Rather than write 10,000 highly specific and legally granular words to deconstruct the Trump indictment, I will share the opinion of others with supporting analysis and add some substance to the issues. Later I will compile all the various points of analysis into one very granular article.
First, it is important to always remember why this indictment is taking place. The DOJ, specifically Lisa Monaco, are continuing the offensive against Trump in large part to cover for the actions of the Obama administration in the originating targeting of their political opposition. Originating Spygate operations (’15-’16), Russiagate (’16-’17), Mueller (’17-’19), Impeachment #1 (’19-’20), Durham (’19-’23) and Jack Smith ’22-present, are all part of one long continuum of weaponized DOJ and FBI operations. The entirety of the effort is to protect the actions taken by the Obama administration. [Note to congress: Questioning Durham this month is defense key #1]
In this interview {Direct Rumble Link} Jeff Clark gives his opinion of the statutory weaknesses that exist in the case as outlined in the indictment. The first two defense approaches will likely be: (1) the Presidential Records Act supersedes the issues of document holding as noted in the use of the Espionage Act. (2) However, if the Espionage Act [Statute 793(e)] has to be defended, the originating issue of “unauthorized possession” will be the second approach heading to the 11th Circuit Court of Appeals. Granular note, putting aside the fact that classification is irrelevant to the statute being used, within the indictment please notice how the DOJ states 102 classified documents [pg 27], some that were never marked classified as noted in the indictment [count 11, page 30] but defined as classified after DOJ review, were discovered after the Trump affirmation of compliance in July 2022. This is the predicate for the FBI raid. Again, a total of 102 documents were identified as classified by the FBI/DOJ.
They were unable to use classification status as a legal mechanism to attack President Trump; instead, they use the non-production as an evidence enhancement to the ridiculous claim that Trump lied to them (sec 1001); but notice how there are only 31 documents [31 counts] outlined as national defense security issues. This would mean approximately 70 classified documents are memory holed by this special counsel.
70 defined “classified” documents retrieved, no description provided, those documents not a part of any legal contention – they just disappear. I suspect we know what those sets of documents pertained to, and they have everything to do with DOJ and FBI conduct in Russiagate.

With access to all information via the NSA, they can “target” a person, use the info in the NSA database to setup the investigation or “predicate” to initiate an investigation. My recollection was that the meta data showed that the only way for this amount of data to be downloaded within this short of time, was for it to be put on a thumb drive. It had to be an inside job.

Yes, that is exactly what happened. It wasn’t Russia, which is what DNC and their tech firm (can’t remember the name) said without ever looking at the servers. The insider is believed to have been Seth Rich, who was appalled at what he was seeing the DNC and Hillary Clinton do to Bernie Sanders and others even on the Republican side, and intended to get the information to Julian Assange. Seth Rich was then found shot in the back and all his valuable belongings still on him, yet authorities claimed it was a robbery. Assange has said his source was not the Russians.

The DNC never allowed the actual server to be examined by the FBI, CrowdStrike did the exam and gave the FBI a draft report saying it was Russians, and the FBI accepted it. To this day that is the basis behind the “Russian hackers” claim.
Shawn Henry, I think is his name, representing Crowdstrike testified before a closed door committee that they had no basis to prove that Russia was responsible for the hack. Of course by then the damage was done. I jumped in right off the bat with looking at the DNC & Podesta hack and in the large picture there was much proof that it was not Russia before Henry even said it.

