The Biden Department of Labor cannot win in court over their use of OSHA to force mandated vaccines. The effort to use an OSHA Emergency Temporary Standard (ETS) did not and will not survive judicial scrutiny.
The exemptions alone nullify the claims the ETS is built upon, and the courts are recognizing the brutally obvious political nature of the vaccine mandate effort.
As a result of the Fifth Circuit (New Orleans, LA) order to stay the vaccine requirement {See Here}, OSHA has now announced {SEE HERE} they will not attempt to enforce the rule:
Dept of Labor – “On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit granted a motion to stay OSHA’s COVID-19 Vaccination and Testing Emergency Temporary Standard, published on November 5, 2021 (86 Fed. Reg. 61402) (“ETS”). The court ordered that OSHA “take no steps to implement or enforce” the ETS “until further court order.” While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.” (link)
While the 5th circuit case from Louisiana was the first, there are 11 total circuit court cases holding the same challenges. As a result, the cases were consolidated and assigned to one circuit court chosen randomly via lottery.
The 6th Circuit Court of Appeals in Cincinnati, Ohio, won the lottery to hear the legal challenges. “The 6th Circuit Court of Appeals, based in Cincinnati, Ohio, is known to lean conservative, with most of its judges appointed by Republican presidents.” The 6th Circuit will have to decide whether or not to lift or maintain the stay instituted by the 5th Circuit Court of Appeals, based in New Orleans.

My husband works at a hospital in Oklahoma. He is a Facilities Director. CMS who is over Medicare and Medicaid are holding the proverbial “Gun To the Heads” of hospitals. No reimbursement unless your employees get the jab. This effects all hospitals across the USA . They told him by 12/06/21 you can submit 2 exemptions. He has. No word yet. You guys need to know the OSHA ruling does not affect the CMS mandate. My husbands boss said that Oklahoma is suing CMS. I did the same. Did you notice how many young people reported severe vomiting hours after the vax and just before they died? There are several.
I ignored the ones that were submitted from outside the medical system. Those might be true, but many are written in a way that I thought was very suspect. Like “my uncle died from.the vaccine three days after he got the shot”, but the person reporting it provided no verifiable information like where, when, vaccine lot number, etc. Some are borderline Facebook rants.

I’ve gotten feedback from at least five people, that they’ve suffered from severe headaches, insomnia and vivid nightmares for many weeks and months after taking the ModeRNA injections. They are not making the connection to their vaccines.
My husband is one of these people, and he also had a bright red rash over his entire head and neck for two days after the shot.
I suspect the spike proteins went straight to his brain, where they may eventually cause a stroke. Frontline doctors suggest that any spike protein damage to the heart and lungs and brain will be irreversible.

Those white pills were likely Pyridostigmine Bromide if they were in little blister packs. PB pills were approved to treat Myasthenia Gravis, but the Pentagon decided they would use them to treat nerve agent poisoning.
Any attempt to mitigate anthrax was given in a vaccine. My unit was given 2 of them since we were told a second “booster” was required within 90 days. We got one at Ft. Sill before being deployed, and a second in-country.
Some units were also given an additional vaccine. I don’t recall what it was for.
None of this was documented in official military shot records or medical records, supposedly since the Pentagon didn’t want Saddam to find out what we were vaccinated against.
Simple photocopied worksheets were used to record the shots with a notation of Vaccine Apple or Vaccine Bravo.
The distinction is for the military is that they can’t force the vax from the batches that are the ETS versions. The “approved” ones don’t exist yet and are being delayed because the big pharma wants to sell out their stock of the old ones.

Have her go to LC.org. That is the Liberty Counsel web site. They have lots of information there on requesting exemptions, and help for those denied exemptions.
If she is denied an exemption, she can submit an EEOC complaint.

