When I read the New York Post article proclaiming that President Trump supports the fraudulent system known as H1B visa hiring, I knew something was amiss because we previously looked at Trump’s various business hires and use of the visa process.
Apparently, the NY Post called President Trump to get him to weigh in on the controversial subject that has been triggered by Elon Musk saying he would “go to war on this issue” to maintain the H1B visa system -and subsequent foreign employment for tech skilled workers- his various companies depend upon.
Here’s the topline takeaway from the article that has triggered many:
(NY POST) President-elect Trump told The Post Saturday he supports immigration visas for highly skilled workers, appearing to side with Elon Musk in the roiling intra-MAGA debate on the issue.
“I’ve always liked the visas, I have always been in favor of the visas. That’s why we have them,” Trump said by phone, referring to the H-1B program, which permits companies to hire foreign workers in specialty occupations.
“I have many H-1B visas on my properties. I’ve been a believer in H-1B. I have used it many times. It’s a great program,” added Trump, who restricted access to foreign worker visas in his first administration and has been critical of the program in the past. (more)
However, if you go to the Dept of Labor website, search or download the database of H1B employment, specifically filtering to Trump’s various companies, what you will discover is that Trump Inc doesn’t use the H1B visa system at all. [Check for Yourself Here]
How does this reconcile? Well, having previously looked at the visa use by President Trump in his various companies {SEE HERE}, I can confidently assert (Occam’s Razor) that within the interview President Trump conflated H2B temporary worker visas, which he does use in his service industry, with H1B visas which he does not use.
The H-1B program applies to employers seeking to hire nonimmigrant aliens as workers in specialty occupations of distinguished merit and ability. At least that was the intent of the program before it was abused by companies who saw the opportunity to avoid domestic market wages and find alternative cheap sources of skilled labor in the tech sector. That abusive ‘labor diversion’ process has now expanded to find H1B claims in other sectors. So much so, there are now a myriad of companies requesting H1B status employees for their various interests.
The H2B program applies to employers seeking to hire nonimmigrant aliens as “temporary workers” mostly in the service industry where extreme seasonal fluctuations in business make it challenging to hire from a very limited market base. H2B workers are found in hotels, resorts, restaurants and service companies anywhere you find big seasonal shifts in service businesses, like Trump resorts.
As previously noted, Does the word “Snowbird” ring a bell? Florida has a “tourist season” which runs from (generally speaking) just after Thanksgiving to Easter annually. January, February and March are the peak. The first Monday in February is the absolute peak as almost every time-share and hotel unit flips that week.
The volume of work within the service and hospitality industry doubles during the tourist season, and those businesses who hire within the general labor market struggle to increase their labor in relationship to the increase in business. In addition, local workers looking for employment are reluctant to take temporary or “seasonal” jobs, and prefer longer term -more stable- employment.
Many businesses need to double, or in some cases triple, their workforce in order to meet the business demand. As a consequence, many companies, including Trump owned resorts, have used H-2B visa workers to fill the gap between large fluctuations in business and the needed staffing shortfalls. From my own experience, many of the workers are students from South America (Argentina, Brazil, etc) who take the seasonal jobs Nov/Dec – March/April between their college seasons – and then return home.
Bottom line – President Trump is referencing H2B visas which he does use, and not H1B visas which he does not use. Whether President Trump conflated the issue, or whether the Murdoch owned New York Post intentionally constructed their questioning to create a clickbait controversy, is entirely up to the reader to determine. I think it’s likely a combination.
♦ All of that said, the issue of H1B replacement workers displacing American workers is not going away regardless of how uncomfortable it makes the Silicon Valley crowd. Many highly skilled Americans have been impacted by the issue of H1B replacement, and the inherent fraud within the special interest employment system is a critical issue for a large percentage of the MAGA base.
In fact, for context you might remember the 2017 Trump suspension of visas from Muslim countries. In response to that suspension, the state of Washington filed a lawsuit against President Trump seeking an injunction to continue the visas. The main subject of their opposition was the financial impact to Microsoft and the H1B visa use.
BYRON YORK, 2017 – “Why is Washington State mounting such a vigorous challenge to President Trump’s executive order temporarily suspending non-American entry from seven terrorism-plagued countries? Of course there are several lawsuits against the president, and there are lots of motives among the various litigants. But Washington State’s is the suit that stopped the order, at least temporarily. And a look at the state’s case suggests that, behind high-minded rhetoric about religious liberty and constitutional protections, there is a lot of money at stake.

