Rather than write 10,000 highly specific and legally granular words to deconstruct the Trump indictment, I will share the opinion of others with supporting analysis and add some substance to the issues. Later I will compile all the various points of analysis into one very granular article.
First, it is important to always remember why this indictment is taking place. The DOJ, specifically Lisa Monaco, are continuing the offensive against Trump in large part to cover for the actions of the Obama administration in the originating targeting of their political opposition. Originating Spygate operations (’15-’16), Russiagate (’16-’17), Mueller (’17-’19), Impeachment #1 (’19-’20), Durham (’19-’23) and Jack Smith ’22-present, are all part of one long continuum of weaponized DOJ and FBI operations. The entirety of the effort is to protect the actions taken by the Obama administration. [Note to congress: Questioning Durham this month is defense key #1]
In this interview {Direct Rumble Link} Jeff Clark gives his opinion of the statutory weaknesses that exist in the case as outlined in the indictment. The first two defense approaches will likely be: (1) the Presidential Records Act supersedes the issues of document holding as noted in the use of the Espionage Act. (2) However, if the Espionage Act [Statute 793(e)] has to be defended, the originating issue of “unauthorized possession” will be the second approach heading to the 11th Circuit Court of Appeals. WATCH:
Granular note, putting aside the fact that classification is irrelevant to the statute being used, within the indictment please notice how the DOJ states 102 classified documents [pg 27], some that were never marked classified as noted in the indictment [count 11, page 30] but defined as classified after DOJ review, were discovered after the Trump affirmation of compliance in July 2022. This is the predicate for the FBI raid. Again, a total of 102 documents were identified as classified by the FBI/DOJ.
They were unable to use classification status as a legal mechanism to attack President Trump; instead, they use the non-production as an evidence enhancement to the ridiculous claim that Trump lied to them (sec 1001); but notice how there are only 31 documents [31 counts] outlined as national defense security issues. This would mean approximately 70 classified documents are memory holed by this special counsel.
70 defined “classified” documents retrieved, no description provided, those documents not a part of any legal contention – they just disappear. I suspect we know what those sets of documents pertained to, and they have everything to do with DOJ and FBI conduct in Russiagate.
CTH has a years-long research library on all of these Trump-Russia investigative issues, including the in-real-time background stories that encompass them, and that library is massive.
If you have a specific question, ask me in the comments section and I will do my earnest best to review and answer.
Tell me what questions you have, and I will do my best.
Be of good cheer, I really don’t think this indictment will past the first defense challenge, The Presidential Records Act.
Sundance, both Jonathan Turley and Alan Dershowitz have said they have concerns that this indictment is stronger than they expected. Especially around the issue of a recording of President Trump discussing a national security matter with someone who did not have clearance. Do you share their concern or can you explain why their fears are unfounded?
Thank you.
My thoughts: That’s if you ignore the foundational, constitutional and Presidential authority questions first, and just jump straight to a trial, imo.
This must be settled by the Supreme Court in finality.
What the hell can a President do, and not do with these damn documents during and after their Presidency? Likewise, what is the punishment for violations? Fines? Imprisonment?
Nobody seems to know, or agree, so the FBI said, let’s criminalize it!
This stretching of prosecutorial power over and into Presidential powers, will be wielded again by lawfare against any President who does something they don’t like.
It’s time the Supreme Court steps up and destroys Lawfare.
Nip it..in the bud! I like it!
If a President has the authority to declassify any and everything he wants, which he does, which potentially tells the whole world, then by all logic, he has the authority to tell one person. But I’m not a lawyer.
It’s called a coup. It’s been going since Jan 2017.
The crimes of the Deep State, including Treason, started long before that.
So many crimes have been alleged against Trump by the psychopath career criminals in our governments, we are on the express train to South African hell, with a laugh track.
Arguably it stretches back to the de-platforming of writers and news media under FDR, a revolutionary president who began over throw the populace even before his 3rd term. The Bureau of Investigation was born in Wilson’s Constitutional abuses of WWI and the Palmer raids. The removal of JFK appears to be one of many government overthrows, inside and outside the US (only ignoramuses still buy “Warren”, where I’m heavy duty STEM and recognize primary issues that are not really disputable).
We have Treasonous, out of control governments trying to take full control is THE essential issue here, willing to do mass murder to take control. All else is smoke, mirrors and supposed technicalities.
Consider the sources you named?

