Ugh, it makes me sick to see these schemes as they are constructed and yet feel helpless to stop them from organizing. Remember which media outlets push the PR campaigns of the U.S. Govt. (1) CNN drives Dept of State; (2) Washington Post drives CIA; and (3) NYT/Politico advance the interests of the domestic intelligence apparatus.
With that in mind, here comes the Intelligence Community laying the groundwork for reauthorization of the FISA-702 surveillance system on American citizens.
They are so damned transparent in their agenda, the stenographers have even dropped “FISA,” the Foreign Intelligence Surveillance Act, as the term within the construct. Now they are just calling it “702 reauthorization.”
(VIA POLITICO) – The intelligence community has a critical congressional ally in its bid to reauthorize a sweeping warrantless surveillance program. However, even he thinks its officials aren’t making a convincing enough case.
“One of the things the community’s got to do a better job of is explaining, in practical non-classified terms, how valuable this tool is,” Senate Intelligence Committee Chair Mark Warner (D-Va.) said in a recent brief interview. “And they’ve not done that as well as they should.”
Warner sits at the heart of what will be a months-long, knockout debate about whether to reauthorize the warrantless surveillance program, known as Section 702, by the end-of-year deadline. The program is designed to gather the electronic communications of foreigners abroad, but has the potential to sweep up those of Americans.
The Virginian, who argues continuing the program in some form is essential but is open to changes, will have his work cut out for him. Influential and newly emboldened House Republicans have made it clear they won’t let Section 702 stay alive without significant changes — if they support reauthorization at all — amid an all-time-low relationship with the Justice Department and the FBI.
And the intelligence community can also count Section 702 critics among House Democrats and senators in both parties, many of whom believe this is their best chance to force more limits on the program. (read more)
As most people are now aware, the Senate Select Committee on Intelligence (SSCI) sits at the epicenter of how the surveillance state is weaponized against American citizens. It is the SSCI who helped create the surveillance network, and it is the SSCI who now seek to defend the unconstitutional system they have created.
Pretenses are being dropped, and you will note how in this reauthorization schedule they are dropping “foreign” communication with American citizens, as a limitation on the authority they have already usurped. Yes, it is factually true the ‘foreign’ aspect was always a ruse, a false premise, that granted the Dept of Justice, National Security Division (DOJ-NSD), and FBI legal authority to conduct intrusive Title-1 surveillance on any American citizen.
Well beyond the “cell phone metadata,” in the era of your portable transponder having internet and social media connection, just about everyone has metadata connected to a foreign person or entity. Use the Twitter app on your phone, you are connected to foreign entities. Use Instagram or Facebook, WhatsApp or Telegram, same/same/same/same.
TicTok? Fughetaboudit. The auspices of only looking at U.S. persons engaged in foreign contacts is totally moot.
The “702 authorities,” which is an innocuous term for a “U.S. Person“, permit DHS, DOJ, FBI and any national security apparatchik to open up your data and check you out. This is the reality of the modern era. This total surveillance reauthorization is what the SSCI wants to permit. It must be stopped completely. It cannot be “reformed.”
4th Amendment – “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
Either you are secure from federal search of your “private papers,” as outlined in the United States Constitution, or you are not.
There is no aspect of this “702” nonsense, where a secret court grants a secret authorization, to engage in secret surveillance, by some secret entity of government – which might be a contractor, just to “see if” you might be doing something suspicious, or against the interests of the federal government. The premise behind “702” reauthorization is unconstitutional.
How strongly do I feel about this?
I will openly campaign against any politician or candidate who does not fully endorse the elimination of FISA 702 Authorization in sum and total. I don’t care who the candidate is, or what his/her political affiliation might be.
I am sick and tired of having to construct communication systems, to engage in ordinary conversation and/or communication, knowing the biggest challenge is to construct the system to defend ordinary people against unconstitutional searches and seizures. Ironically, this includes the very commenting system you are using to share any opinion of this outline. This domestic surveillance system just needs to be stopped.

