Dominion voting systems had sued Fox News for $1.6 billion, claiming defamation about statements surrounding the 2020 election outcome and Dominion voting systems. Today Dominion and Fox settled the lawsuit for $787 million.
The lawsuit itself is odd in that both the plaintiff and the defendant carried the same political motivation within it. As an outcome of ideology, Fox News wanted to cement the 2020 election as clear Biden victory, the same position as Dominion. The settlement provides that narrative to U.S. MSM corporate news. The same corporate news who pushed the fraudulent Trump-Russia collusion conspiracy theory, without accountability.
(VIA ABC) “Fox has admitted to telling lies about Dominion,” Dominion Voting Systems CEO John Poulos said outside the courthouse following the announcement of a settlement. It was not immediately clear where this admission took place, beyond Fox’s statement that “We acknowledge the Court’s rulings finding certain claims about Dominion to be false” — or whether Fox News had agreed to a more formal acknowledgement in a public way. While I don’t disagree with Sundance’s analysis, there are some other factors I can see that played into the decision to settle.
This lawsuit was filed in Delaware state court (Fox is incorporated in Delaware). The jury pool would have been from the overwhelmingly Democratic state of Delaware. Getting it out of Delaware would have required removing it to federal court, and then moving to have it transferred to a federal court in another state. (Not a chance.)
The judge is a registered Democrat appointed by a Democratic governor (Delaware has merit selection, in which nominating commission forwards names to the governor, who must appoint someone from that list).
Fox was accused of trying to deny native son Biden of the presidency by featuring certain guests who claimed Biden won through fraud.
Given that scenario, I’d guess (based on my 40+ years as a litigator up in Philadelphia) that Fox’ lawyers said, “You’re going to lose. The question is how much. I think you should seriously consider settlement.”

Because a jury would not give much weight to the argument about a black box voting machine with unpublished code, maybe. Especially is the Dominion attorney hammered on the internal Fox memos that dismissed the vote fraud allegations, and told the jury the lack of code was a minor matter.
Dominion’s argument would be” “Fox admitted there was no fraud,” while the Fox attorney had a tech guy explaining the complexities of computer code.
Juries often go for the simpler argument. (Occam’s razor, in other words – preferring the simpler explanation to the more complex).
I’m a lawyer, too. This case should’ve been removed to federal court within the 30 days under 28 USC 1446, on the basis either of diversity of citizenship or federal question (first amendment), because if you’re a defendant, you always want to be in federal court, NEVER in state court. That this suit was about to proceed to trial in a Delaware state court to me is conclusive evidence that it was non-adversarial and collusive. Fox News was never interested in defending this suit, only in agreeing with all Dominion’s allegations.
I don’t think the First Amendment qualifies as a federal question. The First Amendment is not a defense to libel. One can use one’s First Amendment right to slander someone – and take the consequences in a civil tort case.
As far as removal for diversity, one would get pretty much the same jury pool. And a federal judge who was probably nominated by a Democratic senator (The last Republican senator from DE was William Roth – who gave us the Roth IRA – blessed be his memory for that).
Yes, a defendant in a civil case usually wants to be in federal court. (The difference between Philadelphia County and the EDPA was like night and day – EDPA included Philadelphia County, but also the four suburban counties as well as Lancaster, Lehigh and Northampton), but here there might be little difference between DE state and federal court.
Even in federal court, it would be an action under Delaware libel law. Delaware procedural and evidence rules might not be that different.

The bottom line is: That software should NOT have been installed on the machines, and because it was, any remote access could have been attempted in a number of ways and modified the votes. Unless you were to do an immediate paper ballot count, you wouldn’t have seen it. The AZ audit proved that someone went through the sealed boxes AFTERWARDS, and just before the audit, and removed a bunch of ballots. Coincidentally, the same day someone found ballots in the trash at the Maricopa elections office, a huge fire erupted at one of the BOS’ farm. It’s alleged that when the fire department came, they were ordered to NOT put out the fire by the BOS candidate. It’s believed that it was a mountain of illegal ballots.
I read that Dominion VP Eric Coomer said that he was concerned about Dominion’s software because it had been hacked.
Sidney Powell said on her website that she has Dominion’s patents which clearly show that the machines can connect to the internet.
The facts that Dominion software and data are not open source tells me all I need to know (in its clearly switching millions of Trump votes to Biden in 2020, per Dr. Shiva’s data & analysis).