Sundance—There is another problem with the numbers of documents. In the indictment, there is a chart showing the three groups of documents by the location in which they were found as follows:
197 documents–Found among the “debris” (Jay Bratt’s word) in the 14 out of 15 boxes Trump turned over to the National Archives.
38 Documents—Found by the search of Attorney Corcoran (if I recall correctly) and turned over to Jay Bratt.
102 Documents—Found in Trump’s Mar-a-Lago office and in the boxes IN THE STOREROOM.
So, how do we know those unlabeled boxes photographed in the ballroom, bathroom, shower, etc. contained any documents with classification markings since none of the 102 reported in the indictment were found there? We can’t tell from labels on the boxes in the photos, and some boxes were brown cardboard, also unmarked. I’ll go over the indictment in detail to see if they are talking about different points in time when UNLABELED BOXES were photographed as being in the ballroom, etc. IN THE RECENT PAST, but were not there when the FBI searched since, as the indictment displays, only 102 documents were found during the search warrant, and they were found in the STOREROOM BOXES and in TRUMP’S OFFICE, not in the ballroom, bathroom, shower, etc.
I almost forgot, the indictment quotes Executive Order 13526, enacted during the Obama Administration, but seems to have missed this section in the Executive Order that says the following about the President’s (and the VICE PRESIDENT’S) authority to declassify on their own initiative:
“(a) Except as provided in paragraph (b) of this section, all information classified under this order or predecessor orders shall be subject to a review for declassification by the originating agency if:…..”
Then we proceed to paragraph (b):
“Information originated by the incumbent President or the incumbent Vice President; the incumbent President’s White House Staff, or the incumbent Vice President’s Staff: committees, commissions, or boards appointed by the incumbent President; or other entities within the Executive Office of the President that solely advise and assist the incumbent President is exempt from paragraph (a) of this section.”
How many of the documents found fell under paragraph (b) exemption?
Just a guess: All of them.
Here’s something else. As Sundance pointed out, the indictment does not always reference documents with classification markings because the Espionage Act is not limited to documents with classification markings, so “National Defense Information” that Trump could not possess did not have to include classification markings. Yet, documents with classification markings were all that were requested in the grand jury subpoena served prior to the search warrant:

I might be wrong, but that just might be a problem here, along with claims that documents were found in boxes in the ballroom, bathroom, etc. when the indictment says only 102 documents were found during the search warrant operation and they were only located in the storage room and Trump’s office. So, what was found and exactly where was it found, and in what exact boxes? We don’t know, but we should.

If elected, Trump would need to essentially eliminate the entire group of three-letter “executive” agencies that are committed to destroying him. That solution, by the way, is the same solution Dan Bongino has been talking about for months. It’s an absolute requirement. So, it’s a situation deep state is fully aware of.

Another problem with going into the merits of the case is that assumes honest judges will rule correctly and without prejudice. That scenario is much like the assumption of fair and honest elections will fix this.

Are you suggesting that the GOPe is something discrete that can be located, isolated and torched? Are you also suggesting that, albeit fake, the GOPe is an opposition party? When you light the GOPe on fire, are you implying the DNC will be spared as if they’re two seperate buildings?
I see the GOPe as a ‘look’ flashed by the UniParty which IS a real thing. The GOPe doesn’t collude with the Deep State it’s one of the Deep State’s many guises. The GOPe is not in open revolt with MAGA Conservatives. It owes zero allegiance to MAGA except the occasional head feint and owes all its allegiance to what it is, the UniParty. My question/request jumps to the future “next phase”: Regardless of how this round ends (my fervent desire is with a Trump victory which is best case), The Republican Party going back to 1860 is now history.
1. How does Trump lead the transition to a constitutionally sound alternative that follows his second administration?
a. Given that a very substantial majority of the GOP congress is fully in the “uni party” and will hopefully be persona non grata.
i. I don’t see how we can elect enough patriots to have Congressional veto proof power let alone a working majority.
ii. If my assumption above is realistic (Sundance’s opinion please), then how do we stop the continued one-party rule?

But on the other question of what happens after the GOP crumbles into a remnant of its former self, here’s my guess what the landscape would look like. Based on Europe and other countries that do not have our two party system and where there are many parties —-a coalition government is the result.
So while a new MAGA party may not be able to quickly gain the majority in congress, achieving a strong minority may give us some power.
I’d guess at some point there’d be at least three parties (DNC, RNC, MAGA) and maybe even a fourth if RFK JR creates a party). And once the two-party system is over, would not be surprised to see more and more parties enter the picture over time.
I know little about how coalition governance work in practice, just a guess that’s where we may be headed.
As more parties enter the picture, I’d expect the DNC to shrink as well. Liberals unhappy with the DNC will leave once they have a place to go.
The MAGA party may attract some defecting Dems (20% regularly show up at President Trump’s rallies) and some may go to another Dem alternative party that enters the field (RFK JR?). If that happens the much smaller DNC and RNC may form their usual coalition, while MAGA would work issue by issue with the other parties. The above of course is just my attempt at psychic prediction. The future when it arrives seems to always surprise.

