If you pull back from the granular debate and think about it, none of the FISA justifications align with reality.
The FISA system is a designated secret court system that is said to only pertain to “foreign nationals.”
Ok, so if we accept the premise. Foreign nationals do not have U.S. constitutional protection. So why does the surveillance and intercept of them require secret U.S. courts?
In reality, the Secret Courts are needed because it’s not foreign nationals that need to be navigated in the surveillance system; it’s the American citizenry engagement within that surveillance that requires a different legal approach.
Why should an American citizen suddenly have their constitutional protections switched from U.S. Federal Court to U.S. Federal FISA courts (secret), simply because their contact -perhaps inadvertent- skims up against a foreign national?
The constitutional protection (4th amendment) should not be arbitrary, depending on your contact. A regular federal court judge can decide on the issue of a Title-1 warrant, that can be filed under seal if the exploration of the contact is a genuine concern.
There is no need for a secret court for either foreign nationals or U.S citizens. The former do not have constitutional protection, and the latter should not lose it under arbitrary determinations of U.S govt officials.
That’s the entire predicate that underpins the 4th amendment.
All of that said…. I’ll tell you why this issue is so important, and it has to do with the future, not the past.
The justification for the FISA-702 warrantless searching of American metadata, is a cornerstone for the enlargement of a surveillance state. The flawed precept behind 702 specifically, is the gateway needed to expand the system.
Real ID, Digital ID, AI used in facial recognition systems, and the larger issue of track and trace capability of U.S. citizen data (connecting your physical identity to a digital fingerprint), requires some legal justification to create a surveillance network DESPITE the 4th amendment.
FISA-702 is the proverbial camel’s nose under the tent of privacy.
IF we were to abolish FISA-702, which we should, then what legal justification would exist to continue unsecuring the American people from “their private papers and effects.”
The build out of the surveillance state becomes more legally tenuous, perhaps impossible, if privacy protections of the 4th amendment are firm.
Finding a way to surveil Americans, while working around the constitutional protection in place to stop it, is why the FISA-702 issue has become more important for those who are building the surveillance system under the guise of national security.
Challenge the legal justification for FISA-702, and you throw a massive wrench in the machinery of a growing surveillance state.
If you are secure in your papers and effects, you cannot be forced to “show your papers.”
Right now, the monitoring system designed is being done so they can get the answers to your identity, without having to ask you to show your papers, which is unconstitutional.
You drive through the metaphorical checkpoint, because the system automatically recognizes your identity. This is said to be a legal workaround.
However, what happens at the checkpoint (bank, atm machine, employment verification, port of entry or even voting booth) when government identifies you (for whatever arbitrary reason they construct) as a “politically exposed person.”
Don’t think congress is stupid about this, they know exactly what is going on. They understand just how dangerous this is; that’s why in the last FISA-702 reauthorization, congress literally wrote into the renewal that federal representatives cannot be subject to the FISA-702 rules.
All members of congress must be notified in advance, if their private metadata is going to be reviewed by the FBI, DOJ or any entity with access to the NSA full spectrum database library. They exempted themselves and secured their 4th amendment protections exclusively for themselves.
That’s the “change” in the law they all agreed to during the debate of the renewal. However, We The People are not granted this same notification or protection from weaponized access.
Expanding the point. In essence Congress made themselves “grey walkers.” Individuals that can go through the checkpoints with a database return result that permits them unimpeded travel. A special designation.
Now, do you see how a surveillance state creates a tiered hierarchy of disparate power and constitutional protection.
If AI converges with this total identity state, which it will, then the automation will have designations for people of special privilege.

The way they’ve been doing it w/o facial recognition is if you like or respond to a tweet or social media post, and that tweet or social media post originated from a foreign national, you are fair game. So pretty much everybody.
Plus, if a US citizen is someone of particular interest to someone in the government, what’s to stop them from having a foreigner make the first introduction or contact of themselves to that person the govt wants to surveille? That 3-hop, or is it 7-hop, rule would apply – “foreign national so-and-so was seen talking to you outside of Walmart” and viola -702 warrant is now okay! where that foreign national could have simply been asking for directions.

TSA is using facial recognition now. No one told me before entering the TSA gate that they would be taking my rights away. Of course i could have sad no and missed my flight, but i would have been stuck with a over $1000 flight to pay for. I’m not rich. Stood there pissed off while being told to stand in front of the camera, or leave the line.
Same thing clearing customers after a cruise….stepped up to the booth, and all of a sudden there was a full body, facial pick of me taken some time ago….Frightening.