I am currently suspended, 5 days, then a hearing, then 10 days suspension, ending in termination. I can choose to get the shot, wait for termination, or resign.
I am a State of MA executive branch employee with natural immunity (ignored), submitted religious exemption – “successfully demonstrated religious belief” but exemption denied due to “undue hardship” to accommodate my request.
Accommodation request was to continue what I have been doing since March 2020, screened at point of entry each morning, tested once per week, masks in common areas. Even the Equal Employment Opportunity Commission (EEOC), whom I quoted, suggests the aforementioned measures as reasonable accommodations for those requesting religious or medical exemption. No dice.
Go to Liberty Council at lc.org, I used some of their information from sample letters and as stated, my beliefs were not the issue, but State cited “undue hardship” – which is the standard “they” can use to deny the requested accommodation. In my case, based on what has been relayed to me, “they” have no leg to stand on in claiming undue hardship.
Lc.org walks you through all the steps you can take if your request is denied. The next step is to file a claim with State and Fed EEOC. In my case I have decided to retain an attorney, just today. From what I understand, in order to bring a case in court, a claim must first be filed with State and Fed EEOC, but not certain – again see Lc.org.
I will have more direction and answers once I have my call with my attorney this coming Friday.

I will discuss the “perceived disability” angle with the attorney. But here’s what I’ve got in my favor so far:
1) A vendor employee similarly situated to me was given the exemption – I’m claiming age discrimination on that one.
2) They have violated my HIPPA rights – employees who I only know in passing and with whom I did not share my vaccination status have asked me outright if I’ve decided to get the shot – documented persons, dates, times.
3) My denial letter came in on Friday 10/15 (we were mandated by 10/17). My letter states “not authorized to report to work after 10/17”. Couple hours later an email comes out to all employees stating “unless expressly asked not to by your supervisor, all employees should report to work on 10/18”.
I was not actually suspended until 11/12, so how do they claim, on 10/15, that I’m a “safety risk” and an “undue hardship” but then have me work another 4 weeks? It undermines their claim. Suspension should have been immediate upon denial.
4) I’ve been told by my supervisor (cannot get information from HR at all, they absolutely will not discuss the decision at all, mostly they don’t even answer you), that the “undue hardship” has to do with our “single point of entry system”. (I work in an in patient mental health hospital, in a private office, my work is financial).
So, through this “single point of entry system” through which everyone passes, employees, patients, vendors, and visitors, no one can be asked their vaccination status, only asked about symptoms, whether they have been exposed, running a fever, those types of questions.
How can it be a problem for unvaccinated me to pass through the single point of entry system when other unvaccinated individuals traverse the same single point of entry system?
Additionally, patients cannot be compelled to be vaccinated and in fact, their handbook spells out something to which they are entitled to, and to which apparently employees are not – Informed Consent!
I will NOT GO QUIETLY!

Unless I am wrong there are two issues your question touches on:
1) The Federal Government, through OSHA, forcing companies with over 100 employees to comply with a shot mandate.
2) Private companies implementing a shot mandate on their own.
OSHA dropping mandate enforcement through the ETS mechanism solves 1) for now.
However, the Federal Government can attempt to force a mandate through other means, such passing a law. It seems unlikely such a law would pass, but if it did then that law would have to be challenged in court.
2) is another issue, because it involves employees suing their employers.
Is the executive order regarding federal contractors still in force? If so, being separate from the OSHA rule, that’s not affected by the actions of the court and the federal system touches a huge swath of American business and critical infrastructure.
Glad to see the consolidated file in the 6th and OSHA dropping the rule but it’s a long way from over and the Communists are zealous.
Something we should be aware of is infiltration into the corporate structure of America, exemplified by so many businesses aggressively rolling out mandates without any rule in place; corporations which historically fight the government tooth and nail on *any* regulation through the courts and/or by lobbying Congress, but here they’re firing customers and employees right and left like the bottom line doesn’t matter.

Agreed. So far all employee mandates have been voluntary (from the point of view of employers-not employees). Most states have “employment at will”, meaning you can fire an employee for anything that isn’t discrimination against a protected class.
That’s why Biden Admin did it the way they did. They never thought it would pass constitutional muster. They were either tricking employers into doing it voluntarily or giving “cover” to employers who wanted to issue mandates and blame OSHA. There is currently nothing to stop employers from continuing with mandates.

Okay … now it is time to demand a court injunction against the very foundation of all of this – the FDA’s illegal(!) grant of “emergency use authorization” and the accompanying legal immunity.

