Atlanta Judge Scott McAfee ruled today that President Trump, and eight other co-defendants in the Georgia election fraud case, can proceed with an emergency appeal of his decision last week. That decision allowed lying Fulton County District Attorney Fani Willis to stay on the prosecution despite her affair with the special prosecutor she hired to oversee it, and despite the lies she told trying to hide it.

In a brief order issued Wednesday, Judge Scott McAfee granted the certificate of immediate review requested by President Trump. They are now expected to ask the Georgia Court of Appeals to take up the disqualification battle before the case goes to trial. (media)

It will be funny to see if Fani tries to replace “special counsel” Nate. It should not be too hard to find another black traffic court commissioner with no experience in felony prosecutions, and pay him 40% more than the white prosecutor experienced in RICO cases who is already on Fani’s dream team.
On the other hand, it will be quite telling if Fani makes no effort to replace Nate. That would speak volumes, just like the University of Chicago Medical Center not filling the $300k/year position vacated by Big Mike Robinson Obama. It was all supposed to be for “the court of public opinion” anyway. The purpose of every one of the 91 indictments was to get people to hate President Trump. They failed miserably. They do not know the full force of MAGA.

I think she will step aside “for the good of the case” and that will include her whole office. It will have to be re-assigned and would basically start over. The whole office is tainted. Andrew Weissman even thought she should step aside before the ruling last week due to the chances it would be turned over in appeal. Either way this case can’t go to trial before November. The whole point of these cases were to damage Trump badly in the polls. They never counted on his popularity soaring.
In my view, Ms. Willis would have to be dragged kicking and screaming off this case. Her baffling arrogance and entitlement has been encouraged and gratified her entire life.

lets go back to what team Trump represented early in the merchant evidence: Georgia law. The conflict of interest does not need to be demonstrated on the basis on evidence. The law specifically addresses “APPEARANCE”…on other words “A PERCEPTION” of conflict.
This is very different than many other states.

And all of this after being appointed State IG in April 21 after the election to pull a Horowitz with the GBI.
And this after being in the background as an Asst US Attorney of the N GA USA that saw 2 US Attorneys resign in an approximate 2 month time period after Trump was requesting assistance out of that office.

The order was nonsensical, and lacked logical nexus given that there were multiple perjuries commited in the judges presence. His sanitization effort , ordering Nathan’s Hot Dog fired, but then Willis could proceed, despite her frauds is a complete legal disconnect.
I do not know the quality of the appellate panel, but if they know the actual statutory law and common law precedent, there should be disqualification and referrals to prosecutors.

It pops to mind frequently under this regime – most recently with the announcement from The Powers That (Should Not) Be at DOJ that the Jan6 political prisoners who might appeal their illegal sentences under a sound ruling from the SCOTUS will automatically get sentences doubled – which is clearly yet another unconstitutional abomination.

Why didn’t he rule that both of them had perjured themselves? I’m glad that he allowed the defendants to appeal Fani’s continuation of the case, but it seems to me that he passed the buck.
I agree Belle and actually I believe he intended to pass the buck for self preservation. McAfee stated in a recent interview that he has had his order already drafted for some time during the two-week interval and various pieces of info leaking out like BK mentioned raising suspicions that McAfee was ‘selected’ for the case against POTUS Trump. Of course he would allow the defense to appeal, another step to make McAfee white-wash his duplicity.

The issue I have with Fani Ellis is how many other cases she has presided over involve fraud.
Surely Trumps RICO case isn’t the first, or the last.
It’s more than obvious McAfee didn’t want to open that can of worms.
Fani has leverage. Leverage means that she gets something big to leave the case or she stays on and Lawfare risks her exposing them.
If she keeps her mouth shut and is removed by the appeals court, Lawfare knows they can trust her and her reward will be large.
Either way, Fani gets paid. Pretty smart.

Why does the judge who mad a bad call have a voice in the appeal ?
Because the trial has not yet occurred, and usually one cannot appeal rulings before a final verdict. (Some states do allow pre-final judgment appeals, but most do not). But in Georgia, with some issues, like this one, the judge can enter an order allowing an immediate appeal. It is still up to the appellate court to decide whether to accept the appeal now or to decline, and make the litigants continue to trial.

The Judge is running for re-election and needed to cover his base. If he ruled to disqualify then he would have lost.

If Fani is disqualified her office will be disqualified and it will have to go to another prosecutor in a different county who may decide it is not a winner. And will cause 4-5 months delay at best and maybe longer. It is a rolling disaster for Democrat lawfare.
Judge McAfee said the prosecutor Wade should be fired. He resigned without any penalties, Willis wrote him a appreciation letter and also commendation of his service. Total bs
