Lawfare Group Begins Delegitimizing Supreme Court…

By now everyone is familiar with the Lawfare network; an alliance of ideological political interests inside and outside government who use the law to achieve their objectives.  [Specific Example Here]

During the Obama administration the Lawfare group: (1) weaponized the IRS for political targeting; (2) weaponized the DOJ and FBI for political targeting; (3) weaponized the intelligence community for political activism; (4) created new legal theories around ‘disparate impact’ to weaponize the National Labor Relations Board; and generally used embedded officials to advance far-left political interests across the spectrum of govt.

After they lost the 2016 election the Lawfare group immediately: (1) worked to delegitimize the presidency of Donald Trump; (2) delegitimize National Security Adviser General Flynn; (3) target, disempower and isolate AG Jeff Session; (4) delegitimize AG Bill Barr and the institution of the FBI outside their control; (5) delegitimize DHS, Border Patrol and Immigration Customs Enforcement (ICE); and (6) delegitimize any institution or office that would now be removing or overturning their former Lawfare constructs.

What we are seeing today from the Lawfare Alliance appears as a designed effort to continue this overall agenda; now focused on delegitimizing the Supreme Court of the United States.

In the last few months the Supreme Court has been moving toward eliminating the ability of Lawfare allied federal judges from ordering nationwide injunctions.  The latest SCOTUS decision was 7-2 to stop this Lawfare practice.  If activist judges are stopped from blocking executive branch policy, this creates a serious problem for the Lawfare Alliance.

Simultaneously, President Trump is filling vacancies on the federal bench at a strong rate.  President Trump has now appointed 150 federal judges into the judicial bloodstream.  This further impedes the ability of the ideological Lawfare Alliance to achieve their objectives.

With the Supreme Court tenuously holding a 5-4 conservative outlook, and the strong possibility the loss of Justice Ginsburg might create a 6-3 court, the Lawfare group is now lashing out and planning for ways to retain their position.

The next Supreme Court calendar is likely to be devastating to the ideological left.  The court is scheduled to hear arguments on everything from gun rights cases to the Census citizenship question and a likely defeat over Obama’s unconstitutional DACA executive action.   Losing on the DACA case would be a catastrophic defeat for the political left, who have weaponized open-immigration for maximum political value.

It’s the DACA ruling in combination with New York State Rifle & Pistol Association v. City of New York [(arguments Monday, Dec. 2) whether the city’s ban on taking a handgun outside city limits violates the Second Amendment] that could lead to major trouble for the Lawfare Alliance.

Ideologically it is possible the Lawfare Alliance will attempt to ignore the Supreme Court DACA ruling by taking a similar approach to their Sanctuary City policies.  That is to say the ultra-far-left political activists will demand ‘blue states’ do not comply with the Supreme Court decision and set up some internal sanctuary network that defies the SCOTUS ruling.   You can imagine this approach would be a problem, as defiant states openly rebuke the Supreme Court.

….So following along with what we know about how Lawfare operates, the current attacks to delegitimize Justice Brett Kavanaugh really give the appearance of entreaties toward delegitimizing the rulings of the court.   Rulings such as the pending DACA decision.

That appears to be the strategic purpose for the Lawfare Group to weaponize their ideological allies in the left-wing media, and to start hyping the SCOTUS antagonism now.

Creating a crisis to achieve their results, is simply how the Lawfare group work…

          It isn’t necessarily a matter of religious faith at all since many Jews are atheists or agnostics. Jewishness is an ethnic identity which may or may not include belief in that peculiar and ancient religion. What it does seem to include is a belief in left wing politics as the solution to all problems.

        There is no reason for you to bring up the Jewish religion as it has no bearing on the people involved in the lawfare being leftists.

        And there are plenty of people who are of the Jewish faith who are on the right and in full support of President Trump.

          I recall that Weissmann’s name, with 2 N’s, is usually the Gentile spelling in Germany. Wikipedia does not mention his religion.

