Fraud Continues – Nancy Pelosi Promises House Impeachment Subpoenas Will Not Have Legal Penalties – House Will Not Authorize Impeachment Inquiry…

According to Capitol Hill members, via Politico, House Democrat leadership has taken a climate assessment of democrat House members and Speaker Pelosi announced they will not hold a House impeachment authorization vote.   As a direct and specific consequence all committee subpoenas do not carry a penalty for non-compliance.

A judicial penalty can only be created if the House votes to authorize an impeachment inquiry.  Absent a vote, the Legislative Branch has not established compulsion authority (aka judicial enforcement authority), as they attempt to work through their quasi-constitutional “impeachment inquiry” process.

Instead of subpoenas, Adam Schiff (House Permanent Select Committee on Intelligence); Chairman Elijah E. Cummings (Committee on White House Oversight; and Chairman Eliot L. Engel (House Committee on Foreign Affairs) can only send out request letters.  The compliance is discretionary based on the ideology of the recipient.

It is likely, highly likely, Nancy Pelosi does not have the votes to proceed with a full House  impeachment authorization; so Pelosi, Schiff, Engel and Cummings have to rely on the duplicity of the media to help them hide their scheme.  So far the media is complying.

Speaker Pelosi & Lawfare’s impeachment scheme can only succeed with a compliant media protecting it.  So far the media has been entirely compliant in not explaining the fraudulent basis for the construct.  If the media would ask questions the fraud would collapse.

Adam Schiff has to hide his hearings because the foundation of the impeachment fraud is to create a public impression.  There is no structural impeachment process or guideline being followed.  The committee leadership are using the closed door hearings to leak information to the media to create the needed narrative.

A legislative “letter” or demand request needs to carry judicial enforcement authority –A PENALTY– in order to be a “subpoena”.

There is no penalty that can be associated with these demands because the Legislative Branch has not established compulsion authority (aka judicial enforcement authority), as they attempt to work through their non-constitutional “impeachment inquiry” process.

It has long been well established by SCOTUS that Congress has lawful (judicial authority) subpoena powers pursuant to its implied responsibility of legislative oversight.  However, that only applies to the powers enumerated in A1§8. Neither foreign policy (Ukraine) nor impeachment have any nexus to A1§8.  The customary Legislative Branch subpoena power is limited to their legislative purpose. 

There is an elevated level of subpoena, made power possible by SCOTUS precedent, that carries inherent penalties for non-compliance, and is specifically allowed for impeachment investigations.  That level of elevated House authority requires a full House authorization vote.

In this current example the Legislative Branch is expressing their “impeachment authority” as part of the Legislative Branch purpose.  So that raises the issue of an entirely different type of subpoena:… A demand from congress that penetrates the constitutional separation of powers; and further penetrates the legal authority of Executive Branch executive privilege.

It was separately established by SCOTUS during the Nixon impeachment investigation that *IF* the full House votes to have the Judiciary Committee commence an impeachment investigation, then the Judiciary Committee has subpoena power that can overcome executive privilege claims. 

There has been NO VOTE to create that level of subpoena power.

As a consequence, the House has not created a process to penetrate the constitutionally inherent separation of powers, and/or, the legally recognized firewall known as ‘executive privilege’.   The House must vote to authorize the committee impeachment investigation, and through that process the committee gains judicial enforcement authority.  This creates the penalty for non-compliance with an impeachment subpoena.

A demand letter only becomes a “subpoena”, technically meaning: ‘a request for the production of documents with a penalty for non-compliance’, when the committee has judicial enforcement authority. That process establishes an enforcement penalty.

The current demand letters cannot carry a penalty because the demands do not contain judicial enforcement authority…. because the impeachment investigation was not authorized by the chamber.

The reason judicial enforcement authority is constitutionally required is because creating Judicial enforcement authority, creating the penalty for non-compliance, gives the Executive Branch a process to appeal any legislative demand via the Judicial Branch (federal courts).

Absent a penalty for non-compliance, which factually makes a subpoena a ‘subpoena’, the Executive Branch has no process to engage an appellate review by federal courts. This is the purposeful trick within the Pelosi/Lawfare road-map.

