targeted. Not the lazy “eff em all” approach.

To answer your question: you are framing this as here and now. Enforcement is decided by those who hold power. So there is a hidden (though obvious) prior state change requirement.
Plenty quality analysis on this site for years on various aspects of the internal usurpation of power in our country. The path to altering that dynamic, however, is a different matter. Since 2015 that has been largely conceived as a political and cultural evolution. The usurpers have already demonstrated they are fully prepared to take things kinetic. That’s how I see it. It makes sense to me to incorporate as many folks into the fold as possible. Blanket punishment of a whole community (i.e., millions of gov’t workers) aint a good move in my mind. You’re gonna need many of these people to effect needed change.
You have to live by the principles you supposedly espouse. Identify and hold accountable the folks who are responsible for all of this. **** em! You have to realize power first to do this. What’s the best path to do so? Is it better to have fewer or more allies? Do you adopt a scorched Earth approach or do the harder work of acting with purpose bounded by core principles?

We know that there are no clean solutions. We know things can get fugly in a heartbeat.
So, what’s the plan behind all of this? Elect PDJT, put his people in power and then tax all gov’t workers until they comply? That’s it?
You know, I have been critical of PDJT when it comes to his personnel selections very early in all of this (e.g., Sessions, Wray). The “he acted on advice” excuse is only partially true. He has his internal process for trusting people – until it’s time not to. The process clearly needs some refining. But I now understand/support the deeper instinct to reach for allies first. I came to the same conclusion when I had to build a staff. I chose folks based on performance and what I understood to be their “nature” and character and placed it in context of the jobs I wanted to slide them into. Sometimes you get it wrong. Let’s not see everyone not mouthing the slogans as an enemy. Just the opposite. Cultivate the allies. Develop new information sources. Build a plan that sustains operations (once real power is achieved) while accountability is meted out and structural changes are implemented.

I knew that that oath meant that I was willing to give my life to honor it, the same as thousands before me had done to insure the freedom of this country. You guys took the exact same oath. My question to you is: Are you willing to give your life to protect the Constitution, either literally as in dying, or figuratively, i.e., politically, by standing for something that would result in your not being re-elected? What I saw was an assembly of “deer in the headlights” looks from the group. Finally, a congressman from GA said, “I’d have to think about that.” I countered with, “did you happen to think about what you were saying when you took the oath to the Constitution?” My “buddy” stood there like he was some kind of royalty, with a smirk that said, “My s*** doesn’t stink”. The question that he showed his true colors was this. I asked them, “How is it that people can be elected to Congress, being not wealthy, make 175K per year, which isn’t bad but it isn’t astronomical pay, stay there for 20 years, and leave worth 20 or even 50 million dollars? In my mind, there are only two ways that that occurs, they are either stealing it or betraying the country by selling out. ” This is when the senator said, “That’s probably something we need to look into.” He didn’t like my comeback, which wasn’t too flattering, and he left the discussion.

I keep reading that to fix the border, all that has to be done is follow the current laws on the books. What are those laws specifically? Even under Trump, he had to wheel and deal with Mexico in order for the “stay in Mexico” policy to work. And, as I recall, he did not simply close the border.
When 5,000 people touch their feet on US ground in one day, what law allows us to expel them immediately? The courts have already tied our hands regarding mass detainment. And detainment is also prevented by the time it takes to adjudicate a claim of asylum. Are there any ways in the current laws to immediately deny asylum consideration at all? After all, we know the asylum excuse is just a con…but it appears to be effective.
To keep it simple, I am trying to identify whether the current laws actually allow the kind of strict and quick fix that many are claiming.
I think when we make that claim, we need to be able to back it up for the ignorant masses.
And that is different from the incentivizing aspect of the problem. However, I would also ask do current laws address the incentivation activities that are currently going on (NGO’s, sanctuary cities, using tax money for benefits and allowing work permits).
I would like to bring this statement into focus, once more, “I keep reading that to fix the border, all that has to be done is follow the current laws on the books.” All laws, are nothing more than processes to be followed. Processes are no better or worse than the people responsible for their use, or to present this differently. The responsible person must ensure that the law is followed. Therefore, the quality of the person selected for “enforcement of that law/process” is of Paramount importance.
All solution to complex problems are composed of less complex processes. Our failure is in selecting the people responsible!
So what “processes” have been passed already that would stop what the invasion at the border and the release of invaders into the country and further to give them benefits including work permits?
We either have to be able to name these existing laws before we can simply pronounce that the problem can be solved by properly enforcing existing laws. How can we make a strong, essentially irrefutable case that lack of enforcement of current laws is the reason for the invasion if we can’t specify laws that exist now to stop it?
The only specific solution I have seen pronounced is the ability for the President to close the border. But even that is a limited solution.

What specific laws – Fraud and Treason. Existing President Was Not Elected. What other laws – RICO violation since it was accomplished through a conspiracy.
