It’s not the first part of the 46-page ruling [SEE HERE] by Judge James Boasberg, threatening to hold President Trump and Main Justice in criminal contempt of court, that presents the biggest problem; it’s the second part where Boasberg is threatening to appoint an independent Judicial Branch prosecutor against the DOJ and Trump that makes a constitutional crisis tilt toward a near civil war between the branches.
Outlining his determination that President Trump defied a court order, U.S. District Judge James Boasberg states, “the Court ultimately determines that the Government’s actions on that day demonstrate a willful disregard for its Order, sufficient for the Court to conclude that probable cause exists to find the Government in criminal contempt.”
As noted by Politico, within the ruling Boasberg goes on to say:
…”if the administration doesn’t rectify the issue, the judge said he may require administration officials to testify under oath so that he can identify the specific individuals responsible for violating his order. He would then request that those individuals be prosecuted.
The judge signaled he could appoint an outside lawyer to prosecute the contempt case if the Justice Department declines to do so.” (link)
I think we all know the very select group of “beach friend” people whom Boasberg would lean toward in appointing someone to prosecute Pam Bondi and DOJ officials representing President Trump.
High on the list of possible judicial branch appointments, who would be subject to review by the authority of Boasberg himself, would be his prior friendship with a previous appointee, Mary McCord. Or possibly Andrew Weissmann, Barry Berke, Norm Eisen, David Laufman or any other credentialed member of the Lawfare alliance.
The ruling somewhat reminds me of a prior situation where federal judge Andrew Hanen found the Obama DOJ also in contempt of a court order regarding the status of the “Dreamers” and the Deferred Action for Childhood Arrivals (DACA) cases. {Background Here} However, unlike Boasberg, Hanen only demanded a DOJ corrective action plan.
Lawfare operatives in robes and out of robes are willing to create a constitutional crisis, because that’s how the Lawfare operatives operate when their grip on power is threatened.
How about Congress simply make it clear that “District” court judges DO NOT have the authority to rule against Presidential (therefore Federal) decrees, EOs, laws, etc! First, this is the Supreme Court’s fault by not ruling that Boasberg was without subject matter jurisdiction, and hanging their ruling on “venue”.
Boasberg knows, however, that he doesn’t have subject matter jurisdiction because he went on at length arguing to avoid that response, citing a couple of cases for the proposition that even if a judge doesn’t have subject matter jurisdiction, his rulings must be followed until overturned on appeal.
Yeah? No. I would assert that this is an asinine interpretation of the law. “No subject matter jurisdiction” means “void, ab initio”. A court cannot just make any ruling in the world it wants to, and has to be obeyed (“Go upstairs and jump off the roof tomorrow by 5 p.m.”) until a beleaguered litigant can get before an appellate court.
The response from the administration at this point will have to be bold — an unsigned response (for the protection of the lawyers) that states: you have no jurisdiction, your orders on this matter are void and ultra vires, you are corrupt and abusing power, and no further information will be provided to you for that reason and also for the reason that deliberations and decision-making are within executive privilege.
And Congress must act — NOW — to remove this judge (and a few others) for “bad behavior”, as well as reining in the Administrative Procedures Act, including, inter alia, that it ONLY applies to orders founded in regulatory decisions or the interpretation of law by agency officers and employees (for the protection of people subject to the weird agency “legislator-prosecutor-judge” power given to agencies, not the President or his cabinet officers, and forbidding nationwide injunctions by any Article III lower court judge.

This is a constitutional crisis, if the judicial branch sticks together to fight the President and his DOJ. However there was a recent ruling from the SCOTUS 5-4 in favor of Trump re: the Alien Enemies Act.
Who has the responsibility and the right to determine foreign policy? The Constitution places this in Article II powers of the President, NOT in Article III or the judiciary branch of government.
Lawfare cases are meant to bypass the Constitution and use judicial decisions to cripple the ability of the duly elected President of the United States from making decisions in foreign policy and domestic policy with which they disagree. It is a political power play meant to neutralize or destroy the power of not just the President, but also the Sovereign of this country, i.e. We the People, and substitute their power for Our power.
If the Supreme Court will not intervene to protect our right to elect our President and the President’s right to do his job the way he sees fit, then we no longer have a Constitutional Republic.
Because Lawfare has been successful to a great degree in eliminating the Constitution’s separation of powers, I think a case can be made for judicial reform involving either (a) ending the funding of these district courts from which these rogue judges are trying to control the US as if they were the President or (b) eliminating these courts altogether, since they are the source not of justice but of injustice for the people of the United States.

PDJT must demonstrate support for his executive branch staff and officers, to prevent “chilling” of their behavior by rogue activist judge criminal threats. A full pardon for any criminal contempt threat SPECIFICALL from, by or on behalf of judge Boasberg would be a good show of support.
How Boasberg gor control of this case also needs to be thoroughly investigated by both Congress, and the DOJ/FBI. That would be part of a conspiracy investigation.
No way does a lower judge have the power to imprison or to punish an entire constitutional branch of government. And by specifying the POTUS as the subject of this criminal threat, he exceeds his powers in a way which SHOULD get SCOTUS attention.
Boasberg knows better. He wants to be impeached by congress. SCOTUS will not act unless the executive branch files a complaint with a higher court. (not an appeal, but a complaint! If it is an appeal, the result will be a higher court ruling which will be passed back down to the originating court.)
