It’s not the first part of the 46-page ruling [SEE HERE] by Judge James Boasberg, threatening to hold President Trump and Main Justice in criminal contempt of court, that presents the biggest problem; it’s the second part where Boasberg is threatening to appoint an independent Judicial Branch prosecutor against the DOJ and Trump that makes a constitutional crisis tilt toward a near civil war between the branches.
Outlining his determination that President Trump defied a court order, U.S. District Judge James Boasberg states, “the Court ultimately determines that the Government’s actions on that day demonstrate a willful disregard for its Order, sufficient for the Court to conclude that probable cause exists to find the Government in criminal contempt.”
As noted by Politico, within the ruling Boasberg goes on to say:
…”if the administration doesn’t rectify the issue, the judge said he may require administration officials to testify under oath so that he can identify the specific individuals responsible for violating his order. He would then request that those individuals be prosecuted.
The judge signaled he could appoint an outside lawyer to prosecute the contempt case if the Justice Department declines to do so.” (link)
I think we all know the very select group of “beach friend” people whom Boasberg would lean toward in appointing someone to prosecute Pam Bondi and DOJ officials representing President Trump.
High on the list of possible judicial branch appointments, who would be subject to review by the authority of Boasberg himself, would be his prior friendship with a previous appointee, Mary McCord. Or possibly Andrew Weissmann, Barry Berke, Norm Eisen, David Laufman or any other credentialed member of the Lawfare alliance.
The ruling somewhat reminds me of a prior situation where federal judge Andrew Hanen found the Obama DOJ also in contempt of a court order regarding the status of the “Dreamers” and the Deferred Action for Childhood Arrivals (DACA) cases. {Background Here} However, unlike Boasberg, Hanen only demanded a DOJ corrective action plan.
Lawfare operatives in robes and out of robes are willing to create a constitutional crisis, because that’s how the Lawfare operatives operate when their grip on power is threatened.

There is no such thing in the Constitution as a “Judicial Branch Prosecutor.” This Boasberg just won’t quit. He’s already lost at the SCOTUS level. He’s been told he’s out of line with this entire thing. The five migrant “plaintiffs” were neither residing in, nor were they apprehended in, Boasberg’s district. He has NO SAY AT ALL in their case and he must withdraw from every word, and every letter of every word, in it.
Boasberg’s ORIGINAL ORDER is what was unconstitutional, thus it is NULL and VOID.

Judges don’t but you must remember this boasberg fella is not just a judge. He is the RULER. Don’t nobody be questioning his diktats.
This idea that there can be such a thing as a “Judicial Branch Prosecutor” is so delusional it boggles the mind. The judiciary cannot prosecute anyone. The Judiciary has to be the impartial presiding official over such things as prosecutions by the Executive Branch. How can any judge preside over a proceeding brought by the judge’s own branch of government? This is a conflict of interest on steroids. This character is so delusional he is practically screaming that he needs to be impeached.
This is also a sign that the Congress better forget about a “Three judge Panel” to determine if some District Court judge has to make a nationwide ruling. CONGRESS has the responsibility of regulating the courts they create. No three-judge panel to supervise District Courts. Congress needs to do that.

I would add that Boasberg is probably not the origin of this Special Judicial Prosecutor notion. It seems likely that one or two of the potential appointees are the Masterminds of this scheme.

Let’s not forget Judge Emmett Sullivan appointed his best friend as a Special Prosecutor when Gen Flynn was trying to get his case dismissed, which Sullivan refused to do even though the DOJ agreed to the dismissal. Pres. Trump had to pardon Flynn eventually.
Sundance has it right. Boasberg will appointment a Lawfare lawyer, despite not having jurisdiction on the case.

I think you indicated earlier the SC had left a hole open in their ruling, in that they did not really take up the presidents powers related to 1798 Lien invasion. Instead they ruled on process of habaes and ignored the other. This will go back to the SC for appeal again even though the case is null and void.

Judges have zero authority to prosecute anyone.
This judge is knee deep in FISA – gate and Russiagate, allegedly. I have wondered if he is taking these antagonistic actions in order to inoculate himself when his role in these treasonous actions become public. He could then instead claim he is being targeted by Pres. Trump. The DNC Media will run with that crap nonstop, Dems will try impeachment, it will be a constitutional crisis, right in time for midterms.
Right now, Democrats have 3 empty seats. They don’t have the #s or committee control to impeach.

Judges have immunity when they have jurisdiction. Supreme court says this Judge did not have jurisdiction. No jurisdiction = No immunity. This judge ordered planes outside US air space to turn around. Only the president can order the military. There is a word for a judge outside of his jurisdiction sitting on the throne and issuing orders to the soldiers. Ever heard of Treason? Congress is working on resolutions for bad behavior to have him removed from the bench, and are also working on articles of impeachment. Trump is also capable of prosecuting treason as this judge is not immune. IMO Trump/Bondi should play along. Boasberg has tipped his hand too early. They just appoint a prosecutor who then does no investigation, schedules a court date, shows up for trial and makes one statement – “The Prosecution Rests”.
Where is the House of Representatives?
Pam should prosecute the judge for treason against the commander in chief. Executive is independent and equally powerful as judicial. President has all the power. Boasberg should be arrested and tried.
