Special Counsel Jack Smith held a press conference today following the unsealing of a federal criminal indictment alleging four counts against President Donald J Trump. [Full Indictment pdf Link]
The four alleged criminal counts are: (1) Conspiracy to defraud the U.S Government; (2) Conspiracy to Obstruct an Official Proceeding; (3) Obstruction of and Attempt to Obstruct an Official Proceeding; and (4) Conspiracy against Rights.
Interestingly, nowhere in the indictment is anything criminally alleged relating to the January 6, 2021, events at the U.S. Capitol building in Washington DC. However, you will notice in the Lawfare delivery of the remarks, Special Counsel Jack Smith factually speaks almost exclusively of the January 6th events.
The absence of a criminal charge (ie. seditious conspiracy or insurrection) when contrast against the extreme verbal emphasis of the event as outlined by Smith in the presser, will be missed by most. Speaking of the non-criminal event as the context for a fabricated/stretched criminal allegation, is Lawfare in action. Why emphasize but not charge? Because the DOJ/FBI does not want the risk of litigated discovery and evidence of coordinated government activity therein, that’s why.

The core Duty of The President, as set in Article 2, is to “take care that the Laws are faithfully executed.” Which he must do as he sees fit, and without regard to where “the transgression(s)” might have occurred.
And:
“The President of the United States” is “The Article-2 Executive Branch.” Not “a private individual.”
Therefore, in the execution of His Office as He alone(!) sees it, the Executive Branch can “do as He damned well pleases.” He can speak to anyone, and say whatever He likes, “off the cuff.” He can “declassify” anything just by referring to it in conversation or taking it out the door.

It has no teeth and the Former Congress that legislated it knew it would unlikely never be tested. So, a president has plenary power over documents and is the Executive Branch of government. That should be the end of the Docs case. As for this latest indictment, the impeachment clause states that a president must be impeached and convicted before he is subject to criminal indictment. Trump was indicted but never convicted. He cannot then be indicted. Enough playing with these fools. God how I wish Trump had some better lawyers!

Indeed, the entire indictment lacks any merit whatsoever. However, taking it on its own terms, the entire mess is based on the false assumption that Donald Trump truly believed he had lost the election fair and square, and that he had no basis for believing that a lawful consideration of the ballots etc. would have vindicated his beliefs. Hence, the entire election evidence, NOT THE DOCUMENTS AND STATEMENTS ANNOUNCING THE RESULTS, but the ACTUAL EVIDENCE ITSELF, I.E., THE BALLOTS, THE VOTER ROLLS, AND YES THE MACHINES, WILL NEED TO BE PRODUCED AND EXAMINED IN COURT.
Lastly, this case, even more than the documents case, will almost certainly not be resolved during our lifetimes because all local election officials in the fifty states would need to be deposed and subpoenaed. As well as all the records from the fifty states. Also the various so-call co-conspirators will need massive amounts of time in order to untangle the many complex legal issues necessary to their defense.

and we had just sort of a moment, him leaning in to say, like, “Pat, you have no idea how easy it’s going to be for me to walk away from this job. | promise you. | just don’t know how can I do that? | know this was rigged. And, you know, if there’s a foreign government’s involved in this, how can | do that?”
| swear in my eyes he was entirely appropriate, more deliberation in my view. | kind of thought maybe he — | wish he had deliberated more.

And|I know Christopher Wray said something about me. It’s not a — but they were very polite. They came back and said, “This is above our pay grade. This is, like, national security, national existence. Let us figure out what we’re going to do with this.”
That, at this point, is unacceptable. There’s 9 million vets who get their vet care from the VA medical system. The Iranians are init. They could be changing everyone’s prescriptions. The initial assessment is that they’re going into the imaging systems.
We could discover more of what they’re doing, but | don’t want to cross that line, by hacking the Federal Government these days, but we have that much.
And that’s all being fed in, along with some other major hacks of national security, if not national existence, as was explained to me. And it’s almost like it’s choked, the system has choked on it. And the system has tried to — it’s — as it being too big for them. And then the system, the higher-ups tried to kill it.
The people are not accepting it being killed. They are the ones who are going as whistleblowers to Congress with a bunch of very damaging information. There’s a guy — Grassley made a criminal referral the other day on an FBI agent who was in the middle of this stuff I’m talking about.
