Some, generally those who recognize a historic context within the moment of its manifest, will say that President Donald Trump carries an anointing – a protection that keeps harm from his purpose.
Others, mainly those who pontificate punditry while exclaiming, “the beginning of the end” and “the walls are closing in”, will likely gnash their horrible teeth and declare the bad man Trump is coated in Teflon. Albeit with a slowly lessening voice, while becoming even smaller than they were.
The indictment of Donald J. Trump IS HERE and the “statement of facts” IS HERE. The situation, as it is represented within the text, is even more laughable than we could have imagined. It is no wonder why the FEC, DOJ and Mueller Teams took a pass on the allegations. The entire legal construct collapses on its face.
In the statement of facts, District Attorney Alvin Bragg says Donald Trump intended to, “influence the 2016 presidential election by identifying and purchasing negative information about him to suppress its publication and benefit the Defendant’s electoral prospects. In order to execute the unlawful scheme, the participants violated election laws and made and caused false entries in the business records of various entities in New York“… However, you will note one key element missing, the statute he supposedly violated.
What is this federal election law Bragg speaks of?
Every single one of the 34 stacked counts are contingent upon some federal violation of election law that the FEC and DOJ refused to pursue. Yet, nothing is cited.
The courts have already determined that campaign funds can be used to avoid potentially embarrassing personal information (John Edwards case). Using personal funds, or campaign funds to avoid potentially embarrassing information, is not a campaign finance violation.
But wait, it gets better…. or worse, if you dislike Trump.
Every single one of the 34 instances when business records were “falsified” to conceal payments to Trump legal counsel, Michael Cohen, happened between February 2017 and October 2017. Guess what President Trump was NOT doing within the Trump organization in 2017, running it!
When Donald J. Trump won the November 2016 presidential election, he subsequently divested from the Trump organization, handing over control to Eric Trump and the company officers and directors.
Throughout 2017, presumably when these false business records (they are not) were created, President Donald J. Trump was not directing any accounting, disbursements or business record keeping within the organization.

In the “Statement of Facts,” in section seven, it says this:
“ In August 2018, Lawyer A pleaded guilty to two federal crimes involving illegal campaign contributions, and subsequently served time in prison. “
Lawyer A is obviously Michael Cohen. Bragg is either lying or at the very least, being deliberately misleading. Although Cohen pled guilty to campaign finance violations, that’s not what landed him in prison.
Cohen was convicted of fraud and perjury.
The fraud conviction was related to 20 million in bank loans related to his (and his family’s) taxi business. In fact, this business was so lucrative that Cohen was known as the “taxi king” in New York.
In 2018, when Cohen was on trial, there were many observers who questioned why he pled guilty to campaign finance violations when the DOJ and FEC both (as many now know) rejected the claim that such laws were broken.
Now we know
Either willingly or coerced, Cohen agreed to plead guilty so the Feds could use it against Trump at some future date.

Accepting the statement of facts in a light most favorable to the DA… the DA is saying that it’s illegal to pay someone to not tell false stories about you if you are running for office…??? The statement of facts notes that two of their stories (doorman and woman 1) as being non-verifiable or outright false before the election. The third (woman 2) has stated that the alleged story wasn’t true since then.
Again, presuming the statement of facts in a light most favorable to the DA… Part of what I saw (as a non-lawyer) – ten accusations of federal wire fraud for Lawyer 1. If you want to include the TO CFO in those – would seem a stretch, but plausible given the allegations. Even then, trying to say that the Defendant is on the hook is an even bigger stretch. To me the DA would need to allege that even after they told the Defendant that it is was unlawful – that he ordered them to do it anyway and for whatever reason they (a lawyer and a CFO) both agreed to this unlawful activity? Otherwise, one simple defense is that he was following the legal advice of his attorney and the financial (legal) advice of the CFO. Two of the people you would hope you can trust to give good, sound legal and financial advice.
Of course as others have noted, even if the alleged actions were illegal, the statute of limitations would seem to have tolled for all of it… the misdemeanors long ago — the attempt to turn them into felonies no later than the end of 2022… even if an underlying (implied) election crime was delineated for each count. And then the (IMO) constitutionally questionable aspect of turning one alleged crime in to thirty-four.
Edit add: I know it varies by state, but is NY a state where convicted perjurers are allowed to testify under oath? And even if he didn’t plead guilty to perjury – it should be hard for him to explain his now contradictory statements under oath about part of this.

In a country without proper due process, anything can happen. He’s beaten all attacks thus far, hopefully this will prove the same. But now his adversaries are highly motived to use lawfare to derail his ability to run for the Office of President and they have quite a bit of time to effect that goal with more cases coming.

So, boy, you do wonder about those people in the grand jury which went ahead and indicted president Trump on these allegations.

The indictment could have just said “bla bla bla” and since it’s New York Trump would still be convicted by a jury of his peers.

The good news is if this ever gets to the Supreme Court its fun to think about the amount of Damages Trump can ask for.
It will probably bankrupt the state of NY.
