I’ll admit to being a little befuddled by the explanation here by South Dakota Governor Kristi Noem. The SD legislature passed a bill to protect women’s sports by banning biological males from participating in biological women’s sports. The bill has overwhelming support in South Dakota; however, Govenor Kristi Noem doesn’t support it.
When asked why she doesn’t support it, Noem seems to say she has received advice and counsel that the law would fail if challenged in federal court. Specifically Noem implies the NCAA would sue South Dakota and she believes the state would lose a lawsuit based on the law. If that is her position, essentially she is attempting to avoid litigation, proactively planning to lose that litigation, on a law supported by the majority in her state. WATCH:

I also watched the press conference yesterday. It was weak, and the backlash probably brought on this interview. Her solution of forming a coalition is a typical uni-party solution to do nothing. Yesterday she was asked if governor’s or AG’s have committed to the coalition and her answer was (paraphrased) lots of people, but none in government yet. There wasn’t pushback on the election fraud, drilling or pipeline from her, and I did not find anything about stopping the illegals from being deposited there. She appears to be a good narrative (squirrel) for the conservatives to be distracted with. Like another gun toting, model type picture taking female who is a favorite of many, she is not what/who you think.
Governor Noem’s arguments are beside the point. Men and boys competing as women or girls is a complete absurdity. If enough states pass laws that prohibit this, the NCAA can ban them from competition and, in doing so, destroy itself. This is exactly what needs to happen. Who cares about the survival of the NCAA if they are committed to biological nonsense?

The underlying issue with girls sports in K-12 is competition for athletic scholarships to college. Unfair competition from males unfairly robs females of opportunities for the scholarships. NCAA is one of the cabals controlling the athletics money at the college level. Now states are in a bind because standing up for sanity and the girls runs afoul of the cabals meting out college athletics money for girls to pay for their college.

Yet – this is the FIRST TIME she’s let this be known.
Why didn’t she ensure that the views of these “legal scholars” made it into the bill?
Instead, by her own words, she let this drag on and, at the very last possible moment, declined to sign, citing “months of discussions.”

It’s clear that the eGOP intends to use this as a campaign issue – nothing more. Just as they did with “Repeal & Replace”.

The time for selling, Kristi, was BEFORE the law was written.. to the legislature. If u were told a law of this type would be struck why write one in the first place? Who, in the legislature, wrote/allowed a dud law?
It is still a wonder to me that in today’s world laws are generally meaningless…to a certain segment of the country.
There was a lack of clarity in Gov. Noem’s response last night, perhaps due to Tucker Carlson’s volcanic interruptions (something she will need to learn to deal with, as other journalists will be much worse), or perhaps due to some shifting ground on the topic. Initial reports were that Gov. Noem would agree to applying the ban on K-12 interscholastic athletics in South Dakota, but did want to impose the ban at this time on intercollegiate athletics. If this is still the case, I’d support her.
Why? Interscholastic athletics involve in-state competitions among public schools, subject to state authority. It would, of course be challenged in court, but I would hope that the state would at least try to defend it. Intercollegiate athletics involve many colleges and universities, public and private, all of which are part of multi-state athletic conferences that make them subject to he NCAA and NAIA. As such, there needs to be a broader, multi-state challenge, which could be brought about by Gov. Noem’s plan to build a multi-state coalition to challenge the big athletics cartels.
Unless the NCAA is pressured to back down by a broadly based national coalition, there will be serious consequences for the student athletes at all colleges and universities in South Dakota. It goes beyond not being able to host a tournament in Sioux Falls; it could mean that student athletes at South Dakota schools would not be able to play in competitions outside the state, that severe limits could be placed on broadcasting of games from South Dakota. Backlash against a single state would be devastating to intercollegiate athletics in that state. Such punitive action will be more difficult to effect and defend when the major sport governing bodies attempt to apply it to a significant number of states across the country.
What was not clear from the interview is whether Gov. Noem has also been told that the interscholastic ban cannot be successfully defended and whether or not she has accepted that advice.
His interruptions were anything but “volcanic”. He simply refused to allow her to stream non-stop gibberish without questioning her on it.
My take: this is about (i) economics (ability of South Dakota to host NCAA sanctioned events) and (ii) the limited impact a small state can have against the aligned interests of the Left, the NCAA, the CoC, and the media. Most tellingly, she asked for the state legislature to revise the bill so that it covers K-12 only where the state has almost sole jurisdiction and the economics are almost exclusively dollars changing hands within the state versus outside dollars flowing in through intercollegiate activities.
The NCAA and aligned interests can run roughshod over South Dakota (ex: North Carolina/2017 NBA All-Star Game). However, if a critical mass of states can organize then it prevents the Left from isolating SD and flips the leverage to the states. For example, if Florida and Texas were part of the coalition and the NCAA had to choose whether to use these open state venues or throw themselves on the transgendered sword in SD, I’m confident that the aligned interests would look for a different opportunity.
Safe to say that my spidey sense is tingling and I can appreciate those who think she is waffling or threading the proverbial needle politically or caving to the establishment. I am willing to see how this plays out before walking away from Noem. If she signs a strong K-12 bill AND leads a coalition that meaningfully advances the cause then it was worth the efforts. If she kicks the collegiate can down the road to avoid a “tough” political issue then my support for her politically is done.
That’s the problem with politicians, in this case Noem is representing herself not the people.

