Kyle Rittenhouse shot and killed Joseph Rosenbaum and Anthony Huber as he was being attacked by a raging mob. Rittenhouse also fired on Gaige Grosskreutz as the attacker held a handgun toward him. Prosecutors attempted to claim that Rittenhouse was a vigilante looking for a fight; however, the defense, and all video of the events, show all shootings were justifiable self defense.
The jury deliberations began earlier today with the defendant using a random lottery drawing of six names to exclude from the full juror pool. The remaining jurors began deliberations immediately following the lottery cull.
Outside the courthouse a mob of pre-staged Black Lives Matter (BLM) and FBI supported ANTIFA agitators are shouting “no justice, no peace” – “if Kenosha don’t get it, burn it down,” and threatening to destroy the city if the jury does not adhere to their demands and convict Kyle Rittenhouse of murder.
While the FBI is supporting the activity of Antifa, according to local media, 500 national guard members are on standby to protect the city from them and the Black Lives Matter mobs. The Rittenhouse trial sets the stage for an interesting conflict between the FBI jackboots and the Wisconsin National Guard.
It is interesting how the city of Kenosha did not form a perimeter around the courthouse keeping the mob away from the steps. There is a park across the street which was previously used for protests as the police guarded the building. However, today, for some seemingly curious reason, the local authorities are allowing the protesting mob and their bullhorns to conduct their agitation activity on the steps to the courthouse.

Kyle Rittenhouse is not guilty of anything. He is the ONLY person to stand up for his God given rights in the face of the communist’s. He is a true Patriot and he is the only person to stand his ground against the mobs and communists, and was willing to fight them to the death on the soil of the United States of America. Today, though, it dawned on me and the fear left me.
If the Jury is afraid, and rightfully so, to do the right thing, it changes nothing for We the People.
We have the right to protect ourselves, our property, our families, and our communities.
No matter how corrupt our government becomes, WE can still do the right things.
The past 18+ months have revealed that fear is incredibly powerful in detaching people from their moral duty to seek out the truth until they are detached from reality itself.
Parents are lining up to have their children poisoned because of a cold virus that has killed fewer children than peanuts. Now we wait for a corrupt and evil system to seal the fate of a child that has already bee subjected to the cruelty of that same system.
The system is the punishment. Until people reject the standing of the entire system and replace their easily conjured fear with faith in a higher power and purpose they will continue to watch their children and their children’s children become sacrifices to the evil that wears our freedom and liberty as a skinsuit.

We had a senior that refused to think about anything but getting home in time to fix her husbands’ dinner. We didn’t know if she was living what she knew, as in out of her routine, or if he would beat her or something. We tried to explain that a man’s life was in our hands, and she couldn’t connect the dots. It was grossly unfair.
It was disheartening to learn how flawed the jury system is. Not all are our peers. Sometimes I think we should try using professional jurors.
One case I wasn’t selected, the lawyers didn’t like my answers to their questions. W/the senior lady I wonder how she passed the screening to sit on the case.

When I did jury duty we were told we were stuck there until we made a decision when we got hung. We had trouble w/some of the legal jargon in the instructions. All we wanted was to be spoken to in plain English, we were left on our own to figure it out. The guy we selected to be head juror was a smart, intelligent man, and he even had trouble. Finally we asked for a chalk board so we could write it out, they wouldn’t give us one, we asked for paper and pen, they did do that. So we all wrote stuff down in an outline to discuss it.
In Kyle’s situation I do not understand how any person could watch the videos, listen to his testimony, and still have questions if he is guilty or not. That is what scares me.

I was on a jury that had 11 voting to convict and one who didn’t.
Totally obvious it was a car theft. Thief stopped driving a car reported stolen. Car had a broken window and a screwdriver was used to force the break the keyswitch & start the car. Screwdriver still in keyswitch.
Alibi: I borrowed the car from Slim. Slim could not be located or even identified where he lived. Thief didn’t know the true owner of the car.
The juror who wouldn’t convict kept citing scenes from TV shows she had watched in the past as why she wouldn’t convict. After 2 days of this nonsense, the head juror went out & told the judge what was going on. Judge dismissed the juror and sent in an alternate.
Result: unanimous vote to convict in about 2 hours.
The took a lunch break.
I expect a verdict by noon tomorrow. Maybe by 5 tonight.