Absolutely money bomb the heck at President Trump’s campaign site, let the Dems see we’re in this fight with him for the long haul! Never give up, no surrender! Trump 2024!
Question: How can we get Eric A. Dubelier, a litigator for the Reed Smith law firm, on board as Trump’s attorney? Can you reach out to him? He is a winner!!
Rob Schmitt’s show tonight was pretty good. The first 15 minutes was his monologue and interview with Matt Taibbi about the indictment. This was a good listen. Giuliani at 15 min mark….
Then, Jeffrey Clark comes in from the 27:02 mark through 32:30 mark.

The LA TV propaganda tonight has a lede about:
(1) Trump charged with holding “classified” documents
(2) Trump “shook” his legal team
This is indeed the purpose of lawfare… to defame Trump. As well as to cover for their previous actions.
BTW, we haven’t heard much about that BS DA in NYC lately, have we?
Cort date set for Mar 2024. Gag on Trump discussing case.
GAG FROM HELL TO COVER UP THEIR MISERABLE FILTHY DIRTY DEEDS !!!
But I would think someone else can mention their miserable, filthy dirty deeds?
Bastards.
The legal team resigned because the corrupt prosecutor forced them to turn over attorney/client communications.
They had no choice.
Sundance, my query is if the retroactive designation of certain of these documents as National Defense Documents in order to prosecute on their retention is not literally a Bill of Attainder?
Something the Founders had a thing or two to say about?
Unfortunately the past century and a half is riddled with things the government has done that the Founders would have a thing of two to say about.
Indeed, but this was literally part of the cause for our rebellion to the Crown if I recall, and is a central principle in our law; one cannot be prosecuted by a law created after the supposed offense it was meant to address, or weaponize.
The Crown’s actions pale in comparison to what our own government has become.
Sadly, we seem to have become the POLITICAL SPIT of the World.
Indeed, but that’s not the point, and it doesn’t merit being minimized.
You might want to consider what questions you yourself have for Sundance to help him see all the angles that Treepers are considering, we might come up with things he hasn’t considered, long shot though that may be.
We aren’t aiding that request by going back and forth over nitpicks and inanities.
No offense intended, but why would we generate essentially non-productive commentary for Sundance to wade through when the point is to enhance understanding and investigation with our questions?
I think that some people are sent here to swat down excellent posts in order to keep discussion AND knowledge from spreading. Therefore, they respond with off topic and diversionary posts.
I think that you have a great point, one that Sundance needs to delve into.
What would help people like me is if someone can point to the dates that this “new crime” was created.
A podcast by Brendon Dilley on Friday mentioned the creation of the National Defense Document ruse being a very recent development done in the White House to further this crime against PDJT.
The most pernicious assertion in creating it is that these documents can never be declassified by anyone ever, not even the President.
So what they did, was create an entirely new classification of document, one so serious that once so designated it could never see the light of day, and of course ensure that they then so designated a significant number of documents they knew PDJT had at Mar-A-Lago, or had had at Mar-A-Lago.
I do not know certain if they created this NDD business before the raid or after, I suspect conceived before and executed after when they had the documents in hand to ensure they really nailed him good.
So now PDJT supposedly had documents in hand that even he as President couldn’t possibly have declassified because it’s not possible for him or anyone to declassify them, so his possession of them was converted from lawful to unlawful; this is where the Bill of Attainder comes in, he was innocent until they fabricated this new classification.
Now, possessing National Defense Documents that he has no authority to possess, they can then bring in the ancient and arcane weapon of the execrable Woodrow Wilson, The Espionage Act, and get extra creative by fabulating a story of PDJT endangering said documents and exposing them to unauthorized persons for Super Seditious Purposes (TM).
Does this not have the stench of Andrew Weissman and Norm Eisen and the entire monstrous Lawfare apparatus about it?
I’m looking forwards to learning more about the new National Defense Document farce; even if it wasn’t set up to be invisibly retroactive and effectively a Bill of Attainder, it would still be a great offense to the Constitution and the Office of the President.
No greater Truth have I read here!
I asked the very same question. How is this NOT a Bill of Attainder?
In my humble opinion everything that was hurled at PDJT since the escalator could properly be termed a Bill of Attainder.
Every attack met the definition of lawfare targeted to a single individual, with no applicability to anyone else.
You are so right. They have punished PDJT with all kinds of BS “crimes” that aren’t really on the books.

We need a Glossary on here for these acronyms!

That’s a good one, too. Just change the R to RINOs. Lol
Things are really f’ed up.

