Earlier today Missouri Senator Josh Hawley announced his intent to challenge the January 6th congressional certification of the electors. A group of approximately 30 House representatives, led by Mo Brooks, will be challenging from the lower chamber.
This sets up a dynamic where formal electoral challenges from both chambers of congress will be taking place based on evidence of election fraud in several key states. The objection will initiate a debate and roll-call vote to certify electors within both the House and Senate. Vice-President Mike Pence will preside over the debate in the Senate.
A combination of The Guarantee Clause (constitution) and the Electoral Count Act of 1887 (law), establishes the framework for some to argue a fraudulent 2020 election result can successfully be challenged during congressional certification on January 6, 2021. Thus five state legislatures -under Republican control- have sent dual-sets of electors to congress: Arizona, Nevada, Wisconsin, Georgia and Pennsylvania.
[Article IV – Sec.4] The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
“The Guarantee Clause” – “At its core, the Guarantee Clause provides for majority rule. A republican government is one in which the people govern through elections. This is the constant refrain of the Federalist Papers. Alexander Hamilton, for example, put it this way in The Federalist No. 57: “The elective mode of obtaining rulers is the characteristic policy of republican government.” [citation] “The Clause requires the United States to prevent any state from imposing rule by monarchy, dictatorship, aristocracy, or permanent military rule, even through majority vote. Instead, governing by electoral processes is constitutionally required.”
Let us be clear… There is little framework for this type of constitutional issue. This is uncharted territory, and consequently there is no body of law or case study upon which to apply a historic reference. However, that said, the issue of Director of National Intelligence, John Ratcliffe, producing a report about foreign election interference could be a fulcrum issue upon which “The Guarantee Clause” of the constitution may apply.
Here’s where it gets interesting…. The Guarantee Clause puts the jurisdiction in the hands of the political bodies, executive branch and legislative branch, to decide the merit of any state vulnerability in their election outcome. There is little, if any, place for the judicial branch to play a role.
In Luther v. Borden (1849), the Supreme Court held questions involving the Guarantee Clause nonjusticiable, meaning that any remedy for a violation would lie with Congress or the President, not the federal judiciary. Nearly one hundred years later, the Court sweepingly declared that the guarantee of a republican form of government cannot be challenged in court. Colegrove v. Green (1946). (citation)
The federal government, not the state government, ultimately holds the responsibility to protect the entire United States from foreign interference within the Guarantee Clause. This would seem to apply to foreign election interference. “[B]ecause protection against invasion or domestic violence is normally available only from Congress and the President, the structure of this section suggests that the political branches have at least the primary duty to carry out its obligations.”
If DNI Ratcliffe produces a report (prior to January 6th) that outlines foreign interference in the election; and if the argument can be made the states with the contested (dual sets) of electors were subjects/targets of that interference; then a foundation to nullify the electors from the contested states is laid in congress.
In this approach the electoral nullification argument would appear to rest on The Guarantee Clause; where the state election outcome was not valid – as it is not representative of a republican form of government, and the majority vote requirement was manipulated.
If this type of legislative challenge was to take place, there is little precedent for the judicial branch to be involved except to qualify what role The Guarantee Clause would/could play and to what extent the nullification arguments are constitutionally valid.
Again, this is all uncharted territory. However, there are people claiming this process could work to keep President Trump in office. The disqualification of the contested state electors under this argument would ultimately fall upon Vice President Mike Pence who is also President of the Senate and in charge of the January 6th electoral vote certification.
There is a lot of “if-this-then” etc within this framework, and all of it ultimately is predicated on congress challenging the election (now appears likely); and VP Mike Pence then deciding which electors would be certified or nullified (long-shot); but that seems to be the argument some are making.
Immediately after Senator Hawley made his announcement, incredibly the multinational retail corporation Wal Mart responded via twitter with a snarky reply.

The employee, according to Walmart, is part of the social media team. Said person on Walmart’s social media team obviously has posting access/authority to Walmart’s social media accounts, since said person posted on Walmart’s twitter feed.
Therefore, said person has the authority to represent Walmart on social media.
So said person did not “illegally use copyrighted Walmart logo”, said person abused their authority/ability to post on Walmart’s twitter feed to convey his/her/they’s personal bias and political opinion.
Obviously this person should at the least be removed from the social media team and Walmart needs to better vet which employees have posting authority to its social media as well as institute strict controls/oversight regarding same.
This employee has done damage to Walmart. As soon as I saw that twitter post, I was done and immediately informed 3 family members not to shop there anymore.
I haven’t been in Walmart since their pathetic reaction to the El Paso terrorist incident.
Our local Walmart pulled handguns+ammo after El Paso, including a good selection of affordable self protective 44 bear loads..
Our locale is wild enough moose and bears have nailed people on the house/building doorsteps, much less walking parks and hiking trails. When I first moved here, one of the guys in the office was killed a few months later by a bear. Handguns are serious business and Walmart is playing PC games – f*’em.
They’re successful because of the decline of the American malls, franchising/duplicating themselves, and being a low price leader.
If the President calls for a boycott at some point we’ll see how much WalMart can be hurt with a decline in patronage.
In my area, there are 2-3 choices other than WalMart depending on what you’re looking for. They’re all selling the same stuff, the markup and packaging are just slightly different. I look for U.S. made products, it’s extremely difficult. Next choice, I look for a product NOT made in China. Also very difficult. I was looking forward to the transition back to U.S. manufacturing and products, I’m tired of cheap garbage from overseas. I’m tired of it all being disposable. I was able to get a U.S. made dishwasher and washing machine in the last few years. Didn’t exactly have all the bells and whistles, but they’re made here. I’m all for it.
WalMart works because of the above, and because the U.S. middle class is constantly being squeezed. My grocery bill prior to WalMart grocery was easily double what it is now. That wasn’t why I switched, but it’s noticeable. In season I shop local for produce and some other stuff that’s grown in state or nearby, but the place I shop at for that is closed 7 months out of the year. Competition is needed, on a level playing field. But there hardly is any, decades of “Free Trade” destroyed competition and made the middle income people poor.