If Fox News was even the slightest bit interested in journalism, and in preserving a legal environment in which journalism can happen, it would never have settled this lawsuit. It would’ve pursued it to get it before an appellate court that could reverse on the law. Reporting on allegations that are circulating is not defamation, if one is not standing behind the allegations and opining that they are true, which Fox News never did..
But, as everyone in this thread has already pointed out, this was a fake, non-adversarial lawsuit, in which both parties shared the same ideology and the same goal to stifle dissent from the the now chronically corrupt, fake non-elections we have in America. Neither is interested in allowing journalism to ever happen again in the United States. This is a very dark day for freedom of the press in the United States. It’s just another nail in the coffin of a dead republic.

I saw on television votes being counted as fractions. The dominion machines have the ability to weigh votes, i.e., biden vote 1.3, Trump 0.7. I do not believe all votes were weighed the same. Even with this initial fraud, they still needed to manufacture votes that evening. President Trump won in a landslide. He received more votes than anyone in history. The cheating was on all fronts, and they needed it to be because biden is so bad a candidate. No part of any of the election was legitimate.

A defamation trial would mean potential impact on judicial interpretation of the law if the jury’s verdict was appealed to higher courts. Many wanted to see a trial with Fox on the stand. Taking the 787.5 Million in a $1.6 billion defamation lawsuit rather than continuing for years is to prevent it finally ending in the hands of the Clarence Thomas; where winning for Dominion is highly doubtful.

I know juries can be unpredictable and the presiding judge was a leftist but from what I read I couldn’t see much of a case against Fox if press freedom still counts for anything in America. All that Fox did was report on the newsworthy claims by Trumps crazy lawyers Sidney Powell and Rudy Giuliani which turned out to be completely baseless.
Unfortunately for Fox some of their hosts reported on the claims of these charlatans – probably without a sufficient disclaimer. One Fox host however – Tucker – was on to these hucksters from the beginning (why does Trump surround himself with the absolute worst?).
I clearly remember Tucker delivering a very strong on-air rebuke to Sidney Powell who refused to provide to Tucker back-up of her claims that Dominion machines were rigged. Tucker was very clear that night that there was no evidence to back up Powell’s defamatory claims about Dominion. That should have been enough to inoculate Fox against any lawsuit from Dominion!
Fox should have proceeded with the trial. Even if the jury were to award damages it is very unlikely it would be anywhere near the $1.6 Dominion asked for and in any event Fox could have appealed. Jury awards are often drastically slashed during the appeal phase so in the end it is unlikely Fox would be on the hook for anywhere near $787 million if anything.
This is a very terrible development for conservative news outlets who will be silenced with the threat of lawsuits going forward. How can Fox report on any story in the future without risking being wiped out in a lawsuit? The only stories that they will be able to do are safe stories about drag-queen story hours and Walmart store lootings.
I wonder what the fallout will be at Fox staff-wise? Will heads roll? Is Suzanne Scott’s job on the line? Judge Jeanine? Maria Bartiromo? Hard too imagine that people won’t get fired. I just hope that Tucker is safe! They want him gone more than anyone!
It was likely issues with disclaimers. Fact is, many were caught off guard as to HOW the fraud occurred, not if. Read Powell’s materials as she was on to something. Knowing what we know now, the fraud occurred in every single possible way related to process and technology. That includes the election supervisors, machine setups/configs, and more – all enabled by what we have always known about mail-in balloting. Frankly, all mail-in and all machines must go. They open up too many avenues to commit fraud – and the left used them all.