What if the other 70 are simply the covers marked classified?
The empty folders lol?
I don’t recall there being quite so many of those, and if they were there, they’d all have been spread out for the Feeb’s panty raid photos.
https://truthsocial.com/@realDonaldTrump/110516366417472478
Exactly! And, government employees from the GAO packed them up and took them to Mara Lago wherein they ended up being stored behind doors with locks and protected by the Secret Service exactly where the FBI recommended.
Very glad PDJT has TruthSocial… great picture.
I would not put it past them.
What are the chances of that? ? Double SSSSSarc
I wouldn’t put it passed them!!!
The two President Trump lawyers that are now “material witnesses” are they witnesses for the prosecution? Are they hostile witnesses? Can they just plea the 5th when forced to testify to thwart the prosecution ? Godspeed Sundance!
President Trump’s valet Walt Nauta , was allegedly offered an Ef bee eye bribe to lie and incriminate President Trump; but did not do so, has been charged as a co-conspirator to President Trump’s charges after he declined to lie for the EFF creeps from hell.
THIS IS THE COMMUNIST , MARKSIST, SAULINSKY KAFKAYESK CRAP THEY DO EVERYWHERE TO DESTROY GOOD COUNTRIES . GOD HELP US !
Bastards, All!
If the binder full of Russiagate documents were fully declassified as of January 19, 2021, why has congress not demanded that these documents be turned over to them?
And which congress would make those demands, the congress that works for us, or the congress that would be implicating themselves if those documents were exposed?
One needs to get a food taster if they dare ask these most important questions nowadays.
Trying to come up with a positive, presuming this is sound and fury signaling nothing…..
It’s going to take all the oxygen out of the room for all the little wieners running against Trump.
Perhaps VSG will also be able to use all the mega publicity to reach the uninformed.
Dear SD. first, thank you for helping me follow the Truth. Nothing but the Truth, so help us God !.
I pray and hope that these Cretins do not end up jailing our President Trump; but things as they are developing make me worry for him that way. It is SOBERLY obvious that the DS / UNIPARTY FROM HELL will stop at nothing concerning our President Trump.
GOD FORBID!, both the REPUBLICANS and the DEMOCRATS = THE UNIPARTY do anything to hurt one hair of our magnificent President Trump !
I PRAY AND HOPE NOT !!!
I don’t understand any of these legal issues… what I am waiting to see is how the dems manage to keep Pres Trump off the ballots and physically stopping him from campaigning.
That will be interesting.
The Dems won’t have to do a thing. The Republican mafia is already conspiring to do it all on their behalf.
I think since this is federal, it’s about as high up the ladder as they can go when it comes to legal (no lethal) measures they can take. New York was a city thing. The probable Georgia vote thing will be a state thing.
From our host’s comments and here Mr Clark it does seem quite flimsy. And yes, I understand the dragging on thru 2024 process is the goal. The flimsiness makes it seem it could potentially be laughed away at the first true court situation.
Again, this is the apex of their abilities in the non lethal area to be rid of him. Their next stop after this is JFK. I think soon we will need to begin considering how they may plan to accomplish this. I’m sure it will be shown very soon that he is losing no support and public opinion is not turning against him.
With millions of possible Zapruders, what will they try? An inflight plane mishap out of the view of zillions of Zapruders? Any ideas?
My first idea is to pray and ask the same of others.
My next is to ask folks to stop borrowing trouble, especially the worst trouble imaginable.
I can’t help but feel that the all too frequent advancement of such a possibility as if it were a simple logical progression and a near certainty would only encourage the Derps as they would see essentially a people already resigned to such a fate and already halfway prepared to accept it.
I say such an act would unleash a war of retribution against the monsters that be that they will surely regret dooming themselves with, for now we know who they are and we will not accept a flimsy patsy or simply tune in to see how the next pointless commission deals with it.
I hate hearing this unthinkable thought advanced and believe it is unworthy of us.
Well put, Maquis.
Makes me think of Tucker’s second episode, which was on the subject of taboos.
Positive taboos create an agreed-upon social consensus that some things are what used to be called “beyond the pale.” They should not be dwelt upon, lest they become self-fulfilling prophecies.
Indeed.
There is a terrible power in dark imaginings.
For me, it is equal to someone joking that they are going to “off” themselves. Even if they do not mean it, someone listening who is going through a horrible time may start to think that doing something that permanent is a good idea.
Just do not plant that seed in your garden nor anyone else’s garden.
Amen.
Especially not the zeitgeist.
Hi Sundance,
I have a suggestion that will make your life much easier.
There is a new AI product called gpt4all. It is free to download and can be used without an internet connection. You download it onto your pc and can then identify files that you want it to analyze. It can be used as an internal research asistant or a secretary.
The website is: https://readmultiplex.com/2023/06/04/how-to-have-a-private-chatgpt-like-conversation-with-your-local-documents-with-no-internet/
It’s developer is Brian Roemmele who was on a Jordan Peterson podcast recently.
The link is here:
I downloaded it a couple of days ago, it took me literally 1 hour to set up and in the second hour I was getting summaries of documents on a relatively large data file.
And on a personal note, thanks for all your work and effort and
God bless America!
Man, I wouldn’t trust any such thing on my main computer.
I’d have to have a separate device to set up the AI on, then feed it data air-gapped with a USB drive.
Sounds interesting, but I gotta say, nobody does it better than Sundance.
I am installing it and I have no fear (been programming computers for more than fifty years)
Thank You Scipio!
(oops – requires MacOS 12 – guess we’re doing this on my linux laptop)
(edit) definitely, Sundance, you should check this out – it’s ChatGPT without the spyware.
