The legislature of Florida and Governor Ron DeSantis waste no time in confronting the fast pace of leftist ideology with legislative and executive order moves to protect citizens within the Sunshine state. The speed of their united effort is actually quite remarkable. Today Governor Ron DeSantis signed SB 7072, a Florida law permitting citizens to sue Big Tech for deplatforming, targeting or censorship.
Under SB 7072:
- All Floridians treated unfairly by Big Tech platforms will have the right to sue companies that violate this law — and win monetary damages. This reform safeguards the rights of every Floridian by requiring social media companies to be transparent about their content moderation practices and give users proper notice of changes to those policies, which prevents Big Tech bureaucrats from “moving the goalposts” to silence viewpoints they don’t like.
- The Attorney General of Florida can bring action against technology companies that violate this law, under Florida’s Unfair and Deceptive Trade Practices Act. If social media platforms are found to have violated antitrust law, they will be restricted from contracting with any public entity. That “antitrust violator” blacklist imposes real consequences for Big Tech oligopolies’ bottom line.
- Big Tech is prohibited from de-platforming Floridian political candidates. The Florida Election Commission will impose fines of $250,000 per day on any social media company that de-platforms any candidate for statewide office, and $25,000 per day for de-platforming candidates for non-statewide offices. Any Floridian can block any candidate they don’t want to hear from, and that is a right that belongs to each citizen — it’s not for Big Tech companies to decide. (read full text here)

You have to ask yourself if DeSantis can move this fast on holding Big Tech accountable, why couldn’t our federal elected poltroons move as fast after they held hearings with Big Tech? After they saw repeated Big Tech targeting of political enemies? Censorship?
I guess they didn’t want to jeopardize a potential source of donations even if a few constituents were shut down.

One thing I don’t like about the bill is that deplatforming FL resident running for a NON FL state office (Senator, Congressperson, Pres or VP) only fines them $25,000 per day, TEN TIMES less than for statewide office at $250,000 per day. Yet NON state office holders are possibly a LOT more important to the country and the state of FL. I don’t think that part makes any sense. BUT that person can still sue, nonetheless WHY must legislators always make mistakes like this? Perhaps someone can explain to me if it bolsters the law Constitutionally or something but whatever.
At the end of the day, this is epic and if some other crooked red states are forced to put the same laws in place that will be a game changer.
Everyone call and thank everyone in FL gov responsible that you can because it has repercussions for everyone and then begin harassing your corrupt state to do the same.
Define “statewide”. If it means the candidate’s name appears on every ballot in every county, then the $250,000 fine applies to US Senators, President/VP – possibly other offices down ballot. Generally more local races aren’t as expensive to run, and there may be contribution limits that would make fines in excess of $25k more nuisance than punishment. Disclaimer: I am not from or in Florida, so this commentis speculation on my part. I’m thinking there’s a reason for the difference, however.

I heard law start day is July 1. If true, I will wager on (give or take by 3 min), July 1. But whoever gets it stalled the 3 min will need a MIGHTY good explanation to not hear his catch phrase as the door slams.

Ron and the legislators may not be able to influence the politically corrupted federal DOJ but they can sure make a difference by changing state laws to protect their citizens as they have shown. The big question is can class actions be brought under this law. If class actions can be brought, “Katie, Bar The Door. ” Big tech will have a tiny little problem. If I read the bill correctly 1) no discrimination between legally compliant users and 2) must notify users of actions taken. Conservatives in Florida are a damned big class and at $100k a member before anything punitive as well as legal fees, trail lawyers must be salivating like dogs at the butcher shop window. If I read this right Florida has unleashed the “Hounds of Hell” on social media.

Why would States wait for Federal Government to take action? Especially when the Federal Government continues to take on policies which harm States citizens?

States can correct or work ahead to prevent an overreaching centralized government which harm its citizens and/or limit their Rights.