          Religious Jews are more likely to vote Republican than secular Jews.
          Jews of all philosophies are more likely to vote for the Conservative Party in Canada than Jews for the Republican Party in the USA, particularly religiously observant Jews.

          Conservative Prime Minister Stephen Harper was a huge champion of Israel, and was hated by Leftists around the world for that reason. I recall conservative talk show host (and Jew) Dennis Prager citing a worldwide poll that had Harper listed as a leading threat to world peace. Now how exactly would that come about?

          It’s becoming a prosaic observation that Liberalism is now both the religion and the political philosophy of secular Jews. For our society in general, the decline in the moderating influence of Judeo-Christian values is having a destructive effect.

        They are mainly the academicized, those who depend for their status and income on their academic degrees. The simple fact is that most Jews who rise in status in this country do so *because* they first got a college degree, and they know it! They are too often willing to discard their faith, in order to raise their status.

        This is what is demanded consistently during the last 50 years of academia, and the demand has been listened to. Indeed, this demand started during the years when anti-Jewish discrimination inside of academia first peaked between 1910 and 1940. The core problem is inside academia, and academia’s institutional incentives to increase political allocation of wealth, not in their Jewishness.

        They believe in that one world order under communist rule. They understand how the human condition is the biggest impediment to the success of their implementations, but just as in the case of the Soviet Union, they had a way of pretty much killing or disappearing people who were human enough to rock the boat.

        That’s who they speak for. People bent of creating a world-wide communist order because such an order cannot survive unless it’s global — it cannot survive if there are other countries not buying into any of it. I was born into and survived the cold war. To me, it’s pretty clear… many many things are clear — especially what it does to the people affected by it. Most of them simply want to escape. But under a one world order, where is there to escape? The answer is obvious.

Its job is to PROTECT the Due Process rights of US citizens, This secret Star Chamber court, which should not even exist, has totally failed in its Constitutional responsibilities. It failed multiple times, as it continued to rubber-stamp and extend political spying on the President. The Judges, who should be removed by Justice Roberts, surely and certainly knew this was a political spy operation, but went along with the coup plotters.

      Despite their high Constitutional responsibility as a Secret Star Chamber Court safeguarding the 4th Amendment rights of unknowing and unrepresented US Citizens, the FISC rubber-stamped spying on hillary’s opponent without any careful on-the-record HEARINGS or questioning about reliability or probable cause for the spying on a candidate and then elected President. If the FISC had done its job, no spy-warrant would have been issued, The FISC was even forced by Admiral Rogers to admit 85% of spying search on its watch has been illegal.

      Remarkably, the FISC has never disciplined the attorneys and evidence-oath-swearers for withholding information or fraud on the FISC, and never withdrew the fraudulently-obtained warrants to spy on PDJT. In the case of “MOTIONS TO SPY ON HILLARY”S OPPONENT”, such an Advocate General Office would have clearly understood the constitutional issues of political spying, required proof that Carter Page was a dangerous foreign agent (who was actually a known FBI/CIA witness asset), asked how the FBI knew Papadoc might be bringing $10,000 undeclared cash through customs, ask about hillary/DNC fabrication of the unverified Pee Pee dossier, ask who paid Steele, Misfud, Turk and Halper, ask how much money Downer gave to the hillary foundation, asked about withheld evidence of unreliability and bias of Steel, etc.
      Such a secret Star Chamber Advocate General could file motions to discipline DOJ/FBI liars, and to withdraw fraudulently granted Warrants. The Advocate General Office would have authority to petition the Chief Justice (here Roberts) for removal or impeachment for bad behavior of FISC judges (with permanent copies to the US President and the Congressional Judiciary committees). The AGO would not report to the DOJ, which presented the political “motions to spy on hillary’s opponent”. . AGO attorneys would be hired by the President, and report to the President and the House and Senate judiciary committees, and the Chief Justice, to divide power. Even crooked, complicit FISC judges now relying on secrecy, would need to be more careful.