In 2017 I found out through research that Georgia had a MOU (memorandum of understanding) with the FBI to add facial recognition to the Real ID driver’s licenses. I was so alarmed that I called the top legal counsel at the DMV.
I had a very interesting conversation with her. She seemed genuinely surprised and said she had only been in that position for a year. I countered with “if you’re the head attorney and you don’t know, don’t you think you should find out?” I gave her the GAO web address where I had found the information.
My takeaway from that experience was that whatever it takes to keep us in the dark while they set up total surveillance into our everyday lives THEY WILL DO.
It was no accident that they put someone like that uncurious lawyer in the top position at that moment. Also, I received some very negative attention soon after that. Most people would be shocked at how easy it is to get on a bad list.

The more I read and consider the 4th Amendment the more it seems to me that this one Amendment is the key for making sure the other Amendments , from the 1st all the way to the 10th and those thereafter, stay alive and enforceable.
It has been a continual talking point line for Democrat politicians since Obama that “the Amendments aren’t absolute” – planting the seed, nudging ala Cass Sunstein-style, to get the uneducated younger citizens to believe that lie so that when the next communist group of politicians take over the White House they will have a majority of citizens agree to the removal of those “non-absolute” Amendments.
Communists are very patient and plan things decades ahead of actual actions.
I keep hoping that John Eastman, Mike Lindell and the other citizens who were unceremoniously searched and had their cell phones, lawyer communications, etc. seized by the federal government over the past 8, 10 years will file a combined lawsuit directly attacking the Patriot Act and its FICA court system because it may take people of that stature and prominent name recognition to wake up the majority of Americans the game the Democrat communists have been playing – direct assault on the very heart of what makes us a republic.
About three days before the deadline to register to vote in Florida had passed, I decided to ignore all the people saying, in effect, you can’t beat Dominion.
Up to that point, I had become so discouraged about the election, I was in agreement with the nattering nabobs of negativism that voting was pointless.
So I registered online (‘independent’) and received my voter ID card in two days!

The courts are not our friends as has been shown over and over.
Besides, the founders never advised a lawsuit for unconstitutional actions.
Madison in Federalist #46 advised 4 steps, taken together, that would give us the best outcome.
The thinking behind lawsuit is the last vestiges of an actual republic lies in the hands of the 3rd equal branch of government – the judiciary.
It is incumbent upon us citizens to find out sooner, rather than later, if that branch still stands.
From the recent ruling which included Roberts and Coney-Barrett is any indication, the democracy crowd is in the lead vs the republic crowd of justices. As that branch falls, we best have a backup plan. If that branch still stands, we need to embrace it and encourage it to continue to uphold the foundations of a republic while we citizens, the voters, get busy fixing the other two branches.
But, that’s just current thinking on this matter, knowing it is the 2nd Amendment that our forefathers recognized as, perhaps, the last tool in our toolkit to retain what they created.

I was an AF crypto-linguistic in the Cold War. The NSA captures ALL foreign communications. It was against the law to tape a communication with an American in it and the tape had to be destroyed, regardless the information. No law was required to intercept foreign communications back then. This is to capture Americans on tape.
I don’t think a Presidential pardon for crimes commited against the nation should ever be allowed to stand. Especially those pardons used to cover-up ones own criminal activity while in office and those that supported it….This is tantamount to having a licence to kill….There needs to be a Constitutional ammendment to this effect. We’re never going to have accountability as long as corrupt politicians can fall back on these corrupted loop holes.
Regarding the exemption for Congresscritters, that is a straightforward denial of the equal protection of the laws. We already had a Constitutional amendment -it was the 14th.
Establish standing, (and be willing and able to have your life destroyed by the DS) and this is not a difficult case. Not constitutionally speaking.
Either the law is unconstitutional and the exemption must be struck, and/or the law as a whole is unconstitutional as a violation of the 4th Amendment whose purported guardrails have now been demonstrated to be wholly inadequate in narrowly tailoring the law to make it constitutional.
Those two prerequisites are tough, though.

I see no reason, however, why it should spell trouble for Tulsi’s appointment. The law was passed by Congress, & must be repealed by Congress. Executive branch appointees are supposed to implement policy, not make it. I’m fine if she takes this position now.

Remember a while back there was a discussion about how when you make a phone call the phone carrier bounces your call through multiple foreign satellites thereby making it a foreign correspondence? I apologize if I describe this in a way that you can’t understand but I recall this gave them, at least in their perspective, the justification to monitor the communication. Was this practice ended or is it just another way they violate us that we aren’t talking about?

