BREAKING: The Fifth Circuit Court of Appeals Rules 2-1 to uphold Judge Hanen Injunction (full ruling pdf below)

In a 2-1 ruling of the Fifth CCA (Judge King has lengthy Dissent) the injunction against President Obama’s Deferred Action for Parents of Americans and Lawful Permanent Residents program (“DAPA”) has been upheld.

The DAPA is commonly referred to as Obama’s Executive Amnesty – Obama Loses.

Twenty Six states filed suit to block the November ’14 Executive Order. A Texas Judge, Andrew Hanen, issued an injunction blocking implementation.  Obama appealed the injunction and lost; then appealed again based on standing – and just lost again.  Here’s the ruling:

However, the release of the 5th Circuit decision today may allow the Supreme Court time to take up the dispute in Obama’s term, if a third appeal is attempted.  A favorable Supreme Court ruling could then override the injunction and permit Obama to implement the executive actions next summer.

The problem for the White House is the substantive legal issues within the original Hanen ruling have not been argued in Hanen’s court or the/any appellate court.  They have only argued the ability of Hanen to block them (ie “standing), not the merits of the underlying case.

Therefore the route to SCOTUS would only be on the legal issues of Hanen’s injunction – and not on the legal issues of the Executive Order itself. It’s doubtful SCOTUS would take up such a case.

This is important and those who understand the TPP deal need to begin pressuring your congress creeps immediately.   President Obama has delivered the required “Notice of Intent” letter to congress.

The White House is legally bound to tell congress they intend to enter into a trade-deal.  Obama has just made the text available to the public. In 60 days he can sign the agreement and send trade agreement to Congress for debate, vote and approval.  Congress is allowed 90 days for debate after presidential signature.  The letter below officially starts the clock.

President Obama is hoping to use Thanksgiving, Christmas and New Year holidays as strategic tools to run out the clock on any efforts to provide WH pushback on the anti-American deal:

UPDATE:  Having watched the full PBS outline (Available Here) any conservative pundit, media outlet, blogger or activist who doesn’t immediately begin pulling back the curtain on this construct doesn’t deserve to be considered as legitimate.

The PBS story absolutely appears to be the initial thread to discover that Speaker John Boehner’s decision to abdicate his position, and the decision by McCarthy to withdraw from consideration, was/is a planned scheme to advance Paul Ryan specifically to attain immigration reform. (more…)

A recent article at Real Clear Politics hits on one of the key aspects of the Benghazi fiasco that recent media are hell-bent on hiding; Hillary Clinton, not President Obama, is actually the person responsible for the crisis in Libya.

Watching the House Select Committee on Benghazi hearings, it was interesting to note how no-one really went ‘there’ to give Clinton full ownership of the 2011 Libyan Intervention.  So let’s review Clinton’s ownership.

It’s as if both congress and the media have forgotten those ridiculous 19-days in 2011 when Hillary was flying back-and-forth to meet with French Prime-Minister Sarkozy and plan their endeavors.

In the U.S. presidential adviser Samantha Power was  bending Obama’s ear with declarations of a “Responsibility to Protect” (R2P) the Eastern Libyan citizens from the boogie man narrative assigned to Gadaffi.

Meanwhile in New York,  U.N. Ambassador Susan Rice was answering calls from her British and French counterparts who were similarly selling an interventionist message.  Back in the White House, President Obama was reluctant to engage.  It was Secretary Clinton working overtime to bring the President into the same line of thinking as herself. WASHINGTON (AP) — No IRS official would face criminal charges arising from the political controversy over the processing of applications for tax-exempt status, the Justice Department announced Friday.

In a letter to members of Congress, the department said that while investigators had found “mismanagement, poor judgment and institutional inertia,” there was no evidence of a crime. (more…)

“I don’t recall” – In a world where journalists were in-tune with events and stories, and in a world where journalists were driven to tell the truth behind events, those three words from Speaker of the House John Boehner would have caused every DC reporter to grab their steno pads and head immediately to his offices.

Alas, few people beyond the inhabitants of the “new media world” (internet) have an understanding of how consequential those three intentionally obtuse words actually are.

“I don’t recall”…

Those words are massive when contrast against a March 2011 President Obama finding memo which authorized a covert State Dept./CIA operation in Libya.  That operation ultimately culminated 18 months later in the Benghazi attack, Sept. 11th 2012.

Speaker of the House John Boehner is, as a consequence of his position, a member of what’s called the “Intelligence Gang of Eight”.  The finding memo would begin a process where then CIA head, Leon Panetta, would have briefed the “Gang of Eight” because specific congressional leadership would have the automatic position of oversight for the operation.
