In the BIG PICTURE a local New York City District Attorney has created a criminal case, structured on a federal crime, that the federal government has stated was not a crime. This is the Rubicon that has been crossed by Manhattan District Attorney Alvin Bragg. In essence this is extreme Lawfare in action.
In response to the jurisdictional issue; in addition to the substantive political construct of the case; the largest mechanism within congress, the House Judiciary Committee has subpoenaed officials from the District Attorney’s office to answer questions about the construct of the case. A return-fire lawfare response.
In reaction to the federal response and inquiry, DA Alvin Bragg filed a lawsuit against the House Judiciary Committee [Filing Review HERE]. District Attorney Bragg also asked for intervention against the subpoena, an injunction against the authority of the House oversight, that was immediately DENIED by the court. Alvin Bragg really doesn’t want the House to investigate his case.

The House has no power to bring charges against anyone. All they can do is write a report and submit it to the DOJ for possible prosecution. The DOJ will do nothing. End of story.
Actually…I remember Pelosi stood up a new Capitol Police force based in multiple cities around the nation in 2021 or 2022. That reported to her. And the Capitol has its own jail. If McCarthy was so inclined he could send his NYC-based Capitol Police team out to grab Bragg and haul him down to DC, throw him in the Capitol jail and give him the same treatment J6’ers have had. I can’t argue with any of her anti Trump assertions, but in her new fandom for DeSantis, I commented on her substack that she is likely to be let down by him as she was let down by Christie, Romney and Trump and that Trump is the only candidate who has any chance of rebuilding the domestic economy and putting his foot down on foreign policy, mostly in the economic realm.

Fair enough. Zero out EPA (and the other 3 letter agencies) so that environmental laws get passed by Congress, not implemented as regulations from an agency. Perhaps propose a law that says every health care facility, from corner clinic to the largest hospital, be disconnected from the electrical grid and tied into 100% renewables. It would be fun to watch liberals say that health care is too important to be reliant upon unreliable renewables.
Perhaps propose a law that every single round of ammunition that Obama bought for federal agencies be seized and distributed to NRA chapters nationwide, to be used as they see fit, either for gun safety and training purposes or simply handed out free of charge (its already been paid for) to NRA members, AND, going forward, federal agents are responsible for buying their own guns and ammunition, body armor, vehicles and gas. Federal law enforcement would be bereft of employees while malls would be crawling with mall cops; no more looting!
It would be fun to watch unarmed IRS agents walk up to a heavily armed NRA member’s house on the basis of the child resident not paying taxes on her tips at the local pizzeria or her babysitting job.
Perhaps gun owners could make a habit of digging grave sized holes in their front yards to welcome federal agents to the property, perhaps a law requiring federal agents to dig said holes upon their arrival on site.
So many opportunities for national renewal if the GOP holds out for what their voters want.

Noting: State attorney generals have extraordinary powers. Make sure your state AG is fulfilling their duties to represent the law and your interests. Likewise your state assemblies should be on your speed dial/contacts.
Voting is the least powerful thing a voter can do. Once every four years is a long time waiting for someone else to put in the work. The other 1450 days is what matters…what you do to get involved… personally.

