Dallas, Texas  — Clinton Broden of the Dallas based criminal defense firm Broden, Mickelsen, Helms & Snipes, LLP. announced that a hearing has been set on the City of McLennan’s motion to quash  the subpoena he issued to Twin Peaks for its surveillance video of the events of May 17, 2015.

The hearing is set before District Judge Matt Johnson in the 54^th District Court at 9:00 am on Tuesday, June 30, 2015.  Presumably a hearing will also be held at the same time on Broden’s motion to sanction the City Attorney’s Office for filing the frivolous motion to quash in the first place.

Broden continued to express bewilderment that the City of Waco believes it has the authority to stop the production of a video that is owned by the Twin Peaks franchisee and which the franchisee is ready, able and willing to produce.  “Everybody needs to understand that this video is the property of the Twin Peaks franchisee.  It is not the property of the City of Waco, theWaco Police or McLennan county.  It is private property,” said Broden. The suspect in the brutal beating of a girl and her 3-year-old nephew was positively identified.  The police issued an arrest warrant.  The family of the teen suspect were not cooperating with local police.  Initially the attacker and her “guardian” fled the area and went into hiding; law enforcement reports the family is now willing to bring the 13-year-old attacker to the police to face charges.

Bree Newsome, the woman who climbed the flag pole today to remove the confederate flag, is no stranger to activism for profit.

Indeed, this morning’s entourage encompassed professional videographers to document the publicity stunt.

A resident of Raleigh North Carolina, in 2013 Ms. Newsome was arrested during a protest against voter ID laws:

Bree Newsome, one of six protesters arrested and taken to jail Wednesday night after staging a sit-in at the office of the Republican North Carolina House Speaker Thom Tillis, said the group is still demanding a meeting with Tillis, who supports the bill. (link)

In 2014 Newsome was a panelist at Octavia Butler Celebration of Arts & Activism at Spelman College; as described: “culminating event brings together the speculative fiction and film communities to discuss the legacy of Octavia E. Butler; the intersection of Afrofuturism, social justice and Butler’s body of work“.

Curiously Mosby is trying to get the two misdemeanor defendants (bicycle cops Nero and Miller) split up with one in each trial.  Possibly she’s looking for contradictions between the two officers to crop up – Or she’s racially seeking to colorize the trials…

(Via Baltimore Sun) Prosecutors on Friday urged a Baltimore judge to try six police officers charged in the arrest and death of Freddie Gray in the city, arguing that it’s too early to decide whether jurors here can be impartial.

Defense lawyers have asked for the trials to be moved elsewhere in Maryland, pointing to the high level of publicity the case has received. Deputy state’s attorney Janice Bledsoe left open the possibility that the case could still be moved if an impartial jury cannot be seated on the eve of trial.

“Until then, the court should not, as the defendants request, demeaningly prejudge the ability of Baltimore’s citizens to fulfill their traditional duty to impartially determine the facts of criminal cases happening within their city,” Bledsoe wrote.

[…]  Gray’s autopsy report, obtained by The Baltimore Sun, showed that he suffered a “high-energy injury” while being transported in the police van. A medical examiner ruled his death a homicide because police failed to follow proper procedures. (more…)

( Via Fox News ) A law enforcement source today confirmed to Fox News that escaped convict Richard Matt has been shot and killed by police.

Matt is one of two prison inmates who escaped from Clinton Correctional Facility in Dannemora, N.Y.  Matt’s counterpart David Sweat is still on the run.  Authorities have been pursuing the two escaped killers for 21 days.

After some awesome sleuthing by Treeper Manickernel the authorities in Rowlett, Texas have been notified the videographer of the horrific video is Ernest Irizarry Jr.

A vicious attack has been captured on a video. –earliest identifiable origin here– A baby and young woman are both victims of a brutal attack, that appears to have taken place on/around 6/23/15.

The video includes no specifics as to location, or identity, of victim or perpetrator.  U-Tube continues to chase the video and delete it, keeping it hidden.

This is rich. While simultaneously saying the people of Baltimore are too stupid a mob to stop destroying their city, Mosby claims that it was imperative she remove the constitutional protections of the police department in order to save Baltimore; and people should be thanking her for sacrificing the police for the greater good of society.

(Baltimore Sun) State’s Attorney Marilyn Mosby’s announcement of charges against six officers in connection with the arrest and death of Freddie Gray restored order to Baltimore “before the entire city became an armed camp or was burned to the ground,” her office argued in a new court filing.

Michael Schatzow, Mosby’s top deputy, asked a judge this week to deny a motion by attorneys for the officers asking that the charges against their clients be thrown out because of missteps they say Mosby made.

The defense lawyers argued that by publicly announcing the charges against the six officers involved in Gray’s April 12 arrest, Mosby unforgivably biased potential jurors against their clients.

But Schatzow said seeking to restore calm was a legitimate move.

“Speaking in the middle of an ongoing riot, Mrs. Mosby was trying to calm the crowd, not incite it,” Schatzow wrote. “Her repeated pleas for peace while the criminal justice system does its work served a legitimate law enforcement function.” (link)
