I’ll admit to being a little befuddled by the explanation here by South Dakota Governor Kristi Noem. The SD legislature passed a bill to protect women’s sports by banning biological males from participating in biological women’s sports. The bill has overwhelming support in South Dakota; however, Govenor Kristi Noem doesn’t support it.
When asked why she doesn’t support it, Noem seems to say she has received advice and counsel that the law would fail if challenged in federal court. Specifically Noem implies the NCAA would sue South Dakota and she believes the state would lose a lawsuit based on the law. If that is her position, essentially she is attempting to avoid litigation, proactively planning to lose that litigation, on a law supported by the majority in her state. WATCH:

Since Gov. Noem was very good at resisting tremendous pressure with regard to the lockdown, I’d be interested in learning who advised her on the subject before passing any judgement.
That said, I expect a leader to be able to make an unpopular decision from time to time. Sometimes, it’s not wrong to let your ego take a backseat to rationality.
We have plenty of virtue-signaling, principled idealists or ideologues who like throwing red meat and making promises both wittingly and unwittingly they cannot keep.
Again, sometimes, there are many methods to accomplish something, all leading to the same result, and I think she made abundantly clear she was not going to back down on the subject.
I will reserve judgment until I know the full background story.
P.S.: I don’t blame Tucker for asking tough questions and not backing down-it’s his job to hold politicians accountable. Ms. Noem is a governor, she is a big girl and can handle Tucker.
Somebody got to Noem. Wish Tucker had asked her who these “legal scholars” are, because most are liberal/lefty hacks for the Democrat Party. She’s obviously very defensive and irritated by the controversy of her own creation. Tucker did not prepare well for this interview.
This stance will likely rule her out in 2024 as conservatives won’t like this and a legit competitor could take her out on this point.
She is considered to be a real contender in 2024, and since this will definitely hurt her, someone pressured her with something to take her in this direction and knock her off her perch. Totally agree with you someone got to Noem. Maybe someone in Nikki Haley’s camp.
Maybe she doesn’t want the national attention that much. I think of D.C. as a hellmouth full of demons. I sure wouldn’t want to be the focus of all that, and she would be. My bet is S. Dakota holds much more allure for her. Some politicians do sabotage themselves – OR, her family’s being threatened, which I also would readily believe.
The NCAA is the most powerful amateur sports sanctioning body in the USA. They control where every upcoming Championship game or tournament is played. They also blow in the direction of the same ‘woke’ crowd that controls most of our college campuses. They obviously threatened to pull a couple of plum venue prizes that the State of South Dakota was hoping to get. These prizes are worth a lot of money for the States who win the venues.
I thought Kristi Noam had more political savvy than this. Obviously, she doesn’t. If she is going to cave on something as ridiculous as this, I definitely overestimated her worth to the America First movement.
Maybe the truth is that she really DOES care more about keeping men out of women’s sports, and wants a better crafted piece of legislation that won’t enable the NCAA’s

Another, more painful but effective remedy might be to withdraw the South Dakota State Institutions from the NCAA. Perhaps if enough states did this, they could form a new athletic association, one that recognizes biological sex (XX vs XY chromosome identity,) over this other transgender liberal nonsense.
This may be a hard road, but perhaps one conservative states must travel. It is not unlike the situation with big tech deplatforming conservatives on social media. Just create your own system.
You want to see fast traction with that option- Get Alabama, Ohio, SC, LA, GA, FL, and a few other football powerhouse states to withdraw their schools. You will see fast traction once the likes of LSU, OSU, Bama, Clemson, and UGA pull their cash out of the NCAA.
The colleges are probably more willing to put up with unfair transgender participation in women’s sports rather than losing their leagues, standing, and bowl game opportunities with the NCAA.
But, if enough fans decided, in mass, that they had enough, and quit watching NCAA sports, that would be the real motivation for change.

I attended UCLA and was an avid Bruin sports fan. I attended the basketball Final Four twice and witnessed Coach Wooden’s last championship win in person. Ditto at least one Rose Bowl championship. I wouldn’t watch the NCAA now if you paid me – or the NBA or NFL…
South Dakota has an AG who is facing criminal charges for a case where a vehicle he was driving struck a pedestrian and killed him. Noem has called for him to resign. The majority and minority leaders of the House began impeachment proceedings against him, which are paused while the criminal case continues.
The Governor wants the legislation written to prevent the trannies from continuing to play in women’s sports during any legal challenges to the lawsuit. Otherwise they will play forever during all the legal challenges. Tucker isn’t smart enough to understand that. Not surprising.
I didn’t see and hear anything to support your contention in that interview. There’s nothing brilliant here – just a retreat on Noem’s part before the actual battle had begun.
I did hear a defeatist position that could be the rationale for not signing the bill because of the extreme likelihood that it would be reversed in federal courts…that seems more an argument FOR a nullification effort in my opinion.
What concerns me more is acknowledging big business interests are exerting undue control over the issue.

My take? I think the pundits ought to shut up and let her win or loose on this via her own tactical moves. I do not know what her next move is however she will win or loose “us” on this of her own accord and I am ok with that. But I get what she is trying to do, I have seen this in business, trying to get to a win/win with some difficult characters. Does anyone truly believe the Courts won’t step in and block South Dakota’s law? Even if it goes to the Supreme Court, does anyone trust the Supreme Court?
Pat McCrory passed the bathroom bill here in NC, and eventually lost his re-election because of it. The NCAA & NBA boycotted the State, which lost Billions in money because of it. Eventually the State repealed the law. The same thing will happen in South Dakota, there’s no doubt in my mind.
I’ve read that in the last 10 years in South Dakota, only one Trans athlete has competed in women’s sports there. One.
Personally, I think the only way to resolve this is for women to boycott their own competition that has the trans-athlete in it, in that state.
Though I don’t think that will happen either.
For that reason alone, the new resistance will require NULLIFICATION on state level of federally imposed edicts. A line has to be drawn because we can no longer rely on the Federal System to check itself.

