It’s not the first part of the 46-page ruling [SEE HERE] by Judge James Boasberg, threatening to hold President Trump and Main Justice in criminal contempt of court, that presents the biggest problem; it’s the second part where Boasberg is threatening to appoint an independent Judicial Branch prosecutor against the DOJ and Trump that makes a constitutional crisis tilt toward a near civil war between the branches.
Outlining his determination that President Trump defied a court order, U.S. District Judge James Boasberg states, “the Court ultimately determines that the Government’s actions on that day demonstrate a willful disregard for its Order, sufficient for the Court to conclude that probable cause exists to find the Government in criminal contempt.”
As noted by Politico, within the ruling Boasberg goes on to say:
…”if the administration doesn’t rectify the issue, the judge said he may require administration officials to testify under oath so that he can identify the specific individuals responsible for violating his order. He would then request that those individuals be prosecuted.
The judge signaled he could appoint an outside lawyer to prosecute the contempt case if the Justice Department declines to do so.” (link)
I think we all know the very select group of “beach friend” people whom Boasberg would lean toward in appointing someone to prosecute Pam Bondi and DOJ officials representing President Trump.
High on the list of possible judicial branch appointments, who would be subject to review by the authority of Boasberg himself, would be his prior friendship with a previous appointee, Mary McCord. Or possibly Andrew Weissmann, Barry Berke, Norm Eisen, David Laufman or any other credentialed member of the Lawfare alliance.
The ruling somewhat reminds me of a prior situation where federal judge Andrew Hanen found the Obama DOJ also in contempt of a court order regarding the status of the “Dreamers” and the Deferred Action for Childhood Arrivals (DACA) cases. {Background Here} However, unlike Boasberg, Hanen only demanded a DOJ corrective action plan.
Lawfare operatives in robes and out of robes are willing to create a constitutional crisis, because that’s how the Lawfare operatives operate when their grip on power is threatened.

There is no provision for a judge to appoint a prosecutor nor (to my knowledge), any legal process that the person so designated can issue that has jurisdictional affect on the Executive.

Boasberg probably does have a pretty good handle on which way Roberts and Barrett will vote on this. Haven’t yet figured out what is going on with Barrett. Time is nearing for PDJT to issue a legal finding re Article II power and that Article III inferior courts can not interfere in the Article II power areas of juridiction, for instance International affairs and military actions. These subject matters are exclusively the Presidents to administer. There is Supreme Court precedent to that effect.

I am unaware of any statute that gives an Article III judge the power to appoint a prosecutor. Article III courts are creations of Congress via statute. They have no powers not expressly given to them by a clear statute.
Let’s remember that in Florida, Judge Cannon ruled that Jack Smith had no power to prosecute President Trump because only an Officer under the Constitution has that power, and Smith was never confirmed as a prosecutor by Congress. That was the correct ruling.
In other words, from a constitutional perspective, Bossberg is blowing smoke out of his rear end here.
For those who invoke what Sullivan did to Flynn, that was an existing case and the DOJ had moved to dismiss. There was at least some claim to continued judicial oversight and jurisdiction. Still, Judge Sullivan went way, way, way over his skis in not granting the motion to dismiss and appointing an alleged substitute – but it would not have held water on appeal because Sullivan violated all sorts of rules and protocols to do that much.
In other words, Boasberh’s threat is all just bs and shadows.

Article III of the Constitution limits judicial power to settling “Cases and Controversies.”
Appointing a prosecutor, directing their own investigation, bringing in their own evidence, etc. (all stunts various Lawfare judges have pulled) violate this limitation. Those corrupt judges are expanding the cases and controversies not settling them. This is THE Constitutional Crisis these days.
SCOTUS needs to issue a Writ of Prohibition to Boasberg pronto. Tell him to cease and desist all actions and statements regarding this case (or any other case pertaining to the Trump administration.)