At this point I’m in favor of our forming a new America First party –as long as it is not structured as a corporation (RNC) and as long as certain other formation measures are in place to prevent an immediate takeover by fake MAGA (Uniparty).
That said, we already have 209 parties in existence in this country.
One of the risks of collapsing the RNC is that other parties may grow their base and new parties may enter the vacuum. At any time a third or fourth party may gain enough votes to become a peer of the other two parties.
Our Constituion does not require two parties. If more parties grow in size or new parties enter the field due to the collapsed RNC, there is nothing to prevent that. It would just be the reality of the new political landscape.
Of course we want America First to replace the RNC as a full-fledged party and retain the two party system. But we don’t control that. If any of the other 209 existant parties grow their base, they’ll be in the mix too.

I had occasion to talk with an Israeli about their government a number of years ago. He disparaged the coalition model because getting anything done took a very long time. That comment is true of any model that is more than one party; hence the need of the world’s monied power players to eliminate the competition.
Over-arching all this, however, has been the gradual removal of (Christian) morals and ethics from public education, beginning in the 1800’s. This has borne inevitable fruit: self-interest above all.

Before President Trump left office he wrote a memo. The memo stated all records to be declassified and reviewed for the process of names and sources. Sundance, why would Fani Willis, Atlanta attorney, wait until August-September to announce charges? Could it be to keep piling on indictments, like Jack Smith’s, only for keeping negative information in media? I can’t imagine another reason to string it out. She was going to “announce” earlier, then suddenly postponed it. Makes me wonder if she and Smith are working together on a timeline. President Trump had excellent domestic policies, foreign policies, energy policies, fiscal policies, China policies, but failed in political policies. He was the Executive and knew that Obama had weaponized the DOJ, why didn’t he un-weaponize it? Why didn’t close advisors, Steve Bannon, and all, advise him? Or if they did, why didn’t he pay heed? By the first year of his term he should have realized that the deep state and the Uniparty were gunning for him? Why didn’t he take actions to stop them in the Executive Branch? For starters, when the Senate wouldn’t approve his appointees except judges, he should have just stop nominating appointees. McConnell wouldn’t recess the Senate so he couldn’t make recess appointments. He should have just stopped nominating and put the burden on McConnell.
He should have rocked Congress back on its heels, but instead he nicknamed opponents. As a businessman and his policies were stellar, but as an Executive politician, he failed. Will he do better on another term? I’m in doubt with his praise of Cuomo’s covid results and other things he’s posted. The Presidency is a very curious role. It is mostly symbolic in many ways. The Office has little actual power given to it, and so must find creative ways to compensate. The very first(!) Officeholder famously said (in so many words): “I can command the Army to do anything, but with Congress I can do nothing.” Yet, so far, Article 2 has never been amended.
George Washington didn’t have the huge Executive Branch that now exists for the President. The President has much power over the Executive Branch, which includes the DOJ. He fired James Comey, nothing happened to the President, but somehow he was convinced not to do any such Excecutive actions again. He didn’t fight for the Executive Branch.
A President has many powers, but he is not King. That’s not how our government works. It takes cooperation and INTEGRITY in all the branches of government. I don’t know a human being alive who could clean up the swamp by his or herself. There are traitors and grifters at every level of our government. Millions of Judases, in every organization, who can be bought off. Our current government operates like the Mafia. If they can’t buy you off, they threaten your family, your business, and as we have seen, people “disappear” quite regularly, while the media keeps everyone distracted.
We are in a dire situation. I’m with other posters – this is not all on Trump – this is on us. They have cowed us into believing we have no power to dissolve our government and start over. Our Constituion was written in such a way that The People have full authority to sweep the board clean and start over. It does not, however, tell us how to do that. But, the 1st and 2nd Amendment speaks volumes. We are free to speak our minds and free to defend what is ours. Let the corrupt unJustice department label us “domestic terrorists”. That is exactly what should have been happening! Why aren’t the States telling the EPA to eff off regarding their plan to ban gas stoves? The SCOTUS came down and told the EPA they do NOT have ultimate authority to set mandates. Yet, nobody tells the EPA to eff off.
The President is not King, but is in power for the Executive Branch, which is huge compared to Congress and the Judicial Branch. Obama ruled the Executive Branch with Executive Orders and weaponization of the departments under his control, such as DOJ, IRS, State. Trump should have fired all the SES and previous appointees. So what if Congress didn’t approve his appointees, the Deep State would have withered with no department leaders and their deputies to submit budgets. At least the leaders would have their coup shenanigans stymied.
All those government entities you list, are under the control of the President. Obama issued Executive Orders to consilidate his power, why couldn’t have Trump done the same? Trump was extremely successful with energy, foreign, finance, trade, domestice policies, but never got control over the Executive Branch.