We all need to research such things and switch….asap. I bought a new Toyota 2020. In the small fine print…well-buried…in their info online, my son found a section that informed the public that the driver had the legal responsibility to inform ALL passengers that they were being recorded. NO Sh-t! We took a copy of it into the dealer…they were blown away…had no idea. We had to ‘disconnect’ everything and it took days. Even though they SAID we were disconnected, when we pushed the emergency button, someone still responded in the vehicle. Eventually, we got it…BUT…I no longer have a radio in my new vehicle. No problemo…cd’s are enough plus we have a portable radio that works great outside the vehicle if we do need to get any alerts, etc.
Look at software defined radios. With the right antennas and SDRs you can monitor any bandwidth with a computer. People can pick up and decode garage door signals with them. You can even decode the digital comms of EMS around you for far cheaper than the modern Uniden systems, then there is software that you can record these transmissions as they happen for review later, or even rebroadcast on the web. Everything is swept up. The limitation becomes a matter of storage for all of that data.
A friend of mine lives 1/8th mile from me.
Sometimes we text or talk on the phone, and have noted how we COULD be talking with 2 tin cans and a piece of string, but instead have our signals bounced to a tower, 3 miles away, which sends it to a satelite, back down and to the other phone,..or something like that.
We pay such an unbelievable price, for the illusions of convenience, prosperity and security!

He gave out a bunch of ‘free’ phones to get everyone ‘hooked’…like a pusher with his drugs. Then he had the power to track and record. Next..he gave out ‘cash for clunkers’. So, all the machines that any handy person could repair, and machines without fancy electronics that record your conversations in your own vehicle, were replaced with more tracking devices. It was all a set-up. What I wouldn’t give to have my ’53 Chevy back that drove like a tank. I recall sitting nights in a garage grinding down valves, replacing the carb or a muffler with the ex… dropping a new engine in the VW. Now, it’s nearly impossible to have all the necessary equipment to work on your own car…or even get at what needs work.
They’ve been working on it for decades…seat-belts, unleaded gas, the so-called safety equipment so that you could immediately be hooked up to someone if you were in an accident, exhaust inspections… It’s all for your own good, right? They’re all looking out for our ‘safety’…they’re our friends and they care about us. GAG! Even the phones that began in the car only and were priced high enough that only the wealthy could afford them…making everyone ask for them because they were ‘special’ and you were ‘special’ if you had one. All could see that you were ‘special’ because you had that extra antenna on your car.
Then the car insurance cos. started giving ‘discounts’ if you ‘allow’ them to put another tracker on your car. If you don’t, you pay more and are penalized.
It’s an Electronic Prison! All the protesting and ‘write your congressman’ BS is time wasted. I don’t mean to preach on this, but I really believe the only way to fight back…peacefully…is to throw the crap out! Go through the withdrawals and get ‘un-hooked’. It’s the only solution that I see.
I had to buy a new front loader washer last Sept. My son actually read the manual, every word. On p.15 it speaks of the ‘open source software’. We plugged this thing in and it showed up on my laptop. I fought with them for 4 mos. I wanted this crap removed. Long story short…it won’t run without it and disconnecting it doesn’t REALLY disconnect it. Only solution? It stays unplugged when not in use. It also gives off radiation, we checked it with a tool. Thankfully, the only other appliance that does that in my home is the microwave so that, too, stays unplugged except when in use. …and don’t get me started on the 5G crap. I’ll make do with an old flip-phone for emergency only purpose or a quick text to one of my adult children. But I’m ready to pitch that, too.
When I speak with people on the landline and they want me to send them a pic of something, I point blank tell them I don’t have that crap (the phone spy) and am not interested in being part of their Electronic Prison. So far, we can still get around things. But, the writing is on the wall. Everything nowadays wants you to hook-up with them with a cell. I will NOT do it. Will it get more difficult to do business without their electronic gadgets? Yes, it will. But then I’m reminded of the Amish. God bless them all.

After I survived my 1st winter, I can still recall the day when my daughter was congratulating me over the phone. She and I both celebrated. I also had plenty of time to fight things out with my Creator. He won, of course..LOL! But I’m so so grateful now.
It really doesn’t matter if it contains all the wifi crap (except for the part that it breaks in just a few years) because if you don’t connect it to your home wifi no data goes anywhere. I choose not to buy that crap but when the day comes that that’s all that’s available I know how to disable it And if someone sneaks close to the house to pick up a signal, we’ll good luck to them. We have a Castle Doctrine law here.
I think being “connected” is disrupting society somehow. My mother moved 2 hours away from her family when she got married in 1956. She & her mother wrote letters to each other once a week and talked on the phone for a half hour on Sunday nights when the long distance rates were cheaper. She bloomed where she was planted. The situation today reminds me of the Tower of Babel. Maybe we are just not supposed to be as connected as we are, at least not by technology. Maybe if God wanted us so connected we’d all be telepathic by now.

