What a horrible argument. How can states give “tacit approval” to violate the Constitution? That is the issue in the Texas lawsuit.
You are hitting it directly on the head, but by not granting injunctive relief yesterday in PA, on a fairly obvious case of PA ignoring their own state constitution, the USSC is saying they abdicate their oath to ensure a republican (constitutional) form of government in EACH state.
PA ignores their Constitution, and the USSC ignores the US Constitution by accepting PA’s illegitimate action.
Plus the Supreme Court literally ignored the law, as the US Congress is responsible for legislating requirements to hold national office and the US Congress legislated the election date under that authority. The states, via state level; Executive Action, Legislative Action or Judicial Action have zero authority to change the date of National Level Elections.
From what I read and have seen they rejected it because our side didn’t have everything together when they went to the first court. Kind of switched directions when they found out they could go to supreme court. I know I explained that badly but I’m pretty sure thats what happened.
Great. Then Trump states can simply state that they only recognize Trump as the rightful president. Since we’re no longer operating according to the Constitution, states should just pick their own president.

The order yesterday likely has more to do with the fact that they simultaneously ordered the other states to respond to the Texas lawsuit.
Think of it this way: Let’s say Alito granted an injunction saying mail-in ballots cannot be counted if they were valid only as a result of an action taken by a court or other non-legislative body. What happens then? Let’s assume that the result in Pennsylvania as to Trump is switched. It’s still a non-issue. Biden wins without more.
But, the Court knows it can grant the same relief (although I doubt it will) in the lawsuit filed by Texas and, in addition, potentially grant relief that affects enough states to alter the outcome.
So, the Court dismisses the Pennsylvania action but it can still theoretically address these same issues in the Texas lawsuit. That’s the way the Supreme Court looks at it. I don’t want to give false hope. I don’t think the Texas lawsuit will succeed. But, it’s pendency allowed them to rid themselves of an obligation to decide the Pennsylvania lawsuit and still have a say on those same issues, but in a way that could have a bigger impact.

That’s not what happened. The Supremes were not about to decide a case of this magnitude on narrow procedural grounds. They were looking for a case with fundamental heft to it and Texas’ lawsuit fit the bill.
The Texas argument goes to the heart of the matter which is that each state’s approach to the Presidential Election (the only office representing the national electorate) must take into account every other state’s interest in fair and impartial adherence to election law. When an election departs from the law it raises the specter of impartiality and tampering. That cannot be allowed.
I have to say that this case is so well crafted that it almost decides itself.
Just watch. The Constitution doesn’t mean a damn thing anymore.

I think I agree with Margot re the vote fraud issue. The thieves intention re fraud is obviously to throw every ballot into an anonymous pile and FORCE the USSC to throw out the entire pile. In PA, they appear to have ignored Alito’s instruction to segregate disputed mail-in ballots, and just threw them all into the same pile. Once they’re in the pile, the USSC can say that “The cure is worse than the sickness, and would ‘disenfranchise’ (oh how I hate that word) voters.” They’re jabbering that Trump has to show invalid ballots in a massive pile of anonymous ballots, in other words. This was done intentionally, you may depend. We would have to get out in the streets and demonstrate in our tens of millions, in order to get off this slippery slope they’ve put us on re an eventual USSC fraud decision.
Dominion issues appear to offer an avenue of attack. States ignoring their own State laws and constitution offers another avenue. These are concrete, no anonymous ballot piles here.
It’d help if Bondo Barr would put those Detroit poll workers in handcuffs and charge them with state/federal election law felonies, as they deserve for throwing out poll observers and locking doors and cardboarding windows. They are on video committing these felonies. That should have happened the day after the election, perp walks, plea hearings on the charges… the works. That would have set the proper tone for all this, but I guess Barr is setting the tone that the Swamp and Deep State want… tacit approval of lawbreaking and election theft.

