Late Monday night the state of Texas filed a lawsuit directly in the Supreme Court against four states: Georgia, Michigan, Pennsylvan and Wisconsin. The intent is to block those states from casting their Electoral College votes for Joe Biden due to the unconstitutional nature of mail-in ballot use – against legislative approval and requirement.
Today 17 states filed an amicus brief [pdf link] in support of the Texas lawsuit.
The seventeen states include Missouri, Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, and West Virginia.
As noted in the supportive filing: “The States have a strong interest in preserving the proper roles of state legislatures in the administration of federal elections, and thus safeguarding the individual liberty of their citizens.”

When non-legislative actors in other States encroach on the authority of the “Legislature thereof” in that State to administer a Presidential election, they threaten the liberty, not just of their own citizens, but of every citizen of the United States who casts a lawful ballot in that election — including the citizens of amici States.

We did NOT approve any of this, theft has increased last election and exponentially this time. Our votes were stolen from us, flipped on us or discounted in favor of the other side. Secession does nothing for you, and it pisses me off that you go to that. Lots of families here that share your values (I assume, since you’re here) and you go to secession? Funny, I expected to be with the other red states on that, since GA is a red state. We are quite able to feed ourselves, so what’s your real solution?

I believe that this has already happened in New York and other Blue states. NY is known for a hundred years to have the most corrupt elections possible. Look at Tammany Hall as an example of how far back it goes.

Loren Culp’s campaign now claims the state has filed to clean up its voter rolls and they have proof of more than 500,000 votes cast illegally. If that’s proven to be true, Loren Culp is the lawfully elected governor, and not jay insee.

I noticed that, right off. I suspect the WAY Az. instituted these covid justified changes to the election law, took a slightly different approach, and therefore didn’t “qualify” like the otbers did.
As an example, in Wisconsin IIRC, it is the State Constitution that spells out, with specificity, the limited process for obtaining absentee ballots, which is what these ballots are considered, AND specifies they must have a signed request from the voter, which must link to the ballot.
They have a bunch of absentee ballots with no request, and they needed to change the Constitution to do what they did.

Every state with an R AG should be signed on. The D-rat states want to shred the Constitution. The Constitution was designed to keep the minority from ruling over the majority. In this election, we have literally a few dozen people who have defrauded a nation of over 230 million out of their voting rights.

and here’s something else to consider.
this issue would not matter if it WAS the majority crapping on the minority.
It’s not really about majority or minority. It has to do with basic legal principles, spelled out in the constitution.
Here are the basic principles:
a. federal and national elections will be conduct fairly and in a standard way. While states can exceed the federal law, they cannot lower the standards below it. We call this federalism. it’s a critically important aspect of what makes our Nation of States operate in a civil, accountable, and reconcilable mode. This principle IS written into the constitution of the United States, and IS written into every single state constitution. Federalism.
b. The electoral college IS written into the constitution (both US and state), to remedy two central risks the founders considered perilous to a authentic national election:
1) logistics. When horse and buggy (and lot of foot walkers) was the ONLY means to travel, it was impossible to imagine holding a national election in a timely manner. it would disenfranchise poor people who did not have the time or the means to travel hundreds of miles to a voting place! In the first iteration of the electoral college, QUALIFIED officials would collect votes and then transfer them rapidly to be counted. it was done at the local level first, and then again with a means to make sure no funny business happened. Yes, real paper votes with an actual working audit trail and positive feedback to individual voters! Imagine that! This EC also as designed accomplished the principle that everyone have the chance to vote and to be counted.
2) Founders were VERY concerned that the general public could be fooled into electing a fraud or that the general public may act stupidly, or that the general public may one day decide to make a mockery out of the election contest. They considered the general public to be mostly trustworthy and reliable and well educated and balance in moral and principle, but they also recognized that a sufficiently sizable group of anarchists, clownsters, and idiots, could cause chaos. I think we can understand they were quite right about this, given some of the kinds of people who have been elected into official office, and not just presidents! The EC principle was so concerned about this risk, the constitution uses very specific language about QUALIFYING BOTH EC MEMBERS AND A QUALIFICATION OF PRESIDENTIAL CANDIDATES. It is quite a sad commentary to understand that this language was never adhered to in ANY Presidential election, save for the basic entry level citizenry, age, and non felon status. But it IS there!
3) the founders also realized there must be another safe guard written into the constitution. A catch all, per se. Lets say natural disaster happens that prevents a certain area to collect votes before deadlines. Or lets say fraud. Or lets say, legal disputes not settled before 20 Jan! Or electors who are faithless to state legislature (spoiler: we are going to see alot of abuse in this area in the near future as this seems to be the nuclear option for the radicals)..Pretty much anything. So, the founders WISELY created a legal means to overcome obstacles that cannot be settled in a “normal process”..This backstop was ADOPTED BY EVERY SINGLE STATE AND REMAINS ON THE STATE LAW BY EVERY STATE. This has been performed twice to my knowledge. 1985, and in 1876, This legal remedy allows state representatives to select “special electors” and then provide those results to congress both house and senate. We are not “there” yet, but I would predict at least a legal argument can be made that this is how some will desire elections in at least 4 states to be handled. It’s not possible to “do over”..it’s not possible to “audit” using the same system that produced irregularities. it’s not possible to KNOW which votes were from what person and if that vote met the deadlines or NOT!! see the issue? So, there IS a pretty good case, that state representatives will be called to step up and appoint special electors. This will most certainly trigger ANOTHER SCOTUS case, either way!
tldr: some say we need to preserve the constitution and affirm it. I agree. But the real reason to do this is because the constitution ultimately is about people. We need to affirm that WE THE PEOPLE will have fair, equal and non spoiled elections. Our entire society exists such that no matter where you live, how you live it, your vote will count and it will not be spoiled. Where this case is interesting is that there is pretty good evidence that THE MOB has created a mockery of the presidential nomination and not just fraud, but clownster acts, anarchy business. THIS IS PRECISELY one major concern for the Electoral College and why it was designed with specific language. perhaps it’s time we revisit what it really means with clarifying language about qualified EC members and ALSO qualifying Presidents. Does anyone really believe a ambulatory degenerate like biden is qualified?