At this point, does anybody really think that not reauthorizing the FISA 702 will keep them from continuing to monitor electronic communications? Big tech and cell service providers have shown that they are more than willing to share info with the government, even without a warrant.

I look for a contrived, dramatic event between now and November ostensibly prevented by FISA 702 developed information that “proves” just how “necessary” this “Constitutional exception” is for the general welfare of all Americans.

FISA has been around since 1978. Trump had an opportunity to veto the reauthorization legislation in 2018 and force Congress to pass the reauthorization over his veto, but he didn’t do it. In the end, he tweeted his support and signed the 6-year 702 reauthorization.
Listen, I fully support Sundance’s take on FISA — that whole bill is abhorrent and should be eliminated. I only commented on his statement because it is bold of Sundance to pledge to campaign against any and all who support it regardless of their political affiliation when he, as have the rest of us, supported Trump who acquiesced in signing the bill.

It was a GOP Senate and GOP House that forwarded the 702 reauthorization in 2018 to the GOP White House. Initially, Trump had reservations about it and could have vetoed it and kicked it back to Congress. Instead he ended up saying we need it, he supported it, and he signed the 702 reauthorization. For all of FISA’s obvious faults no one in our government, not even Trump when he had the majority, wants to kill it. You say “eyes have been opened, convictions have been sharpened”; after 45 years of FISA (I have personal experience with FISA when it was implemented in 1978) I guess better late than never that people are waking up to its threat. Unfortunately, it will be at least another 6 years of living under it and that sucks.
Well then, Trump obviously made a mistake.
It’s my understanding that the FISA 702 authorization allows the government to use evidence collected under it’s auspices against you in a court proceeding. Anyone thinking that a 702 or any formal nicety is needed to gather raw intelligence on anyone is naive.
Just think…With FISA, they can spy on you just for knowing foreigners and they keep letting millions of them in. No warrant required.

I am tired of begging people to please stop, or at the very least, cut way down on cell phone use.
The “convenience” is seductive and addictive. It is a very deliberate way to put everyone on trackers. Even those who conscienciously maintain landlines, cabled desk computers, and use paper/pen low-tech for privacy. Social media? Is there really any good reason that most people who are not journalists “need” to do this during all hours from everywhere? Texting? That’s a written record. Do you really have to keep personal records on and do financial transactions from a cell phone? Never mind GPS (it’s still legal to remove from vehicles, but for how long…)
Every single person sitting in the DC gulag is there because he or she was tracked via cell phone.
More importantly, this stuff actually has not made life easier or better.
I had to go to a hospital for a minor procedure a few weeks ago. They demanded that I not only “check in” using a smart phone (which I do not carry and refuse to use), but also sign the contracts/consents and answer a litany of questions into the electronic database. Well surprise. Somehow they managed, reluctantly, to check me in using paper. (And by the way, as a lawyer, I want to point out that you can’t cross stuff out or add notes in the margins when you sign stuff on electronic forms this way.)
But… I’m tired ot begging, pleading, warning. This is not going to get better no matter how many privacy laws are or are not passed.

It is amazing to see the look of utter astonishment on friends and acquaintances faces when they find out I do not have or use a cell phone. Sometimes it seems they are looking at an actual caveman or something.
You are very right in both the seductive lure of those devices and the real addiction they create.
It’s easy to discover just how addicted one has become to these personal monitoring devices people call smartphones with a simple test of purposely leaving it at home for 24 hours. And then for a week.
When going to a medical institution/doctor, etc. I tell them point blank that I do NOT use bio-metrics…that’s it’s against my religion…which it is. I believe it’s setting the stage for the ‘mark of the beast’. They either have to sign me in or I’ll use a tool of some sort..at times I’ve signed in with my knuckle. NO BIO-METRICS!!!
Did anyone see that Blackstone bought Ancestry.com??? So, they now ‘own’ the DNA all those Folks voluntarily handed over because they were excited to learn more about their ‘roots’. I am old..I did not grow up in today’s’ ‘Electronic Prison’ and my life was not inundated with I-phones/Smart phones, doorbells that videotape all of their neighbors walking down the street and that record their conversations, Smart appliances that spy on Folks inside their homes, vehicles that also record all conversations inside their car and send them only God knows where.
I wish Folks would disconnect all such things. If Folks would stop purchasing ‘stuff’ that has the ability to spy on everyone, including themselves and their family, perhaps that in itself would send a message. After all, money does still talk. Want to have a ‘modern day Tea Party’? Throw all that junk in the trash. Stop using surveillance on your friends, neighbors, strangers, family, and yourselves. If we want to send a message that we do NOT want surveillance, then we have to begin by taking such a stand in our own lives. Otherwise, we are saying one thing while doing another. I believe that’s called hypocrisy.
We need to stop spying on one another. Then, maybe, our voices will truly be heard.