We must be able to speak our minds FREELY with no repercussions (the 1st Amendment).
We must be able to protect ourselves, our families, and our property AS WE SEE FIT. (the 2nd Amendment).
We must not be forced to “quarter” the military, i.e., the military can’t walz in and occupy our property (the 3rd Amendment), and that goes for the FBI!! They are so fond of busting down doors and dragging people out in their pajamas after getting secret warrants, then shredding personal belongings going through underwear drawers.
We must be safe in our persons and papers. Illegal warrants are forbidden and that includes the spy machine (4th Amendment).
I agree Sundance, although the founders laid it out in steps. We must be free and we can back that up with protection devices. And I will go further and suggest that we have every right to shoot down the military, the FBI, or anyone else who trespasses. That was the whole point of the 2nd.
Agencies, such as the USDA, who bring military force when raiding a farm, for say, selling raw milk or meat off your farm (Amish farmer Amos Miller). When there’s a dispute with the wholly corrupt IRS who can confiscate your wages with impunity. The FDA who thinks they can mandate harmful injections. The list is long. Every government agency is guilty of trespassing, whether physically or electronically.
My personal opinion is that the 2nd is foundational. Jeopardize our safety, fiddle around and find out. Make the 2nd Amendment great again! I want these agencies, all of them, to back off.

The FISA “Court” is not a court at all. The target does not know he is being targeted and cannot defend himself. The “judges” hear only the Government’s side, and they give a rubber stamp. Which is also secret.

There are so many vexing questions and issues regarding FISA 702. I agree with Sundance. Technology is going to advance. The ability to record data, both purposefully and inadvertently is going to continue to increase. The ability for massive analysis of this data will continue to increase. The desire of men to use that data for both good and evil will always increase as there will always be good and evil.
I was a pioneer/Early adopter of the use of Electronic Medical records. In my desire to use my physician role treat the whole person to help them be better people, I was very interested in the comprehensive collection of data on patients, families and communities to be used to enhance my ability to use the relationship and help them be healthier, not only medically, but emotionally and spiritually.
Fast forward from the late 1980s to the early 2000’s when the government and insurance companies hijacked the power of computers and now electronic medical records have turned physicians, nurses, and healthcare workers into slaves: Requiring collection and reporting of data that increases profits of hospitals and insurance companies in order for us to be paid — and doing so at the expense and worsening of the actual care delivered.
I think Sundance (and hopefully Tulsi) are saying our growth in technology must be done in such a way to keep our basic rights intact. Or more fundamentally, the distinction and classification of good vs evil must be defined ahead of the growth of technology.
What data should be allowed to be gathered? Can we even limit that data when technical ability is growing so fast?.
The arguments of the pro IC community is that we must use these tools or we will not be able to find the bad guys/terrorists among us (with no limit of course) and out of the other side of their mouth, promising (we won’t use it on citizens)
Consider the knowledge of suicidal or homicidal intent, or the knowledge or child abuse, elder abuse, or sexual abuse. The right of protection of confidential medical information is not only waived, but there is an obligation of medical officials to report it. We accept that breach of our privacy. Should it be reported or held private?
Consider the knowledge of communication to weaponize a deadly virus, to spread it world wide. Consider the knowledge of an intent to suppress scientific research disclosing that a known drug is not helpful but harmful. Should it be reported or held private?
Consider communication in which U.S. citizens are selling commercial or national secrets to foreign governments or agents. Selling weapons grade or raw uranium? Plotting to launder money to enrich politicians or U.S. citizens (there is a difference now, you know)

Military officers and elected officials used to be held to higher moral standards, especially in sexual areas, to protect them from spies and honey traps.
In all of our digital tracks (as was our behavior/reputation in the smaller communities of previous centuries) is data that reflects us. Withing the illusion of secrecy are the tracks of addiction, sin, breaches in our moral standards: Drunk driving, broken marriages, gambling, drunkeness, legal affairs, viewing of pornography, communication of affairs. All of this is data that is used against citizens, officers, politicians to control them.
There is no doubt that this information is being used to hijack our nation, long before Hillary’s acquisition and control of the FBI files. We cannot stop the advance of technological abilities, but we can control, limit it as we have attempted to do with many things such as nuclear weapons. In each case there must be a distinction between good and evil, good and evil behavior, and good and evil people. Since all people have in them the capacity for good and evil, the remedy must be a wise balance of sunlight and checks and balances.
I am not sure that is a valid solution to our dilemma (a wise balance of sunlight and checks and balances), and I am curious as to what Sundance and other Treepers see as the goal/solution to this problem.
What is good and evil: While most of our framers were Christian, they made the bold statement: “We hold these Truths to be self evident”.
Once again we return to the most fundamental solution to the preservation of our Nation: The nation is best governed by a free citizenry who are each individually pursuing being their best self, seeking individual excellence, and the well being of others.
Sundance says (as I hear him) , “Get right with God, seek his will, trust your gut, love your people, live your best life, throw sand in the machinery, speak your voice”. Do you honestly believe that if 702 were ruled unconstitutional that all the players involved in developing and using the electronic surveillance and control systems would stop?
Not only no, but hell no.
I half-suspect that the players behind this would rather 702 was ruled unconstitutional and thrown out, because then they wouldn’t even have to pretend a little bit to be law-abiding. And forget all this “fruit of a poisoned tree” evidence that can’t be used in court, too. They will simply create a confidential source to explain how they got whatever information they gleaned from their illegal surrveillance.
