#2) The entire framework of the case against Trump in the Colorado decision is predicated on this: “[the complainants] asserted that he was ineligible under Section Three because he engaged in insurrection on January 6, 2021, after swearing an oath as President to support the U.S. Constitution.” [pdf, page 6] REMINDER – President Donald Trump was not charged with “insurrection,” is not accused of “insurrection,” does not fit the complaint under the definitions of “insurrection,” and has never been found guilty of insurrection. The complaint is moot before the court. But hey, it’s Lawfare… and we all know Lawfare is created for public media consumption, so that takes us directly to the biggest point.

Yes, that’s correct. As long as President Trump appeals the decision to the Supreme Court, the appeals court stays their own ruling – essentially indefinitely. The Colorado primary ballots printed, and the primary election will be over, before the Supreme Court puts this on their docket.
In addition to the virtual guarantee the high court will overrule this political nonsense, SCOTUS can make the entire issue moot before them by following their own normal schedule for submissions, arguments, deliberation and opinions delivered by the court.
The Colorado appellate court knows this, that’s why they put this self-stay into their 4-3 ruling. It’s a politically correct way of giving the optics of telling their tribe, ‘hey we’re with you,’ without the ramifications of the political backlash. In other words, psychological lawfare stuff – intended for media consumption.
Making the issue that much better for Donald Trump, the efforts of the Prescott-Bush clan (look it up – they live in CO) will backfire bigly. The public backlash against a judicial ruling that interferes with the right of the citizens to determine their own election candidates plays perfectly into the sunlight operation against the Lawfare left.
This backlash will be epic, albeit hidden by MSNBC and the rest of the insufferable media. Why? Because it doesn’t fit the Lawfare narrative.

The 14th Amendment was part of the “Reconstruction Amendments” that were ratified following the Civil War. It was passed to prohibit former Confederate military and political leaders from holding high federal or state office. These men had clearly taken part in a rebellion against the United States: the Civil War. That makes it all the more absurd that a left-wing group in Colorado is asking a federal court to disqualify the 45th President on the same grounds, equating his speech to rebellion against the United States.
And there’s another legal problem: Trump is not a former “officer of the United States,” as that term is used in the Constitution, meaning Section 3 does not apply. As the Supreme Court explained in Free Enterprise Fund v. Public Company Accounting Oversight Board (2010), an “officer of the United States” is someone appointed by the President to aid him in his duties under Article II, Section 2. The term does not apply to elected officials, and certainly not to the President himself.
The Framers of the 14th Amendment would be appalled to see this narrow provision—intended to bar former U.S. officials who switched to the Confederacy from seeking public office—being weaponized by a sitting President and his political allies to prevent a former President from seeking reelection. Our country is becoming unrecognizable to our Founding Fathers. (read more)

Colorado has a large percentage of “Unaffiliated” voters, many like us who left the Republican Party after Colorado voters passed a ballot measure allowing Unaffiliateds to vote in the primary of their choice. The purposes of the Fourteenth Amendment are over a century past completed, it serves only to create mischief in this day and should be mooted if not repealed, it is an artifact of history being employed to end history in the name of Godless Communism.
It is also worth noting many Confederate military and political figures were allowed to serve as governors, senators, and representatives after the war after the passage of the 14th Amendment.
President Trump is being prosecuted more fiercely for alleged insurrection than men who held the rank of Major General in the Confederate Army, and the Vice President of the Confederate States of America, all of whom demonstrably broke their oaths (rightly or wrongly is irrelevant to this discussion) and waged war against the United States.

Higher ups in the party were running around like crazy in their bright orange Cruz shirts, being annoying and disrespectful to all of us Trump supporters. Steven Miller was there to speak on behalf of candidate Trump and they treated him like crap. Ken Buck and Cory Gardner both tried to stop Miller from speaking to CD4 delegates. That was when I realized this state GOP sucked bigly.

Extraordinary times require extraordinary responses. If Vivek wants to be seen as he’s presented himself, then the stand on principle is not the Colorado primary ballot (who cares?), but the race itself.

The state has simply been overrun from California for the past 40 years and now from the south (across the border). You don’t get to do interrogatories and disclosures at the appellate level when you appeal a court decision so it can’t be for that purpose.

No, there is more to this than meets the eye. We just had a huge effort to educate the state on what is going on here – it’s trying to undo a trick on the CO GOP from some years ago.
Colorado has an open primary – D’s can’t vote in R primaries and vice versa, but everyone else can vote in either. Unaffiliated voters actually get a ballot for both (with the instruction to only vote one – which honest people obey…) This is an insane idea that started in California, but the CA Supreme Court actually threw it out because it was the state telling a private business (D and R parties) how to run its business. So it was brought to CO with a slight change to claim this is not the CA-rejected law. It’s being challenged, but will no doubt take years to get through court.
So the CO GOP is trying to get around this illegal law in a way that will let Republicans not be disenfranchised in their own primaries by non-Republicans. Basically, the GOP doesn’t own its own primaries anymore, the SOS (the one who jailed Tina Peters) does. But the GOP does own its own caucuses and assemblies, and that is actually the historical way the party chose its candidates.
I’ve been following the open primary efforts but proposing a caucus, even as a last resort, will ensure a handful of GOPe and RNC operatives control the caucus sessions and outcome.
Starting in 2008 we had a strong Tea Party effort here and turned NC around – electing the first Republican legislature in 100 years. Then we took the Governorship. Never in state history. The GOPe was, and still is our enemy. Their Republican governor candidate forced on us along with Burr and Tillis sabotaged 8 years of work.
Watch your back with the GOPe – especially if the Bush clan lurks.. They help you make ground then shaft you.
Well, we’re working on that too. If you are in Colorado, make sure every MAGA person you know shows up to caucus (there may be more than one because of the open primary mess – so show up for all!) and gets themselves voted in as precinct leaders and county and state assembly representatives. In the past I went to these and was totally disgusted as I could tell the real decisions were being made somewhere else. BUT this is the kind of thing that is “under entirely new management” now. Find a local MAGA person tied in with the state GOP to learn more about the strategy.
