The supreme court has taken a knee… let me explain why it is so evident:
In a 6-3 ruling today the U.S. Supreme Court has refused to grant writ to hear the Pennsylvania election challenge cases [pdf here – begin page 25]. While the majority of media will likely celebrate this decision; and while the court has refused to hear the case(s) based on their position the issues are “moot”; there appears to be an underlying motive not being discussed.
It only takes four justices to agree to hear a case and grant a writ of certiorari. In October 2020 the issues with the Pennsylvania court overruling the Pennsylvania legislature was of such importance four justices agreed to block the lower court order. However, four months later the majority claim the arguments within the case are “moot”; & the election is over.
In essence the Roberts Court is saying they will allow any/all methods and manipulations of election law within states, and only look to the state outcome. This is very troublesome.
Why would Justice Kavanaugh reverse his position? In October the state action to supersede the Pennsylvania legislature was a hazard. In February it is moot.
While it is never a good idea to look into the background of the court for motives, one cannot easily dismiss that Roberts, Kavanaugh and Barrett may have voted against the writ because they were concerned such a decision would cause the senate to start a process of “packing the court.” Retaining the current number of justices within the court is more likely if the justices avoid triggering the consequences from the previous threat.
Justices’ Thomas, Alito and Gorsuch remained consistent with their earlier decisions to hear the cases and settle the disputes. Barrett never weighed in on the October injunction, but Kavanaugh has completely reversed his position with his denial of the writ.

While I disagreed with the statement at the time it was written, I have come to understand the events and sentiment that cause that reaction.

I have absolutely no ‘faith’ that anything former President Donald Trump will be able to accomplish since the Supreme Court has also granted a free license to both New York State and New York City law enforcement to harass him for new and imaginary crimes under the guise of tax fraud that he will be allowed to do anything but spend the rest of his life, and his fortune, defending himself and the media and GOPe will take those lawsuits to slowly silence those who would support his ideas, voice or future candidacy (PDJT may fall into category #4 below, along with Gen. Flynn and the others who preceded him, perhaps they were deep-state practice run for their big target Pres. Trump).

The US Constitution itself is really an agreement between the states, as to what common tasks & standards are best addressed by a distinct umbrella agency of governance, e.g. national security writ large; limits on its governance, etc; a.k.a. the Preamble.
Over time, we’ve invested so much political & emotional capital in letting the Big Kids in DC handle more & more of what should be handled at the local levels, that they’ve gladly accrued the corresponding power & influence therein. Funding streams, baby!
This particular ‘Great Reset’ is long overdue. No illusions: Break out the brass knuckles, rhetorically speaking. Authority and governance of the states is the way to apply ‘corrections’ to the federal government. All of it.

They put these cases on the regular schedule KNOWING that by the time they were heard the relief requested would no longer be available

no mail on voting for anyone, unless they are disabled, can prove it, and the mail in vote is collected and counter-signed by three witnesses …full addresses and phone numbers of each…no voting boxes anywhere other than directly at the 24/7 control and located at official election sites, and of course concrete deadlines that follow the national standard with no provisions allowable to ANY delays past that date. All paper votes must be 100 percent PERFECT or they are rejected with zero allowances for any correction., and no re-scanning of any votes for any reasons, can be made by vote operators. A fully transparent voting committee who prepares a report detailing the error, how it was corrrected and then an audit is performed before and after the correction to verify the corrective action was proper and that the data was not corrupted.
all voting images from any scanner will undergo a fully three stage vote verification. Any mismatches ANY, will trigger an investigation into ANY mismatch to determine the fault. NO errors will be be tolerated..no algorithms or statistical analysis will determine how errors will be resolved. All errors will be treated as defects and errors UNTIL PROVEN correct. This philosophy will require a new paradigm shift, where the system will be presumed flawed and that ONLY audits can verify accuracy, and not the other way around.
“deals” and “compromising” agreements between two parties who disagree with verification results will be adjucated IN A COURT ROOM, set up specifically for voting election verification. No politicization or LA senate actions will interfere. Secretaries of State will NOT have the power or the authority to set any other rule, policy, regulation, or guideline. The secretary of state will follow the law and enforce those laws.

There were warnings about her real loyalties as signaled by her response in her Senate hearing. She made very clear her preference for not changing “settled law” as determined by prior court decisions, regardless of how far from the Constitution those decisions were.
I admittedly did not afford proper weight to those warnings or her statements, preferring instead to assume that since other conservatives and especially PDJT was pushing her, she would be loyal to MAGA.

The further you move to the ideological Right, the farther away from centralized government you get. The only “monster” that would arise from the right is total anarchy, ridding the country of all government.
Libertarians are a better example of far rightwing governing ideology. They advocate for minimal central government and minimal state government. In fact they advocate for minimal government everywhere. Not a complete absence of government, but a limited government that was involved in nothing more than the Constitution directly assigns to them. Not meddling in education, not in taxing and regulating commerce down to the local level, not in regulating taxicab permits, nor gun permits, no most permits or licenses.
I see LIbertarians’ reasoning and for the most part it’s logical and reasonable. But in some areas a lack of government oversight will result in monopolies and other unreasonable and unbearable suppression of people’s liberties and rights that unscrupulous individuals and groups would be quick to assert.