Pelosi and Lawfare’s plans are designed for public consumption; she/they are creating the illusion of something that doesn’t exist.  The purpose of all this fraudulent impeachment activity is to create support for an actual impeachment process.

Because the current Lawfare/Pelosi roadmap intends to work around judicial enforcement authority, the impeachment process is destined by design to end up running head-first into a constitutional problem; specifically separation of power and executive privilege. That predictable constitutional issue will end up with arguments to The Supreme Court.

THAT appears to be why Democrats and left-wing activists have been working for months to de-legitimize the Supreme Court. They always intended to run into this problem. They planned for it.

The Lawfare impeachment road-map is designed to conflict with the constitution. It is a necessary -and unavoidable- feature of their impeachment plan, not a flaw.

Speaker Nancy Pelosi and her Lawfare allies can change House rules (they did). Pelosi and Lawfare can also change House impeachment rules (they did). Pelosi/Lawfare can change committee rules (they did); and in doing so they can remove House republicans from the entire process… Which They Did.  However, what Lawfare and Pelosi cannot change is The U.S. Constitution, which they are destined to collide with.

Speaker Pelosi’s ‘Lawfare House rules‘ and/or ‘Lawfare impeachment rules‘ cannot supersede the constitutional separation of powers.

Nancy Pelosi cannot decree an “official impeachment inquiry”, and as a consequence nullify a constitutional firewall between the Legislative Branch and Executive Branch.

        Actually there is now more than enough justification for the Senate to simply drop it if it ever got that far. Ignore House findings and run out the clock. Under the circumstances it is doubtful they would see any backlash in dropping an unconstitutional witch hunt.

        Your post reminds me of the founders warning about our type of government only being fit for a moral people.

        There will be consequences for what they’ve done, and I think we can take President Trump at his word when he says this must never be allowed to happen again, but the consequences for the evil we are witnessing probably won’t happen the way we wish it would.

        Color me naive and old fashioned, but I always thought protecting the country from this kind of coup attempt is what sedition and treason laws were all about.

      The Founders provided the legal means for our own defense, in particular in fire times such as these, in the 2nd Amendment. Most gun owners skip over the words regarding the Militia and ensuring a well ordered society.
      Citizens with Rifles and sufficient ammunition is the Greatest barrier to UnConstitutional Government Tyranny. Also the Experienced Patriots, aka Veterans, can help create the organizations when needed, But the mere presence of millions of Armed Citizens scares these NWO Globalists-marxists Traitors in our country, hence their paranoia over guns, especially “assault” rifles.

    Sounds more like a feature than a bug. Anti-Trump administration officials can pretend they didn’t want to spill the beans but were forced to reveal x y and z which makes their testimony sound more credible. People who support Trump are likely to decline the invitation, giving the Democrats an opportunity to complain instead of contradictory testimony to explain.

          Very true! President Trump saw through this smokescreen of bullbutter weeks ago, when he called Pigglosi’s bluff – “If you want to impeach me, then call a vote! Put it on the record!” (paraphrasing of course). Many of us have supported this move.

          Pigglosi never had the votes, and she knows it. This past election in Louisiana confirmed what many of us have known from the beginning (except of course the genius prognosticators at FOX News, with their 14-point democrat weighted poll). and the total evisceration of the “America-hating Party” is both a confirmation and a justification.

So as Shiff and Nadler continue to make asses of themselves, CNN continues to be exposed as a leftist propaganda group for the DNC thanks to O’Keefe and that patriotic and now unemployed former CNN contract worker, I sincerely hope that Barr and Durham get it together and show the corrupt politicians and federal workers caught up in the attempted coup of our DULY ELECTED PRESIDENT that heads are going to roll and people will be held accountable in a court of law for their illegal actions.

    I don’t think Pelosi wants a House vote unless she thinks the Senate will vote to remove. Even if some GOP senators would like to be rid of President Trump, there probably aren’t 20 of them while 90% of Republican voters are sticking with the president. And I can’t see republicans turning on the president – if only because they don’t want to let rat bastards like Schiff and Comey and Rachel Maddow and all the purple haired weirdos get a win. This is war and we won’t give in any more than the Left will. So the composition of the Senate gives us an edge.