We did this in the Navy all the time. When an officer put forth a rule or edict that we plebes (enlisted grunts) knew would cause more work or just plain back fire, but were met with just do it, well….we did it. We did it EXACTLY as told. And, we made sure more sailors participated and did as told than normally would…..kill the system by using compliance against itself. It worked every time.

Because of her reputation, I go with her answer. Lawsuits are expensive; can be dragged out for years with nothing accomplished which makes it the wrong path if chances are slim you could win. If she was a typical politician she would file the suit just to get the publicity. Not being that, she made a more strategic move to go after the NCAA as a group of states. Strength in numbers and share the legal fees.

Things got confusing on Tucker’s show. Before I saw Noem on Tucker’s show, I saw her explaining her position elsewhere. She seems to be playing a long game claiming there’s no point in her signing the legislation because, eventually, the law will be overturned in court. I don’t know enough about existing federal law or the bill she declined to sign to say how I predict a court challenge would turn out, but given how things seem to go in federal courts these days, let’s assume she is correct. From that starting point, she’s saying a better strategy is to build a coalition of support to keep biological males out of female sports. She believes that a coalition among the member schools of the NCAA would be a stronger defense against the attacks of the woke.

I was always suspicious of Noem because she came out of nowhere, saying all the right things, and had such a huge push of support. It seemed to me very astroturf. But I didn’t write her off. I just wasn’t jumping on board like so many were doing. Now this. Her reasoning makes no sense to me. Other states have passed a similar bill so if the NCAA sues, it won’t be JUST SD! And who cares if they do sue? Her reputation was that she fought against this exact type of thing. And she ain’t living up to that reputation.

Trying to perfect the legislation to withstand court challenges is the wrong way to go about it. Put your faith in the Courts Noem! What are you doing?
As the former head of a small business, I look at this from a business perspective, as Governor Noem has to do since she is the chief executive in S. Dakota. One needs to weigh all the downstream consequences and figure out the smartest path forward. She might lose in a court of law but she can definitely win in the court of public opinion. And they say politics is downstream from culture. A win on the principle but a loss in the courts is no win at all.
If it were me, I would work to gain support across the country and box the NCAA and other Corporations into a corner. Hold them to their own standards. Call out Megan Rapinoe and other high profile women athletes. Ask the other side: Do you support women’s sports? Yes or no? Then I’d run a PR campaign on how males have a huge biological advantage in sports over females and publicize the real-life stories of females who have been negatively impacted by the issue (lost college scholarships for example).
I’d ask my supporters to contact and boycott the NCAA and the companies who support biological males competing against females. These are biological males first and foremost, no matter what else someone wants to label them. You can change what you label them but you cannot change their DNA.
What does surprise/concern me is that Governor Noem does not appear to have anticipated the pushback and lawsuit(s) that would likely come from the left, especially since this is their usual M.O. This is the big leagues and she should have strategized better.
So let’s all go to the coalition website and make our voices heard to pressure the other side to back down.

This attack is based on Noem following the advice of her advisors who painted her into a corner by advising her that this bill is flawed and that she should veto it and have her legislature give her a new bill that accomplishes what her constituents want. She said she asked for certain changes to the legislation so that it would be harder for ACLU LGBTQ lawyers to use legal challenges that would set precedents that would allow the Obamaletes to STAY IN your daughter’s locker room and spoil her chances of getting sports scholarships.

This is what the “coalition” that Noem is now flogging has on its home page:
We believe:
1) Only girls should play girls’ sports. Title IX was passed to protect fairness for women.
2) The federal government should enforce Title IX in a way that protects fairness for women’s sports, rather than misusing it in a way that undermines fairness.
3) The NCAA and other athletic sanctioning bodies should not take any adverse action against any state or school that acts to protect fairness for women.

The “coalition” is calling on the federal government to do what this SD bill would have done.
The federal government? Really?
Does anybody believe there’s a snowball’s chance in heck of that happening any time soon? Does Noem believe that?
This is an outright fraud, being perpetrated by the eGOP on its membership, in the mold of “Repeal & Replace”. An issue that the eGOP has no intention of doing anything about with the exception of using is as a perpetual campaign issue, for as long as they can get away with it.
(To Tucker Carlson’s discredit, he was apparently completely unaware of what the “coalition” says it wants, else he certainly would have question Noem as to why this “coalition” is looking to the federal government to do the job. Carlson should look into hiring more effective researchers and producers.)
Noem is trying to meet evil half way. Half way to evil is STILL EVIL. If women cannot compete fairly, they should simply boycott sports. Why compete where the outcome is rigged against you? Take Noem’s argument to its logical conclusion. The NCAA demands men must be allowed to compete in women’s sports. Women compete and lose. How is that a “good” outcome? How is Noem standing up for women in sports by such a position?
I don’t care how many judges make fools out of themselves by ignoring biological reality. Why should any woman play a rigged game she is sure to lose? It is humiliation baked into a poisoned cake.
Kristi is all for illegal immigration, seeding your towns with people you don’t want and cannot afford, so really, no surprise to me.

That was 14 days before this Tucker Carlson interview.
Yet in the interview, she states she’s been discussing this bill with “legal scholars” for months.
If that were true, why was she so ready to sign it two weeks ago?
How much clearer do people need something to be, to see that something happened between March 8th and March 19th [the day she declined to sign the bill] to make Noem change her mind – something that has nothing to do with discussions with “legal scholars”?
p.s. some have seen the silence of various cat’s that swallowed the canary (on fox). Remember?
And yet, some here already want to give the interviewer, a trusting pass?