Thomas and Alito should just call for a press conference and announce their resignation from SCOTUS. The whole constitutional premise of the courts existence is now Moot. What difference does the Supreme Court make when by far the most important case in the history of the Court, the integrity of the election system as set out in the Constitution, can be ignored? Thomas and Alito should be embarrassed to have their names associated with this immoral Court.

By staying all Thomas and Alito are doing is giving SCOTUS a patina of credibility.

This is a stunning disappointment, and appears to be cowardice on the part of six or seven justices. Did Gorsuch take the third vote for hearing the case because, needing four, he was a non-impacting vote, much like Manchin does too often? IMO, Thomas and Alito stay and dissent, dissent, dissent, otherwise who will contradict the ways of the cowardly and put it in the record? And it will take two less to get the court back again, if that is even possible.
Perhaps this now becomes the work of the state legislatures, to counter the illegal changing of election rules. But can they prosecute the crooks?

Thomas was referring to the ~20,000 ballots that were segregated by the PA Secretary of State, as pertained to Judge Alito’s order. That is all of the ballots that the PA SoS said were impacted by the decision (narrow purview) and of course not enough to alter the election in PA. Thomas isn’t commenting about the other stuff that went on, just commenting on the narrow case that was before him (which is all he is entitled to do as a justice). Anyway… IMHO

Kavanaugh is a metro-sexual and very weak individual. That was on display at the kangaroo court hearing. Comey-Barrett is a fraud, and they all knew it – that’s why they went easy on her. And who knows about Gorsuch? He is another Sauter. Swings both ways, whatever the wind is blowing that day. These picks have no solid grounding. They are light-weights. AND if you are paying attention (please do), Sen McConnell HAD (past tense…senate is now in the hands of dems now) full unchallenged power to select whomever his lobby desired on that short list. If you have any doubts about this power (whether you agree it is acceptable or not), look at the record breaking achievement of McConnell to confirm a 100 percent success rate of federalist society candidates into judge robes….That’s not chance. McConnell is many things, but a political dummy he is not.
President Trump was in a position, like so much of his 4 years, in constant battle with the senate….But on this issue he really had few options.
Don’t mistake his running to the defense of Kavanaugh for those vile attacks as his tactit support of that candidate. I am sure he would have preferred someone else.
There is this unreasonable but understandable resentment we must all feel have our election stolen…and hindsight is a hard nut. But lets not try to re-write history and consider President Trump as a failure.

President Trump made the choices that were presented to him by McConnell as “passable”. I agree they were all bad choices now that we’ve seen these cowards in action, but 95% of the Treehouse (me included) were very much convinced that they were all good / best choices among the names in President Trump’s long-published list of potential candidates.
I wrote earlier that some here (and elsewhere) were warning about ACB’s statements in the nomination hearing that apparently strongly hinted she would not change Rowe or ACA other “settled law” cases that had been decided by prior SCOTUS decisions. This should have been a huge red flag fr us but we bought the line that ACB was a strict constructionist because of her alleged religious convictions.
Face it, Alito and Thomas were just extreme outliers when it concerns GOP Party nominations to the Supreme Court.
If you look at the history of Supreme Court justices nominated by Republican Presidents, you will see that many of these justices might as well have been Democrats: David Souter, Earl Warren, John Roberts, etc

If Clarence Thomas has any specific evidence as to how his fellow Justices, especially Roberts, Barrett and Kavanaugh, were “persuaded” to vote in a certain manner, then he needs to speak out NOW! He has to know that he will probably be Scalia’ed as soon as he does but he also has to know that it is the only hope we have…he is a man of rare courage and conviction and I pray that he will take a stand!
I think Justice Thomas has a fire in his heart. He gave the sniffer a long diatribe during his confirmation hearings. He had many battles in order to prove his worth and remain above the nasty politics, for the position he now holds.
Regarding the “choices” POTUS was given and the following bruhaha….I compare those hearings much like what they are doing with the ‘all saving vaccine’…(people did not really overall want it…now we have shortages of it and everyone now wants it….cute little business tactic of supply and demand).
We were presented with “viable” candidates. Then there was the nasty political drama involved. Then we all jumped up and down wanting these “conservative” judges, especially when the ‘going was getting tough’. Now we are stuck with them. We were manipulated. Fool me once….but never again.

I think for a long time they considered themselves to be the final arbiters of all things related to the preservation of the country…kind of “above the fray” of anything political. Frankly I haven’t ever had much respect for the US Judicial System. Takes too much time to explain my reasons, but let me just say I grew up with the belief that justice was blind! From all appearances that is an illusion since we fret over liberals, conservatives, and whatever ideology reigns the courts these days.

It is literally enshrined in the Constitution that the Supreme Court has a duty to resolve disputes between states and among states yet the Supreme Court decided to abdicate their constitutional duty to hear and resolve Texas’s election lawsuit by claiming that Texas has no standing, even though judicial standing as a concept does not even exist in our Constitution in the first place!

When the Supreme Court, established to resolve Constitutional issues, refuses to address an issue as critical to our Constitutional Republic as free and fair elections, they render the Constitution moot as well as themselves. You damn well better believe we expect better.
How can they say it is moot when they are asked to review a lower courts decision with potential to affect all future elections. I agree with Sundance. They bowed to the threat of packing the court. The other option is ACB and Kavanaugh bowing to threats from Roberts. Also could be fear of exposing the most fraudulent election in U.S. history. Maybe all of the above.
