When I read the New York Post article proclaiming that President Trump supports the fraudulent system known as H1B visa hiring, I knew something was amiss because we previously looked at Trump’s various business hires and use of the visa process.
Apparently, the NY Post called President Trump to get him to weigh in on the controversial subject that has been triggered by Elon Musk saying he would “go to war on this issue” to maintain the H1B visa system -and subsequent foreign employment for tech skilled workers- his various companies depend upon.
Here’s the topline takeaway from the article that has triggered many:
(NY POST) President-elect Trump told The Post Saturday he supports immigration visas for highly skilled workers, appearing to side with Elon Musk in the roiling intra-MAGA debate on the issue.
“I’ve always liked the visas, I have always been in favor of the visas. That’s why we have them,” Trump said by phone, referring to the H-1B program, which permits companies to hire foreign workers in specialty occupations.
“I have many H-1B visas on my properties. I’ve been a believer in H-1B. I have used it many times. It’s a great program,” added Trump, who restricted access to foreign worker visas in his first administration and has been critical of the program in the past. (more)
However, if you go to the Dept of Labor website, search or download the database of H1B employment, specifically filtering to Trump’s various companies, what you will discover is that Trump Inc doesn’t use the H1B visa system at all. [Check for Yourself Here]
How does this reconcile? Well, having previously looked at the visa use by President Trump in his various companies {SEE HERE}, I can confidently assert (Occam’s Razor) that within the interview President Trump conflated H2B temporary worker visas, which he does use in his service industry, with H1B visas which he does not use.
The H-1B program applies to employers seeking to hire nonimmigrant aliens as workers in specialty occupations of distinguished merit and ability. At least that was the intent of the program before it was abused by companies who saw the opportunity to avoid domestic market wages and find alternative cheap sources of skilled labor in the tech sector. That abusive ‘labor diversion’ process has now expanded to find H1B claims in other sectors. So much so, there are now a myriad of companies requesting H1B status employees for their various interests.
The H2B program applies to employers seeking to hire nonimmigrant aliens as “temporary workers” mostly in the service industry where extreme seasonal fluctuations in business make it challenging to hire from a very limited market base. H2B workers are found in hotels, resorts, restaurants and service companies anywhere you find big seasonal shifts in service businesses, like Trump resorts.
As previously noted, Does the word “Snowbird” ring a bell? Florida has a “tourist season” which runs from (generally speaking) just after Thanksgiving to Easter annually. January, February and March are the peak. The first Monday in February is the absolute peak as almost every time-share and hotel unit flips that week.
The volume of work within the service and hospitality industry doubles during the tourist season, and those businesses who hire within the general labor market struggle to increase their labor in relationship to the increase in business. In addition, local workers looking for employment are reluctant to take temporary or “seasonal” jobs, and prefer longer term -more stable- employment.
Many businesses need to double, or in some cases triple, their workforce in order to meet the business demand. As a consequence, many companies, including Trump owned resorts, have used H-2B visa workers to fill the gap between large fluctuations in business and the needed staffing shortfalls. From my own experience, many of the workers are students from South America (Argentina, Brazil, etc) who take the seasonal jobs Nov/Dec – March/April between their college seasons – and then return home.
Bottom line – President Trump is referencing H2B visas which he does use, and not H1B visas which he does not use. Whether President Trump conflated the issue, or whether the Murdoch owned New York Post intentionally constructed their questioning to create a clickbait controversy, is entirely up to the reader to determine. I think it’s likely a combination.
♦ All of that said, the issue of H1B replacement workers displacing American workers is not going away regardless of how uncomfortable it makes the Silicon Valley crowd. Many highly skilled Americans have been impacted by the issue of H1B replacement, and the inherent fraud within the special interest employment system is a critical issue for a large percentage of the MAGA base.
In fact, for context you might remember the 2017 Trump suspension of visas from Muslim countries. In response to that suspension, the state of Washington filed a lawsuit against President Trump seeking an injunction to continue the visas. The main subject of their opposition was the financial impact to Microsoft and the H1B visa use.
BYRON YORK, 2017 – “Why is Washington State mounting such a vigorous challenge to President Trump’s executive order temporarily suspending non-American entry from seven terrorism-plagued countries? Of course there are several lawsuits against the president, and there are lots of motives among the various litigants. But Washington State’s is the suit that stopped the order, at least temporarily. And a look at the state’s case suggests that, behind high-minded rhetoric about religious liberty and constitutional protections, there is a lot of money at stake.
Judging by the briefs filed by Washington State, as well as statements made by its representatives, some of the state’s top priorities in challenging Trump are: 1) To ensure an uninterrupted supply of relatively low-wage H-1B foreign workers for Microsoft and other state businesses; 2) To ensure a continuing flow of high-tuition-paying foreign student visa holders; and 3) To preserve the flow of tax revenues that results from those and other sources.

Vivek Ramaswamy, David Sacks, Elon Musk (with his influencers) and the tribe in/around Silicon Valley, have placed their flag of influence on this H1B hill. They are willing to do whatever it takes to retain this system, much to the angst of the MAGA supporters who have been victimized by it.
When a system has been so thoroughly corrupted as to now create harm, there should not be a great deal of controversy in suspending that system until the market can correct itself. However, losing control of the H1B visa system is viewed by the Silicon Valley tech group as a non-starter position.
♦ It will be interesting to watch how Silicon Valley’s ally, JD Vance – a political entity wrapped in the cover of Hillbilly values, reacts to this H1B visa and immigration debate.
As we watch the arguments inside the H1B debate, it is worth remembering the group who promoted, pushed and ultimately influenced the JD Vance nomination consisted of: Charlie Kirk, Tucker Carlson, Elon Musk, Peter Thiel, Bill Ackman, David Sacks, Chamath Palihapitiya, Jacob Helberg and of course, Vivek Ramaswamy. On the inside of the Trump orbit, the network had Donald Trump Jr also promoting JD Vance.
JD Vance was then invited to be an attendee at the June 6th San Francisco fundraiser for President Trump, hosted by Sacks and Palihapitiya, and that’s likely when the first one-on-one running mate discussion between President Trump and Senator Vance took place.

Vance, quit her job as a corporate litigator at DNC-affiliated Munger, Tolles & Olson, within minutes of hearing that JD had been selected as President Trump’s Vice-President nominee and running mate. Usha Chilukuri-Vance worked in Washington DC for the firm.
The American workers who Silicon Valley advocate for replacing with foreign workers, are the proverbial “Saxons, with nothing to lose.”
The Big Tech group may not have initiated the background; in fact, the offshoring and replacement cycle was started many years before. However, when you strip a group of Americans of their value, label them, ostracize them, ridicule them, belittle them and then denigrate them for failing to support your abuse, think “rust belt”, you create a group of Americans with nothing left to lose.
Calling people “racist” and “nativist” who voted for President Trump specifically on this issue is not going to work. Musk et al should be very aware that this H1B debate is targeting the “nothing left to lose” American team.
If they think their immigration position is both zero-sum and survivable, think again. There is much for them to lose. The true zero-sum position is already held by a much bigger tribe of American workers who truly do have nothing left to lose.
Silicon Valley ends up fighting an army that will never concede because they have already been stripped of everything they hold dear.

Dragon, yes, we certainly have Americans that are less qualified/caring than we should in this land of plenty. They are societal issues. We do have 300,000,000 + Americans and I find it impossible to believe within that number, we can’t find capable and able individuals to fill any need. Were that the case these companies would not be firing highly educated and skilled citizen workers over one hundred thousand at a clip and then forcing them to train substandard h1bs that replace them. They wouldn’t be refusing to interview citizen grads with experience. It’s also beyond h1b, citizen medical grads are being denied the residencies needed after graduate before being licensed, which is why areas where Obamacare forced established citizen doctors out by fining them for ordering diagnostic tests beyond basic X-rays and bloodwork, there are virtually only horrendous Indian etc. Despite Sundance’s assurances, I remember in 2019 young citizen med school grads organizing and reaching out to Trump on this discrimination and asking him get the number of residencies increased, he ignored them. When checking out,i told the nurse they were nice but I would never be back,she said what if you have another stroke. I said Read my lips,I will never come back to a Hospital again. Having worked at the U.S. border for 20+ years, I’ve seen the abuses of H1B visas. Prior to joining U.S. Customs and Border Protection I’d applied for Tech jobs and was never contacted. Then while at the border I see the Canadian/Indians/Chinese come down en-masse under the H1B taking jobs where I’d applied.

Then those H1B visa holders are BOUND to their sponsors and that impacts their market freedom and hence their income, which depresses the pay for the positions. They are effectively 21st technology “slave workers.” They don’t have the ability move companies, so they are taken advantage of in the workplace.
Second, you are wrong about them not needing training and “hit the ground running.” The system is SO abused that a lot of these workers may be among the BEST from their country, but quite average compared to the American worker. Yes, there are some highly qualified people.
When the H1B was started, it WAS for the highly exceptional. Think of entrepreneurs that started companies or contributed greatly to existing companies. It WAS to bring the best of the best here. Now, it’s just to legally import cheap workers.

With the USG highly bloated it does not take a financial genius to analyze the numbers and suggest some miraculous path forward. There are decades worth of studies that layout solutions.
To balance the budget all that is required is to implement the 2019 pre-covid budget.

Ramaswamy devised a solution: His mother, Dr. Geetha Ramaswamy, conducted a new Phase 2 trial in 2015 involving “684 subjects.” This trial conveniently claimed to demonstrate sufficient improvement to “support Phase 3” trials.
The aftermath was a triumphant $350 million IPO in 2015, followed by a drastic fall. By September 2017, the stock had plummeted 75 percent after Ramaswamy and his mother announced the Phase 3 trial’s failure. In Silicon Valley it was really simple. Your job was outsourced and if you made a stink about it, you were blacklisted and no one would hire you. I don’t have a problem with H1B as long as Americans come 1st and an honest effort to hire Americans 1st is made. I used to have a landscaping business with seasonal employees and used H2B workers because we had to. We just did not have the local work force. I had to prove that the job was first available to Americans with expensive help wanted ads, attorney fees and such. The program sometimes helped but was run inefficiently by the FEDs. No surprise there. I stopped using the program when I spent a lot of money and was never given any workers. The stories we have heard about H1B workers coming into the country and the Americans have to train them to take their jobs are troubling. That just cannot be allowed to happen.
A point is that today is not yesterday. What could not be done then might very well be a success today. President Trump received a record number of votes from our younger generations. They deserve a chance before bringing in replacements.

Let’s go to 30,000 feet. The biggest problem with H-1B–and legal immigration in general–is the area of “culture.”
PJBuchanan was adamantly in favor of immigration, so long as the immigrants were imbued with the Judaeo-Christian culture. Importing people who worship hundreds of gods, or Allah (definitely NOT the “Christian God”), or who are (in effect) solipsists, will degrade the culture.
Why? Because then we will have a country in which Mammon–material success–is the real god, there being no other unifying belief. Don’t believe that? First and foremost, this should have be a short term problem solved by the end of term 1, but it was thwarted by the evil insiders who brag about literally taking things off the President’s desk because they did not want him doing anything about their illicit grifts.
Once upon a time I was in membership sales for a 3 county regional chamber of commerce that was part of a very large midwest metro city. One of our counties was the fastest growing in the area and business was booming. It was like taking candy from a baby. I was paid the same 10% as the Big Guy gets but only for the first year.
When I met with most company heads to talk about membership they asked the same questions everyone else was asking, and that was about people. Where do I get the people I need and what can the chamber do for me in that respect? They said they were literally having to hire people who had a pulse.
I made up a list of resources for them, and of course, working with the colleges and educational institutions in the area was at the top. I pointed out that they already were chamber members so you would have all the intros needed, and if they weren’t, I’d be bringing them in pronto.
There is a reason sports teams have recruiters who go into colleges and schools looking for talent. The same goes for college recruiters into high schools.
As a business owner YOU need to set up the programs that develop what you want and need within these institutions, or create your own. The onus is on YOU.
Trust me, they LOVE partnerships with area business owners. It makes them much more valuable too if they can say they provide great job placements straight out of their colleges or high schools. This will in turn force higher quality measures within the schools themselves. It’s a Win-Win!
Internships, paid or otherwise, apprenticeships, mentorships… There is a plethora of ways to overcome this alleged obstacle in a very short period of time, and then we should never have to discuss it again.
Do you see what I mean now about short term? How long would that take to graduate what you need? A year, two years, three years, four? Can’t be more than four. We could/should have had this done and over with and not be having this convo ever again.
The program has caps. Make them concrete and make them stick. The era of business laziness must end.

If H1B visas are necessary due to Americans being uneducated and untrained, then the American college and university system cannot be the best in the world attracting global students.

We all know this pot has been brewing for a long time…I had many friends displaced from American university spots in the medical field (which was super competitive back in the 1970s) by foreign students because the universities made more money….and the Americans had to scramble for out of state spots or even went to other countries to get their degrees or just opted for another degree.
In the 80s, while at the university for continuing education classes, university professors were urging us to write our state legislators to push for the foreign student graduates to get visas to remain here because there just were not enough American health workers to fill the positions. Hmmmm, I wonder how that happened? Ever wonder why so many doctors and pharmacists you see today are foreign and often difficult to understand. This is not rocket science. It has been engineered.
This is not new. My sister’s engineering firm brought in foreign people which they had to train for their own jobs!