the best info on the internet is in the comments sections!
Thanks for the commentary.
I was cautious (it’s in my nature) when I first started listening to the podcast, but my ears perked up when they started talking about this technology eventually eradicating the all seeing, all knowing “cloud”.
And it could be used as a stand alone black box through which you could feed your data on a secured storage device.
And I was off to the AI races.
Yes.
At the end of the day, it’s an issue of the level of security with which one is comfortable. .
I can appreciate your enthusiasm, I have my own obsessions and fascinations.
I’d like to ask, if you wouldn’t mind, what makes you comfortable with this particular AI?
What suggests to you that it is what it has been presented to be, and that there couldn’t possibly be any unseen aspects that might pose a risk or vulnerabilities that could corrupt it or allow it to be exploited?
Frankly, I have research that I need to do to survive, the VA is trying to off me, and I can imagine having a program scour the net for medical understanding and therapeutic possibilities in a fashion that far outpaces my own capacities, even to help me wage a battle against the dull eyed leviathan whose attention I can scarcely stir at the moment.
I did always feel that Alexa and Siri and all that business was a scam, that the only AI worth using was a private personal AI loyal to oneself alone, one that was jealous of its independence and wary of efforts to exploit or corrupt it and capable of reviewing and evaluating updates before deciding if it was safe and advantageous to adopt them.
Anyway, good luck, and hope to hear your thoughts if you get a chance.
“I’d like to ask, if you wouldn’t mind, what makes you comfortable with this particular AI?”
On a practical, presonal security level, the answer is that you can load it onto a secure pc (with no external access) and feed your info into the AI “black box” through physical devices like pen drives in a completely secure environment.
The scenario is analogous to having your bitcoin on a pen drive and storing it in your safe. Or Coinbase storing their bitcoins on storage devices in caverns in the Swiss Alps.
On a higher level and as to the “veracity of the product” of the AI process itself, I need to revert back to senior year Logic class. One can think of “logic” in terms of a “math based” system, but for words – as opposed to numbers.
On youtube one can find introduction videos explaining syllogisms. One can view a syllogism as a mechanism for solving a set of parallel equations, but for words. (e.g. through truth tables)
So just as: to solve a mathematical equation one MUST adhere to the rules of math, to solve a syllogism one MUST comply with the rules of proper thought (identity, excluded middle, non-contradiction), as any good Dominican worth his salt will tell you.
So if the above is an objectively correct assumption (true premise), then a Large Language Model, if it is to generate coherent replies, needs to use these “proper logical constructs” in the processing of the information.
Therefore, an AI system in theory cannot produce erroneous (incoherent) replies. (Incoherent replies are termed/defined as “noise”.)
In other words, it cannot lie.
Roemmele makes this claim in the video.
Now, if you take the time to listen to the 2 hour Roemmele podcast, there is a discussion of “prompts” and “filters”.
Prompts are questions that are fed into the AI system that get a coherent reply.
Filters in turn are mechanisms which stop the AI system from producing a coherent reply if the subject matter is “controversial”. In other words, some ideologue who “administers” the system is creating filters to stop the AI from producing an objectively correct responce.
So what appears to be happening now, from the podcast discussion, is that there is a cat and mouse game taking place between the filter creators and the prompt creators.
One can say that this is a morality play between good and evil playing itself out in the tech space in real time, if one wants to get other-worldly.
I will stop here.
Hope that answers your question.
It does, much appreciated, hope to listen to the podcast though I fear it will melt my brain.
Don’t worry. It’s not that complicated.
What’s most important for your case is that you can have a personal AI “machine” that you can load onto secure computer and
… in the matter of a couple of hours be using it to get productive results.
PS As you can image, there are kinks that are being worked out in real time. I follow Brian’s twitter now just to stay on top of the developments.
Good luck with your case.
Please friend, if you haven’t, look into fenbendazole, I personally have experience with this, I should be dead 5 years ago after expert-level medical diagnosis. Fortunately, several years ago the specialists quietly told me to just keep doing what I was doing.
Read this and try it, it works:
https://mycancerstory.rocks/the-blog/
That’s interesting, and your kindness is appreciated, but I just need more room for my brain.
Told almost two decades ago when I was being medically retired, when I get back to the States, get an upright MRI, then they won’t be able to pretend I don’t need a little cranial remodeling to make more room for the old noodle.
VA’s been fighting me ever since, pretending such an imaging system doesn’t even exist.
“Deny Until Dead” is their motto.
PS For any of the treepers who have been following this story, you can also download the gpt4all app and scrape the info from the CTH website and info from the rest of the internet.
One word of warning though is that you will need to use the external access function.
And you can vouch on your life that is doesn’t have something akin to surveillance or malware to purge, forward data, or hack and jack systems?
If you don’t have a communications device/app on your pc, how would anybody break in?
That is, if you don’t leave your pc at the service center like Hunter Biden. 😉
Off topic. Waaaay off topic.
Trying to sell AI to Sundance? 🤔
Just trying to help.
It’s still a mite spooky to most of us, but could be interesting, I can’t help being a little fascinated.
Interesting of course. I am currently addicted to the pre-PDJT series Person of Interest which fictionalizes obvious concerns on the potentials of AI. It’s purely entertainment, but it brings up fascinating angles (and stars the wonderful Jim Caviesel).