They’ve done the polling; they know if they visibly oppose Trump — let alone vote to remove him from office — those careers are over.

      Careerism is the main reason the federal government must become MUCH smaller: At the size we have each Congressman can move so much money that every large organization MUST BUY several. Citizens paying them a paltry $700/day have no chance against $18,000/day in ‘campaign contributions.’

I knew Clinton and his evil “wife” were commies and I had pretty good reason to believe that old man Bush was in a similar orbit. I voted libertarian in 2000 because I knew that young Bush was Barbara’s son and that he had to share much of her leftist ideals, in addition to those of his old man. What I did not know was the depth and breadth of the Communist infiltration of the Republican Party. It is now clear that the entire “neoconservative” movement was a subversive, Communist operation.         It has to start at the local precinct level, and then district, county and State.

      Fiona Hill was involved in writing the dossier that was used to topple the elected and presidency of president Trump.

And then then Republicans would still be in control of the House.

    This has the legally dubious, sleight-of-hand feel of a Special Counsel being appointed under statutory mandate for a *criminal* investigation, when in fact no criminal predicate has been identified; the criminal investigation then used both the powers of a prosecutor — and the tools and tactics of a counterintelligence investigation to gin up a narrative, any resistance to which becomes the crime. Just like resistance to improperly wielded “subpoena powers” becomes the crime.

    Both possible ONLY because the media and the majority of Congress are unwilling to say the sky is blue and the world is round. And a disturbing number of our countrymen can stare at the truth and not believe or absorb it, simply because authority figures refuse to do so.

      I see your analysis as a result of what we can expect. But, I would like to focus on the motivation that produced the result.

      It seems to me that Pelosi and Schiff and others in our government are motivated by the need to avoid prosecution for their actions in the Ukraine and to continue with their current positions and lifestyle. And so it follows that Pelosi and Schiff must create a distraction big enough to avoid prosecution. This is leading to the constitutional crisis as outlined by Sundance.

      It has been documented and on other publications (such as, Gateway Pundit) that Pelosi and Schiff our arranging government contracts for a Ukrainian arms Dealer. Naturally they want to avoid prosecution and for this information to remain unknown. They seem to be even willing to destroy our Constitution and our way alive in order to avoid payment for their actions.

    No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.
    So I have to ask, what Law authorizes the Democratic Caucus (not “The House”) to spend money and use House staff and facilities for the activities they have engaged in for these last 10 months?
    Should they be allowed to continue? Spending without authorization is a felony. Should someone at least demand the DNC reimburse the Treasury for the money spent on unauthorized activities.

    The question should not be
    “Are you authorized to do that?”
    but
    “Are you authorized to spend Money from the Treasury doing that?”
    Lets put a stop to this mess, OK?

      Yes, “The Democratic Caucus (not “The House”)” has commandeered funds from the treasury to be used as an election hammer against the President via it’s not taking a full House vote to initiate an impeachment.

      The Specious Impeachment, like the Specious Counsel, is illegally concocted, and [both] should be considered misappropriations of public funds used as an election tool and a violation of:

      “18 U.S.C. § 371 Conspiracy to Defraud the Government. In summary, those activities which courts have held defraud the United States affect the government in at least one of three ways:
      [cited in JM 9-42.001]
      1. They cheat the government out of money or property;
      2. They interfere or obstruct legitimate Government activity; or
      3. They make wrongful use of a governmental instrumentality.”
      -each shall be fined under this title or imprisoned not more than five years, or both.

      Also, the Senate’s role in this extra-constitutional process, connived by House leaders with their ‘lawfare alliance,’ is either obliterated or truncated, depending on whether or when the House ever votes on articles of impeachment. The trial by proxy can go on [indefinitely] or until the next election cycle, when the balance of power may or may not shift in the House or the White House.

      This trial, by proxy, is conducted by a biased Chairman behind closed doors using ‘select’ witnesses to testify. Schiff then frames the proceedings through a biased media and a biased press for consumption by the general public, who also by proxy, become the jury. The intention is to get The President’s poll numbers to tank.