To those who say the Civil War concluded the matter of succession, the same shall be used against them; the Constitution guarantees a Republican form of government.
Those 18 states represent 36% of the Republic. It will be interesting to see how, if it should come to that, will the SCOTUS refuse to abide the grievances of the People of those states. I say anything, including open rebellion*, is on the table. This issue is not one for making decisions based on anything other than original interpretation of the Constitution.
*NOT to overthrow the government but to remove those interlopers who have sought and do seek to destroy the Republic. My cause is to reestablish the Republic as originally founded.
The total population of those 18 states (~79 million) represent 24% of the U.S. population estimated by 2020 Census (328,877,386).
Good stuff. It’s a shame that something as simple as the Supreme Court agreeing to hear arguments after tomorrow would be a huge relief. I’m very skeptical that SCOTUS will weigh in, let alone grant the relief sought by TX. Then, if TX gets its relief, I’m skeptical that the GOP Legislatures will do the right thing because they will literally be threatened with their lives and the lives of their families and friends. Plus they’ll be threatened with riots and terrorism in major cities.
This is what made the Declaration of Independence such a big deal…those men literally put their lives on the line for the cause. We don’t have many men like that in politics today in large numbers. Not that I’ve seen, anyway.
It’ll be important for Pres. Trump to secure the cities with the military IF all this comes to pass. And it’ll be important for Patriots on our side of the divide to protect our communities with the requisite self-defense necessary to deter aggression.

The terrorism resumes if SCOTUS sends this back to the states. We have to be clear-eyed about what this means for the Justices (they want the status quo and stability) and the State Legislatures (who will be threatened and targeted). They will all need safe havens to do their work without fear.