Jude. I so agree. Years ago I had a long conversation with a retired client whose grandson was working with some guys on a certainnew internet search engine. He had spent his post-academic professorial career in computing for military weapons systems. I was waxing euphoric over how great computers were, how they had enabled me to do so much more with less secretarial staff etc. etc. etc.
I was shocked when this man, who had been on the cutting edge of the founding of “electronics” said that he forbid any computers in his home.
He said to me — and I will never forget his exact words — “One day you will hate them.” What!? Why. He just shook his head and said it again. He knew. “One day you will hate them.”

I’m with you, brother. 30 years ago, I wouldn’t let my kids use their Texas Instrument calculators to do math — they learned to do long division the old-fashioned way.
It’s sister, but that’s ok (Jude short for Judith..LOL). Yes, I remember well when my sons 1st came home and told me they had to have those calculators. Hogwash! I made them learn to do Math in their heads like we all had for generations upon generations. Multiply by tens then add the single digit by ten and you have your answer. I can still beat my children in a race for the answer. LOL!
We were the only parents in my son’s 8th grade class who did not get him a programmable calculator. He received low grades because he could not “answer” 3o graphing test problems in an hour, because he was not entering digits and letting the calculator do the work (and he was not at a public school). He is now a year ahead of his classmates in math and science, because he actually understands the math rather than the entering of digits on a calculator pad. Sadly, he still hates math. How I hate common core, which this stupid state mandates. I have my grandfather’s slide rule, will regress to that if needed!
Yes…my ‘brain-child’, the electrical engineer, went on to learn mathematics far beyond calculus and trig…maths I never even heard of… If you know any electrical engineers, you know they live on a totally different plane. They work with the ‘invisible’ like radar, etc. I once told him that whatever he did…don’t ever do drugs…cause he’d be flying so high he would never come down. LOL!! Slide rules are beautiful instruments. I have a few old ‘gadgets’ myself. My boys love them. The schools error when they make it all about ‘speed’ rather than personal accomplishment vs. pushing some buttons on a machine. Brain Power will always exceed machine power. Though, some do believe machines will eventually think for themselves. If they do succeed in creating such a monster, it will lead to the destruction of mankind.
My kids once found my old slide rule and asked, “What’s this?” “An old-style calculator,” I replied. They turned it all around but were stumped as to what powered it. I told them, “Brain power.” LOL! I sound like Jude.

I would sit in front of the ‘telly’ and watch A & C as often as I could with him. I can hear him laughing at this. Great bit! You have to also remember the “three hops” rule in 702 (about) queries. For every identifying detail they enter, whether an email address, IP, or phone number, they get back warrantless access to every bit of data that “mentions” between 100 and 100,000 citizens. That’s just what they are “legally” allowed to view without a warrant. Everything about everyone online is recorded, ready to play back years later, whenever an agent enters a 702 query.

It had a bunch of “key words” that would trigger an algorythm, like “explosive” but the actual message was inoccuous, the idea was for LOTS of people to send out the message, to overwhelm the system.
Then, the words were all words related to islamic terrorism, now I guess words like “catechism” and “anti-abortion”, “all lives matter” “Constitution and Bill of rights” would be enough to do the job?

Superficial changes will not solve the inherent problems. Patriotic Americans should tell their politicians they cannot trust the government to use the FISA in a just and responsible way and that it should be abolished. If not, they should tell Republican party politicians beforehand that this will be the last time they vote for any of them. I predict the warmongering Republican politicians will fold on this vote and this is why the party cannot be fixed or reformed – it needs to be replaced with principled and morally upright representatives.