POTUS pushing back with the warning about the attempt to force Kav to vote with the libs, when he was actually warning Roberts, a swing vote essentially, not to vote with the libs because he’s afraid of the fall out from supporting a Kav vote?

      Roberts is in a vise now, and isn’t capable of cleaning up anything. Any cleaning up will done to him, not by him.

    Frankly, I think we conservatives have been much too easy on corporations which have bowed to the left all these years, starting with their succumbing to the threats of guys like Jesse Jackson and Al Sharpton.

    I know conservatives say they don’t believe in boycotting businesses but I think it’s necessary. You don’t have to throw rocks through their windows; rather, en masse, you have to let them know that if they continue to “take sides” with progs, they will pay a price, a heavy price in losing customers.

    Seems to me a light need to be shined on Lawfare.

    • I don’t boycott. I am, however, a little choosy about where I spend my $$. I haven’t been to Target since the men were welcomed into the little girls’ changing rooms. I haven’t spent $$ on a Hollywood movie in over a decade. I refuse to purchase or listen to music that denigrates women or condones violence. None of that is a boycott. It’s careful spending.

Does anyone know of a good source that compiles all the stuff we know, like that the supermarket Ford remembers was built years later, the utter farce of Blasey-Ford’s “lie detector” (polygraph) test and what she attested to (or not), the fact that the door they built happened at the wrong time, and how the legal privilege of one’s counsel with a psychiatrist comes into play to evade questioning, the lie about being afraid of flying, her scrubbing social media, etc.?

    I’ve seen so much and I remember it, but sources vanish so quickly and it doesn’t help that Google is burying them just like they bury TCT as we learned from that Google leak….

        But until then, for the people who didn’t follow it very closely, I’d like a good timeline of how her story changed and all the evidence to the contrary. There’s so much, but it’s all getting lost over time. It really needs to be a good collection of original sources, like the building plans for her house and the grocery store and other government docs that are hard to source.

    The attacks on Kavanaugh reached an intolerable point long ago and Justice Kavanaugh should sue the accuser/s. If it was Justice Ginsburg or Justice Sotomayor being regularly defamed about some alleged illegal action in their distant past, it’s likely Justice Roberts would speak out.

    It’s far worse to slander and defame a SCOTUS Justice with despicably false or unprovable accusations than it was for P Trump to accurately criticize the Lawfare activist judges in California. That caused Justice Roberts to speak out and defend the activists.

    All that aside, P Trump’s powerful, resilient Presidency is weakening these sleazy manipulators as SD pointed out and hopefully it will continue to weaken them for 5 more years plus whatever days apply.

    IMO, the rule of law is now just a concept, and it is multi-tiered in its application depending upon a criminal’s status and party affiliation.

    Would love to see Justice Kavanuagh follow the suggestion of POTUS and bring a libel action, framing a template for others to successfully follow, and place inferiors courts in a position of opining he is unable to state a cause of action or survive summary judgment. With all of the infringements haphazardly enacted against the 2nd Amendment, media insulation through the 1st Amendment seems more than ripe for judicial review. The media (what is it now – 6 or so companies owning almost all of it) marches lock, stop and barrel in messaging reticence in opposition to gun control. I trust Brett is a good person, but the media has certainly left that trust to be somewhat blinded and worthy of redress.

      I, too, would love this. I fear, however, that it’s a high bar. We all know the damnable lie of it, but the standard for defamation is “actual malice” given that Kav is a public figure. Even if we prove that he didn’t traumatize her, she could retreat behind the shield of victimhood to evade the actual malice by just giving jurors enough doubt about whether she was mistaken instead of malicious.

      I personally have zero doubt that this was a brazen, malicious, calculated lie that meets and exceeds the actual malice standard, made obvious by how it was constructed for maximum legal defense, but I have little confidence in 12 jurors coming to the same conclusion and see that a loss in a forum where the burden of proof was on Kav due to the high bars imposed by various SLAPP laws would be a propaganda tool.

