I’ll admit to being a little befuddled by the explanation here by South Dakota Governor Kristi Noem. The SD legislature passed a bill to protect women’s sports by banning biological males from participating in biological women’s sports. The bill has overwhelming support in South Dakota; however, Govenor Kristi Noem doesn’t support it.
When asked why she doesn’t support it, Noem seems to say she has received advice and counsel that the law would fail if challenged in federal court. Specifically Noem implies the NCAA would sue South Dakota and she believes the state would lose a lawsuit based on the law. If that is her position, essentially she is attempting to avoid litigation, proactively planning to lose that litigation, on a law supported by the majority in her state. WATCH:

Allyson Felix is regarded as one of the best female sprinters in the world. According to a report I read (can’t credit the author as I don’t remember) there are at least 300 American high school boys who can run faster times than her. And that’s just American boys. How long will it be before the women’s NCAA basketball teams consist of five bearded (former) males comprising their lineups? The only women’s sport I see as having a strong chance of remaining all female is gymnastics due to the body builds necessary to excel on their events.
The NCAA is so “woke” that it is actively working to bring about its own demise. How much revenue do they derive from women’s sports, and why will anyone attend, watch, or even participate in them when they are taken over by men? I’ve read the pros and cons about Noem in the comments below and am reserving judgment on her planned actions. But the NCAA needs to be confronted by concerns regarding their bottom-line, and if a coalition of states threatens to abandon them and start their own association, maybe the NCAA will “wake” up even more. But it’s going to take organized resistance from women to stop this insanity. Where is NOW? If this craziness stands, then Title IX should be eliminated.
If the law makes it easier for transgenders to sue the team for not allowing them based on gender Gov. Noem’s approach makes sense. If all other states fail to protect female athletics with South Dakota standing alone as the only state passing laws banning cross gender participation in competitive athletics they will get steamrolled by the “Woke Machine” but if a coalition of states rise in opposition and loudly fights back in public they might have a chance to defeat this bullshit agenda.
Agree. I like that Tucker questioned her hard, but her answers make sense. If there’s a coalition of states before making a stand, the NCAA is less likely to go up against, but if she falls on the sword and the NCAA sues and wins, then that win will be used as not only precedent, but will be used to threaten any other state from moving forward with logical legislation. She’s being smart.

I call BS on her explanation, and I like Kristi Noem. Why not pass the bill AND go after the NCAA by forming a coalition. Her comments don’t make sense. I don’t see how the NCAA could possibly win in court. She’s listening to bad advice. There are plenty of good attorneys that would gladly back South Dakota. There are lots of states passing this same type of legislation.

Noem said SD would lose any case brought against the law as written because the fed court district where the case would be filed/tried is strongly democratic and the law was poorly written. She then quickly pivoted and talked a bout the coalition with other states, etc. etc. My guess. She’s looking to create a favorable environment in which to try and win this or similar case(s). The long view. ..
Or perhaps she could have paid attention and worked with the friendly state congress when writing the bill? I mean if she’s really into solving the problem, why would she be so ignorant in the written form of the bill? Did she not know any lawyers who could have checked this law out? She f’d up royally. She’ll most likely be done nationally. What a stupid way to go. Republicans never die on their shields in battle they die cowering to some of the worlds biggest cowards. Shame on you Noem. At best we can blame it on her handlers….Why are these people so dumb they need handlers?

A proper response would be to pull all of SD colleges out of the NCAA asap and lead the ways for other colleges to do the same.
But her lawyer, who also represents the arena that profits from the NCAA games held there- counsels her differently- and she listens to him.
How long? Six months? Two years? A decade?

I beleive Noem has a point.
NC’s Uniparty(R) governor and Republican legislature passed what we call the Bathroom Bill to stop the city of Charlotte’s letting male perverts into girl’s locker rooms and bathrooms. The NCAA immediately told them they would pull the NCAA basketball playoffs out of NC – that is HUGE here. Everyone then caved.
It was an emotional knee jerk reaction to Chalottte’s unconstitutional usurpation of State power which should have been pursued strategically – all a setup.
1) Mississippi passed a similar bill recently and expects to be sued. Why not sign this bill and join up with them, then use your leadership-by-example to lobby other states that are on the fence to pass a similar bill as well?

Why was so much trimmed out of SB 2536 as it passed through the Mississippi legislature?
Noem sent the bill back to legislature suggesting specific revisions.
If Kristi Noem really had spent months discussing these problems/this bill with legal scholars as she claimed, why did Noem agree to sign the bill at all, as she said she would do prior to vetoing the bill?
Why did Noem only consult with legal scholars, and not with reputable trial attorneys?

Noem did not veto the bill.
Her answers make sense to me. She wants some language changes to make the law defendable in a hostile federal court. There’s no way she wants to be on the wrong side of this, she just wants the ability to win without SD getting steamrolled. I think she’s earned the right to the benefit of the doubt.
