DOJ Once Again Changes Trump Seizure Evidence List Dropping “Empty Classified Folders”, and Continues Refusing to Give President Trump Lawyers the Affidavit Used for Search Warrant

In a recent court filing [Document Here] President Trump through his legal counsel has requested Judge Cannon to unredact and unseal the search warrant affidavit used as the predicate for the FBI raid on Mar-a-Lago.  Apparently, the DOJ have yet to provide President Trump with the constitutionally required predicate documents to support their search.

Additionally, the DOJ previously leaked to media about “empty folders with classified banners” as part of the evidence cache they collected.  According to the filing the DOJ has since presented three different versions of their evidence collection list, with the most recent list dropping any claims of “two empty folders with classified banners.”

[Source, page 4]

While asking the court to provide the affidavit to the defense team, the lawyers for President Trump are noting the fourth amendment protects everyone against warrantless searches and seizures, and that same protection also guarantees the target the right to receive and review the claimed justification for the warrant.

The unredacted affidavit is obligated to be supplied so that it can be determined if the search warrant was legally valid and predicated.  General search warrants are not legally permitted.  The warrant must specify what is being searched and why.  The DOJ is fighting against this affidavit release.  The Trump lawyers are asking the judge to make a decision.

Foreboding Signals Amid Discovery the FBI Can Launch Pegasus Cell Phone Targeting With Appointment of Special Counsel

If you read the article about the “Pegasus Project”, spyware created to infect cell phones that was marketed by Israeli intelligence through a company called NSO {Go Deep Here}, then you essentially know the background.  Pegasus is “no click” targeting spyware that can be deployed against cellular phones, simply by inputting the phone number and transmitting to it.

The Guardian previously reported, “Claudio Guarnieri, who runs Amnesty International’s Security Lab, said once a phone was infected with Pegasus, a client of NSO could in effect take control of a phone, enabling them to extract a person’s messages, calls, photos and emails, secretly activate cameras or microphones, and read the contents of encrypted messaging apps such as WhatsApp, Telegram and Signal.”

Pegasus was deployed to target tens-of-thousands of cell phones by the people who Israel sold the spyware to.  The Guardian, and a group of allied leftists in media, were previously granted access to a leaked batch of 50,000 phone numbers that the Pegasus software was operating in.

In a recent update from the New York Times they stated, “[it] has been used by police and intelligence services to hack the phones of drug kingpins and terrorists, but gained notoriety when it was revealed that governments, like Saudi Arabia, Mexico, Hungary and India, had deployed it against political dissidents, journalists and human rights workers.

It was also recently revealed the U.S. FBI under Director Chris Wray purchased the Pegasus program for “FBI experiments” and “exploration” into how the spyware program could be used domestically.

The FBI was initially reluctant to reveal their ownership of the Pegasus program, however, within FOIA documents related to the potential for domestic surveillance and concerns about fourth amendment constitutional protections, the FBI admitted they retain the capability – but promised it has not been deployed.

(New York Times) – […] The Times revealed in January that the F.B.I. had purchased Pegasus in 2018 and, over the next two years, tested the spyware at a secret facility in New Jersey. Since the bureau first purchased the tool, it has paid approximately $5 million to NSO.

Since that story was published, F.B.I. officials, including Mr. Wray, have gone further than they did during the closed meeting with senators last December. They acknowledged that the bureau did consider deploying Pegasus, though they still emphasized that the F.B.I.’s main goal was to test and evaluate it to assess how adversaries might use it. Sunday Talks, Democrat J6 Committee Confirms Intent to Transfer Evidence to Special Counsel During Lame Duck to Begin Republican Targeting Operations

If you doubted the intent of the primary function of the appointment for Special Counsel John Smith, you can put that doubt to rest now.  Appearing on CBS FtN Democrat Rep Zoe Lofgren confirms the intent of the Garland appointment is to receive evidence from the J6 Committee and utilize that evidence in the targeting operation against Republicans in congress.

Read the carefully worded statements from Lofgren and compare them to the background we previously outlined.  Everything is clear.  WATCH:

Primary goal, create enough of a legal mess as to obstruct any republican legislative effort against the Biden White House.  Additionally, if Smith’s DC team can pick-off a few republican House members under charges of “supporting an insurrection“, the political power will revert back to the Democrats in office.

They didn’t just think this up overnight.

This is why the January 6 committee never ended.  They are using J6 as a weapon against their losing the House to republicans.  The Democrats are now structurally targeting Republicans with the appointment of Jack Smith.  It’s actually a brilliant move.  The executive is now investigating the legislative branch; the legal structure of this eliminates the separation of powers issue.