Reagan fired the Air Traffic Controllers when told he couldn’t do that. He did and the Executive branch came under his control. He successfully exerted the power of the Executive Branch. Trump after firing Comey and was aware of how he was being targeted and lied to by the FBI, should have fired all the appointed heads including the Attorney General. The President is the Commander in Chief and also the head of the DOJ. The FBI was created by President Theodore Roosevelt in 1908 to fight political enemies, the Anarchists.
If a President created the FBI, a President should be able to dissolve it the FBI, and all the Executive Branch departments. He had power to do so. Trump would be heavily criticized, but he was already under fire for fictitious accusations. If Congress had passed legislation that controlled the Executive Branch it was unconstitutional and Trump should have challenged the laws put on the Executive Branch by Executive Orders, like Obama successfully did.
Not much of a resistor from you as a supporter of this country. I am a great supporter of the MAGA movement, but can also what happened, that embroiled President Trump from carrying out all his domestic agenda.

Retired Magistrate here: With regard to the audio where President Trump allegedly discusses a national security issue with someone who does not have clearance, where does the audio come from; Mar-A-Lago or the White House? Under what authority was the audio made, was it with President Trump’s knowledge and approval? If the recording was made in Washington D.C. only one party consent is required. If the audio recording was made in Florida, two party consent is required.
If the audio was obtained illegally it should be excluded from evidence as fruit of the poisonous tree.
I believe the audio is from the former Watergate reporter Bernstein that had taped interviews with the now former PDJT in order for the author to write his book.
There was one other author that may have taped conversations with President Trump, a well-recognized Presidential historian who was also writing a book about the Trump Presidency.
Could have been both of these writers recordings were subpoenaed.
I thought I read that the audio came from Trump’s Bedminster golf course. In New Jersey.

The DOJ sure is lucky that Trump wasn’t smart enough to make copies of those very specific documents. Can you imagine the cacophony if he submits them into evidence in a court of law ?

Something that keeps bugging me in the back of my head. I’m from Illinois. I have watched the “anointed one” manipulate elections since before his successful senate run. It is about taking out the opponent to control the outcome of elections. If it means weaponizing the institutions of government to accomplish this, it will be done. It did not work in 2016, and it frosted his ego. My question comes down to wasn’t there an attempt or early indications of using the tools of weaponized government against the man from Utah during the 2012 election. It just never went that far because the man from Utah was such a weak candidate? I don’t know, 2012 is in the back of my head as showing signs of this
From what has been leaked to the press, one of the items in question was Gen. Milley’s absurd plan to invade Iran. As the President, could DJT not have held a press conference firing Milley and telling the assorted Jim Acostas how he had proposed invading Iran. That seems within a President’s prerogative.
Accordingly, he could do whatever he wanted with that information as our Commander-in-Chief, including packing it into a box and storing it in his bathroom, where similar odiferous material is handled.
I will find a way to vote for Trump even if he is in solitary confinement.

