Special Counsel Jack Smith held a press conference today following the unsealing of a federal criminal indictment alleging four counts against President Donald J Trump. [Full Indictment pdf Link]
The four alleged criminal counts are: (1) Conspiracy to defraud the U.S Government; (2) Conspiracy to Obstruct an Official Proceeding; (3) Obstruction of and Attempt to Obstruct an Official Proceeding; and (4) Conspiracy against Rights.
Interestingly, nowhere in the indictment is anything criminally alleged relating to the January 6, 2021, events at the U.S. Capitol building in Washington DC. However, you will notice in the Lawfare delivery of the remarks, Special Counsel Jack Smith factually speaks almost exclusively of the January 6th events.
The absence of a criminal charge (ie. seditious conspiracy or insurrection) when contrast against the extreme verbal emphasis of the event as outlined by Smith in the presser, will be missed by most. Speaking of the non-criminal event as the context for a fabricated/stretched criminal allegation, is Lawfare in action. Why emphasize but not charge? Because the DOJ/FBI does not want the risk of litigated discovery and evidence of coordinated government activity therein, that’s why.

At that point in time, Donald Trump was the Sitting President of the United States. Therefore, “his powers, prerogatives, and Constitutional Duties” are defined by Article 2. (Which fact-of-law has clearly been established by the SCOTUS in many already-settled decisions.)
According to Article 2, Donald Trump was “the single-person Article 2 Executive Branch Of the United States Government.”
It is therefore literally impossible for him to have “violated any law” by the execution of his Branch. Each Branch is by definition “sovereign, and separated.”
His particular powrs regarding “classified materials” are plenary, as stated (e.g.) by “Navy v. Eagan.”
It is high time that Donald Trump assert his right to appeal to the Supreme Court, as his “court of primary jurisdiction” as a Former President, and to ask them to re-affirm what they have already decided several times.

I think that eventually SCOTUS will throw these charges out, like they have done in past with Jack Smith’s phony indictments. However, his lawyers may request a motion for SCOTUS(this is Roberts’ jurisdiction) to intervene to quash the government’s indictment for the following reasons:
Presidential election interference.A President cannot be charged with an alleged crime committed while in office due to Presidential Immunity. Obviously: if “any ‘Tom, Dick or Harry’ Grand Jury, anywhere,” could without restriction “sentence a ‘former President of the United States’ to thousands of years in prison,” as though said individual were “merely a private person,” then our entire system of Government would very quickly break down. A court in Pennsylvania ruled that actions, thoughts, words, deeds carried out by President Trump while he was still in office, up until noon on January 20, 2021 affords him Presidential Immunity as he was doing everything while still in office. The things that Jack Smith (or whatever his real name is) has indicted President Trump for happened while he was still in office.
