I’ll admit to being a little befuddled by the explanation here by South Dakota Governor Kristi Noem. The SD legislature passed a bill to protect women’s sports by banning biological males from participating in biological women’s sports. The bill has overwhelming support in South Dakota; however, Govenor Kristi Noem doesn’t support it.
When asked why she doesn’t support it, Noem seems to say she has received advice and counsel that the law would fail if challenged in federal court. Specifically Noem implies the NCAA would sue South Dakota and she believes the state would lose a lawsuit based on the law. If that is her position, essentially she is attempting to avoid litigation, proactively planning to lose that litigation, on a law supported by the majority in her state. WATCH:

I will just come out and say it straight to everyone here: Kristi Noem fans are uncomfortably reminding me of the Amy Coney Barrett fans that used to be everywhere, even this website, before fading away into the wind after Amy Coney Barrett ended up being just another cowardly RINO and her utter disregard of her constitutional duty to not only hear and address disputes between states but the entire presidential election, itself!

Some amateur psychology: it’s very difficult for people to face such the dire situation we find ourselves in. So what most folks tend to do is grasp at any straw that’s available, and hope against hope that this straw will prove to be different.
To me, there’s no other way to explain the fact that people are simply unwilling to recognize that Noem is carrying out the typical (and not very subtle) machinations of a member in good standing of the eGOP, despite the fact that it’s happening in real time in front of their very eyes.
And despite the fact that on March 8th, which has been branded as “International Women’s Day”, Noem tweeted that she was “celebrating” it by looking forward to signing the bill very soon. Yet in this interview, she claims that she’s been discussing the problems with the bill with legal scholars “for months”.
She and her handlers can’t even keep their own lies straight, yet people still insist on hoping against hope that somehow, through some miracle, this one will be different.

Second Point… she gave up on this for the colleges – USD and the SDSU (not the one in San Diego) and one large corporation building a warehouse on the outskirts of Sioux Falls SD – Amazon. The Threats from the NCAA and the loss of future jobs flipped her decision. She will is very popular within this state and will easily be re-elected. She has not burned herself politically as much as Senator “Tom Thune” has within the state. Senator Marion Rounds should take heed also.

I have heard this excuse about not signing bills because it would only go be lost in a court battle for over 40 years now, maybe longer.
And it was almost always said by a Republican governor.
Decades ago when we had finally elected what we thought was a tough solid R governor and had a Republican legislature in some states that I lived, and we were finally able to get some conservative bill through then the governor would refuse to sign them.
The excuse was ALWAYS the same that they would be challenged in court and the governor did not want to go through that because the governor did not want the state to have to spend money on a long drawn out legal battle. ( always thoughtful guys not wanting to waste our money)
So many of us back then thought that sounded reasonable and hoped that the bill would be reworked and sent back to the governor.
Of course we never heard anything about it again.
Year after year after year we would see bills pass and then the governor would have this very reasonable sounding excuse of not wanting to spend the taxpayer money on a lawsuit or waste time.
We soon started to notice that liberals ( the other side) had no such problem and would send outrageous unconstitutional bills to the governors.
If the governor did not sign for one reason or another these liberals had NO problem suing the State for years or decades or as long as it took.
But our side always had this reason about it being challenged in the court so it was not worth the trouble or the money or the effort.
That is why our side lost so much in the last 40 years.
We never even fight.
Noem needs new advisors or she needs to get back on her horse and ride into the sunset.

I was very impressed with Gov. Noem until she had an “interview” with Margaret Brennan of “Face the Nation” in February.
Brennan took aggressive control of the interview from the start as she usually does and Gov. Noem was unable to adequately defend her COVID policies. She accepted every one of Brennan’s framed narratives and never produced a strong convincing argument except to say she did better than Cuomo etc. It was then, I realized that the corrupt media would crush her in a Presidential campaign.
Her latest decision to fold early and not fight to the end for the rights of her own gender in sports and instead surrenders them to a small minority of self entitled transgender men probably ends her chances of having a viable POTUS run.
I am more than a little confused. Seriously.
First off, for the record, my opinion/belief is that transgender females (born male) should not be allowed to play girls sports – juniors, rec league, high school, college, professional, etc.
Second, I have not read the bill passed by the SD legislature. I am also not a lawyer, so I don’t know that I would be able to determine what’s “wrong” with it, even if I had read it.
Third, I like Gov. Noem, and I have also heard Sundance (and others) express negative opinions about her, specifically with respect to her running for President sometime in the future (2024 or beyond). And, I have heard many opinion-makers (on the right – Mollie Hemingway, Jack Posobiec, et al) make sweeping, negative comments about Gov. Noem and this legislation, and her “not signing it” (she says on this episode with Tucker “she did not veto it”).
But, I have not heard anyone specifically state what is wrong with her response to the legislature (style and something-or-another – please change some words). Are her proposed changes going to weaken the legislation, or just limit it to K-12 (under 18 sports) so as not to pick a fight with the NCAA? That is what I heard her say in the Tucker interview. Is she lying? If so, how come nobody will point out the specific wording that is faulty?
There are a lot of the “right people” against her. I am tempted to believe them. But where are the specifics? Can anyone help?