Vivek Ramaswamy, David Sacks, Elon Musk (with his influencers) and the tribe in/around Silicon Valley, have placed their flag of influence on this H1B hill. They are willing to do whatever it takes to retain this system, much to the angst of the MAGA supporters who have been victimized by it.
When a system has been so thoroughly corrupted as to now create harm, there should not be a great deal of controversy in suspending that system until the market can correct itself. However, losing control of the H1B visa system is viewed by the Silicon Valley tech group as a non-starter position.
♦ It will be interesting to watch how Silicon Valley’s ally, JD Vance – a political entity wrapped in the cover of Hillbilly values, reacts to this H1B visa and immigration debate.
As we watch the arguments inside the H1B debate, it is worth remembering the group who promoted, pushed and ultimately influenced the JD Vance nomination consisted of: Charlie Kirk, Tucker Carlson, Elon Musk, Peter Thiel, Bill Ackman, David Sacks, Chamath Palihapitiya, Jacob Helberg and of course, Vivek Ramaswamy. On the inside of the Trump orbit, the network had Donald Trump Jr also promoting JD Vance.
JD Vance was then invited to be an attendee at the June 6th San Francisco fundraiser for President Trump, hosted by Sacks and Palihapitiya, and that’s likely when the first one-on-one running mate discussion between President Trump and Senator Vance took place.
Usha Chilukuri Vance, the wife of Ohio Senator J.D. Vance, quit her job as a corporate litigator at DNC-affiliated Munger, Tolles & Olson, within minutes of hearing that JD had been selected as President Trump’s Vice-President nominee and running mate. Usha Chilukuri-Vance worked in Washington DC for the firm.
The American workers who Silicon Valley advocate for replacing with foreign workers, are the proverbial “Saxons, with nothing to lose.”
The Big Tech group may not have initiated the background; in fact, the offshoring and replacement cycle was started many years before. However, when you strip a group of Americans of their value, label them, ostracize them, ridicule them, belittle them and then denigrate them for failing to support your abuse, think “rust belt”, you create a group of Americans with nothing left to lose.
Calling people “racist” and “nativist” who voted for President Trump specifically on this issue is not going to work. Musk et al should be very aware that this H1B debate is targeting the “nothing left to lose” American team.
If they think their immigration position is both zero-sum and survivable, think again. There is much for them to lose. The true zero-sum position is already held by a much bigger tribe of American workers who truly do have nothing left to lose.
Silicon Valley ends up fighting an army that will never concede because they have already been stripped of everything they hold dear.
Beware the wrath of the angry Saxon. This immigration topic is Musk, Ramaswamy and Sacks’ first trip into what they call ‘flyover country.’ They are experiencing strong MAGA pushback, something very new and uncomfortable for them, likely for the first time; hence, their emotional reactions.
We understand the UniParty is smiling as they see us debating this issue; however, if Making America Great Again doesn’t benefit working Americans, then what exactly is the point.




The H2B visa program gets abused, too. During the Great Recession I worked for a winter at a ski resort that used H2B visa workers. That year, even though the resort hired significantly more American workers than usual, they favored the H2Bs with better shifts and more work hours than the Americans. I had hoped to work there permanently, but come spring, my and other Americans’ hours were cut below the H2Bs’ and we could not support ourselves.
To understand, by ‘cut below’ to you mean you were cut ‘before the H2bs were fired’ so the h2bs kept their jobs and you lost yours and lost employment? I ask to understand the real world impact with respect to the h2b arguments bickered back and forth on twitter as to what is the real citizens emploment interest and effect consequent of the H2b positioning. Who is the make american great again hero in the policy debate, unemployed americans or the tech management for globalist out reach?
The H(2) B contracts have a definite length the employer has to fulfill. Not the same with regular workers.