They should be working to shut down every committee and every vote and use every procedural delay in every situation regardless of its relevance to the attempted coup. The name of the fake-whistleblower should be announced in every interview, just say it, and the GOP should walk out of every hearing and announce exactly what the witnesses were asked and what their responses were REGARDLESS of whether it is some stupid delineation between “deposition” and testimony. They need to grow a spine and exercise some good old fashioned civil disobedience.

    This crap the Democrats are pulling is a lawless act, and it demands lawlessness as a response.

He calls it a hoax every day, but he should call it a fraud. A hoax can be perpetrated without malign intent. A fraud is an illegal act designed to take power and treasure from the victims. In this horrible case, the U.S. citizen is the victim (except for the actual perpetrators in politics and the media).

Roberts has already made his bones in that regard, and I fully expect Kavanaugh to do likewise, which is the likely reason McConnell maneuvered his nomination on Trump. Kavanaugh hadn’t been included on Trump’s pre-election list, and we can be certain that was a carefully considered list.

          You can call it a marker, you can call it illegal coercion of Swamp creatures using alphabet agency spying, you can call it whatever you want, but I’ve come to believe that the entire system is corrupt and corruptible including the SC. The Swamp knew good and well that the next president might pick 3-4 SC judges, and they would surely have an action plan to mitigate the damage that might do to the Swamp.

        Let’s try to move through some of the possible actions. One would be to pack the Supreme Court with socialist Democrats, another would be to assassinate or in some way Incapacitate setting Republican Supreme Court justices.

        Another approach would be to implement a constitutional amendment that would in effect change the makeup of the Supreme Court and perhaps even that of the executive and legislative branches, too.

        All of these would seem to take time, time the socialist Democrats don’t appear to have before election time in 2020.

        So whatever they got planned must be pretty expedient?

          Are we on the same page? I’m confused and thinking out loud but not disagreeing with you. Anyway, I suggested their plan might be to “expediently” replace the justices because otherwise they might as well try to have him removed via the 2020 election of they don’t need him out immediately. Reconfiguring the court quickly or somehow leveraging the justices are the only logical ways to successfully deal with them if they can’t wait till 2020.

          Anyway, it goes again to the claim that they have a plan to oust DT that can somehow be executed despite a sure SCOTUS firewall, and that delegitimizing SCOTUS is a working part of that strategy. This is SD’s claim as I read it but again, I don’t see the exact mechanism for how that happens in this article. Hence my thinking out loud.

      The plan is nothing so lofty. Her it is:

      1) “Subpoena” an individual with some connection to the Trump administration, no matter how irrelevant.

      2) If he responds, leak selected portions of the testimony. If he does not respond, shout “Obstruction!”

      3) Watch the polls in Trump’s 2016 districts, especially those represented by a Democrat now. That is the most important step, by the way.

      4) If the polls do not move appreciably, repeat as necessary until they do.

      Right now Pelosi does not have a majority for impeacment. She is not “protecting” her members. In fact she is increasing their chances of defeat next year. Until they are on the record as opposing impeachment, they will almost certainly lose in 2020.

In both your cases President Trump would be voted out of office, illegally but out of office. This is what the coup plotters would like to have happen in order to cover up their corrupt and illegal actions in the Ukraine for starters. Voting President Trump out of office would not be a constitutional crisis.

    The DEMS and their allies in the media are carrying out a de facto impeachment with constant, 24/7 allegations, whistleblowers, insiders’ leaks, twisting of anything the president says to make it controversial and “evidence of instability,” etc. etc. etc.

    They are using Stalin’s and Hitler’s and Mao’s technique of REPEAT THE BIG LIE in the hope that enough Americans will believe that something is wrong in the White House, and elect a DEM to end the daily, hourly barrage about how awful President Trump is.

    The House will not impeach the president and the Senate will not vote to remove him: therefore , a de facto impeachment via endless investigations, gossip, rumors, and outright lies must take place, so that the removal of the president will be done by voters in November 2020.

    Yes, the DEMS obviously believe that this will work, or that it is their only option.