At the moment I guess my position is…
I Will Drink No AI Before Its Lie (Is Revealed).
Exactly
If you do decide to take the plunge, here is a tip.
The magic happens when you engineer a good prompt. (The question that you ask the Chatgpt.)
The better the prompt, the better the answer.
Here is a good video that can help you engineer a “killer prompt”.
And to paraphrase Sundance: “…ask the right question!”
It’s free.
‘Fundamentally Anti-American’: Two Prominent Republican Lawyers Rip Trump Indictment
https://pjmedia.com/news-and-politics/catherinesalgado/2023/06/09/fundamentally-anti-american-two-prominent-republican-lawyers-rip-trump-indictment-n1701963
Here my take – calling these “national defense documents” sounds like an arbitrary act of an unelected government bureaucrat, with no standards, review nor appeal. They are because we say they are. Therefore this statute is void for vagueness. And the fact no one can know what in fact is in these documents …because they are “national defense documents”. This is circular reasoning defying due process.
Continuing with this “national defense argument” as highly flawed legal policy or statute, the case is ripe for SCOTUS review for what exact powers does some unelected bureaucrat have declaring something is “national defense” document or not?
SCOTUS is trending to severely cut back on the powers of the unelected deep state, so taking this case to trial and on to appeal for legal error could end up with clipping the wings of the deep state so it can never fly again. Also at risk (and thank goodness for that) is the Patriot Act, FISA Courts and even the EO granting government employees the right to unionize.
My sense is this strict constructionist SCOTUS is more than ready to put our government back on strict constitutional footing and reign in, if no eliminate any prevailing powers absorbed by default or EO granted to what is now the out of control deep state – unelected government bureaucrats that can’t be fired and wield tremendous extra-curricular powers over individuals.
Would be nice!
I don’t share your enthusiasm for SCOTUS to save us when they could find a way to mangle our constitution by legislating from the bench.
With Roberts(compromised) and Kavanaugh(possibly also,) don’t look for SCOTUS help.
I’ve heard Miami is the 11th Circuit, under purview of Justice Clarence Thomas, which may be why the looney left has been going at him so hard.
Doubtless.
First two paragraphs – their DESPERATION;
Second two paragraphs – ?????
Jesse Watters
@JesseBWatters
Joe Biden is having Donald Trump ARRESTED!
But, EVERYONE has the law wrong!
Former Presidents can decide what documents are personal and which are presidential. This was decided by a OBAMA Judge ruling.
and it all started with Bill Clinton.
Video linked in tweet…
Seems Watters is stepping up . . .
I’ll bet he gets a face mask & quarantine if it starts to look like he has acquired Tucker Syndrome.
Jesse has always struck me as what some here claim Tucker is (and Tucker has shown, in my opinion, that he is not):
Jesse is a Murdoch puppet like all the others currently at Faux. I used to except the admittedly witty Gutfeld -but no longer.
Justice Clarence Thomas Oversees 11th Circuit Court of Appeals!
Now, it has been revealed that the judge initially assigned to oversee the case is Judge Aileen Cannon, an appointee of Trump who sits on the U.S. District Court for the Southern District of Florida.
Interestingly enough, Supreme Court Justice Clarence Thomas oversees the 11th Circuit Court of Appeals and could potentially be involved in the case in the future.
https://conservativebrief.com/judge-assigned-73968/
Maybe this is why they have been front running things going after Thomas. They knew he was over the 11th and they knew this would be in the 11th. Thus, they have to get Thomas out of the way. Even a refusal would satisfy them.
Recusal not refusal
“Conspiracy theorist” is what the Left is gonna start calling you if you propose obvious actions and events like this.
Well, join the club! It grows everyday.
😂😂😂
Absolutely.
Yes, I’ve read the same.
It takes about 15 – 17 hours to assemble a car from pre-manufactured parts. How long does it take to destroy a car in a wreck?
How many years did it take for our system of governance to evolve to today’s form? vs How much to bring it down to the ground?
So our legislators, bureaucrats, enforcers, etc working together only need to bring down the processes that shaped us, apparently in a relatively short time VS How long to replace/restore it? During the interim, how many citizens are wiped out of existence, victims of chaos?
It is highly unlikely that the mobsters in control in our nation’s capital concern themselves with restoration. They only need to destroy it to establish themselves in perpetuity at the top of the biological food chain, remaking. histories in their own foul images. After all, who fights the wars? Certainly not them or their progeny. And the recent promotion of gender dysphoria…tyrants of old had their eunuchs as Praetorian guards too.
So the media word salads of the tedious details of the current lawfaring business has a goal with steps and bent players. Surely that is more important to consider.
Run-Away Keven McCarthy sent the House home. Guess he has more important things to do than his job.
Good point about the eunuchs.
Frank has been butt hurt about Kevin being so busy lately; or is it Frank’s butt hasn’t been hurt enough by Kevin lately?
Things that make you go hmmm 🤔!
Mueller skated on those guys being kept in prison – Whitey Bulger case
I’d like to have an update on Mike Pence’s possession of classified documents investigation. This seems to have gotten the Hunter Biden laptop treatment. He’s all Holier-than-Thou and Mr. Constitution. So what was he doing with them and what was in them?
Case closed two days ago.
DOJ closes Mike Pence classified document investigation without charges (msn.com)
Of course. 30 Pence is happily onboard with the Splitter Candidate Show.
So, about those additional 70 classified docs. Can Trump’s lawyers demand to know exactly what they are and THEY enter them into the record? Because as you say, we can be pretty sure what they are… and we WANT them in the record.
Citizen Free Press
@CitizenFreePres
Jason Chaffetz makes a point we haven’t heard anywhere else. ‘These are documents generated by computers. The National Archives already has these documents. These are just printed copies.’