thanks for the pointer. I just read that Federalist article, and while it explains what Gov. Noem is proposing (remove language re: annual verification, and remove portion pertaining to college athletes/athletics), there is nothing in there to support the anti-Noem hysteria I am hearing: e.g. “she is a sellout to corporate interests”, or “she is just in it for the money”, etc. And, in the article, when referring to one of Noem’s portions (annual verification of age, biological sex, no PEDs, etc., which the Gov. also mentioned in the Tucker article), Ms. Cleveland attacks Gov. Noem’s “rationale” (too much administrative burden) as being “suspect”. Why?
I get it – when someone has a history of using “weasel words”, and trying hard to obfuscate their real motives, then they deserve to be challenged; but we seem to be very willing to withhold “the benefit of the doubt” when we don’t like someone, or someone’s position, or worse, when a crowd has already started attacking a person or their argument.

We got in the situation we are in because we failed to hold the politicians feet to the fire. If they are legitimately who they say they are then they can withstand Tucker’s questions. Why would we condemn him for questioning, seeking to prove or disprove someone’s position when we rightly condemn the mainstream media for their utter failure to do so?
So if I heard this correctly, Noem is fine with a female athelete suing everyone on a sports team that denied her a spot due to a male taking her place, but doesn’t want the state to take on that similar burden? WTH?

To be honest, I didn’t really understand all of the dynamics of the bill that Noem spoke of. But what struck me about this interview with her attitude. She was very defensive. And that is what makes me suspicious of her motives. I also watched an interview from a link posted in one of the comments. It was very sad to find that she is not a Trump Republican. In fact, I don’t think she gets him at all. Which says to me, she doesn’t get us either.

I actually watched her press conference this morning where she articulated her stance to be one that bears the benefit of the doubt. The NCAA is the one who makes the rules and being a separate entity holds the power. If she were to sign the bill ‘as is’ the NCAA could sue S Dakota and prohibit it’s women from competing in NCAA competitions as well as prohibit S Dakota from hosting NCAA events. Allowing that to happen would severely fracture women’s sports in S Dakota. How would that help the women in sports in her state then? She doesn’t agree that men posing as women should play with the women. She believes biology should determine what team you play on. She’s trying to ensure women in S Dakota have the opportunity to play in college. Sometimes a deal with the devil has to be made for the greater good.
My question to that would be: should you send girls from your state to compete in NCAA events against biological males from other states?
Seems to me that this issue is going to end up in the courts anyway, so why not enjoin the battle sooner rather than later?

I think she’s being sincere. It is a mistake to pass a law that will not win in court.
For decades years in utter frustration I have watched non-lawyer advocates push laws that have unintended consequences or which will fail in court. The politicians pass these either because they are ignorant or because they are pandering to their constituents. Anti-abortion laws are a biggie here, but there are many others. I have sat on multiple bar legislative committees reviewing proposed laws for this reason. Lawyers will go after loopholes and weaknesses, however strained, and judges, frankly, are often political creatures themselves and not too bright (they either seek election, i.e. politicians, or get appointed because of their networking not because they are brilliant lawyers.) Litigation itself is often a crapshoot, and it’s time-consuming and ecpensive. Worse, a bad decision — bad judge or less than great lawyering — can stand as precedent.
I often advocate for careful “step” corrections rather than sweeping bills. This may not satisfy activists, but it builds a stronger foundation.
I have not studied this particular bill and so I don’t know what changes, approach or strategy I would advocate regarding it (and depending, I may or may not be inclined to publicly publish my advice.) But assuming that the legal advice that she has been given is sound, then it seems to me that Gov. Noem is showing remarkable conviction and courage. I will look at the bill and see if I can follow up by the weekend.

I will add to my comment above that “gender” law is not as black-white or concrete as some folks think. There are a small percentage of people with chromosomal anomalies. Get the law wrong, fail to appropriately legislate so that they are not discriminated against, and the entire issue could be screwed up for good.

I just read Margot Cleveland’s column. This is actually far worse than it appeared on Tucker. Noem is gutting the legislation. Not only is she insisting that the law not apply to collegiate sports, she is also cutting out the civil remedy for girls in High School. So there’s no remedy if the law is violated.

pit seems she believes if this legislation passes as written it will not achieve the goals we all want which is girls play girls sports and men play men’s plus it will invite litigation and adds burdens on citizens to prove their gender every year over and over again.
I think what she wants is to create language that somehow utilizes title nine laws already on the books against the NCAA and other woke organizations from effectively stopping the new law through litigation. Plus close the loopholes.