      So, as sick as it makes me, he’s probably better off ignoring it and leaving it up to them to prove it against him instead of bringing a defamation lawsuit which would put some of the burdens on him to prove his own innocence.

      But make no mistake, I am under no delusion that this was anything but a carefully planned smear campaign premised on an utter lie. Anyone who dares compare it to Bill will get asked “so, where’s the blue dress?”

      Kav had better watch his trash… I have no doubt they will keep trying to fabricate something. You’d think that the history of proven liars who went after him would count for something, but these people are delusional.

        Not only that.. but Kavanaugh HAD to come out and fight against these lies during his confirmation, but now as a sitting Justice on the SC, he almost degrades himself to have to fight the charges, and force them to show what they got.

        In the meantime, he would have to be taken out of any decisions on the court. Gee… maybe that is the whole point!!

    I think the left has already written off RBG’s seat which is why they are desperate to take down Kavanaugh.

    They think RBG will be gone before 2020 so they are hoping to put enough pressure on the system to do three things:

    1. Delay any SCOTUS nomination because of the impeachment of Kavanaugh. “We can’t consider another nominee while in the middle of removing a sitting judge.”

    2. Drag out his trial in the Senate so it will go past 2020.

    3. Win in 2020 and therefore save RBG’s seat from Trump.

    They won’t even care if they don’t get enough votes to remove Kavanaugh. It’s all about saving RBG’s seat for a Democrat.

    I’m also tired of anonymous sources being used all the time by the media. I support the First Amendment but I’m of a mind that if you’re going to make accusations like this it needs to be on the record and out in the public.

      I am past hating these crazy people…Now I just worry about them, and their kids and neighbors, and their ability to even take care of themselves. You cannot be this blind without something terrible happening eventually. It must be awful to surround yourself with only hatred and darkness. They cant even see anyone thru any lens other than politics. Despising half of your fellow Americans is just a horrible way to live. I would guess that its only about 10-20 percent of the population, but they scream like they are the majority.

  40. I frankly place very little emphasis on what “Democratic candidates” (sic) say about much of anything, and I also believe that the Lawfare Group’s influence is rapidly disappearing. They managed to make a ton of money (at least 50% of which should be refunded) creating the Mueller Report, and they continue – for now – to have the ear of “Democrats Who Hate Orange Hair.” But their legal theories are basically worthless.

    What they have – for now – mastered is “the art of making headlines.” But third-party fame and third-party political influence is an astonishingly vacuous thing in Washington, DC.

      The press plants a false story, it creates headlines, talking points, pushing the right buttons to create the frenzy for congressional calls for impeachment, all based on fake news.

      They did it to candidate and then President Trump, continue to do it with anyone in this administration, now easily doing it to a sitting Supreme Court Justice.

      Yesterday we saw Congress step aside to insert a private lawyer to interrogate a private citizen on national television about an incident that never happened (didn’t give the memo to then AG Sessions) for a crime that never occurred (collusion/obstruction).

      If the head of the Senate Judiciary committee, Graham (who I doubt has the ability) or the head of the Department of Justice, Barr (jury still out), don’t take control over this situation, whether through holding to account the media’s use of false stories in order to influence congress and the courts, we will soon see the new darlings of the media, the googles, facebooks, twitter owners of the world with their blatant use of disappearing voices they don’t like, we will soon see the calls for Constitutional amendments to end both freedom of the press and freedom of speech will make the current calls to end the right to bear arms and ending the electoral college look like child’s play.

      Good Lord, how long have we been asleep in this nation? Have we awakened in time to save it?

    The problem Lawfare is that the left has become as toxic as Jim and Tammy Faye Baker were to Christians. Their tactics bring in the sucker money and keep their most faithful followers engaged , but the pool of their loyal suckers is dramatically shrinking, not growing.