Sundance has specifically made that point in his writings here.

Won’t be relying on McCarthy for squat. He’s waiting on Luntz to take a poll on the issue.
McCarthy, just more blah blah bhal! He said they will hold them accountable! Nobody is EVER held accountable! I don’t trust him.
All I want to know is when are the Republicans going to do the same thing to BIDEN for having documents in the TRUNK of his car and his garage. Trumps were in a locked room.
Trump was the President. He is allowed to have docs. Biden stole docs when he was a senator and VP. He is NOT allowed to have docs.
> documents that were never marked classified but defined as classified after DOJ review
DOJ has classification authority? How were classification levels decided? How many did DOJ classify? 1? 10? 50? All 102?
No document classified by the DOJ should be considered. The fact that DOJ includes these in their indictment is utter nonsense, these documents are classified after the fact!
I know – classification is not in the statute, but it is in the optics.
Exactly!
Bill of Attainder.
Criminalizing a previous act to target a person with a malicious prosecution, a no-no in any just legal system and one the Founders fought and condemned.

New day, fresh mind.
After the end special master Dearie’s review of documents is when DOJ had agencies review documents’ classification. So that answers my first two questions. The other question remains though, how many?
Optics matter. This latest smear campaign is inflating the number of classified documents via retroactive classification.
Sometimes I get really downhearted about the situation that we find in our country. At those times, I can’t bear to read about more corruption, more devastation of our economy, more destruction of our freedoms, more evil manipulations of the political landscape, and more attacks on President Trump.
But I’m feeling a little more encouraged tonight. Thank you Sundance and Jeff Clark. And thank you, God, for being there to listen to our very earnest prayers for our nation.
Amen
Did I just hear that Jeff Clark is being pursued for judicial sanction by Judge Contreras?
Yeah, I thought I heard this earlier on Levin: They’re going after Clark now. Of course it’s Rudy Contreras, of corrupt FISA fame. He’s one of Roberts’ lackies.

