Well out here in the real world, employers are desperately seeking additional workers to keep up with current demand for goods and services. The LAST THING they want to do is run off 50% of the people who actually show up for work. Now many of these businesses are nominally regulated by OSHA, but they also have regulatory obligations to other state and federal authorities. What is likely to happen is that they will send out a company-wide email, and post signs in the employee break room, saying that in accordance with OSHA regulations, all employees are required to be vaccinated for Covid (OSHA inspectors love to see signs posted in the work place that demonstrate appropriate fealty). This will formally demonstrate compliance with the regulation and avoid the fines. Now the rub will come when/if an OSHA inspector asks to see proof of vaccination status. Asking an employee for personal health information is a big no-no for the HR crowd. Try asking a female employee if she is takes birth control pills, or a male employee if he takes HIV medications and see how well that works out for you. Employers will argue they are complying with the federal regulations by REQUIRING Covid vaccinations, but they are also complying with federal and state regulations by respecting employees confidential medical history. I figure this should be enough to keep the lawyers busy for the next decade or so.
In the mean time, we’ve got orders to fill.