The DOJ is not investigating republicans, they are investigating defined criminals; insurrectionists that are national security threats, that happen to be republicans.  See how that works?

Sunday Talks, Prepping the Landscape CBS Interviews Former DAG Rod Rosenstein About Garland Special Counsel Appointment

DATA Links:  (1) Merrick Garland DOJ Statement on Appointment of Special Counsel ~ (2) pdf of Legal Appointment ~ (3) Statement of John Smith upon Appointment ~ (4) Transcript of AG Merrick Garland Public Announcement.

The pretending is severe as CBS recruits former Deputy Attorney General Rod Rosenstein to discuss the decision by Attorney General Merrick Garland to appoint a special counsel to investigate republicans in congress and President Donald Trump.

You can tell the pretending is severe because neither Rosenstein nor Brennan even touches on the primary aspect to the written instructions by Garland to special counsel John Smith.  The primary function of the special counsel is completely avoided in the interview, [again, read the pdf of the appointment]. Instead, the conversation with Rosenstein focuses on the second, lesser included instruction, the Trump-centric portion.

The corporate media engineers, working on concert with the DC agenda, are pulling Rosenstein into the picture to frame the narrative toward an announcement of an indictment against President Trump. WATCH:

In response to the question of the appointment itself, Rosenstein noted he “probably would not” have made the decision to appoint a special counsel.  However, don’t get too caught up in the granules of the interview itself.  Instead, ask why the media is pulling Rosenstein into the prosecutorial debate?   What benefit is there?  Within those answers you then overlay the fact the primary function of the appointment itself is not part of the conversation.  [Transcript Below]

Idaho Investigators Have Identified Sketchy Food Truck Lurker and Is Reported to Be Cooperating with Police

Many people have been following the story of the four Idaho University college students who were murdered last weekend.  In part of a video released by police a person of material interest was noted, and police asked for help with identifying him.

The person has now been identified and is reportedly cooperating with police.

(Via Dail Mail) – The man who was filmed with two of the four murdered Idaho students in their last hours has been ‘identified’ and is ‘cooperating with police,’ according to one of the victims’ sisters.

The young man’s name has not yet been made public but he was he was filmed walking up to a food truck with Madison Mogen and Kaylee Goncalves on Sunday at 1.45am – less than two hours before they were murdered in their home.

He was filmed standing near the girls but not speaking to them as they waited for their food from the truck.   Once they were handed their order, the girls – who staff said appeared to be slightly intoxicated – walked off together, leaving him behind.

On Thursday night, Kaylee’s sister told Chris Cuomo on his NewsNation show that the boy had been identified.  ‘I think a lot of people were curious about that person. We were able to identify him.

Senator Rand Paul Questions FBI Director Chris Wray on the Construct of the Domestic Surveillance State

Senator Rand Paul (R-KY) recently questioned FBI Director Chris Wray about the nature of how the FBI is receiving or retrieving surveillance information on domestic U.S. citizens, through the use of social media and electronic data collection.  {Direct Rumble Link}

At the core of the issue is a system created in the last 14 years where private social media companies and the intelligence apparatus, to include the FBI, have formed partnerships in the larger surveillance network.  The fact that FBI Director Chris Wray cannot and will not answer specific questions about the issues, only exemplifies the nature of the issue as it relates to unconstitutional violations of privacy.

There is ample & overwhelming evidence, much of it open-sourced, highlighting how federal law enforcement and social media companies are working together to assemble, filter and investigate data based on a collaborative agreement.  Legal protections for privacy are being destroyed in this assembly of constructs.  WATCH:

Paul:Are you purchasing what is said to be anonymous data through the marketplace and then piercing the anonymous nature to attach individual names to that data?

Wray:I think it’s a more complicated answer than I could give here.”

Biden DOJ Assigns Special Counsel to Investigate Republicans in Congress and President Trump for Insurrection, Additionally Investigate Trump for DOJ Defined Classified Documents and Obstruction

Okay, first things first.  CTH will not play the pretending game or structure the discussion of the special counsel appointment through the prism of MSM references.  Instead, we will stick to the facts as they are presented, explain the events as they are factually reflected within the actual documents, and avoid the pretending constructs.

DATA Links:  (1) Merrick Garland DOJ Statement on Appointment of Special Counsel ~ (2) pdf of Legal Appointment ~ (3) Statement of Jack Smith upon Appointment ~ (4) Transcript of AG Merrick Garland Public Announcement.