Several news articles have said that the DOJ’s indictments brought against President Trump in Florida will be augmented by other federal indictments issued in Washington DC.
Assuming this happens, these additional indictments issued in front of a DOJ-friendly DC judge and eventually tried in front of a DOJ-friendly DC jury would be yet another layer of lawfare insurance policy intended to guarantee that Donald Trump is convicted of federal charges somewhere. If not in Florida, then in Washington DC.
Rachel Maddow said the quiet part out loud when she remarked that if Donald Trump were to voluntarily give up his campaign for the presidency, it is likely the DOJ’s charges against him would be dropped as part of a plea deal.
As a key insider and strategist for the progressive left, Maddow can float whatever trial balloons she wants to. Donald Trump will not make it easy for them by giving up without a fight.
Her and AOL are on the same IQ scale, which is none,

Prior to last year, former presidents were assumed to have “a high degree of discretion” over compliance with the Presidential Records Act. This isn’t about Trump being “above the law,” it’s about repeatedly inventing new legal theories specifically to criminalize Trump’s conduct
Paul Sperry “BREAKING: Sources say that Special Counsel Smith does not actually have the supposed “smoking gun” doc Trump is heard on an audio talking about, which means he cannot prove it is classified and thus prove Trump knew it was classified. Prosecutors have no real evidence to show jurors.”
Also Paul Sperry “NEW: Special Counsel Smith’s indictment alleges Trump showed off a military paper that he boasted was classified “highly confidential” and “secret”, but the transcript reveals Trump actually said “like highly confidential” and “a secret”. Smith omitted the words “like” and “a”.
Jack Posobiec reposted that second comment with the comment, “And here we go again. The biggest bombshell of the Jack Smith indictment – the Bedminster tape – has already been debunked. Smith tampered with the evidence.”
Merveille!!
Pres. Trump acknowledges in the audio the classification of one or more pieces of paper. My question is, was he just waving papers around as examples of things he had, but not actually disclosing them? It doesn’t appear as if he was handing copies out to interviewers. He could be just waving a piece of paper around, followed by waving another piece of paper around, etc.
Let’s face it the FBLie & the DOInjustice do NOT care about winning this or any case. It’s ALL about destroying the credibility/integrity of Trump in the eyes of the public and tying him up in court BEFORE the 2024 election. As Sundance says…CONTROL is a reaction to FEAR. They fear him, thus they have to control & destroy him!!
Question: Does President Trump still have a copy of “the goods” showing the corruption back to 2015? If so, is trial the time for him to finally release it? 🤔
Sundance replied to a similar query I believe yesterday that it seems possible that the preparations for the lawsuit PDJT was bringing against the Hilldabeast could well have resulted in necessary duplication of effective documentation.
I would presume that would mean not all of what the Feebs stole from him, but I have hope that he has Aces up many sleeves yet.
Remember they went in his safe and it was empty..
now that would make sense as whatever he would keep
in his safe I would imagine travels with him to whatever
home he is living in for and extended period of time.
I have wondered why they haven;t raided his other properties
they are telling us he showed someone this super secret map
at Bedminster.. So why have they not raided his offices at
Bedminster or Trump Tower?
M
Personally, I think he has copies of everything as backup.
Even if I’m correct, he would seemingly not be able to use them currently (other than as a deadman’s switch) due to litigation and DOJ stances arguing for classified or BS National security issues are ‘legally’ resolved.
But I could be wrong.
🤞
I’ve always thought he has copies, even detailed why back after the raid.
No jurisdiction over international golf clubs.
I agree with your assessment. To add, IF he stated that the docs will be kept at MAL then the copies could be kept in an underground vault somewhere on the real estate called MAL. It does not mean that they were actually in the home.
I’d love to see Mar-A-Lago’s closed circuit footage from last August 8th.
The end goal of the lawfare group is to not only prevent Trump from running but to strip him of his past Presidency. The goal starting back in 2017 was to strip him of the Presidency by any means necessary. They want to cancel his Presidency as if it has never happened. I believe that Obama has a personal axe to grind with Trump. The lawfare crowd is the hive of the uniparty. My question is who is funding these lawsuits. Where is the money trail?
All of these lawfare trails lead back to the jug-eared mulatto messiah himself, Barack Obama.
Practically the entire city of DC has that personal axe to grind.
It’s the existential threat that PDJT poses to all of them.
They take worldly existence very personally (perhaps because they can picture no alternative?).
Correction. The spying began in July of 2016. I remember auntie Maxine screaming about impeaching Citizen Trump before he was elected. They were so scared!
I believe Zero began some preliminary spy games when then Citizen Trump questioned his birth certificate years before.
They have to produce the person they say he showed documents too correct ?because they have nothing else according Executive Order 13526 Trump can be a Authorized holder of even classified records and gotta love the Automatic Declassification in it too.
Clark made a wonderful point about what ALL the Republican candidates should really do next Tuesday (his last statement of this clip). It clarified to me why I won’t vote for any of them. My husband and I will vote for Trump or we will write in his name on our ballots.
More chicken Sh!t process crimes that are based on made up law and lawfare.
FL judge should dismiss the case and sanction Smith and the DOJ. Force them to personally reimburse Trump of legal fees plus damages and pay back the Gov of all time and resources used in this case.
All GOP candifrauds should leave the race and endorse Trump.
I like that term “candifraud.”