Okay folks, listen up. Here, IMHO, are the key things about January 6th and what role it is going to play in freeing this nation from tyranny so that we can rise up in a new birth of freedom. It doesn’t depend in any way on a hopelessly corrupt Congress or SCOTUS DC doing the right thing by the way:
First, January 6th is Epiphany. That means revelation. On the Christian calendar, it is the revelation of the Holy Spirit to the disciples. For this nation, POTUS means it to be both as revelation of truly shocking evidence to the whole nation of the degree to which we have all been betrayed, and also a revelation of God’s calling of this nation back to Christianity and Judaism.
Second, go read Article II of the Constitution. The reading of the votes by the President of the Senate (Pence) must take place before both chambers of Congress. There are requirements about a two thirds quorum and a majority vote. That means: EVERY. MEMBER. OF. CONGRESS. WILL. BE. PRESENT. They literally cannot afford to skip it, because of the Constitutional requirements (plus all of America and most of the world will be watching in real time).
This is where we come in: They will be present, and they will be completely SURROUNDED BY US. I am guessing there will be the same big screens set up on Constitution Avenue and elsewhere that were there on December 12th, and those screens will also be streaming live. Direct to us.
Mitch and Nancy are in a no win situation. They cannot constitutionally fail to hold the certification. If they do, they declare the election illegitimate and it is incomplete. No President. The Swamp LOSES.
If they hold the certification and they allow debate and the President is afforded the opportunity to present evidence of fraud and foreign interference, then you know that whatever video (probably) POTUS has in his back pocket is going to be a MOAB, psychologically speaking. With the entire world watching, there will be no opportunity for the MSM portion of the swamp to play its normal “nothing to see here” role. Jaws will drop and Neo waking up in the Matrix will have nothing on hundreds of millions of Americans, not to mention billions worldwide watching in real time. The Swamp LOSES.
If they hold the certification but refuse to allow debate (We are now here according to the latest scuttlebutt), POTUS will find a way to get the evidence out in real time during the proceedings anyways. Then Mitch and Nancy look even worse, due to the attempt to cover up and hide the truth. In real time, the information still hits the whole world. The Swamp LOSES.
Whatever is coming is going to leave 635 Members of Congress surrounded, in a shut down city, with no way out. Surrounded by hundreds of thousands if not millions of people who will be having a color revolution moment. As in, pitchforks will look merciful.
That is why it is going to be wild, and THAT is why every able bodied patriot needs to be in DC on January 6th.
Congress may still refuse to act. It might declare Biden the winner anyways. But it won’t matter. You are misinformed as to the purpose of Gohmert’s suit. It is intended to grant full constitutional authority to VP Pence unrestrained by the 1888 legislation.It is seeking clarification that the constitution has superiority over legislation.
Yes, you are correct re the purpose of Louie’s lawsuit. He spoke about it at length on Rush’s show a couple days ago.
Many lawyers argue Pence right now has the authority to do this (regardless of any lawsuit) – so I suspect Louie wants this ruling to give Pence the backing to do so, as well as to “legitimize” the move for others who do not believe it can be done this way.
ECA is an act that was meant to amend the 12th Amendment, which itself amended Article II. Since then the ECA provisions have controlled the electoral count process, I believe.
The ECA process from my understanding is not in our favor. It requires, again, from my understanding, a majority of Senators to vote for the objection (note all the Rhino Senators either not speaking up or blasting the President over this idea)- the House not sure if individual members (not in our favor, would require some Democrats) or, if by delegation then in our favor.
The cleanest, surest way – again from my understanding, would be for the legislatures of the states in question to decertify Biden electors and certify Trump electors.
An interesting question I have is whether an Act can amend a Constitutional Amendment as the ECA purports to amend the 12th Amendment.

I even commented to the cashier how dirty the conveyor belt was, the worst part is she agreed but didn’t pull out a bottle of cleaner to wash it down. She put clean bags on it so I could put my stuff down to be rung up. I hate to do it since I am in a rural area but I am going to have to change banks.