Retired Magistrate here: Let’s just take it one day at a time because that is all we have anyway. Right now this is headed in the right direction. I do believe the Supreme Court will send it back to the State Legislatures and let them elect the appropriate electors. Should be for President Trump given the evidence of fraud; however, we will see.
Don’t forget the President still has Executive Order 13484 to clean up the election process. This was never going to be easy. Please do not get discouraged. This is the Christmas season and miracles do happen!

If we can’t get a court victory and he then is forced to invoke the EO, then he looks like a Dictator/Tyrant trying to overthrow the govt and take the country. Marcia, I agree that sending it back to the states seems a likely remedy, but I’m not sure that ultimately helps. It’s in the state’s court now and for a variety of reasons, they’re unwilling to make a change. Will they somehow find the courage to fix this against the overwhelming pressure to leave the electors as they are? Hopefully the SC will not only recognize the fraud and violations of the law, but also recognize that the states continue to refuse to fix it themselves and not rely on them for the remedy.
I’m with you, OXO. I hope I am wrong, but I have lost faith that our Republican state legislatures have the courage to assign their electors to Trump if the SCOTUS chooses that remedy.
I am hoping the SCOTUS simply invalidates PA, MI, WI and GA electors and force this to the House. It is the option with the best chance of a positive outcome.

Executive Order 13484 is a 2009 Bush executive order titled “Amending the Order of Succession Within the Department of Agriculture”. I’m not sure how that could come in handy.
If you’re referring to the 2018 executive order “Executive Order on Imposing Certain Sanctions in the Event of Foreign Interference in a United States Election”, I’m not sure how helpful that is. I’m not a lawyer, but as far as I could tell from reading it, it doesn’t grant any powers of the sort some people seem to think that it does (like declaring martial law so a new election can happen).

AG Hunter challenged the constitutionality of the court’s decision to change the absentee ballot receipt deadline. Kansas, Nebraska, Tennessee and West Virginia attorneys general joined AG Hunter as amici curiae in support of the Pa. Republican Party’s petition.
Does anyone remember a response from the Pa. Supreme Court about the constitutional issue then? Or was the petition simply denied? I kept asking myself why no one was raising the constitutional violations to SCOTUS, instead of trying to prove fraud, cleverly concealed from detection in real time and from forensic tracing to the real time event even thirty minutes later.
Who would have ever imagined the brazen use of USB drives, Internet access given to foreign countries during an election of the president of the United States and suitcases of ballots, some counted multiple times without observers?
Moreover, who would have ever thought that a presidential candidate, who benefited from these overt acts to steal votes, would stand in front of a microphone and admit, unambiguously, “We have created the most extensive and inclusive voter fraud organization in the history of American politics.” Why has no one raised in court Joe’s public admission of creating an extensive voter fraud organization? It’s certainly not hearsay.
Judging by the reaction of the left, they really really don’t like this lawsuit. In many of their comments they still include “there is no fraud” even though this lawsuit is not about number one about fraud.
I think the seething is really about this lawsuit negating all the money and time spent over the last 6 months suing all these states to get the changes they wanted. This lawsuit basically takes away everything they’ve sued for, in that all the court decisions about elections are unconstitutional.
Hopefully the court will not see their responses as valid. We’ve already heard from the left that the election changes that were made were actually allowed by the state laws. The Supremes will likely have opinion on that.
As far as outcome, I believe the SC will send it to the legislatures with a ruling saying it is their duty to uphold election law and the electors clause, giving legal cover for the state legislatures to appoint Trump electors. It will still be portrayed as stealing but with a SC decision the reps will more likely go along. But, is there a blue governed state that Trump won that could throw a wrench in the machine and use the law to pick Biden electors? Messy!

If tbe SCOTUS fails to uphold the Constitution, if the obvious fraud is not dismantled and the will of the people illegally usurped PDJT has a duty & obligation to defend America from enemies foreign and domestic. He will invoke the Insurrection Act as he is legally authorized to do. He will arrest, detain, sieze assets as he is legally authorized to do. Anything less he would be derelict in his duties. He will not let America down.

