Hundreds of requests for details on the specifics of the container shipping backlog. So, I spent 3 days calling sources, digging for details and gathering information on the substantive issue at hand. The epicenter of the problem is not what is being outlined by financial media, corporate media and politicians who have a specific interest in distracting from the issues at hand. This has nothing to do with COVID-19.
The issues being discussed today relate to events that happened a long time ago. As a matter of fact, it was so predictable that Amazon, Walmart, UPS, FedEx, Samsung, The Home Depot and Target all had taken actions years ago -long before COVID- because they knew this day would come. It was not accidental that those companies showed up at the White House to discuss the issue, because there’s now a full court press to hide it.
There is one very specific regional issue driving the problem. Read on:
The trucking issue with California LA ports, ie the Port of Los Angeles (POLA) and the Port of Long Beach (POLB), is that all semi tractors have to be current with new California emissions standards. As a consequence, that mean trucks cannot be older than 3 years if they are to pick up or deliver containers at those ports. This issue wipes out approximately half of the fleet trucks used to move containers in/out of the port. Operating the port 24/7 will not cure the issue, because all it does is pile up more containers that sit idle as they await a limited number of trucks to pick them up. THIS is the central issue.
On October 16, 2020, the EPA reached a settlement agreement [DATA HERE] with California Air Resource Board (CARB) to shut down semi tractor rigs that were non-compliant with new California emission standards:
2020 SAN FRANCISCO – “Today, the U.S. Environmental Protection Agency (EPA) announced settlements with three interstate trucking companies imposing $417,000 in penalties for violating the California Air Resources Board’s federally enforceable Truck and Bus Regulation, Drayage Truck Regulation and Transport Refrigeration Unit Regulation.
“As trucks are one of the largest sources of air pollution in California, EPA will continue to ensure these heavy-duty vehicles have the needed pollution-control equipment and operate in compliance with the rules,” said EPA Pacific Southwest Regional Administrator John Busterud. “These companies have agreed to bring their trucks into compliance and operate more cleanly in all communities they serve.”
Transportation is a primary contributor to the high levels of air pollutants in Southern California and the Central Valley. Diesel emissions from trucks are one of the state’s largest sources of fine particle pollution, or soot, which is linked to health issues including asthma, impaired lung development in children, and cardiovascular effects in adults. Many of these trucks are older models and emit high amounts of particulate matter (PM) and nitrogen oxides (NOx).
[…] California Truck and Bus Regulation and Drayage Truck Regulation have been essential parts of the state’s federally enforceable plan to attain cleaner air. California requires trucking companies to upgrade vehicles they own to meet specific NOx and PM performance standards and to verify compliance of vehicles they hire or dispatch. Heavy-duty diesel trucks in California must meet 2010 engine emissions standards or use diesel particulate filters to reduce the diesel particulates emissions into the atmosphere by 85% or more. In effect, what this 2020 determination and settlement created was an inability of half the nation’s truckers from picking up anything from the Port of LA or Port of Long Beach. Virtually all private owner operator trucks and half of the fleet trucks that are used for moving containers across the nation were shut out.
In an effort to offset the problem, transportation companies started using compliant trucks (low emission) to take the products to the California state line, where they could be transferred to non-compliant trucks who cannot enter California. However, the scale of the problem creates an immediate bottleneck that builds over time. It doesn’t matter if the ports start working 24/7, they are only going to end up with even more containers waiting on a limited amount of available trucks.
Yesterday, in an effort to obfuscate and actually hide the epicenter of the issue, the White House put on a performance to provide political cover. In a grand pantomime, Joe Biden met with the heads of the Ports of Los Angeles and Long Beach (Gene Seroka and Mario Cordero, respectively), and the International Longshore and Warehouse Union (ILWU).
The publicized meeting and White House conference was sold as Biden and Transportation Secretary Pete Buttigieg showing actions they are taking to address delays and congestion across the transportation supply chain in Southern California.
As a result of the meeting, the Port of Los Angeles (POLA) announced that it will join the Port of Long Beach (POLB) in expanding to 24/7 operations. POLA will add new off-peak nighttime shifts and weekend hours, nearly doubling its hours of operation. The ILWU said its members are willing to work those extra shifts to add needed labor capacity.
That publicly promoted action event was a complete political farce. No amount of extra productivity in working the docks to off-load ships will solve the issue of trucks that cannot pick up the containers and distribute them toward manufacturing or warehouses.
As I noted, the issue started becoming visible several years ago when the California Air Resource Board (CARB) announced the new environmental regulations. Several massive multinational corporations, with specifically in-tune supply and logistics operations, immediately recognized the issue they would face if 50+ percent of the trucking fleet would be blocked from entering California ports.
Yes, years ago the private sector predicted this would happen, and they started taking actions to protect their supply chains. What these massive corporations did to reduce their exposure to supply chain disruption was to immediately formulate plans to divert their goods to other ports. This was a very expensive shift in supply chain and logistic efforts for these massive corporations, which includes: Amazon, Walmart, UPS, FedEx, Samsung, The Home Depot and Target.
A long time before and during the era of the Trump administration, those massive multinational corporations knew they would need to redirect their import cargo quickly to avoid the bottleneck caused by California’s new emission standards. They began organizing new destination ports for their products and began setting up new hubs and distribution networks to avoid the predictable California port bottlenecks.
Obviously, for politically correct reasons; and in an effort to avoid the woke mob of environmentalist jackboots, the corporations didn’t publicly share any of the issues they could foresee coming – they just worked independently and quietly to avoid the issue.
However, it costs more money to move and entire supply chain for trillions of tons of goods coming. Hence, we saw prices climbing as a result of increased transportation costs being factored in to the new logistics. Did you hear about massive increases in container shipment prices? Well, THAT’S WHY. The entire supply chain from Asia to the United States was being modified from the closest port (California) to the ports where internal transportation would not be an issue.
Ships from China and SE Asia being diverted from California into the Gulf of Mexico or East coast have to go through the Panama Canal. It takes twice as long and costs twice as much, if not more. Hence, massive shipping price increases:
Unfortunately, small companies and small brokers of import goods do not have the control over their part of the supply chain from Asia to the West Coast. They don’t contract for entire cargo ships with thousands of containers. Those wholesalers, brokers and smaller companies that feed raw material and parts supplies to manufacturing and smaller retail outlets are stuck waiting for their containers to get through the trucking issue in California.
The bottleneck at the Ports of Los Angeles and Long Beach run by Gene Seroka and Mario Cordero is not caused by a lack of longshoremen and dock workers to off-load the vessels. The bottleneck is caused by half of the previous trucks used to enter the ports and pick up containers not being allowed. Factually, it doesn’t make a tinkers damn worth of difference if the port works 24/7/365. The ports are simply running out of space.
The ports are running out of places to store containers full of goods that are getting off-loaded. Hundreds of thousands of them are piling up. The central issue is the inability of emission compliant heavy transportation in California to move those containers full of goods to manufacturing, warehouses and distribution points.
This California bottleneck has been building, and building and building for years, until now it has reached a crisis point.

