The New York lawsuit against the Trump administration -over disqualification of unlawful aliens in the 2020 election- was dismissed today by the Supreme Court [full pdf here] under procedural grounds.
However, that said, there is a clear indication where the outcome is likely to end-up once the court takes up the case next year.
The high court noted no harm currently exists because the census report hasn’t been delivered to congress to begin the representative apportionment.
The ruling was 6-3 on process, with justices Elena Kagan, Sonia Sotomayor and Stephen Breyer signing a dissent on the case. Justice Breyer wanted to fire a shot into the administration by outlining a liberal opinion/perspective of the issue:
…”The plain meaning of the governing statutes, decades of historical practice, and uniform interpretations from all three branches of Government demonstrate that aliens without lawful status cannot be excluded from the decennial census solely on account of that status,” Breyer wrote. “The Government’s effort to remove them from the apportionment base is unlawful, and I believe this Court should say so.”
Beyond the liberal argument this majority part should alarm everyone:
[…] “Everyone agrees by now that the Government cannot feasibly implement the memorandum by excluding the estimated 10.5 million aliens without lawful status,” the opinion later said. “Yet the only evidence speaking to the predicted change in apportionment unrealistically assumes that the President will exclude the entire undocumented population.” (read more)
In essence what the court is saying is they will not support unlawful aliens being excluded from the census and, as a consequence, congressional representation. It is just too early for them to decide because the harm has not been incurred.
This is an alarming position when cast against the recent SCOTUS decisions on 2020 election. Texas has no standing to file suit based on harm from election fraud, the voices of Texas voters are moot to the court; and now the same court is saying any unlawful alien residing in the United States should be granted a voice in government.
So the only way to exclude unlawful aliens from the U.S. census is to return them to their own country.

It would have been collateral damage to choose a different candidate and let him swing in the wind. But maybe there was another way to save him. I’m not sure.

As it turned out, Kavanaugh was a big crybaby and a weak man. We cared about him a helluva lot more than he cares for his country or any of us who supported him. Don’t feel bad- we were all fooled.

The vast majority of Americans have been busy trying to make ends meet while squeezing in some vacation and R&R time whenever possible. Not to mention raising children and maintaining their homes. Not until the last 20 years was there much information available on the internet about the subversive elements within our federal government.
Some of that information was available in books but without the internet one does not have ready access to the huge number of books that are in print. Unless one spends many waking hours roaming libraries and new and used book stores, and pulls books off shelves to peruse jacket cover summaries or sample some chapters inside, finding reliably respected books that document what the Establishment prefers you didn’t know – is not an easy task.
Yet even with the internet, it is now challenging to sort fact from disinformation and a lot of folks working 12 hour days, or two jobs or more through the week, don’t have the mental energy to spend hours researching political subversion in our nation.

When the Supreme Court refused to hear the Texas (et al) case, they abdicated their Constitutionally required duty. But with their refusal, in front of tge entire Nation, they lost their authority.
Now, again, they give the finger to American citizens, in exchange for pats on the head at DC cocktail parties.

I hate to say it but The Constitution requires a decennial census to determine the “actual enumeration” of the “whole number of persons” in the United States. A strict construction originalist reading of that clause very well may say whole number of persons doesn’t exclude illegal aliens, meaning the only way to prevent counting illegals is to amend the Constitution, which is unlikely with demokkkrats and rinos running the show. Originalism has its limits and can be turned into a fetish the same way libertarianism has been. The decision today likely means the SCOTUS will side against POTUS and common sense on this one when it is decided on the merits. On the other hand, I have been wrong on clown judge Sullivan being reprimanded by higher courts for his unconstitutional persecution of Flynn. In my time as a trial lawyer I formed the strong opinion that judges usually decide the outcome first and come up with reasons second. In this case the first part of the giveaway is the length of the dissent. It rambles on and on and on attempting to justify how orange is really purple.
The second and more important part of the giveaway is the total absence of statement about the division of power between the three branches of government.It is NOT the place of the courts to decide matters of government policy. And where is that in the judicial opinions? It is conspicuous in its absence.
Shameful stuff by the court and a clear and present danger to your great nation.
So, Texas should have standing to sue California for permitting sanctuary cities. California is breaking federal law to increase its illegal population and thereby damage Texas’ proportionate representation.
Yup. Lets just wait until America is no longer America. We’ll tackle those “important” issues then…
So the game plan appears to depopulate (through COVID) the United States and West, while important millions of 3rd world aliens to forever change the make up of these countries.

At this point in time, it may be too late to amend the Constitution to scale back the ever power hungry and corrupt Judicial Branch since a 2nd Constitutional Convention is dubious in this corrupt age but Congress can still pass a bill that reduces the salaries of all federal judges to minimum wage as punishment for all these corrupt judges.
If federal judges can only earn minimum wage, such a financial barrier should help to weed out the most arrogant and corrupt candidates for federal judgeships.
low federal judicial salaries would mean that only the wealthy ‘establishment’ or bribed would be judges.
sort of like a wealthy donor buying a Senate appointment in GA?
Well, you could always prosecute bribed judges.
As for the “wealthy establishment”, in such a scenario, they would earn more money being lawyers or lobbyists so I can say with confidence that the most greediest, money hungry establishment would end up passing over a federal judgeship should salaries for federal judges be reduced to minimum wage.
Not only that but some priests or monks in our history used to take a vow of poverty, why not judges?
I don’t think the vows of ‘poverty’ were for the ‘Leadership”. Just hair shirts for the plebes and peons.