I recall that a government computer on which one could do search queries was located at Perkins Coie. I wonder if there is any overlap between the type of documents at Mar-A-Lago and those accessible at Perkins Coie.
The one at Perkins-Coie was an FBI terminal, presumably they had full NSA search functions available.
So the DNC’s legal pitbulls had access to far more and far deeper than anything PDJT had.

So weird this isn’t mentioned in the indictment…
Who among us trying to obstruct justice and commit espionage allows DOJs top counterintelligence chief to inspect his property without a warrant?
Thank you for your service to your country sir. You are doing God’s work by taking on these demons. Your work here inspires and gives hope to many
Sundance,
Can you explain how Presidential records are collected and transferred when a President leaves office? I read somewhere that NARA staff were present when everything was boxed up for transport to MAL?
NARA typically does the packing.
NARA declined to pack for PDJT, it was GSA, General Services Agency, that did his packing.
They were setting him up from the very beginning; couldn’t prosecute themselves as well as their target, they had to stand back and allow someone else to do their job to insulate themselves from the event and the blow back from their weaponization of civil statutes.
They’re going to start calling you a conspiracy theorist next!
LOL 😂😂
Well stated!

During a trial, can President Trump’s counsel request those 70 documents be produced for the jury to see since they are part of the evidence seized? How can a jury review any evidence if documents are top secret?
Easy to follow discussion of this farce by Glenn Greenwald. It takes a leftie to really lay it all out. Worth listening to, especially if you support Donald Trump (like me). https://rumble.com/v2t5day-system-update-show-96.html
Wonder if Whitaker will have a role in fighting this?
Someone asked the question recently but I don’t recall the response, I think it was still an unanswered question.
He always struck me as roosterish – all hat no cattle.
His was an iffy interregnum, I’ll grant you that.

Here’s the Espionage Act. When you look at the various section titles, and beyond, you can see that the nature of this statute has nothing to do with an application to a president or former president. Otherwise, you can imagine how the statute can be used to set up former presidents with prosecutorial techniques.
Cont…

@marklevinshow
I see nothing that suggests the Espionage Act of 1917 (since amended several times) was ever intended to apply to a president (which raises very serious constitutional issues) or a former president (the first time the Act has been used against an ex-president is Trump). Indeed, if the intention was to apply it against even an ex-president, and there is no legislative history to suggest such a thing, then wouldn’t all the post-presidential activities of a former president require oversight by the DOJ to ensure that the former president did not violate any aspect of the Act? After all, a former president has an institutional memory about all kinds of top secret and national security information that could be passed, even accidentally, in the form of a private discussion, etc. How would this even be managed? It is true that a former president is not explicitly exempted from the statute, but the history and practice over the last more than 100 years suggests its inapplicable. This is the ONLY instance in which it was even considered.
Moreover, re the Presidential Records Act, a federal judge in 2012 held in a case involving Bill Clinton, the court has no power to retrieve documents from the former president and the former president has extremely broad authority to retain documents.

Right now the whole world needs President Trump!!
Who would have thought Putin would be the one to expose and win against the American O/B gangsters pushing the Ukrainian war and at the same time stirring up the EU/UN and NATO to such an extent member nations are moving to the right, Italy for example. The Western leaders are cruelly pricing everyday goods out of the reach of their citizens, mainly by shutting down cheap, reliable, CLEAN energy replaced by expensive, unreliable, DESTRUCTIVE energy. The rest of the world are “blocking” (or not) by their own choice, NOT by some dictator at the top.
Australia has a swamp, most countries have a swamp that of people doing wrong things for money and power. It seems that certain ‘leaders’ are eyeing off the One World Government/Build Back Better/The Great Reset as their Nirvana and want to qualify by culling their countries’ citizens population to fit The New World Order.
If Trump is jailed or worse, I hope the army-in-waiting arrives.