As you watch this really good discussion, think about how long Amazon Inc. has known about the problem in order for them to have put such a massive solution into place in order to avoid California.

I sat in on air quality meetings with epa/CARB at a coatings conference in LA around 2005. The topic was lowering voc’s in paints/coatings to improve air quality. The regulations made the paints/coatings move away from proven chemistry to products that didnt last as long and performed poorly. I asked the question “what happens if lowering voc’s in paints doesn’t improve air quality”. The epa guy said without blinking “if you think we would repeal the regulation we won’t”. Even if it doesn’t work the regulation was going to stay in place. Btw I sat in traffic 2 hours on the way to this meeting. California had an express lane that was unused. They wanted that toll money. Glad I never moved there

At that time the study of anomalies was a big thing we were expecting global cooling based on solar minimums, less magnetic radiation from the sun leading to a decreased magnetosphere which blocks less radiation allowing more gamma rays to get in. Polar shifts, changes in the Earth orbit, plate tectonics and increased volcanic activity causing a volcanic winter and other climate changes. It has been a long time ago but I don’t remember CO2 being part of it. We are in a solar minimum right now with increased volcanic activity and global cooling should be right around the corner. I’m sure someone on this site knows more about than I do but facts don’t change. I’m sure more studies have been done since then, what was once cutting edge is now old science.