My superstore Walmart is old and very dirty. Last summer all their old refrigeration broke down and probably needed to be serviced or replaced long before. You may have a beef with WM. But do not base it on their mask policy. At no time have I worn a mask. When confronted (only at the entrance door) I simply walk right past with no acknowledgement other than a ‘Good day’ to them. Never, not once, have I been confronted by employee or customer for not wearing a mask.
Perhaps it is because I am imposing in stature. I don’t know about that for I am not over 6 foot and even some women are larger. I think it is more that I am focused on what I came to do and am not about to engage in idle banter. Very few persons dare to intrude upon one who appears driven to their task. I reckon its how one carries themself.

The Mask Patrol Greeter (MPG) hounds me everytime I run into to bank, yelling after me she will have to call the manager.
The manager never comes. The last time I was their she yelled across the store I could get a mask at Customer Service. I did not.
So, the MPG approaches and forcefully places a mask on the banking counter, “You must wear a mask.” The MPG walked through the store with a mask that was NOT in a package, placed it facedown on the dirty customer counter that is in major aisle way, and actually thought it should be worn to stop the spread.
This was at Walmart going to bank inside.

I saw what AG Barr was doing. Announcing an “investigation” into those states, but then allowing the worst offender to determine when and if he would hand over the data upon which the investigation would be based.
Once “after the election” (what did an election have to do with it? Cuomo was not running for anything) came and went, and the date for handing over (public, FOILable) records was moved to sometime in January, I was certain that the Attorney General of the United States had pulled a head fake on all those grieving families.

lets not forget, even IF these were not companies largely controlled by China and other foreign countries, these big box stored displaced and literally sunk locally owned family run small businesses everywhere in America (and arguably, around the world!)….if the sense of national security doesn’t alert one to the danger, then at a minimum the concentration of supply chain and power to a tiny fraction of the world. Just one small black swan (looking at you COVID-19) and the effects become very real. The reality is that while small locally owned family operated small businesses may never be capable of delivering the best PRICES….their existence is absolutely profound is providing real jobs, and weathering economic and natural caused events that these big box stores are simply not agile to solve.
Big isn’t better. Cheaper is better. A WIDE AND DEEP competitive supply and manufacturing economy isn’t just being American…it’s smart!

I have, more than once, walked out leaving behind a cart due to long lines and little customer service/help. I have long felt this way and these feelings were greatly enhanced after watching the documentary “Wal-Mart: The High Cost of Low Prices”. It is eye-opening.
Thank you for this. Absolutely disgusting. I have been shopping at WM superstore since the Covid shutdowns. I’ve never liked the store and basically only went there because of the convenient one stop shopping. Even with all the business this store was getting, they had the audacity to charge 6 cents for each of their plastic bags!
As of tomorrow, I will never set foot in that store again.
NV does not have a Republican legislature. There are two sets of electors but the R set was not chosen by the legislature. Republican party did it, I think.
I was heartened seeing the comments saying that people are going to boycott Walmart. I will for sure boycott Walmart. It has long seemed to me that the corporations need us more than we need them. There are other pharmacies besides Walmart. If Walmart thinks so little of us there is no reason to shop there. Is it possible that if 74 million of us do not shop there that will be the end of Walmart?
IMO, much of our power as citizens lies in our pocketbook. Where we shop and what we buy are the cornerstone of the corporate hold on us. They work very hard to make sure we remain customers.
But……and this is a big BUT……we need to ALL boycott Walmart. That is key. I do not know how to mobilise people across our nation so we all boycott Walmart, so I can only lead by example, and will.
One of my complaints about Walmart, from recent years?
Those limited quantity sales, of items coveted by those with very low incomes, that they know will result in violent mobs, trampling one another and getting in fights?
How is a corporation “woke” and socially responsible getting away with creating this kind of situation, again and again, and acting as if they bear no responsibility?
Remember when a person or persons unknown went around and cleared the shelves of toilet paper at random locations throughout the country? It created a panic, which the MSM then blamed on us being silly.
I remember that one place that seemed to have toilet paper when no place else did, was Walmart.
The sky-screaming from the RATS and RINOS indicates Good American Hawley has hit a Big Cheat nerve !!!
20 years of doing my grocery shopping at Walmart but it ends now. Oh well. Target is even more extreme left and I don’t know if Costco has moved away from censoring conservative books. I guess its back to regular grocery store prices.
I really don’t get this monopoly situation we have with Google/Facebook/Twitter/Walmart (sort of) etc. We have dozens of car companies where it takes a ton of capital to enter the market. IF the Republican actually represented conservative voters, they could easily use their position to set up seminars to get entrepreneurs together to create conservative alternatives and provide direct access to the Republican voting population. Instead, you can bet the establishment Republicans would be horrified at this idea and call anyone who suggested it a communist.
Maybe Walmart rather likes the old trade arrangements with China?
I emailed Wal-Mart about how disgusted I was about their stupid response to Senator Hawley and here’s the response I got:
