When I read the New York Post article proclaiming that President Trump supports the fraudulent system known as H1B visa hiring, I knew something was amiss because we previously looked at Trump’s various business hires and use of the visa process.
Apparently, the NY Post called President Trump to get him to weigh in on the controversial subject that has been triggered by Elon Musk saying he would “go to war on this issue” to maintain the H1B visa system -and subsequent foreign employment for tech skilled workers- his various companies depend upon.
Here’s the topline takeaway from the article that has triggered many:
(NY POST) President-elect Trump told The Post Saturday he supports immigration visas for highly skilled workers, appearing to side with Elon Musk in the roiling intra-MAGA debate on the issue.
“I’ve always liked the visas, I have always been in favor of the visas. That’s why we have them,” Trump said by phone, referring to the H-1B program, which permits companies to hire foreign workers in specialty occupations.
“I have many H-1B visas on my properties. I’ve been a believer in H-1B. I have used it many times. It’s a great program,” added Trump, who restricted access to foreign worker visas in his first administration and has been critical of the program in the past. (more)
However, if you go to the Dept of Labor website, search or download the database of H1B employment, specifically filtering to Trump’s various companies, what you will discover is that Trump Inc doesn’t use the H1B visa system at all. [Check for Yourself Here]
How does this reconcile? Well, having previously looked at the visa use by President Trump in his various companies {SEE HERE}, I can confidently assert (Occam’s Razor) that within the interview President Trump conflated H2B temporary worker visas, which he does use in his service industry, with H1B visas which he does not use.
The H-1B program applies to employers seeking to hire nonimmigrant aliens as workers in specialty occupations of distinguished merit and ability. At least that was the intent of the program before it was abused by companies who saw the opportunity to avoid domestic market wages and find alternative cheap sources of skilled labor in the tech sector. That abusive ‘labor diversion’ process has now expanded to find H1B claims in other sectors. So much so, there are now a myriad of companies requesting H1B status employees for their various interests.
The H2B program applies to employers seeking to hire nonimmigrant aliens as “temporary workers” mostly in the service industry where extreme seasonal fluctuations in business make it challenging to hire from a very limited market base. H2B workers are found in hotels, resorts, restaurants and service companies anywhere you find big seasonal shifts in service businesses, like Trump resorts.
As previously noted, Does the word “Snowbird” ring a bell? Florida has a “tourist season” which runs from (generally speaking) just after Thanksgiving to Easter annually. January, February and March are the peak. The first Monday in February is the absolute peak as almost every time-share and hotel unit flips that week.
The volume of work within the service and hospitality industry doubles during the tourist season, and those businesses who hire within the general labor market struggle to increase their labor in relationship to the increase in business. In addition, local workers looking for employment are reluctant to take temporary or “seasonal” jobs, and prefer longer term -more stable- employment.
Many businesses need to double, or in some cases triple, their workforce in order to meet the business demand. As a consequence, many companies, including Trump owned resorts, have used H-2B visa workers to fill the gap between large fluctuations in business and the needed staffing shortfalls. From my own experience, many of the workers are students from South America (Argentina, Brazil, etc) who take the seasonal jobs Nov/Dec – March/April between their college seasons – and then return home.
Bottom line – President Trump is referencing H2B visas which he does use, and not H1B visas which he does not use. Whether President Trump conflated the issue, or whether the Murdoch owned New York Post intentionally constructed their questioning to create a clickbait controversy, is entirely up to the reader to determine. I think it’s likely a combination.
♦ All of that said, the issue of H1B replacement workers displacing American workers is not going away regardless of how uncomfortable it makes the Silicon Valley crowd. Many highly skilled Americans have been impacted by the issue of H1B replacement, and the inherent fraud within the special interest employment system is a critical issue for a large percentage of the MAGA base.
In fact, for context you might remember the 2017 Trump suspension of visas from Muslim countries. In response to that suspension, the state of Washington filed a lawsuit against President Trump seeking an injunction to continue the visas. The main subject of their opposition was the financial impact to Microsoft and the H1B visa use.
BYRON YORK, 2017 – “Why is Washington State mounting such a vigorous challenge to President Trump’s executive order temporarily suspending non-American entry from seven terrorism-plagued countries? Of course there are several lawsuits against the president, and there are lots of motives among the various litigants. But Washington State’s is the suit that stopped the order, at least temporarily. And a look at the state’s case suggests that, behind high-minded rhetoric about religious liberty and constitutional protections, there is a lot of money at stake.
Judging by the briefs filed by Washington State, as well as statements made by its representatives, some of the state’s top priorities in challenging Trump are: 1) To ensure an uninterrupted supply of relatively low-wage H-1B foreign workers for Microsoft and other state businesses; 2) To ensure a continuing flow of high-tuition-paying foreign student visa holders; and 3) To preserve the flow of tax revenues that results from those and other sources.

Vivek Ramaswamy, David Sacks, Elon Musk (with his influencers) and the tribe in/around Silicon Valley, have placed their flag of influence on this H1B hill. They are willing to do whatever it takes to retain this system, much to the angst of the MAGA supporters who have been victimized by it.
When a system has been so thoroughly corrupted as to now create harm, there should not be a great deal of controversy in suspending that system until the market can correct itself. However, losing control of the H1B visa system is viewed by the Silicon Valley tech group as a non-starter position.
♦ It will be interesting to watch how Silicon Valley’s ally, JD Vance – a political entity wrapped in the cover of Hillbilly values, reacts to this H1B visa and immigration debate.
As we watch the arguments inside the H1B debate, it is worth remembering the group who promoted, pushed and ultimately influenced the JD Vance nomination consisted of: Charlie Kirk, Tucker Carlson, Elon Musk, Peter Thiel, Bill Ackman, David Sacks, Chamath Palihapitiya, Jacob Helberg and of course, Vivek Ramaswamy. On the inside of the Trump orbit, the network had Donald Trump Jr also promoting JD Vance.
JD Vance was then invited to be an attendee at the June 6th San Francisco fundraiser for President Trump, hosted by Sacks and Palihapitiya, and that’s likely when the first one-on-one running mate discussion between President Trump and Senator Vance took place.
Usha Chilukuri Vance, the wife of Ohio Senator J.D. Vance, quit her job as a corporate litigator at DNC-affiliated Munger, Tolles & Olson, within minutes of hearing that JD had been selected as President Trump’s Vice-President nominee and running mate. Usha Chilukuri-Vance worked in Washington DC for the firm.
The American workers who Silicon Valley advocate for replacing with foreign workers, are the proverbial “Saxons, with nothing to lose.”
The Big Tech group may not have initiated the background; in fact, the offshoring and replacement cycle was started many years before. However, when you strip a group of Americans of their value, label them, ostracize them, ridicule them, belittle them and then denigrate them for failing to support your abuse, think “rust belt”, you create a group of Americans with nothing left to lose.
Calling people “racist” and “nativist” who voted for President Trump specifically on this issue is not going to work. Musk et al should be very aware that this H1B debate is targeting the “nothing left to lose” American team.
If they think their immigration position is both zero-sum and survivable, think again. There is much for them to lose. The true zero-sum position is already held by a much bigger tribe of American workers who truly do have nothing left to lose.
Silicon Valley ends up fighting an army that will never concede because they have already been stripped of everything they hold dear.
Beware the wrath of the angry Saxon. This immigration topic is Musk, Ramaswamy and Sacks’ first trip into what they call ‘flyover country.’ They are experiencing strong MAGA pushback, something very new and uncomfortable for them, likely for the first time; hence, their emotional reactions.

Yes because we all know that paying more will hurt the likes of Musk. How about cutting back or making it only in certain circumstances such as not being able to get Americans for six months or more.
How about, if a company applies for h1b employees they also have to make a training program at their local community college for the expertise they are fishing for and promise to to phase out the h1b as they certify American graduates.
Or some other program that shows their immigrant labor is a temp fix, not a long term business plan.
That is a new idea that has merit that I have not seen! Privatize the education and and cut out the Dept of Education and get your moneys worth!

I have seen a few people comment that companies are paid subsidies of some kind for foreign workers. If true, eliminate that.
I have also seen comments that the recruiters of foreign workers get paid or the foreign workers are actually employed by an agency and that the agency gets paid attractive fees with less to the workers.
If workers are required to work more than 40 hours, why aren’t they getting overtime?

Maybe our colleges should focus on quality technical programs versus social and “woke” training. It is very difficult to remain objective about college programs and the real merits to society. The problem with technical programs is that they generally take knowledge, commitment, and hard work to complete and more work than many students want to exert. Community colleges are doing a better job of fulfilling technical jobs versus some 4 year institutions.
I really like your idea, but unfortunately… it would be abused. So long as corporations and “self made” brats like Elon feel they are entitled to whatever they want, at the prices THEY think they should pay (they would pay nothing, if they thought they could get away with it), there will be nothing but abuses of any fix.
The problem is, I finally now realize, not at all a logical or economic one, but a deeply embedded cultural rot, down to the very marrow. It started when the Baby Boomers reached their prime working years. Both my parents (Gen-X, here) were required to train their replacements — a foreign replacement, in my Dad’s case, a “temp, for now”, in my Mother’s case — only to then be told they were “over-qualified, we can’t keep you, BYE!”. And they couldn’t find any work until they finally reduced their pay requirements to roughly 2/3rd what they used to make. But, again, they became “over qualified, BYE!”, then found new jobs making half the pay they used to make (from the first job).
And as I was growing up, I could see the writing on the wall. I wanted nothing to do with the fields they were in (electronics engineering, for my Dad, and accounting, for my Mom). But I had friends, and I could see the same things happening in their families. Frankly, I was about to commit suicide, seeing no sensible future, no possible way to do half what my parents did, let alone even or better. See…
When there is no future, the psyche naturally sees the present as less. that’s where things like drug abuse actually come from, as well as the aforementioned suicidal ideation. It also happens because people no longer have kids… when there’s less future, the present becomes worth less, as well. So people tend to indulge in the most meaningless and oft-times harmful of things. Why live right, when there’s no future?
And all so some rich people can save a few lousy bucks on what they pay their employees. And now that I think of it, they want these Indians to come here, work 80+ hours/week for half the pay… so they can build their robotic replacements before sending them back into the trash heap, all their money spent here just trying to make ends meet!

Money is a tool, and like any tool it can be used or it can be abused. When it becomes an end in and of itself then it also becomes a false god. Those who only look at what they call ‘the bottom line’ are not looking deeply enough.
In 2020, President Trump wrote EO 13843 to ensure the prioritized employment of US citizens at the TVA versus foreign contractors. Very similar concerns, expertly handled in the Executive Order. Part of the immigration program was designed to bring talented professionals into the nation, but we can see how that was distorted. Elon Musk isn’t the most astute commenter on social media, and Vivek also falls into “nerdism” which often includes insensitivity at the wrong times while trying to address facts.
Musk’s vitriol was likely in reaction to the myriad real racists who infest X every time there’s a hot topic involving Israel (jews), muslims, or other foreigners in some negative light, especially illegal migrants or H-1B visa migrants.

There is this thing called the Van Allen Belt, not something you want to go through without some kind of shielding witch none of the crafts had, it would be like riding in a microwave oven. Unintentionally, they put a spotlight on heavily abused H-1B visa program. It literally took just a few hours for people to dig up statistics on how H-1B are used and who benefits the most. Tesla, by the way, is up there with the most heavy hitters on H-1B foreign labor force.
To have a starting point in the conversation let’s dispense with traditional “H-1B is for the geniuses” nonsense. The starting point should be: “H-1B is to help corporations to reduce their expenses and to pad their bottom line”. When you put it this way, they run away form this conversation because of the optics. You can no longer say that there is not enough Americans with talent and skill and that Americans are lazy. Why, because now you know the motive behind of H-1B hires. I know something myself about it. I was H-1B myself back in 1997 and saw the first hand how the process worked. Now I am a fully naturalized American citizen so I do have a stake in it.
Steve Bannon said it best: “if Elon and Vivek say they need more H-1B visas because there is not enough talent and skill in America amongst Americans, let’s audit them. Let’s find out who those H-1B geniuses are.”

He is a great engineer, no doubt about it. But I will not be taking advice from him what’s best for Americans.

I just read Thread Readers analysis of five years of H-1B visa ap data and here are the highlights:
1) H-1B’s original intent of attracting the world’s most elite tech talent to the U.S. isn’t happening because the DOJ, in collusion with several major US and Indian companies, has corrupted the program and use it to recruit hundreds of thousands of lower-wage tech workers that rightly should be filled by Americans.
2)The H-1B program has a statutory limit of eighty five thousand visa approvals per year, but the DOL is disregarding it’s own statutes and in 2024 approved eight hundred and sixty eight thousand visas, more than ten times the level approved by law!
3) The bottom line is that our government, working in collusion with U.S. companies like Google, IBM and Salesforce, as well as Indian companies like Cognizant, Infosys and Tata, are openly flouting the law and have corrupted the good intent of H-1B and turned it into a very large middle finger held up to the faces of thousands of unemployed American tech workers!

The data you’re referring to is for all LCA applications, not just H1b. And it also includes renewals, rather than just new applications. I posted about this upthread. H1b’s are renewed unless the renewal application is rejected, so this data includes the renewal applications of many visa holders whose visas were issued in prior years. Only new applications are included in the cap.
Also, maybe you know this and I’m just reading it wrong, but “thread readers” is just a tool for organizing multiple posts for ease of reading on X. I assume you’re referring to Robert Sterling’s posts. He self-identifies as a non-expert on the subject. He just downloaded a bunch of data and put it into charts w/o much concern for clearly identifying exactly what the charts reflect.

That should be changed immediately and make them pay. It will help the Social Security system which is scheduled to run out of money in five years!

Living in a seasonal resort area I am aware of the seasonal hires using visas and there is abuse with this program as well. There is one large company here that built several condos on the beach and manages the rentals. Most of their hires during on season are visa hires.
While they profess to offer employment to locals they claim that most do not pass the drug testing. I doubt the foreign students are tested ….because what would they do with them if they fail…they are financially invested in the students. They house them in condos that they rent to them where there are 10+ per condo unit.
Students mostly clean condos and are paid a low fee with ridiculous expectation for cleaning detail instruction. The more units they clean in a day the more pay, this does not lead to a clean condo. I can tell you this, I would not stay in one of their condos. I personally know that it is entirely possible to find pubic hairs inside a refrigerator. Think cleaning rags that are not changed out. This is not an issue of “better workers” cause the locals are slackers. Sorry if I ruined someones future vacation plans.
Bottom line this company does not want to pay a fair wage and they get what they paid for.

Elon has stated plainly that he will ‘go to war’ over H1 to protect his business model but will now concede to a tweaking due to the pushback.
I still hope Trump will come out and reaffirm his 2016 promise to end H1 but unfortunately hasn’t done so.

We are hearing extreme versions of arguments about using H1Bs, and usually the correct answer is in the middle. In 2020, President Trump wrote EO 13843 to ensure the prioritized employment of US citizens at the TVA versus foreign contractors. Very similar concerns, expertly handled in the Executive Order. Part of the immigration program was designed to bring talented professionals into the nation, but we can see how that was distorted. Maybe our colleges should focus on quality technical programs versus social and “woke” training. It is very difficult to remain objective about college programs and the real merits to society. The problem with technical programs is that they generally take knowledge, commitment, and hard work to complete and more work than many students want to exert.

This whole thing strikes me as a tempest in a teapot…and a big distraction (perhaps a necessary one!) from the mass deportations that are needed. It runs the risk of taking our eye off the ball. The big prize here is the mass deportations. That HAS to get done.
Yeah, we can tweak the H1B visa program, and it affects a very small number of people in the grand scheme of things. But this country will be unimaginably better if we booted out 20M-30M illegals. I can’t even begin to describe the positive impacts of kicking that many people out who are just a massive drain on the taxpayers, criminal justice system, and even things like housing prices and food prices.
Putting a tax in H1B that says, “OK, you can hire an Indian programmer, but if you need it THAT BAD then you’re going to pay a tax for it which we’ll use to train an American Citizen to replace said Indian programmer so the Indian can go home.”
Oh and just take away the citizenship piece. Nobody on those visas should ever be eligible for citizenship or chain migration of family members here. It’s only purpose should be to hire somebody whose skills are not available from a qualified American citizen. Once that position is filled, the H1B holder GOES HOME. Period.

The teachers are not allowed to teach anything they want!
For example, in our school district They are not allowed to teach multiplication tables . (Which I memorized in 3rd grade back in the day)
Students cannot multiply a 3 digit number by a 2 digit number such as 324 x 28 without a convoluted discussion of hundreds and 10s and ones. . Not allowed to just start by multiplying 8 x4 and carry the 3.
To divide 7/8 by 1/2 you are not allowed to just invert and multiply 7/8 x 2/1. Instead you have to draw bars and line segments and other new concepts which in my view are not helpful.
The curriculum and daily lesson plans are dictated by the DOE admin downtown or in our state capital or in Washington.
The elected school board has no clue.
In my view it is not the teachers fault the kids can’t do basic arithmetic. It’s the curriculum that is the problem in my opinion. The teachers have no discretion.

The “new math” is a stupidly misguided attempt to teach average kids patterns and connections in mathematics that the brightest kids intuitively grasp, invent, and/or rapidly figure out and use all by themselves — all taught by teachers who themselves didn’t hail from that set of students.
While it apparently plagues those who are of the sort that used to get by adequately enough through required elementary and secondary school math courses with plugging and rote memorization, I’ve seen no evidence that it’s causing a problem for the math whiz kids who would in the future be pursuing fields heavy in mathematics.

There is much anecdotal evidence that regular non-whiz kid American workers in many less sophisticated industries are losing jobs due to H1B problems
In my town 100 workers lost jobs when a call center processing Medicare part D pharma mail orders was shut down. The call center lost the contract to Infosys. These were American high school grads making only $15. Per hour but Infosys found Indians here in this country willing to work for less..

Common core puts the cart before the horse in its approach to math. It tries to teach concepts before teaching how to do arithmetic. Young children need to learn arithmetic. Advanced children need to understand the concepts behind it but they do not need to learn that in elementary school. There has always been a large group of students who never get the concepts behind math or critical thinking, but, they all need to know the basics for financial survival in our modern world.

What does this have to do with the original topic of H1B visas?
According to the 1952 Immigration and Nationality Act, the H-1 visa was created for “an alien having a residence in a foreign country which he has no intention of abandoning who is of distinguished merit and ability and who is coming temporarily to the United States to perform temporary services of an exceptional nature requiring such merit and ability.”The visa was called an H-1 visa because it had been made into law by section 101(15)(H)(1) of the Immigration and Nationality Act.
The 1952 Act was changed by the Immigration Act of 1990 and other Acts in subsequent years. It’s interesting that the original language quoted above is hardly being used today. The foreign outsourcing of our manufacturing and other industries is what brought in these visa changes in 1990 and later. Skilled people with years of experience and training found themselves on the unemployment line seeking new jobs in unrelated fields, many of which did not need specialized skills. So we ended up with a drain that Silicon Valley and their lobbyists took advantage of with the Congress. We did this to ourselves with the years of outsourcing our industries. And the H1B program became a way to bring in cheaper labor.
President Trump was given a mandate to deport ALL illegal immigrants out of this country…period.

Where did your opinion come from? Someone else you’ve decided to trust so you didn’t personally go to the primary source ie Elons conversation thread and take into account his long established conversation/interaction style on his personal account before forming YOUR own opinion

Fwiw, especially during vicious psywars like this one, its survival savvy to remember that both foes and those who are seen as friends may want the power to tell YOU what to think about things rather than helping you to learn how to unemotionally research, analyze and think for yourself.
Notice how President Trump typically uses humor which triggers a Light Hearted laughter reaction when speaking about something as opposed to those who words that typically trigger Dark Hearted emotions that has the same effect on the brain as booze ie these “toxic” emotions immediately impair the part of the brain that does logical analysis of new data?
Notice how President Trump often offers real questions rather?
Notice those who instead give answers and who insists that the answer they’ve given you is the only correct answer ie theres no need to think about this just repeat this answer and you’ll be correct, trust me?
Notice how President Trump tends to speak for himself when he gives an opinion?
Notice those who instead claim to be speaking for a huge group when giving their opinion; a group, like MAGA voters, they have no actual authority to speak for?
Notice how President Trump encourages people to take a “wait and see” attitude when “fighting” erupts?
Notice those who instead use their influence to whip people into a violent vigilante frenzy?
Bottom line, President Trump is THE person I turn to when I want a guide who will no me safely navigate my way through a PsyWar Storm. And I evaluate everyone else’s guidance, ESPECIALLY those who claim to be a trustworthy friend, by how closely their approach resembles President Trumps. Or doesn’t.

USAID has school programs in India. I wonder if we set up and financed those tech schools that feed the H1b pipeline? I am going to guess YES. USAID did the same thing when we off shored our textile industry to central America. They are awful helpful.
