I had not been paying close attention to the overarching issues of President Trump removing Fed Governor Lisa Cook for cause – fraudulent filings on her three mortgage applications. However, the appearance of Norm Eisen as her lawyer certainly highlights the political nature of the defense effort.
Norm Eisen is a well-known Lawfare operative, second only to Mary McCord in his high visibility and connections to all of the anti-Trump efforts. Eisen, like McCord, is at the center of the leftist effort to stop the Trump agenda through the manipulation of the courts, ie. ‘Lawfare.’

So far Cook and her attorneys have been making a lot of noise, but the evidence appears to be stacking up and none of them, nor Powell, want this case to go to the SC where they might just rule that President Trump can fire her and anyone else in these so-called “independent” agencies that are performing Article 2 executive functions. The interest rates on mortgages are higher if the home is not a primary residence, or if it is going to be a rental property. So, the banks DID lose money: all the money from the higher interest rates they were entitled to get but didn’t get becasue she lied in the applications.

You always have/ had the right to due process if you believed and or had evidence that the termination was unjustified or illegal under U.S. Code.
Historically, most people of average means who were/are faced with that situation are often deterred from pursuing their rights due to the cost of legal representation (lawyers). And, unlike the plots of some movies, most pro bono lawyers who operate in lower economic class areas are not the most skilled or who have unlimited resources to investigate the offending employer.
So we make decisions based on practicality- can we afford to fight the unethical employer or do we move on to another job.
As with real sexharrasment cases, we decide based on legal fees & the stigma of having filed & won such a case, what is the likelihood that someone will hire you afterward?
Although I personally once faced a question of bias within my company, I chose to not pursue it because I enjoyed my job and the position for which I was not chosen but given to a minority female turned out quickly to have been misrepresented by the hiring manager.
But the latter issue you raise is sort of self-solving. If an employer won’t hire you because you won some kind of discrimination case with a previous employer, then, as long as you don’t have a conspicuous *history* of filing discrimination cases against a series of employers, the prospective employer should have no issue with you if you’re qualifications are good. If they DO have an issue, then you would be more correct to turn THEM down, and move on to to another prospective employer who will respect your decision to seek relief against the previous unethical employer.
This is of course speculation and in an extremely tight job market, I’m sure that the dearth of available jobs will come very heavily into play with one’s decision making.

There are two issues here. The one that is specific to Cook, i.e., is lying on three mortgage applications sufficient malfeasance to meet the “for cause” requirement? (Yes. If she can’t handle her own finances, she shouldn’t be handling the nation’s.)
The broader constitutional issue is whether there can be an “independent” unit within the federal government that is not really part of the legislative, executive or judicial branch of government.
The issue first came up in a case you will probably be hearing a lot about in the coming SCOTUS term. Humphrey’s Executor.
Humphrey was appointed to the Federal Trade Commission by Herbert Hoover. FDR fired him. Humphrey sued, but died as the case went on; the executor of his estate replaced him as plaintiff, as he was asking for back pay, which would be an asset of the estate. The issue was whether the FTC enabling statute, which limited firings only to “for cause,” was constitutional.
SCOTUS ruled in 1935 (9-0) that Congress could create a “quasi-independent agency.” It ruled:

SCOTUS already ruled that the president could remove the head of Elizabeth Warren’s creation, the Consumer Financial Protection Bureau, even though it enabling statute had similar “can’t be removed except for cause” language as to its head. Seila Law LLC v. CFPB (2020). That was a 5-4 decision. RBG was still on the Court. (Yes, who knows how ACB would vote.)
The Seila plaintiffs had argued that the whole agency was unconstitutional, but SCOTUS wasn’t going that far. It did find the restrictions on the president’s power to fire the head unconstitutional. The majority in Seila ruled:

Yes, the Fed would be the ultimate test of Humphrey. I’d expect a case involving another agency challenging Humphrey‘s precedent will make it to SCOTUS first. Until Humphrey is overturned, the lower courts are bound by it, but they have been distinguishing their fact situations from Humphrey’s.
Last term it was Chevron, Chevron, Chevron (overturned by Loper-Bright). This term it will be Humphrey, Humphrey, Humphrey.
This is issue is already coming up through the federal appellate courts. The Fifth Circuit just ruled that the restriction on “for cause” firing in the NLRB enabling act was unconstitutional. Space X v. NLRB (2025). I expect the NLRB will petition for cert. And yes, that is the Space X (Elon’s company).