Let’s keep in mind the fact that the H-1B visa is a NON-IMMIGRANT visa which allows the recipient to live and work in the U.S. for from three to five years. Of course, there are tons of immigration attorneys and lots of carve outs to try to keep these folks in the country legally after the original visa expires.
What we really need is a total overhaul of our immigrant/non-immigrant visa system . Since that is a political can of worms, I’m not holding my breath. Oh, by the way, forget about getting excited over the effort to end “birth right” citizenship. That will take a Constitutional Amendment which is simply not going to happen.
The easier route would be that the supreme court has a case come before it to <look> at the original amendment and decide whether it applies to everyone of just what it meant (if ambiguous) when it was wrote to apply to civil war issues.
I do not think the supreme has ever looked at it thru litigation before.
If we start deporting people / mixed family of anchor babies, it WILL come up & quick.

I used to know a guy who lives in Africa who comes to the midwest every farming and harvest season and drives the big tractors, tractor trailers, all the big stuff in farming. They put him up in a hotel while he’s here. He goes back home and doesn’t have to work the rest of the year. Owns his house and property outright. Lots of expensive toys too.

Licensed Professional Engineer here. Roughly 50% of US citizen STEM graduates are not working in STEM fields.
H1-B is not a problem in the abstract — we want to attract the best talent. The problem is that in practice, it is horribly abused by corporations with the willing participation of the federal government. The result is displacing American workers. When layoffs happen, it should be H1-B that gets the axe first. But in reality, it’s US STEM that gets the axe. For the reasons below.
By and large, H1-B engineers are talented people. However, due to the situation and their cultures of origin, they are willing to work longer hours for less pay and can be easily pressured into making questionable ethical choices. They don’t necessarily want to do so, but the corporation has all the leverage — Do what you’re told without complaining or you’re going straight back to the s***hole you came from. Nothing has to be said, they know the deal.
These comments are from firsthand experience. H1-B will work longer hours and do what they are told regardless of the ethics because they are essentially indentured servants. Many come from cultures that believe you do what the boss says and don’t worry about the ethics anyway — defer to authority.
Wrapping up, H1-B is not inherently a bad thing, but needs massive reform and aggressive enforcement. Easiest way is to force companies to pay a 25% (or higher!) penalty on the H1-B salary, and lower the numbers cap.
This comment, and many others similarly rational, must get to President Trump’s desk. Perhaps someone in his immediate circle can put together a brief. Also get the brief onto X and Truth Social. I’m not conversant with them, but surely many here are.

There is a quite large contingent of young men, only visible online, for whom the future seems bleak. The radical feminism indoctrination of public schools and “universities” has attempted to teach them they are evil, and has succeeded in teaching women men are evil.

Watch President Trump come out and Make Coding Cool Again to Gen Z and Gen Alpha by making it an American cause (think WW2 War Bonds or going to the moon or NYC ironworkers back in the day or building the US Interstate Highway System) and by ensuring it is a recognized & rewarding path.
Also by doing this it will have a dual benefit of increasing math and science skills development in America while exposing those teachers who are weak, woke and worthless math/science teachers.
The lack of American participation in this field can change quickly simply via leadership so watch PT to correct this initial error and make coding all the rage.

Having been a software developer in the past, I wholeheartedly agree that the principles of coding (variables, data structures, functions, loops and conditional expressions) are not that difficult to learn, and can be explained quickly. Using it to solve a real world problem is entirely another story. You have to know and understand what it is you want to produce and why.
Thats why can’t stand this whole “learn to code” crap. It’s all about solving problems and creating things. Code is no different from a Lego brick in that respect.
We have plenty who do code or could code – it’s that tech companies want to pay low salaries and have them work long hours without OT. Basically they want indentured servants and the US Government facilitates that.
Many of those visa workers live in cramped apartments with other indentured servants. They are not paid enough to live decently. It is very similar to the houses with 10 or 15 illegals who do day labor – accept the illegals actually have more freedom.

Wow. Critical analysis, non judgmental, non biased take of an issue. I know you do this so often but it really just hit me after seeing so much hyperbole on the Visa controversy and having read so much on other sites. So many people have such a large ego that it is hard to even hear their argument because you have to filter out so much “noise”. Kudos, well done.

The discussion of H1B has been worthwhile as showing clearly the corruption in it use. The program as it exists is indefensible, but it is correctable. The number of H1Bs must be reduced or halted (depending who wins the argument). Reaching a solution now, however, would be fractious and thus premature. We need unity to turn back the marauding hordes flooding our border .

My experience: goes to school, gets multiple advanced degrees while working in Silicon Valley, told I needed “technical certifications” – handily obtain every cert there is to obtain across numerous platforms + management training, etc etc etc. Pleasant person to work with. Get dumped for H1B VISA holders because they are cheap labor, even though I worked 60-80/week on a salary. On call 24×7. Never complained.
BTW, when a company outsources their networks and security to IBM…. IBM staffs with H1B VISA holders. And I’m sorry, they just aren’t that good, but whatever.
I’m a farmer now. The tech world can bite me.