So many things can happen in a jury room.
The dynamics of juror personalities, influencors vs. influencees, hidden bias and personal life experiences, creates unpredictable results. I’ve heard things from jurors post-trial that amazed me. Things the lawyers can’t predict.
The is no predicting what a jury will do, or why they do it.
I was in a jury and we deliberated quite a while on how guilty the guy was as we did not want to convict him of anything more than was right. We were unclear until defense testimony, then knew he was 100% guilty, but which charge gets confusing. They may have one or more jurors holding out and disagreeing.
My husband was on a jury many years ago where the defendant was accused of sexual abuse of a minor. There was no evidence of any crime, other than the words of a young girl who was angry that her parents had split up, and who admitted that she was mad that her mother had started dating.
It was pretty clear-cut that the poor guy was being railroaded but ONE juror absolutely refused to vote for an acquittal because, in her words, she would rather send 1000 innocent men to prison than let off someone who “could” be guilty, even if there was no evidence! They finally hung the jury 11-1 because she refused to budge. When they talked to the Prosecutor afterwards, he told them that they were the THIRD jury that had hung 11-1 or 10-2 in favor of acquittal!
Feelings over facts…Sadly it could be the motto of our world today!
A hung jury would be a good way for this jury to wiggle out of their tight spot. The case was so obviously politicized from the start that I’ll bet it would never be retried.

My ex-police officer anticipates one of two outcomes, Kyle will be exonerated or the jury will be hung, meaning they can’t agree unanimously with a verdict. I think one juror is already conclusive since they only asked for 11 copies of jury instructions. Hopefully based on the compelling evidence of self defense that one juror will be the one who hangs the jury if they decide that their safety is more important than justice.

Methinks that the jury was given one copy of instructions to be read aloud by whomever they vote to be jury foreman. Other jurors didn’t like that arrangement and wanted individual copies that they could closely read/write comments on.

It worries me that it is taking them a good while. If they started deliberating about 10:00 EST, then that has been 6-7 hours even if they had time out for lunch. I have been praying all day.
There are going to be jurors that will never acquit out of fear for their lives and who could blame them.
AT any time, they could have asked to be removed from the jury.
I would blame them, too . . . they had an opportunity to be excused if they thought they would be intimidated.
Hopefully they’re taking their time to address each item carefully, thoroughly. I would be suspect of any quick return that it would be subject to scrutiny that leads to further commotion about this case. Be careful, and get it done right the first time.
There should be a dismissal with prejudice given the threats directed to jury members.
No jury should have to risk his safety and the safety of his family while struggling to reach a just verdict in any case.

I am wondering WHY the judge had Kyle pick the names of the jurors to be dismissed rather than having the court clerk do it, as is normal procedure? Could he have been giving the defense a reason to appeal the verdict if the jury wimps out and declares him guilty because they have been threatened? Any lawyers on this thread who could opine as to whether or not that would be grounds for a re-trial?
Like you, I was really hoping that the judge would just outright dismiss the case with prejudice – there were certainly enough opportunities for him to do so!
I read where it is not uncommon for this judge to let the defendant pull from the hat. I don’t have a link, I have read so much and site hopping I don’t remember where the article came from. I thought it was kind of an odd thing too.

At least with Chauvin there were reasonable questions about whether or not his actions contributed to Floyd’s death. I don’t believe they did, but nevertheless he continued kneeling on the neck/back of a suspect for several minutes after his partner said “no pulse.”
Kyle Rittenhouse’s case is much, much more clear cut. He’s innocent. Full stop. One guy threatened to kill him and chased him down, grabbed for his gun as gunfire was ringing out. Another tried to crush his skull with a skateboard. And a third pointed a gun at him. All three while KR was attempting to flee the crowd and flag down the police.
If he is acquitted, he is going to be a very rich man when all is said and done.
We can hope Kyle will become the second Nicholas Sandmann.