Sundance’s analysis is deeply appreciated. But all along – since last year, when he doubted that the Mar-a-Lago raid would lead to criminal charges – I believed that the fanatical Stalinist Merrick Beria Garland would ‘go there’ and risk all to ‘get Trump.’ And so he has.
Likewise, I can’t share the optimism that this indictment won’t get past the first defense challenge. Federal criminal courts are a conviction machine; their conviction rate is north of 95%. A high-profile case like U.S. v Trump can bounce like a pinball between the district and appeals courts, at least past the November 2024 election, as Beria Garland intends.
President Trump could win the election and pardon himself. Or, another Republican candidate could win and pardon Trump, just as Gerald Ford pardoned Richard Nixon. But standing in President Trump’s shoes, I would hate to gamble on that outcome. The Swamp, including RINOs, despises Trump and would gleefully lock him up in a cell next to Julian Assange.
Beria Garland’s weaponized, hyperpartisan DOJ is a very serious threat to anyone targeted by it. President Trump may find a path to escape its clutches, and I hope he does. But it is not going to be easy, simple or quick. 🙁
Is the indictment the result of ‘mistakes Trump made’? Can FBI prove there was ‘intent to do harm or benefit’, or any proof of harm/benefit directly resulting from mistake(s)?
They’re not trying to prove anyone’s guilt. Because no one accused is guilty. They’re trying to hide their own guilt. It takes no creativity at all to predict what those “70 documents” really are.
This current Trump persecution is just ANOTHER cover-up of another Biden crime! They WAITED and ginned up the drama for as long as they could hold back the Biden bribery evidence. They had an impeachment over a Trump phone call asking Ukraine for an investigation AFTER Biden appears on the news bragging to the CFR about blackmailing Ukrainian officials and then laughing about it. They have done this very same thing for Hillary several times and of course Hunter has made their careers great.
The Dems are buying protection from the FBI and DOJ, but I wonder what they are getting in return? $, blindness, who knows?

I officially have, “President Trump Indictment Fatigue.” The over reporting is crushing. The only redeeming parts are, it keeps President Trump’s name out there, and displays the left’s verbal venom. How do they look into a mirror???
This is ludicrous; a waste of bandwidth, tax-payer money, and, a crush on our once Constitutional Rights. It’s just so hard to take, especially against a man who stabilized our country.
I’ve already voted for President Trump three times (one Primary and two Generals) and fully intend to do so in 2024.
if, in the meantime, I turned into a lib, I’d vote for him from many different counties, States and from some unnamed graveyard. Alas, I am but one pretty stinking offended American citizen who will crawl over broken glass to vote MAGA!

It is apparent to me that this country is abundantly blessed by people who love it, value it’s people, and the Constitution and what that document means to our culture, legacy and life. I think it is safe to say that the 70 “memory holed” documents were found in Trump’s office. The others in a box, or boxes, in the storage room, and NONE were found in boxes in the shower, bathroom, ballroom, etc. since what was displayed in the chart, found in the indictment, for the 15 boxes surrendered to NARA (197), the (38) surrendered by grand jury subpoena (which only demanded documents with classification markings as set forth in the subpoena), and the 102 found in Trump’s office and in storage room boxes.
I always thought the ones in Trump’s office were the ones declassified and were Crossfire Hurricane documents he used to develop his lawsuit. They were also the ones in the “white bankers box” that David Ferriero saw Trump’s group carrying to Marine One for the flight to AF 1 for the return to Mar-a-Lago. Trump cared about those being packed for the trip. The others were unknowingly packed at the White House, and unknowingly sent to NARA to start the whole thing.
I’m convinced the pictures the DOJ is leaking were staged by them. As meticulous as DJT is, I don’t believe for a second that he stored his records in a bathroom. Especially when you consider that his storage area was inspected prevously and was only told to install a better lock. This is total BS
I have to agree. I think it’s a swipe by the H Clinton people that her bathroom server is being ignored.
Great observation. Thumbing their nose. Add to that Hillary actually speaking up and fund raising off Trump’s Indictment, and you get that this is a powerful intentional statement by the Power that they are fully and totally in charge.
This explains why DOJ and FBI refused to allow Trumps attorneys to be present during the “search”
There is also the thing about so few documents being left (102), with likely 70 of them being the Crossfire Hurricane docs in Trump’s office. This leaves 32. Who in hell would move all those boxes around when all you had to do is find the remaining 32 docs and hide them somewhere. Why move all that around? As they run low on docs, their stories get more ludicrous.
I’d be willing to bet that DJT has copies of everything stashed for reprisal when he becomes President again!
I am thinking the same thing that those pictures were staged by the FBI just like the documents on the floor they released after the raid last year.
… Or on the stage in the ballroom for ALL his guests to peruse while enjoying one of DJT’s many events.