Jim Jordan really needs to pull out the big constitutional stick that is going to be needed to stop this weaponization against Trump: the Article IV section 4 guarantee to the states that they each shall have a republican form of government.
SCOTUS totally bolluxed the republican guarantee by claiming that they couldn’t figure out what “republicanism” is, maintaining this position even after they had embraced Alexander Hamilton’s definition of republicanism in their adjudication of the First Amendment and elsewhere.
Hamilton at the New York constitutional debates: “The true principle of a republic is, that the people should choose whom they please to govern them. Representation is imperfect in proportion as the current of popular favor is checked.” (Cited by the Supreme Court in Powell v. McCormack, 395 U. S. 486, 541 (1973), and in U. S. Term Limits v. Thornton, 514 U. S. 779, 795 (1995)).
For the people to be able to choose who shall govern them, the first two requirements are:
1) that elections must be honest and cannot be stolen by such mechanisms such as ballot box stuffing (2000 Mules), phony ballot counting (Dominion), or by refusing to deliver ballots to one side (Maricopa 2022), and
2) that the powers of government cannot be weaponized to suppress political opponents.
It would have been relatively simple to use the guarantee clause to overturn the stolen presidential election in 2020. Yes, the Court would need to be convinced that we know what “republicanism” means (or at least one thing that it means), but that’s already in precedent (outside of guarantee clause law) and with a majority conservative Court, it should have been well within reach.
We missed that chance (I have never had success in getting people to listen to me). Still, the honest-elections half of the republican guarantee is the simple part to pursue because all elections, federal and state, are run by the states. Thus the fact that the guarantee clause promises each state that it shall have a republican form of government automatically reaches all elections, federal as well as state.
If a state runs dishonest elections, those are unrepublican elections, making the government that runs them unrepublican. And notice who enforces the republican guarantee: “The United States.” That means all three arms of the federal government have their own independent power and responsibility to enforce the guarantee.
As the full clause makes clear, the anticipated remedy was war (the guarantee to each state that it shall have a republican form of government is joined at the hip with a promise to protect the states from invasion), and so the Court assumed that responsibility for enforcement would usually fall to “the warfighting branches” (another reason why the Court shied away from trying to enforce the clause itself).
As I tried to tell Trump at the time (fail, sigh), he did not need to wait on any court to be able to take whatever action was necessary to nullify the unrepublican stolen elections in several states. What he was hoping at the end that Pence would do, he could have done far more thoroughly himself in mid-November. The Democrats would sue and after that the Court would have had to decide whether Trump got it right. (My pitch to Trump at my link.)
Or he could have presented the Court with a guarantee clause suit against the stolen elections and let them rule first. Either way, the guarantee clause clearly applies, because a seriously dishonest election constitutes an unrepublican form of state government.
The non-weaponization half of the republican guarantee is trickier. It is only straightforward if the weaponization is by state government against its own within-state political opposition. That is not what we are facing today.
Instead there is weaponization of state governments by Democrat state and local politicians (in New York and Georgia), against the leading federal candidate of the Republicans, and weaponization of the federal government (using yet another special prosecutor) against the same Republican candidate, our beloved Donald J. Trump.
Both of these categories of weaponization against political opponents are arguably not covered by the guarantee clause. On the other hand, the arguably ARE covered, and that is an argument that very much needs to be placed before the Supreme Court and won.
It is not enough just to stop the states from rigging elections. That’s huge and we need to do that, but we also have to be able to stop weaponization by the federal government, and the only legal tool that has the power to do that is the guarantee clause.
It has special power because it is the only guarantee in the Constitution. In order for that guarantee to be a guarantee (as it guarantees), it must trump any and every other provision that it may at any point come in conflict with, and that is as it should be.
If we lose our republican form of government we have already lost everything. Logically, the tree of liberty must come first, and that’s how protection for republicanism was framed by the founders. As the only guarantee, it must come first.
That makes it a Sword Excalibur. It is not just every competing constitutional provision that must be set aside to uphold the guarantee, it is every law, every regulation, every legal norm.
SCOTUS does net tell the country what legal case it needs to present to the Court to win on a particular issue? That would be assuming an improper activist role? By norms yes, but that is exactly what they should have done in 2020, and it is what I think they would have done if they understood the guarantee clause themselves.
They would have written the winning legal briefs themselves and handed them to Trump. That was the only way to keep our republic from being usurped, and they are charged by the guarantee clause with guaranteeing that that did not happen. They failed that guarantee, we all did, and now we are in the much more difficult position of trying to get it back.
So we need to put the guarantee clause in play, belated as it will be. How to do it?
One way is to go for the whole enchilada via a kind of “reverse incorporation” (interpreting a provision of the Constitution that is worded to apply to the states so that it also applies to the federal government). With the guarantee clause, this approach is very propitious, because the wording of the clause actually seems to require that it be interpreted as applying to all levels of government.
Since each state falls not just under its own state government but also under the federal government, the guarantee that a state shall have a republicanism form of government is violated if either one of those forms of government is unrepublican. It’s right there in the words:
“The United States shall guarantee to every State in this Union a Republican Form of Government.” If any part of the state government is unrepublican, then the government that the state is under is unrepublican, and if any part of the federal government is unrepublican, the government that the state is under is unrepublican.
There can’t be any election stealing anywhere, and there can’t be any weaponization of the powers of government against political opponents anywhere.
This is a completely logical and compelling and even necessary reading of the words that are already there, it’s just that the Supreme Court, pouring over its magnifying glasses, has never gotten within a thousand yards of this issue before, so it’s all new territory, but it should be winnable.
Then there is the usual approach, where cases are presented that only ask the Court to follow a line of constitutional interpretation one step at a time. First get the Court to recognize that yes, it does know what the first requirements of republicanism are, in a case that purely applies state elections for state officers. Then get it to expand this to state elections for federal officers. Then expand the clause to cover weaponization of state powers against intra-state political opponents.
Then maybe there is an interim step that could be argued: that Bragg’s weaponization state powers to suppress the opposition party’s national candidates violates the republican guarantee by depriving New York State voters of their right to vote for the national candidate of their choice. Once that argument is made, go on to make the case for “reverse incorporation.”
Given the lateness of the date, it is unavoidable that much if not all of the usual incrementalism will have to be rolled into one case. The individual steps that all logically follow one after the other will have to be laid out for the Court to accept all at once, because we have gotten to the last minute with the most important provision in the entire Constitution in a state of complete desuetude. It’s the damned Court’s fault. It should have been blocking insecure voting systems for 200 years on the grounds that they undermine the guarantee of a republican form of government.
This is one of those “we have to stop the terrorist every time while they only have succeed once” things. Once we have been usurped (as we have been), we only have a long-shot of getting our republican form of government back. That’s why we needed the Court to be vigilant all those years, when instead it was not paying any attention at all. Confront them with that and they might feel some compunction to rectify their long history of tragically costly blundering.
Not abiding by incrementalism would be a huge step for the Court, but that is where the top priority nature of the republican guarantee being a guarantee comes in. It must take priority over every other constitutional provision, so of course it takes instant and total priority over mere norms like judicial incrementalism.
At this point, any opportunity to put the guarantee clause into play is a desperately needed opportunity. So it’s not the simplest case. We will have to get the Court to recognize weaponization as a violation of republicanism in a case that is not entirely at the state level.
That’s fine. A three-point instead of a two-point shot. We’ll take it. We just need to start scoring.