That plea deal gave the man 12 months probation instead of jail time. He reportedly violated that plea deal the following year, and was sentenced to seven months in jail.
The man has a criminal record that dates back decades, including felony convictions for car theft, drug possession, ID theft, and escaping custody.’
Of course they’re allowing them on the steps to intimidate the jury. Praying for Kyle’s acquittal. Even if it wasn’t prudent to go there, he didn’t act recklessly. All the video shows he acted in self-defense. The only blurry interpolated picture of Kyle “pointing his gun” is a total fabrication on the last day of witness examination. My bet is a hung jury. There will be at least a couple that have the intelligence and courage to adamantly refuse to convict for an obvious self-defense case. I also expect there will be one or two corrupt, bigoted, easily influenced members that will not under any circumstance vote to acquit. Hopefully the former will be strong to emphatically state under no circumstances will I/we vote to convict on any charge.
One question – if they come back hung, can the judge still dismiss at that time with prejudice?
Retired Magistrate here: If the jury comes back deadlocked, the Judge can and probably will give them what is called an “Allen Instruction” or a “Dynamite Charge Instruction” which tells the jury to go back and try harder to come up with a consensus.
If the jury is still deadlocked it will be up to the prosecutor as to whether or not to re try the case. Given this prosecutor, it would certainly be re tried with a different judge.
My office in the Court House used to be outside of the jury room. The walls were thin and many times I could hear jury deliberations. Unfortunately, there are times when jurors rule not on the evidence but on emotions. In this case emotions are running high due to juror fear and the high profile case. I would like to think that the jurors will rule on the evidence which would result in a non guilty on all charges. However, given the times we live in, I don’t think that will be the case. I certainly hope I am wrong.
If re-tried, probably a different prosecutor after the two doofuses who tried this case. These were only assistant prosecutors. They are stuck with the testimony they elicited, some from their own witnesses that damaged their case.
If the judge declares a mistrial, he might be able to hang on to the case. He knows the issues and testimony, and more importantly, he isn’t afraid of trying it. I can just imagine a chief judge trying to find someone new, and the spineless ducking it.

Retired Magistrate here: With a high profile case like this, it would not have mattered where it was tried. Juror intimidation would have taken place where ever the venue was changed to.

Sounds as if he may be delaying making a ruling on dismissal hoping the jury will do the right thing (meaning, acquit Kyle); but, if they don’t, and especially if they do not because of threats from BLM and Antifa, he will dismiss for that reason or even some other reason.
This is a perfect time for the gov’t authorities in Kenosha and Wisconsin to let all malcontents who wish to riot know that they will be shot without warning if they riot, loot, or commit arson.

Just as the jurors today, WE ALL are going to have to make some very tough decisions in the coming months and years. Who we choose to be is up to us. Freedom ain’t free, and we’re getting a block of instruction on this right now. Kyle had to fight or d i e. He made his choice and he acted on it. Anyone who wants to say different, has no comprehension of the United States Constitution or the Bill of Rights. The willful ignorance is off the charts with way too many people in this country today.
Truly disgusting that the lefties in Wisconsin state government and the Federal Bureau of Intimidation are trying to bully the jury into a guilty verdict with their not so subtle threats. Of course the Wisconsin Governor could have prevented this whole situation from happening in the first place if he had just called out the National Guard when the burning, looting and shooting began in Knosha. But he was too chicken.
I don’t have a lot of faith. It should be illegal to congregate outside a courthouse during a trial (or deliberations) and threaten to “burn down” if a preferred verdict isn’t rendered. That’s barbarianism.
But we live in a sick world where due process and the rule of law mean nothing. Kyle should walk on all charges. But I’ll be surprised if he does.

Picking jury numbers from a tumbler is normally always done by a member of the court.

If I was on the jury, this would add a personal dimension to my individual verdict – and encourage me to hold strong against rogue jurors arguing the inarguable.
I wonder if this action would be grounds for an appeal if the jury wimps out and finds Kyle guilty. It is NOT standard procedure and the defense could argue that point…not sure if it would matter but I really don’t understand WHY the judge deviated from normal practice in this case?

Also don’t forget that the judge brought that to the juries attention. Yes, he could assure them that in that instance they were protected. But it made them painfully aware that they were being targeted.

Just like the Chauvin trial, the fix is in. In both cases, the prosecutors behaved abominably and should be disbarred. In both cases, the prosecutors got away with it and the judges allowed mistrial levels of abuse. In both cases, the juries were threatened.
I will be very surprised to learn the jury had the guts to do the right thing. Especially since that would mean the bad actors failed in their attempts to be on the jury.
I hope in this case that the innocent defendant will be declared not guilty on all charges. But with all the last minute lesser charges thrown in, I won’t be surprised at an attempt to split the difference. But would such an attempt really stop the rioting?

I wonder if the judge can replace them. The alternates are usually replacements for jurors who get sick, have a death in the family, or something like that. Just not voting with the majority might not be enough to replace. The judge has to respect each juror’s opinion.

That’s why I have urged anyone who would listen to gather up your things and come help fortify already red areas so that it is impossible for leftists to get elected let alone cheat. If you do have to stand your ground in a red state chances are you will not be thrown to the mob.
