The Democratic governor said she is expecting legal challenges but felt compelled to act in response to gun deaths, including the fatal shooting of an 11-year-old boy outside a minor league baseball stadium this week.
The firearms suspension is tied to a threshold for violent crime rates that only the Albuquerque area currently meets. Police are exempt from the temporary ban on carrying firearms.
Lujan Grisham said the restrictions “are going to pose incredible challenges for me as a governor and as a state.”
“I welcome the debate and fight about how to make New Mexicans safer,” she said at a news conference, flanked by leading law enforcement officials, including the district attorney for the Albuquerque area.
Lujan Grisham referenced several recent shootings in Albuquerque. The number of red counties outnumber the blue ones in all three states.
Like so many states now days the big cities gain control, I belive, by vote cheating in the most populous counties and have done so for many many years.

I was born and grew up in New Mexico. It has always been a poor State. The people there have gotten used to being ruled by Demcommies.
The Demcommies gerrymandered all three of the Congressional Districts in New Mexico to the point where people from Chaves County, where Roswell is, can be part of all three Districts. The same is true of Albuquerque, where the heaviest volume of Demcommies are from and where half of the State’s population lives.
Michelle Lujan Grisham has been actively pursuing the Vice Presidency for several years and she thinks she can use that title to run for President. A politician from New Mexico has no other pathway to the White House. Nobody should think this is funny because Biden was within a hair’s breadth of putting her on the ticket before Obama installed Kamala Harris in that spot. I think Grisham is making another play for the VP slot on the ticket.
Five years ago I would have never thought a stunt like this would ever play with the voters, but now I don’t know if anything will ever wake up the voters of New Mexico. Let me explain why, in shortest possible but still useful explanation. The doctrine of emergency is predicated on the “rule of necessity.” The rule of necessity is a legal concept that provides cover to do that which would ordinarily be illegal because, it is alleged, there was no other [rational] alternative. For instance, it is illegal to exceed the speed limit, but cops do it all the time. They do so under the cover of the rule of necessity. Did you know the rule of necessity can also cover you, if for instance, you’re speeding to a hospital because your passenger’s having a massive heart attack?
This is the doctrine that lies behind self-defense claims in shootings, for instance. An intruder entered your home under cover of darkness, brandishing a weapon, and you retrieved/drew your weapon and shot him, killing him. Killing another would ordinarily be illegal. In many rational jurisdiction, but apparently not New Mexico, this would likely get you off the hook. The grand jury would no-bill the matter and pass on indictment because they would likely find your actions reasonable and necessary to preserve your life, family, property, etc. This is the rule of necessity providing an out against what would otherwise be a charge of criminal liability for a death.
Let me explain something else, and it’s something you must know: Very often, these sorts of emergencies are permitted to play out first, and then, after the fact, when the damage has already been done, the courts MIGHT come along and “fix” it. If you were unable to defend your life on the streets of Albuquerque, resulting in your death, because you adhered to this emergency dictate, but your assailant did not, the eventual reversal of this emergency by the court will be of slim damned consolation to your loved ones who will have buried you some months/years before.

The provision in the Constitution that permits the Governors of the States to declare medical emergencies and suspend the Consitution during those declared emergencies is in the same Article that permits States to secede from the United States. Oh. Right. The Constitution contains no such article.