I live 18 miles from the most remote ski resort in Utah, Eagle Point. They import ALL of their lift operators from South America. First, they suck at it. Terrible experience because you are constantly being stopped, on the lift, because these imports hate Americans and barely do their job. Here’s the thing only 1 hour away is a university with hundreds of students who would LOVE those jobs. But on the bright side, the owners are libs from New York, so the local staff, all married, give out free season passes to their friends under the guise that he/she is my gay lover! The bartenders and cocktail waitresses were Russian. In talking to one of the bartenders, he said that the majority of the in – season staff was either from Russia, Czechia, Slovakia or Belarus. Yes, jobs with long hours but if one is good they can make decent bank with tips.

H1-B visas are a slam dunk for Trump because not only do they displace American workers and provide a cheap source of labor for greedy corporations, they also open Americans up to further costs by the chain migration that comes after greencards are awarded to said visa holders and they begin to import their wholly unskilled family members who then get entitlements.
Despite this reality, some are arguing on the thread to not rock the boat for fear of pissing off Elon Musk, or some such nonsense. My point is that patriots will never be in a better position than right now to scrap and claw for every inch of terrain possible, and we should take every single opportunity to do so, vociferously.

All H1B Visa approvals are vetted by the U.S. Department of Labor which is a tower of incompetence!!! Several years ago the DOL approved an H1B Visa application for 500 Air Traffic Controllers to be imported from Peru because the FAA had a recruiting shortage. The DOL never checked with the FAA about the completely ridiculous application and approved the application. Now, FAA requirements for ATC Positions require:
A: US Citizenship
B: English fluency
C: Top Secret Security Clearance
D: College degree or 4 years ATC or pilot experience (typically US military).
…and the FAA has no problem getting applicants for these GS-14 positions that have federal law enforcement retirement.
A top priority should be the complete gutting of DOL staff involved in the process of H1B approvals!
That FAA recruiting problem for the ATC positions did not happen all by itself. Do not forget the fiasco which occurred when Obama’s team decided the ATC qualifying exam – for which both colleges specializing in ATC courses prepped their student – was ‘racist’ and eliminated it. The colleges went to court and demanded info so that they could properly prepare their students. For a while there was no exam – then the usual solution of merit based scores for some and ‘other’ factors for others. Aside from problems with the ‘others’ not being able to get through ATC training by the FAA, when they hit the towers and started directing traffic the results were disastrous.
Skies were kept safe by the time tested method of promoting incompetence away from the front line. Solved the ‘equity’ problem but seriously bloated the ATC budget.
You could solve the ATC staff problem simply enough by raising wages for the position, and changing working conditions. It is a high stress and demanding position. Instead of benefiting seniority alone, you could make the actual shifts more user-friendly on the bodies doing them; raise wages; and you would attract a lot of retired military, retired pilots, or competent pilots who have no desire for the airline life of 20 days/month away from home, crap food, lousy hotels, and dirty airplanes with no pension at the end of it.
There was NO air traffic controller recruitment problem. It was a lie by the company that submitted the H1B Visa application to the DOL as justification for bringing in 500 Peruvians which they illegal charged $10,000 each for the visa.

A big shot employment attorney in California called me last night re: H1B visa fraud / trafficking of workers. Here’s what she said:
The market is cornered by visa body shops who apply for ~50% of the visas.
The economics of it: These body shops are headed by former hiring managers from Big Tech companies. They bring people to America, rent apartments for them, and house about 10 together in one apartment.
They put these recipients through a ~4 week bootcamp of basic tech training, fraudulently rewrite their resumes, teach them how to interview.
The body shops land them jobs, primarily at the companies these hiring managers came from, and pay the workers less than half of the money in hand.