What about disbarment? What about filing a criminal complaint against him for abuse of office, perjury? Stop talking and do something that puts them back on their heels. All the republicans do is play a weak defense.
generally speaking a prosecutor can be charged with misconduct. I use this term liberally. A judge can rule on it independently for a variety of blatant rules violations. Color of law abuses included. Delimiting grand juries to exculpatory evidence in order to achieve an indictment for instance. willful failure to proceed with a timely speedy “trial”. leaking grand jury material to the press to influence the trial in the media. These are things that a judge can do without a motion from the defendant.
Absent that independent action, the defendant can file those motions..on the same arguments…with evidence. The judge MUST rule on those motions.
there are other prosecutorial misconduct violations that can actually rise to criminal.
for instance, fabricating evidence. Willful destruction of evidence. Committing perjury before the court. Willful filing of false court documents. conspiring to defraud the court.
at the lower end of the violations…where potential penalties are censur, recusal from office or a case, expelled from the court for a period of time, disbarment, monetary fines and penalties….these occur on matters involving: bringing frivolous indictments..(no specific underlying criminal violation!). engaging in blatant political abuse of office (DA office is a particularly powerful position so the bar is held high for integrity). repeated filing of baseless and poorly constructed motions before the court. Pressuring or influencing jury members in an unethical way. publicly alleging criminal acts of a defendant but failing to actually bring charges/indictments to those alleged acts. Stacking charges….stretching the extreme limits of interpretations and then breaking away from the norms and customs of reasonable prosecution. (i.e, If I drive 10 miles over the limit and 1,000 people paid 100 dollars fine and it’s a speeding ticket…it would not be fair or regular that I receive a 500 dollar fine, a criminal felony violations and my license suspended. So “stacking charges is a type of prosecutorial misconduct..and a judge can find the prosecutor held liable personally for this kind of lawless contempt for the common practice.
beyond that…as with the latest news that president Trump has sued cohen for 500 Million…apparently on the basis claim that cohen violated his signed contract: an NDA ..and also caused harm through his mismanagement as Trump’s lawyer AND that he has slandered President Trump and caused a false claim that has aborted into a very real criminal violation indictment. So too can President Trump sue the state of NYC (I am not sure he can sue Bragg directly..I’ll have to research on that). The key is that the case must be dismissed FOR CAUSE. Meaning, the case is meritless. Has no basis…something very fundamentally wrong about how the case is constructed. I believe that the case presents no underlying crime is that error…and from that alone, this case will be dismissed…before the trial even begins …as it should.
then President Trump can sue the hell out of the DA’s office…and maybe…just maybe that causes these reprobates to lose their jobs. It would also be important going into three other cases pending. It would hopefully force those other prosecutors to think hard and long if they are willing to risk getting exposed with a lawsuit about their abuse of law and inadequacy to be in such important positions.