The overarching Lawfare framework has been transparently created by President Obama’s former White House Legal Counsel and current U.S. Asst Attorney General Lisa Monaco.  To wit, earlier this afternoon Joe Biden’s Attorney General, Merrick Garland, announced the appointment of DOJ Attorney Jack Smith as special counsel to investigate two specific areas:

♦ First, to investigate current republican members of congress (House and Senate), former President and current candidate Donald J Trump, former Trump administration officials, former White House staff, and other individuals, groups and organizations for their role in supporting an insurrection on January 6, 2021, against the incoming administration of President-Elect Joe Biden.  In essence, the J6 investigation – with an emphasis on congress – transfers to Special Counsel Jack Smith:

The Special Counsel is authorized to conduct the ongoing investigation into whether any person or entity violated the law in connection with efforts to interfere with the lawful transfer of power following the 2020 presidential election or the certification of the Electoral College vote held on or about January 6, 2021, as well as any matters that arose or might arise directly from this investigation or that are within the scope of [Special Counsel Regulations 28 C.F.R. § 600.4(a)]. (pdf)

This is an extension of the January 6th Committee special investigation that transfers the committee’s investigative findings, ie phone records, text messages, transcripts, emails, prior testimony and all evidentiary records, into the newly appointed Special Counsel.

However, all prior and current DOJ prosecutions against citizen individuals will remain within the control and direction of Main Justice.  This structure frees up Jack Smith to target the new republican controlled congressional members, their staff, families and/or communication network.   Main Justice keeps focus on the citizen insurrectionists, Jack Smith now appointed to go after the public officials.

J6 Committee staff, committee investigators, FBI agents and DOJ lawyers will now transfer from the committee to the special counsel office. Watch. (More on why later)

Election Over, Washington Post Quietly Reports Construct of FBI Top Secret Narrative Around Trump Mar-a-Lago Documents Was False

Go figure.  If you read between the lines of the Washington Post’s current description of the “classified” documents, as noted by anonymous federal officials connected to the investigation, the ‘classified‘ documents in context were personal correspondence between President Trump and Chairman Kim Jong Un about the need to chill out on the nuclear stuff.

President Trump considered these types of papers personal mementos, while the administrative state -seeking to weaponize the DOJ/FBI for maximum political damage and narrative engineering- considered them top secret national security documents.

The election is over, so the narrative is no longer needed. Narrative dropped…

(Via WaPo) – Federal agents and prosecutors have come to believe former president Donald Trump’s motive for allegedly taking and keeping classified documents was largely his ego and a desire to hold on to the materials as trophies or mementos, according to people familiar with the matter.

As part of the investigation, federal authorities reviewed the classified documents that were recovered from Trump’s Mar-a-Lago home and private club, looking to see if the types of information contained in them pointed to any kind of pattern or similarities, according to these people, who spoke on the condition of anonymity to discuss an ongoing investigation.

That review has not found any apparent business advantage to the types of classified information in Trump’s possession, these people said. FBI interviews with witnesses so far, they said, also do not point to any nefarious effort by Trump to leverage, sell or use the government secrets. Instead, the former president seemed motivated by a more basic desire not to give up what he believed was his property, these people said.

NBC2 Bay Area Confirms From Police Body Cam Footage Same Pelosi Attack Details as NBC Report by Miguel Almaguer That Led to His Suspension

NBC journalist Miquel Almaguer reported on The Today Show {Direct Rumble Link} that Paul Pelosi opened the door, didn’t declare an emergency….. and then walked back to his attacker and was attacked.  The report by Almaguer contradicted the FBI probable cause statement as written. NBC immediately scrubbed the Almaguer report after broadcast and then suspended journalist Miquel Almaguer.

However, now that the midterm election is over, NBC Bay Area reporter Bigad Shaban did some further research, talking directly to police sources who reviewed the body cam footage.  Mr. Shaban confirmed the details of the original NBC reporting by Miguel Almaguer on November 4th that led to his suspension. Something sketchy is going on here.

(Via NBC) –  […] Police body camera video that captured the attack on Paul Pelosi, and the moments leading up to it, contradict one of the details included in the Department of Justice’s account of what happened that evening, according to a source familiar with the Pelosi investigation who personally viewed the body camera footage and spoke to the NBC Bay Area Investigative Unit.

In recent days, the Department of Justice and the San Francisco District Attorney’s Office have outlined differing accounts of who opened the door when police responded to Pelosi’s 911 call. (read more with video report)