I’m still trying to make intellectual room for both sides of this controversy. The H1B program, like so many other programs begun in Washington, may have begun with good intentions. But again, as with so many other programs begun in Washington, there’s a strong argument to be made that it has been hijacked and distorted beyond its original purpose, much like Washington itself, to the detriment of the American people, who always seem to catch the short end of Washington’s good intentions.
Whatever else happens, Elon needs to remember that “burn it all down” does not apply solely to the GOPe. If a billionaire, eyes dazzled by the opportunity to advance parochial interests, forgets what drove this movement that he’s latched onto, then he need only remember the last election – 2.5 billion aggregate dollars flushed down the toilet by the Harris campaign in a spectacular losing effort to fight against the tide. There are bigger forces at play and not all of them can be bought off by a well-funded Super PAC, let alone by pique evidenced on, and banning perpetrated by, X. I agree!!! The H1B visas have effected many occupations. My son is an accountant. He is still only able to get work through a temp agency 4 years after graduating. (graduated Dec 2019, right as the country shut down). I still remember so many companies making American workers train their replacements, example Disney. I think at least some of them were accountants. Accountants are not some super high tech super skilled occupation. Many Americans can do those jobs.

There has been a change in tone and attitude, particularly on the part of the Silicon Valley team – but the debate is far from over and some things being said are simply better worded but without significant change in position.
As far as the ‘compromise’ hocus pocus – ‘compromise’ was what got us into the dire straights we are in now as a nation, with one side taking a position on the far extreme edge of a debate and the other starting on a more reasonable near center spot. you seem to be having a bit of trouble with your reading comprehension. what you’re saying is not what he said. what he’s saying is make it more expensive for companies to hire foreign workers and that the pay level has to be the same as for a domestic hire, no lower wages. Make it a merit program and require that the positions be offered first for domestic applicants then to foreign if no qualified applicants can be found. I had to do that when I hired immigrants for positions on my workforce along with personally sponsoring their immigration here and putting up the bond cost for 5 years because every domestic hire I tried lacked their skills or work ethic that I required.

Yes, the rhetoric is highly inadvisable. Castigating opponents of H1B visas as racists and using inflammatory rhetoric was a huge mistake by Musk, who has had few such missteps to now.
Having said that, I think it’s true that there is a cap of less than 100k H1B visas per year allowed (actually think its ~65k). While recognizing the injustice done to Disney IT workers when they were replaced en-masse by Indian workers, I have also experienced the pain of trying to hire tech workers. H1B visas do help. And in a highly competitive segment like AI, this matters a lot.
They get exceptions to those limits all the time. Those limits are a joke.

The cap is per year. That means it’s CUMULATIVE over 6-7 years, PLUS visa program to bring in working spouses — and this is without considering the numbers who then attain green cards and remain, and all the special visa programs for foreign students to work and ultimately stay.

I think Trump possibly intentionally misstated H1B for H2B to look at all the varients (many including OPT and others)of immigration AND the illegals (air-drops) of the biden regime AND the others here previous.
I think a large percentage do get some taxpayer funded programs.. and what about SSI from social security? Ya I think they have an path to that, wrongly, and any chain-migration clan they bring in when in possession of a green card or above. Add in what the USG/taxpayers pay to partially fund each one of these positions granted. Add in that many qualify and take SNAP and child tax allowances. And on the other end social programs to real Americans in almost all cases wrongly displaced or NOT allowed to take that job. Think about what the biden regime did ..they basically air-dropped in the surge of the bottom of one’s shoes ( as soon as possible) so-called immigrants and gave them work permits. All in an effort to say they are/were bonafide migrants are working and can’t be deported back. A very large percentage have low IQs, no work ethic, no English language ability or desire of achieving this. Almost all are hugely unneeded and a good percentage unwanted in our country and on our culture and economy. Yes a big difference with some H1Bs to H2Bs but a hard NO all around. 95% not needed and unwanted. Btw just saw musk changed position AND says it must be much more expensive to use H1Bs beyond what a local American hired would cost and pay.. YES!

Yesterday I asked whether PDJT might have somehow conflated H1-B with OS-1, which is supposed to be for the really rare genius-level applicants (right?). I wondered this because he mentioned high skills in his answer in the June interview with Sacks.
Today sundance uses the same word (conflated) today – and I see he’s (as usual) more likely correct, because H2-B and H1-B are even easier to mix up. The fact that PDJT does not have any H1-B employees is the proof.

I’m familiar with those H2b workers I think. The amusement rides at the Jersey shore are largely staffed with European kids working on English and a tan. It’s a great experience for everyone including the locals visiting the shore.