What will have to happen is that girls en masse will have to boycott competitive sporting events. The best way would be something huge like an NCAA tournament when all people already there fans and competitors. All on the field and all girls just walk off the field as one. Now that I’ve read the Gov’s “style and reform revision” which is not a veto, I understand her position and agree with her. This problem was not caused by ND and it is unreasonable for the ND legislature to think it can unilaterally fix a national problem. That which it can fix, it should and that which it cannot, it should not try . . . Let’s work smarter and quit responding to dog whistles. The measured and intelligent approach is the correct one.

It sounds to me that the Legislature presented a poorly crafted law and she asked for it to be re-written. I’m sure the NCAA, ACLU, and other left leaning law firms have been poised to take whatever gets signed to court. It seems responsible to make sure the law is something that the SD AG can defend in Federal Court.
I understand women’s college sports were carved out of bill. It could be she/state will write a separate law for college sports.
I think she’s playing the long game on this. It would be better for women’s sports if this is written well and will hold up to court challenges.

I have read all the comments up to this point in time.
First, MAGA is going to need to get smarter than just flipping the equivalent of the left’s cancel culture switch at the first hint of a problem with one of our own. We are all going to disagree from time to time as to the best path towards a common objective.
Second, if you the think we are ever at an advantage in the Courts based upon the Constitution, Bill of Rights, Common Sense or Logic, think again. The forces we face are pure evil and they don’t play by any rules.

In other cases, however, the “candidates” will be smarter, and be sure NOT to expose themselves until it’s too late.
This is yet another example of why the “primarying” strategy cannot work. It allows the frauds to lie, yet remain comfortably within the GOP “funding umbrella” in order to gain office. Once that’s achieved, they then reveal themselves – with suitable nonsense explanation as in Noem’s case – of why they can’t vote this way or that way on a specific issue.
Rhetorical question: HTF did we get to the point where a percent of a percent of the US population creates the rules for the rest of us? These people are genetic dead ends, yet they dictate what our futures will be.

1) she’s been “discussing with legal scholars for many months how to protect women’s sports”, and
2) she intended to be guided by those discussions,

Why didn’t she make known those “scholars'” views to the legislature, and even better, why didn’t she request that the legislature hold hearings and request those “scholars'” to give their opinions, in public, so that the bill could be created from the beginning in a form that would be acceptable to all?
But nope. Instead, at the last possible SECOND, she pulls out this total rubbish as a fraudulent reason for not signing the bill.
Just might mean she’s a fraud.
OK, I listened carefully to the whole segment and I understand what Governor Noem is saying: “Pick your battles.”
The NCAA is an 800 pound gorilla. Picking a fight with the NCAA at this point in time, on this ground, will accomplish nothing except to invite costly litigation the state will certainly lose. Instead, she is asking the legislature to leave the NCAA out of this bill. Focus on K-12 public schools which the state fully controls, and draft language to limit the opportunity for litigation. Fight the NCAA as part of a broad national coalition of states to counter NCAA’s financial leverage. The NCAA doesn’t care about South Dakota, anymore than it cared about North Carolina. But 30 or 40 states bringing pressure against NCAA flips the script. Now it’s NCAA on the defensive as powerhouse schools demand no trans athletes in women’s sports.
It’s disappointing on an emotional level; but it seems very practical.

She attended the Installation Ceremony for Harris/Biden and now caved to the mob on allowing men compete against women in women sports. Why does she just not advocate for 3 sports categories? Male (XY chromosome), female (XX chromosome), and everyone else who can compete against each other.
Not a very talented leader, if her excuse is “I can’t”.
Contrast this with Governor Ron DeSantis, who contrary to revisionist history, made a really stupid, awful, anti-Bill of Rights decision to go along with the Fauci fraud, but then recovered his senses.
Against tremendous opposition, he is doing everything he can to reverse and repair the damage done to his state, and indeed to take steps to make sure Floridians will never be susceptible to this kind of totalitarian takeover again, by encouraging and making available a good, solid civics curriculum for Florida’s schoolchildren.
Another Republican that says all the right stuff until the corporations tell them no.
It’s called “selling out”.
And somehow, the “revised bill”, and the “new bill”, and the “special session”, and the “coalition” (see 6:00 in the video) will all unfortunately drag on past the 2022 election.
So this will be a big issue in the 2022 election. So make sure to donate to our coalition. And be assured I will be “fighting” for this all through the campaign, and continue “fighting” even past the 2024 election!

I admit I was confused by the Governor’s rational as well. She didn’t spell out what as so problematic with a law that says boys compete with boys; and girls compete with girls. Said determination will be judged by the persons biological sex at birth. Seems so simple.