Insurrection Act allows him to use the military for those things (arrests, detentions, etc.). Severe but necessary to save the republic and Constitution, which is his primary duty as President.

The fraud issue is not “clean” it requires the careful amassing of evidence that has been subject to cross-examination and verification, as findings of fact, and then it only gets to the US Supreme Court on appeal. The PA case ((which was not dismissed, only the motion for emergency relief denied, I think, because the Court is waiting for several of these cases to show up, then consolidate for a broad ranging disposition. The PA case and the Texas case do not rely upon the fraud allegations. Rather they rely simply on questions of law. No fact finding required. I am optimistic a landmark decision on voting is on its way that will make Trump fans, but more to the point fans of law and order, very happy. Ignore the media on this one. If you have time, go to SCOTUSBLOG and read the petitions, motions etc. yourself. Supreme Court pleadings are a model of simplicity and succinctness, readily understood, no law degree required.

The Supreme Court MUST be our backstop for supporting the Constitution. Otherwise we don’t have a country. The fact that there are now 9 or 10 states that are suing MI, WI, GA, & PA has to carry more weight than just one state suing the other four. SCOTUS is the only venue for this kind of suit. I don’t see how they can NOT take the case. If Texas et al wins, and I think they will, I hope the remedy is to have each state’s Legislature choose their Electors instead of the Congressional delegations. I keep hearing that all 4 defendant states have majority GOP delegations, and that is not true. Michigan has 8 GOP, 9 Dem, and 1 Libertarian who rarely votes with the GOP. If Senators are included, MI has 2 Dems. Either way, it’s not a GOP majority. MI State House & Senate are safely in GOP hands, though.
It is the individual state legislatures that choose the Electors.

The real issue here is: Are there 5 Supreme Court Justices with enough spine to grant the relief requested?
Don’t fool yourself into believing that the issue is whether the equal protection rights of Texas’s (or any other state’s) citizens were violated. That’s a vehicle to get access to the court, but that’s all it is.
Anyone paying attention when Justice Roberts ruled that Obamacare was constitutional as a tax will understand that judges’ views on the law are irrelevant at this level. Well, let me rephrase that: The issue is whether there are five Justice’s who will blindly follow their views on what the law requires.
My bet is there are not. The three liberal Justices will be joined by Roberts and Gorsuch. Those five will decide that citizens of other states don’t have equal protection rights that are entitled to constitutional protection vis-a-vis how another state chooses to run its election.
The Supreme Court’s order requiring Wisconsin, Georgia, Pennsylvania and Michigan to respond is just a way for the Supreme Court to assuage conservatives by letting them think they had their day in court.
I hope to be proved wrong on this one.
Sadly, I think you’re correct. This is the honeypot into which they hope to attract all who believe this to be a stolen election, so that the USSC can slap them all down decisively and with finality.
But if a state’s residents can’t sue to force a state to obey its own state constitution, and if another state can’t sue to force a state to obey its own constitution, then who DOES have standing to sue? Nobody? Do they just steal the election and nobody has recourse in law? That’s ridiculous.

As I read ton’s of opinions it all seems to boil-down, in my mind, to one inescapable conclusion. President Trump, once understanding the forces and reasons the Swamp exists, made the most logical of decisions. Basically, without trying to elaborate, President Trump marshaled his most effective strategy and charged forward. To me that looks like exposing the corruption, placing honest people in DNI, Military and Courts. Then leave it up to these Trump Administration entities to either follow our proscribed written, and on the books, Constitutional Law or watch while the whole thing destroyed itself. One man in four years no matter how tough and gifted he is can reinvent America alone.
Curious. If Texas prevails and ballots are tossed what effect will that have on down ballots? Are they wiped as well? Thinking of Perdue race in GA. I believe he was leading as well before the steal happened.
