During a White House announcement today, Joe Biden pledged to have all agencies in the federal bureaucracy begin to target private industry for charging service fees, or what the administration calls “junk fees.” The junk fees relate to everything from bank overdraft charges, to hidden cleaning fees on car rentals, to hotel resort fees and even fees on airlines for seats with more legroom.
According to the White House, the junk service fees disproportionately impact marginalized communities, minorities and low-income households. The airline fees are particularly racist because the airline prices for more comfortable seats have a “disparate impact” (legal term for federal intervention) on protected categories of people.
Poor people cannot afford bigger seats. Poor people are disproportionately minority. Ergo a higher percentage of minority people cannot afford the comfortable seats. That makes charging more for comfortable seats an illegal practice according to the legal theory of ‘disparate impact.’ WATCH:

The justice department’s use of the legal theory behind “disparate impact” was an outcome of Barack Obama and Eric Holder taking office.
The Disparate Impact outlook then became part of the regulatory and compliance system within every agency of the federal government, including the Dept of Labor.
Essentially, it is a progressive legal theory advanced by the long-term members of Lawfare, and it carries inherent conflict with existing law. Take this example…..
The Dept of Labor states that businesses cannot discriminate in employment law based on legally protected categories of person, like race, marital status, nationality, sex, gender, pregnancy, or sexual identity. Simultaneously, it is also unlawful for businesses to hire illegal aliens as workers. When businesses used social security systems to check employment eligibility, they ran afoul of the ‘disparate impact’ rule.
A higher percentage of Mexican nationals were disqualified from employment because a higher percentage of Mexican nationals in the U.S. used fake documents. Because the percentage of disqualified Mexicans for employment exceeded the percentage of Mexicans in the population, the use of the SSI system for employment eligibility was originally unlawful under the rules of ‘disparate impact.’
It sounds crazy, but that’s the way this legal term is used within the federal bureaucracy.
Disparate Impact is the underlying premise behind the regulatory authority Joe Biden is stating today in his approach toward “junk fees.”

A pretty weak assumption by the legal beagles. People who believe in ‘disparate impact’ forget that he who pays more is more impacted by the value he receives for his payment. That he pays more for a little more comfort on an airplane is not necessarily an indicator that his action has impacted any other person besides himself. If I get 6 more inches of leg room I might be 8 inches taller than a man who is only average height. Neither condition implies that one person can make another less comfortable by his decision to purchase extra legroom for himself. Therefore, there is no direct evidence that the passenger, who was willing to pay more for a little larger piece of rented space, got a seat that was more comfortable for him than another passenger who boarded the plane got less value for his purchase. When I was young, I could have been happy sitting on the toilet seat at the back of the plane for a few hours if the price for that seat was less. But such a solution would not be possible for me to endure at my current age. I now have to spill more money to get the same level of comfort I had on a bad toilet seat as a 20 year old. Since my race and my financial resources have no impact on the decision I make to spend more for a more comfortable accommodation, I cannot be blamed for anyone else suffering from ‘disparate impact’ because of me. If I cannot be blamed for ‘disparate impact’ because I bought more comfort, then nobody else can be blamed for ‘disparate impact’ because they bought a 1st class seat just because they are not a person of color nor a disadvantaged person like myself. There is no ‘disparate impact’ if my action did not prevent another person from taking the same action as I did. Maybe one of you smart lawyer types can find that precedent in the rulings of the Courts.
And “comfort” varies from person to person.

Every time I book a long haul flight, I go to seatguru.com for free advice on the most economical way to get a few extra centimeters of legroom. You usually have to pay dearly for it up near business class, but a lot of jumbo jets taper toward the aft, and there is often free space where the rows go from four to three, or from three to two. Problem solved.

I have been in aviation for 40 years. A few economic facts to consider behind this announcement – in no particular order:
1) Airlines are totally economically dependent upon goernment largesse. Their most valuable assets – route authorities between city pairs are 100% a function of government handout. Ergo, always struggling to please the administration;
2) Airlines fell over themselves to go woke – mandatory vaccines, masks, aggressive pc hiring and promotion, etc. – resulting in a very large share of the pie of PPP and COVID handout money – lots of charters to fly supplies, etc. – while massive layoffs and mistreatment of employees.
3) Government workers required to fly ‘economy’ by contract. To woo the BIG US govt contracts, the airlines invented ‘Economy Plus’ seating. Large corps and frequent flyers already had access to Biz class seating. Arrangement suited everyone – US taxpayer footing the bill and gov workers happy to have a little more space.
4) If powers-that-be now frown on Economy Plus, airlines will be thrilled to remove it and get 3 more rows of revenue seats in the same planes. Do not expect a reduction in ticket price to match.
5) The real biz travelers already use business jets and so do senior airline execs and their financiers. This is a slap in the face to the middle management government workers.
6) The ‘excess’ fees have been a tool to manage price since DOT policy is for cheap ticket prices at all costs (including safety) and the internet search engines prioritize by basic ticket price. Doing away with excess fees by regulation will raise basic prices.
7) Please note airlines just had a very profitable quarter without passing COLA adjustments to workers
8) If you want to know what airlines really think of their passengers – including government employees – read the case of Steenstra vs United – where United refused a medical diversion to save a desperately ill Us govt employee on board. His emergency condition started while the airplane was still over North America, but they bypassed all the midwestern and west coast airports and pressed on to Japan where he died after 10 hours of agony.
9) Or read case of Hanamura vs. United where United refused to divert to save a 3 month old baby even though emergency medical care and full trauma center was nearby.
10) The FAA is basically useless because the big airlines are on VDRP – Voluntary Disclosure Reporting Program – the same system which worked out so well for Boeing – on the same theory that the large corps will self-report and self-correct more efficiently than govt regulators.
These people argue backwards. 1) Start with the desired goal in mind 2) Find the law that facilitates the desired result 3) Construe an argument (no matter how tortured the logic) that seems to make a logical connection (even if the logical construct is an emotional perception based on feelings) between original “problem” and how it is resolved by application of said law.
This is progressive legal theory.
Next, they will declare that it is racist and unfair that only pilots fly airplanes. To be fair, anyone can fly because, after all, computers do most of the work anyway. What better way to get the homeless off the streets?
Tackle inflation by making airline seats less racist ?? Airlines are still waiting for Biden to manufacture aircraft that fly like birds to be net zero.

after I took an inexpensive flight from NY to MB, Florida I thought about signing up for an airline associated credit card that gives credit miles.
Even though it is about 1300 miles between NY and MB I would only get 535 miles as a credit.
If you buy a cheaper ticket you earn fewer miles even though you go the same distance as every other passenger on the airplane.
Okay but no thanks on the card.