Such as: “an aggressive and destructive disease (“Spanish Flu?”) for which no other treatment exists.
However, many prophylactic treatments have always been known to exist. They’ve been known, and described, and studied, for more than 250 years … if not longer.
These “emergency” powers were only intended to be used when an actual “emergency” actually exists,” and then only with extreme caution. They were never meant to be used to give Big Pharma a pass: to allow them to rake in “hundreds of billions of dollars in profits,” while entirely escaping legal liability for the consequences. It was never intended to “bypass” the mechanisms of clinical trials, which were always intended to be laborious and therefore expensive.
And yet, this is precisely what was done. We now have tens of thousands of deaths, and hundreds of thousands of irreversible injuries, to show for it. Even as “Big Government” shows itself to be fully in-bed with “Big Pharma.” Yeah, “the Big Guy” – well, whatever is left of him at this point – is still taking his cut.
It’s time for We, the People to demand that Federal Law must actually(!) protect us. It is very plain, at this point, that we will never have any legal rights at all unless and until we demand them in no uncertain terms.
We have no friends left. We have no allies. “Yes, in the pursuit of nothing more than Money, they would kill us, and our children, and think nothing of it.” Yes, “it has come down to this.”

Officials at every level of government have exploited the “Emergency Powers” loophole since March of 2020 to circumvent and erode the rule of law.
Such powers were intended for hurricanes and blizzards, not shutting down the economy for years, fundamentally altering the electoral process, or mandating invasive medical treatments.
It is a precedent which cannot be allowed to stand.

Old Ron Klain – White House Chief of Staff – delivered the kill shot by retweeting that the OSHA rule was “the ultimate workaround” to the fact that vaccine mandates are not legal and not Constitutional. 5th Circuit quoted him. This is similar to when Biden stated that the eviction moratorium was not Constitutional…and the SCOTUS agreed.
The key to this is what regular citizens decide to DO with the information. Do the people who were fired file class-action lawsuits? Do the people who got the vaccines, based on illegal Government orders, sue their employer for forcing the vaccinations? As Liberals like to crow, the damage is already done. They got what they wanted: higher vaccine compliance.
The 6th Circuit will get this right. Then the people in charge will appeal to the Supreme Court which will not actually have to rule on the Constitutionality of forced vaccinations. They’ll just say “OSHA can’t do that”, and they will weasel out and say that Congress would have to authorize OSHA (or some other agency) to compel vaccinations. The Government Party will be happy to comply with this, maybe not in an election year, but the Government Party will find a way to sneak it into legislation when they think nobody is looking.
I still think people injured by the vaccines, or the families of those killed by the vaccine, should sue the Federal Government on the grounds that the vaccine immunity protection is unlawful because the “vaccine” confers neither immunity nor does it disrupt transmission. Therefore, it is a treatment, not a vaccine, and therefore the immunity is illegal.
I hope you’re right because (and I don’t say this happily) it buys enough time for them to be no longer able to hide the harmfulness of the vaccine the more people get sick and/or drop dead from it. When the evidence starts to pile up, even the media/tech stranglehold won’t be able to contain people’s apprehension and righteous anger about this whole fiasco.

So how do we band together and push back effectively? I filed a religious exemption a week ago and haven’t heard anything back. I work for a contracting company that only has contracts with the Federal government; Dept. of Army, Dept. of Defense, FAA, DOT, etc. The company is running scared because they are bankrupted if their contracts are cancelled or their employees walk out.

I really tried to get the college kids I know to just take a year off and see what happens. Most were too anxious to get on w/ their “college experience” and folded.
Then they get what ever comes. Taking a gap year is easy to do. Why would you risk your life?
Absolutely. Some of us had to take a year or a semester off to work and earn money for college. It makes you more motivated to do well in school if you’re the one paying for it. Plus, I worked for the university every semester I was there.
In some programs, engineering is the one with which I am familiar, some required classes are only offered every other year and are prerequisites for other classes. Taking a year off can make a 4-5 year degree take 7-8 years. In addition, many scholarships end if a student does not have continuous enrollment.
I knew from the moment they started giving gifts, there was “no good” involved. That was the tell tale truth……..
I know, apparently it’s okay for the various governments, in the name of “a public good”, to commit outright bribery!

I believe this ruling strips private companies of their immunity protections while the stay is in effect. If they choose to mandate employees take the shot during the stay period they are liable for damages.

I need help and advice. How do I get an exception for the Executive Order on the vaccine mandate quickly? I believe I have both medical and religious possible excemptions, but starting with medical?