This 12 minute Juan Browne Blancolirio You Tube video seems to fit in with this topic of the backlog in the shipping yards – this video has already gotten him in trouble with you tube so not sure how long it will be up.
Titled “SWA Meltdown and the Federal Vaccine Mandate” talking about what happened with the Southwest Airlines over the past week (this video, dated Oct 11), he ends his video by saying “So if you thought the pullout of Afghanistan was a snafu, wait until you see what this vaccine mandate is going to do.”
It does explain some of the inner workings, over-booking, short staffing, etc. that seems to be a logistics problem so figured it fit in with the shipping topic.
Juan Browne is the cat’s meow as far as the praxis of aviation is concerned. So he’s got the SWA issue wired with the one exception of the “sickout”. Wonder what he has to say now re: American Airlines. There are many more data points than he is willing to acknowledge at this juncture.
As a lifetime (>50 years!) general aviation practitioner/enthusiast I can say that Juan’s channel is excellent. I don’t agree with all of his assessments, but the man is a great pilot and his understanding of GA and commercial aviation is unsurpassed. That was my first reaction too, when he first talked about the SWA issue, but as he went along realized his words were being couched in a rather protective-for-the-current-pilots at SWA bringing up that of course any strike or sickout would be against the union’s current agreement, especially since he follows that and brings up the union is currently in renegotiations with the airline.

Another issue being overlooked is California’s ‘Uber’ law. Basically they have outlawed Independent Contractors in California. The target was the ‘Gig’ economy. Can’t have all those Uber/Lyft drivers making money. The side effect is it affects Owner/Operators, who are a LARGE segment of the trucking market.
So not only are the number of trucks limited. WHO can operate the trucks was limited too.

One major underlying issue is: This will never be resolved as long as CA is pushing to eliminate all fossil fuel, nuclear and hydro electric power generating plants in addition to the replacement of internal combustion engines with electric motors in the near future. Of course the non availability of economically feasible electric powered trucks with the load hauling capacity and distance coverage provided by the current fleet used by the transportation industry plus the necessity of a fully operational national grid of charging stations and electricity to power it in order to enable the continuous movement of goods between destinations makes CA’s position even more ridiculous. This is basically just another example of the Democrats operative mode of let’s just pull another brilliant plan out of our back end without any forethought regarding consequences that creates more problems while solving nothing. But then again Democrats love spending taxpayer money under the guise of infrastructure and shovel ready jobs while really using it to payoff off their key donors/voting blocks while enriching their own pockets.

California, is worried about pollution from semi trucks? They have a state wide 55 mph speed limit for semi trucks. At that speed, you are at the low end of 12th gear / high end of 11th in a big rig. The truck is not operating at it’s best efficiency (which is 65) and putting out more pollution.

Driving a truck in kali was always an unplesant experience. Emission standards has always been about making life hard for the trucking industry. Try parking your truck in LA. Good luck. You have to pay out of your own pocket. There is not one inch of that place I like. Some do, but its a chore at 8am on I-5! In some ways its worse than the east coast and I-95…any time of the day. To make the trucking situation even worse, Governor Should-have-been-recalled Newsom signed an executive order requiring all these trucks to be electric by 2035. They can only go a couple hundred miles before they need a charge and there are very few charging stations even available on California highways. This isn’t going to end well.

Remember in 2019 when it was trumpeted that President Trump had effected the ban on the sale of the Chinese take over of the Long Beach Port?
Long Story short, in 2012, Obozo gave a 40 year lease to the Port of Long Beach to the Hong Kong Based shipping conglomerate, Orient Overseas. Orient was given full authority over the operations of the vessels and the rail at the Port.
In 2017 the State-Owned Chinese Cosco Shipping Co bought Orient Overseas. Cosco had control of the port.
In 2019, the Trump administration banned the sale of the Long Beach Lease and that was cut out of the purchase. Cosco moved forward, a carve out was made on the Long Beach lease, and Cosco purchased the Orient Overseas.
In the 2019 sale agreement, Orient Overseas was given the right to continue running the vessel & rail operations of the Port of Long Beach for another twenty years.

Also, AB5 eliminated a lot of owner operators – i.e. contract workers. When the new emission rules for trucks came out, there were programs to help the owner operators buy new trucks. Then they implemented AB5 and wiped them out.

Never forget California has more Republicans than the rest of the trans Mississippi west (minus Texas) combined. Hand waiving the west as the “left coast” is intellectually lazy and morally indefensible. Think out of the box. Realigning state borders is a start.
To me, here’s the basic problem with all of the Socialist “so-called ‘elites.'” ?

And so, they become the ultimate “bull in a china shop,” because they have absolutely no idea what they are actually doing. Their entire “thought process,” such as it is, never goes beyond “stage zero.”
Likewise the election: they knew just enough to steal the vote, and to arrange every layer of the Judiciary (including the equally-clueless(!) US Supreme Court) to keep it that way, but they don’t know how to run the country. Because there are no “trade-offs” anywhere in their picture. Throughout literally all of their lives, everything has simply been handed to them on a silver platter. “Father, forgive them, for they know not what they do” just does not work anymore. We are in desperate need of adults to steer us out of these people’s insane asylum.