It was published today that Gov. Noem, in her actions to rewrite part of the Bill before sending it back to the state legislature, utilized a form that is designated for the purpose of making very minor changes, like corrections of grammar and punctuation on Bills sent to her by the legislature.
The point that grabbed my attention is that the form the Governor used – some are saying “incorrectly” – allows the legislature to pass her restructured language of the legislation with a simple majority.
If it is the case that passage of the reworded legislation would have required a larger majority if her changes had been recorded on the standard designated form, an important question seems to have been overlooked in this discussion.
At this hour of the morning, after having skimmed through the newsworthy emails that came in throughout the day, I wasn’t able to locate the piece where I read about this SD situation. But the matter of her choosing to make “corrections” to the Bill on a government form that is designated as a spell-check type of document struck me as odd.
And P.S. further to my promise, above, I have pulled the text of the bill and IT DOES NOT do what it’s being touted as doing, promote “fairness for women”. It’s an invitation to litigation. Any legislation that is to be passed if is to be legally unassailable is going to have to address chromosomal anomalies and disabilities, as well as errors on birth certificates. Has to define — however distasteful this is — the meaning of “male” and “female” for purposes of the statute. Because “plaintiffs” will be found whose birth certificates indeed were wrong (e.g. chimeras, intersex, AIS, etc.) and that’s going to beg for some judge to resolve the litigation, define the terms himself, and write the law in a bad way.

Unless,as I suspect, he was lying about having read the bill and proposed revisions, he could’ve asked substantive questions about its provisions instead of acting like a progzi parody of himself. My wife suggested perhaps Noems concerns about being sued were legitimate. I politely disagreed, stating it’s interesting how she changed her tune once big money threatened her state. I further suggested if Noem is worried about a potential legal fight then add to the bill a requirement for anyone wanting to sue they must first post a $50,000,000 bond. The bond requirement may not be legal but give it a try.

This is a sticky situation and her stance seems to stem from a legal standpoint not an ideological one. What is frustratingly infuriating regarding the issue of trandsgender men competing in women sports is the fact no one wants to raise the equivalent obvious question as to why doesn’t transgender women compete in Men’s sports? Oh I know, because they know they can’t. So even though Noem may have a point on the legal grounds regarding the overreach that the NCAA has in regards to this issue, I think she maybe be trying to make it a national issue by creating a coalition where more states join in and offer more broader support to defend women’s sports.
As far the criticisms regarding Noem’s decision on this specific bill, I am not willing to label her as someone who is pandering or acquiescing to special interests or for that matter caving on the issue altogether, but someone who is trying to make the right the decision. I am willing to wait and see how this develops going forward before I start writing off Noem as another “Icky Niki” that should be castigated to the RINO club.
I watched her presser, it didn’t seem that she was running away from the issue but trying to be transparent as to why she didn’t want to sign this bill as she stated previously that she did not veto the bill but sent it back to be revised.
I wish to add one more comment. When Georgia passed one of the toughest right to life laws in the country, (which is another topic for another day), every corporation threatened to leave the state. The result??? More movies & TV programs are being made than ever. Amazon??? They built a massive distribution center and cannot find enough help. Noem should have called their bluff. She did not and more than likely her political career is toast.

If Noem is going to give that sort of answer on a news channel and then asked to explain further, then she needs to get in the weeds. Otherwise, she comes off as dishonest and evasive.
I read her explanation in her tweet the other day the proposed changes. Tweets 7-10, regarding performance enhancing drugs, made sense because it appears to be open schools up for litigation as it stands. If the goal is to close that door, then it is reasonable. But her explanation on Tucker sounded suspect. I also like the idea of creating a coalition of states. That will be needed for much more than just this issue. It will be needed for voting and 2nd amendment policies moving forward. A coalition that can impose state nullification is definitely a missing piece to our presently wobbly Constitutional framework. We need the friction and maybe she will help usher the way in that regard.

My daughter competed in year-round swim team and did very well against girls her age in breast stroke and butterfly all through her elementary and middle school and high school years. It made her strong in other areas of her life. It was a wonderful thing for her to be involved in a team and individual sport such as swim. They are stealing this experience from women now. Why? NCAA Regulations on “TransAthletes” is as follows:
The National Collegiate Athletic Association (NCAA), which organizes competition in 23 sports at over 1,000 colleges and universities, does not require gender confirming surgery or legal recognition of a player’s transitioned sex in order for transgender players to participate on a team which matches their identity. However, things become a bit more complicated when hormones are used. The recommended NCAA policy requires one year of hormone treatment as a condition prior to competing on a female team. Conversely, athletes assigned female at birth remain eligible to compete in women’s sports unless or until that athlete begins a physical transition using hormones (testosterone).
NCAA Policy on Transgender Student-Athlete Participation
The following policies clarify participation of transgender student-athletes undergoing hormonal treatment for gender transition:
1. A trans male (FTM) student-athlete who has received a medical exception for treatment with testosterone for diagnosed Gender Identity Disorder or gender dysphoria and/or Transsexualism, for purposes of NCAA competition may compete on a men’s team, but is no longer eligible to compete on a women’s team without changing that team status to a mixed team.

I don’t see that much potential conflict with the NCAA. Most male-to-female transgenders either take estrogen, or male hormone blockers in high school or earlier. NCAA has no jurisdiction over high school and junior high athletic competition, so a bill concerning that level of sports should be allowed to go forward.