    I know lots of otherwise intelligent dyed-in-the-wool progressives and they will suck up anything to maintain their feelings of superiority over the Deplorables. But when they realize that the billions of poor, diseased, homeless are not going to be taken care of with Federal money and instead will be supported by their own state (and thus their own community), they will be the first to wank and demand border control.

    In 1989 after serving 26 years as a soldier/cop and in my third year as a civilian police chief, I prepared 12 of the 15 lessons learned presented below as part of a book I was writing detailing my experiences as an American soldier and police officer. Everything I have seen, read, and heard since D.J. Trump walked down that escalator in Trump Towers has convinced me that all of the original 12 lessons learned and the three I added recently are more relevant today than they were 30 years ago. The behavior of most of the American political class, the American bureaucracy, the American media, and American Academia has also convinced me that God still loves Americans and America. I know this because God has sent us a true leader who has clearly displayed that he has mastered all of the Seven C’s of Leadership (see lessons learned #2). I believe God sent D.J. Trump here to lead America to a height we have never imagined. I also believe God has/is demonstrating that he has a sense of humor. Why else would he place so many blabbering idiots (i.e. media, politicians, bureaucrats, academicians, etc…) among us generally insulting the intelligence of the dumbest among us with their daily doses of pure manure? Today’s media, bureaucrats, academicians, and political class are the same and/or newer versions of those that inspired the lessons learned presented below and a book yet to be published (due to the amount of still classified material therein). The title of the book may provide a hint or two as to my basic attitude. The book’s original title was: Rape, Pillage, Plunder; America You have Been Had! After B.H. Obama was elected to his second term I re-titled the book. The new title is: Rape, Pillage, Plunder; America You have Been Had. And, It’s Your Own Damn Fault!

    NOTE: In consideration of my fellow Americans with sensitivity issues I have omitted four of the original lessons learned.

    A Soldier/Cop’s Lessons Learned

    1. Soldiers (ground combat soldiers, that is) do not fight first and foremost for their country, the flag, motherhood, nor apple pie. Before all else, soldiers engaged in ground combat fight for their fellow soldiers and their unit.

    2. The Seven C’s of Leadership according to a 1980 survey of 1646 of Vietnam era ground combat veterans listed of the order of their importance are; Candor, Competence, Consistency, Commitment, Courage, Compassion, and Courtesy. The reason the soldiers in the survey chose the word “candor” is because to them candor encompasses both omission and co-mission. To a combat soldier lack of absolute candor, be it co-mission or omission, are equal sins! In short, soldiers expect/demand absolute candor from their leaders before all else.

    3. Omitted.

    4. The American people are the most effectively lied to people in modern times thanks primarily to the American political class, the American bureaucracy, the American media, and American academia.

    5. Arrogance coupled with ignorance equals stupidity.

    6. The greatest threats to the American people are the corrupt and/or incompetent politicians/bureaucrats/academicians found at every level of government/academia, and the majority of the American so-called media.

    7. Most of the politicians/bureaucrats/academicians I have encountered during my years as a soldier/cop I most kindly refer to as; self-serving, witless, cowards.

    8. The American Profession of Arms and our brothers/sisters in blue have failed to protect the American people from all of their enemies, both foreign and most especially domestic.

    9 – 11. Omitted.

    12. There are only two primary requirements to be a career soldier and/or cop in America. One must be smart enough to do the work and dumb enough to take the job.

    13. American soldiers and police officers must in addition to mastering all of their professionally mandated tasks, learn to accomplish the same with at least one arm tied behind their backs and their vision impaired 50% or more. (Added 2019)

    14. After carefully watching the whole of the political class since Donald J. Trump walked down that escalator in Trump Tower to date, I can say without reservation that most of the group will sell their souls and our bodies just to remain in power. (Added 2019)

    15. Want to see what the United States of America will look like if the left takes control of the government? Take your pick, New York City, Baltimore, Chicago, San Francisco, Los Angeles, or the complete package; California. (Added 2019)