This judge is very-obviously practicing “Lawfare,” at the behest of persons unknown who are undoubtedly enriching him. But he is also revisiting the response first raised by “Andy” Jackson and Abraham Lincoln.
Namely, that the US Constitution purposely gave absolutely no power of “review and consent” to the Judicial branch. Judges cannot pore over the decisions of the Executive, any more than they can confront Members of Congress and attempt to prosecute their staff members. The Executive Power is vested in a President of the United States.
Unless either the Congress or the SCOTUS acts first, President Trump must exercise his own Constitutional authority to formally declare that all such Judicial actions are unconstitutional, and so without any force or effect. And to instruct all Executive offices to disregard them entirely.
The Constitution gave the Judiciary the power to interpret the laws, but purposely assigned no power to “execute” them. They are empowered to make “rulings,” but not to enforce them.
This, if necessary, must even extend to the SCOTUS. The Constitution did not create “400+ Presidents,” nor did it even create “nine.”
It is unfortunately very possible that there is only one way out of this: “to kick them in the face.”

Lots coming today from Judge Boasberg’s opinion after I have a chance to review it in detail.
One clear issue I see coming;
Yes, there is much SCOTUS case law about litigants being required to comply with Court orders — even if erroneous — until they are reversed.
NONE of that case law deals with a contest between two branches of the federal government where the Exec. has been dragged into Court without jurisdiction, the court does not appropriately establish that it has jurisdiction, and the court then issues an unlawful order directing the Executive branch to act in a particular manner.
SCOTUS is going to need to defuse this bomb that Judge Boasberg has started the timer on.

Good luck getting Roberts and ACB on board with that. President Trump can “diffuse” this himself by bringing the entire weight and the full scope of Executive Branch Power down on the crooked judge’s head.
It’s one thing to find someone in contempt for an erroneous ruling from a judge who has jurisdiction, but for him to try the same thing for a case he had no jurisdiction to preside over to begin with should be an easy one to dismiss.
Boasberg knew well in advance of his oral order that he had no jurisdiction in the case because he told the Lawfare attorneys to rewrite their complaint and eliminate Habeas! So, Boasberg actually committed a crime by ordering the flight to return to the U.S. because he knew what he was ordering was wrong!
Why didn’t conservative judges ever think of this to fight Dem lawfare? The DOJ should figure out a way to prosecute Boasberg for something.
The DC Circuit is a nest of bad-behaving vipers. Read the transcripts of the J6 trials. You had a judge lying from the bench about “police who died” on J6 (none did) and another one telling defendants what political positions they should hold. There’s lots more. (See Julie Kelly) The Congress has the power to abolish the DC Circuit (*Any* federal court below SCOTUS) and they should do so. The judges could be reassigned to the DC traffic court. Deep dive into his finances, his associations, and the same for his family. Put this guy’s entire life under a microscope and on the news. Isn’t that how the Lawfare Game is played?

Can someone please answer this… What authority does the court have to establish its own prosecution? Is this not a purely executive branch power? The United States is not Brazil or other socialist hellhole where unelected Judges can create and wield their own private enforcers.

These rules govern the conduct of criminal proceedings in federal courts and are developed by the Judicial Conference of the United States, then approved and transmitted by the Supreme Court to Congress. Congress has the opportunity to review and modify or reject the rules, but if it takes no action, the rules take effect. Thus, Rule 42(a)(2), which addresses criminal contempt proceedings, is a court-adopted procedural rule, not a statute or a judicial decision.
Enforcement is typically carried out by the U.S. Marshals Service, which has the authority to execute federal court orders, including arresting and detaining individuals sentenced to imprisonment or ensuring payment of fines. If the contempt involves a failure to comply with a court order, the court may also direct other federal agencies or officers, such as the U.S. Attorney’s Office, to take specific actions to enforce compliance.
IF POTUS/DOJ declined to enforce, it creates a Constitutional crisis… possible impeachment trap…. probably let the courts play out and then Pardon everyone involved if that is needed. Hopefully the Supreme Court wakes up and stops this before it comes to that.

Trump has already stripped clearances for some of the names in the article I believe. Roberts is the wild card in this crazy affair.
It’s a nice life that Judge Boasberg is enjoying while holding Kangaroo Court in DC. It would be a shame if anything happened to him.