It’s amazing how many people (not you) think that the world is different than it was 200 or 400 years ago. It’s not. Technology has changed, most of the civilized world has evolved in their treatment of others, but we are still human beings. There will always be a threat to your life when you sign up to serve your country, whether that be political or in the service. The naivety of the ruling elite laughable and dangerous.
I’m with you. I go back and read the writing of the Founding Fathers and then I compare that against the best our generation of leaders can come up with, and it’s like putting a monkey in a room with Kip Thorne to argue about the physics of a singularity.
The ruling elite requires the status quo to be maintained. That means the Courts and the Legislatures have to act in ways that preserve the status quo. Disrupting the status quo means violence, and violence is tricky for the Uniparty because you never know which way that’s gonna go. They have a 50/50 chance of swinging from a noose.
But that status quo is getting harder and harder to maintain. Back in the 1990’s, they only had the white middle class to worry about, but the people in that middle class has grown and diversified in unpredictable ways, and EVERYONE has caught onto the game at this point. Some still play along with it because it benefits them in some way. According to the Sekulows, if it ends up at the House, there are 27 Republican delegations and 21 Dem delegations. Also there are 2 ties. (Trump should win.?)
And they can just as easily make up some new law out of whole cloth that says that “disenfranchising illegal and fraudulent votes is far more concerning to the court than bureaucratic procedure.”
I don’t think they’ll punt it to the House. If they act at all (a big IF), they’ll take the most Constitutional-sounding and reasonable sounding route possible and send it back to the States to fix. This also gives the Court an “out” because the four states being sued might simply wind up voting to certify the election results that have already been certified.
There are no guarantees here for us.

We do everything correctly, we vote on election day between 7am and 7pm, if we arrive at the polls at 7:15 we can’t vote, and then somehow all these ‘votes’ are allowed to come in for the next week or two? Those are rights we don’t have.
I am optimistic. For those concerned that “the courts are hestant to decide elections”, despite Bush v Gore doing just that, its worth noting they won’t be, and so can deflect that criticism.

I don’t mean to plagiarize, but a CTH commenter made an excellent point on another thread today and it bears repeating. The point was this: The document that binds the individual States as one nation is the Constitution. If SCOTUS will not uphold and enforce the Constitution, then nothing else is binding–unless by brute force.
I believe it was Twain who said that history may not repeat itself, but it does rhyme.
Texas reserved to itself the right to secede at the conclusion of the first Civil War. This situation is explosive. And it all has come about due to systemic infiltration and corruption going back over 100 years. This situation has to end with the restoration of the Republic. Then, the rest of the anglosphere has to follow the lead of the USA and restore their own representative democracies in the same way.
That right was given when Texas joined the union. Texas was their own Republic prior to becoming a state in the USA, and this was negotiated during the statehood settlement. Also, it is the reason that the Texas state flag can be flown at the same height as the US flag. Only state in the union that is allowed.

Brilliant argument by the States, but does the Supreme Court have the courage to do the right thing?
If it doesn’t, it will quickly learn that black robes offer no defense against treason at a military tribunal.
If anything, their ‘exalted’ position would make their failure to uphold the Constitution even more reprehensible and responsible than the flunkies who harvested votes because they were offered $5 a ballot they could pull in and probably didn’t even know it was illegal.
Further, if it comes to a National divorce, I suspect the big blue cities would have little support from their country-sides. The majority of Pennsylvania did NOT vote for the blue tyrants and if the National Constitution doesn’t hold, I see no reason for those of the states whose officials unconstitutionally disenfranchised their own citizens to hold either.

Wyoming’s Governor is a dimm in Rino clothing, at best. The AG in Wyoming is directed by the Governor, I think. So calling the AG… may or may not help. I find it interesting that Utah signed onto the suit yet Senator Romney continues to say that efforts to challenge the election fraud should cease. Funny, I thought a Senator was supposed to represent the interests of the State that elected them.
Our Utah AG, Sean Reyes, is a big, vocal supporter of the President. I would guess Romney wasn’t as much of a hindrance to him as our RINO governor and lt gov (unfortunately also our gov elect). But Sean did the right thing and signed on to the TX case today. Just wrote him a thank you note as follow-up to my letter yesterday urging him to support the TX effort.
Ohio AG David Yates and his RINO buddy Dewine are no where to be found.

Reading this brief makes me feel for the first time that POTUS has a good chance to pull this through. I don’t see how SCOTUS could deny hearing this case and find a remedy.
PA lied to them about securing the mail in ballots under dispute, and they did nothing. I wouldn’t be surprised if they took it up, I’d be less surprised if they didn’t take it up. The Chief Justice, in addition to being vain and egotistical, has clearly been under blackmail the entirety of his tenure on the court. Three others are rank activists who would enact communism tomorrow if they could. Of the other five, there are 2 who may actually care about the constitution. Roberts will play this as “We don’t want diminish the court by being involved in politics.” The court is already diminished though by failing to take up equal protection cases with clear constitutional implications prior to the election.
What are these equal protection cases you speak of?
