Earlier today Missouri Senator Josh Hawley announced his intent to challenge the January 6th congressional certification of the electors. A group of approximately 30 House representatives, led by Mo Brooks, will be challenging from the lower chamber.
This sets up a dynamic where formal electoral challenges from both chambers of congress will be taking place based on evidence of election fraud in several key states. The objection will initiate a debate and roll-call vote to certify electors within both the House and Senate. Vice-President Mike Pence will preside over the debate in the Senate.
A combination of The Guarantee Clause (constitution) and the Electoral Count Act of 1887 (law), establishes the framework for some to argue a fraudulent 2020 election result can successfully be challenged during congressional certification on January 6, 2021. Thus five state legislatures -under Republican control- have sent dual-sets of electors to congress: Arizona, Nevada, Wisconsin, Georgia and Pennsylvania.
[Article IV – Sec.4] The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
“The Guarantee Clause” – “At its core, the Guarantee Clause provides for majority rule. A republican government is one in which the people govern through elections. This is the constant refrain of the Federalist Papers. Alexander Hamilton, for example, put it this way in The Federalist No. 57: “The elective mode of obtaining rulers is the characteristic policy of republican government.” [citation] “The Clause requires the United States to prevent any state from imposing rule by monarchy, dictatorship, aristocracy, or permanent military rule, even through majority vote. Instead, governing by electoral processes is constitutionally required.”
Let us be clear… There is little framework for this type of constitutional issue. This is uncharted territory, and consequently there is no body of law or case study upon which to apply a historic reference. However, that said, the issue of Director of National Intelligence, John Ratcliffe, producing a report about foreign election interference could be a fulcrum issue upon which “The Guarantee Clause” of the constitution may apply.
Here’s where it gets interesting…. The Guarantee Clause puts the jurisdiction in the hands of the political bodies, executive branch and legislative branch, to decide the merit of any state vulnerability in their election outcome. There is little, if any, place for the judicial branch to play a role.
In Luther v. Borden (1849), the Supreme Court held questions involving the Guarantee Clause nonjusticiable, meaning that any remedy for a violation would lie with Congress or the President, not the federal judiciary. Nearly one hundred years later, the Court sweepingly declared that the guarantee of a republican form of government cannot be challenged in court. Colegrove v. Green (1946). (citation)
The federal government, not the state government, ultimately holds the responsibility to protect the entire United States from foreign interference within the Guarantee Clause. This would seem to apply to foreign election interference. “[B]ecause protection against invasion or domestic violence is normally available only from Congress and the President, the structure of this section suggests that the political branches have at least the primary duty to carry out its obligations.”
If DNI Ratcliffe produces a report (prior to January 6th) that outlines foreign interference in the election; and if the argument can be made the states with the contested (dual sets) of electors were subjects/targets of that interference; then a foundation to nullify the electors from the contested states is laid in congress.
In this approach the electoral nullification argument would appear to rest on The Guarantee Clause; where the state election outcome was not valid – as it is not representative of a republican form of government, and the majority vote requirement was manipulated.
If this type of legislative challenge was to take place, there is little precedent for the judicial branch to be involved except to qualify what role The Guarantee Clause would/could play and to what extent the nullification arguments are constitutionally valid.
Again, this is all uncharted territory. However, there are people claiming this process could work to keep President Trump in office. The disqualification of the contested state electors under this argument would ultimately fall upon Vice President Mike Pence who is also President of the Senate and in charge of the January 6th electoral vote certification.
There is a lot of “if-this-then” etc within this framework, and all of it ultimately is predicated on congress challenging the election (now appears likely); and VP Mike Pence then deciding which electors would be certified or nullified (long-shot); but that seems to be the argument some are making.
Immediately after Senator Hawley made his announcement, incredibly the multinational retail corporation Wal Mart responded via twitter with a snarky reply.
Good grief, it is stunning that Walmart would allow such a response. I will never step foot in their store ever again.

If I understand the key issue correctly, the question in the House is whether the state delegations vote to approve the objection, of it is simply majority rule.
Since objections were made (albeit symbolic) after the 2004 and 2016 elections, we would be wise to see what the House and Senate did then. That precedent will weigh heavily on the outcome.
If it’s just a simple majority in the House, then Biden wins. The same could also be true in the Senate, though Pence would break a tie.
He will be under extraordinary pressure to recuse himself, and will be told that he cannot choose slates that benefit him “personally”. Republicans ALWAYS fall for that line (eg Jeff Sessions).
Anyway, DNI Report is moot of it is straight majority rule in the House. No Democrats will defect. The DNI Report could provide top cover for squishy GOP delegations if the delegations are allowed to vote.
It is very strange to me how quiet the news has been around the DNI Report. No leaks after that initial flurry prior to 12/18. By now, they would have briefed the Go8, and the lack of leaks is odd. If it said there is no interference that affected the election, we’d have heard it by now. Ditto the opposite. Strange.
It seems as though the vote should be Consitutionally consistent. In that since they would vote by state for President, the vote as to whether or not to accept the electors should be by state. I don’t know what precedent or existing rules / laws might be, but this might be challengeable to the SCOTUS by the state delegations…

I stopped shopping Walmart for good the day before Thanksgiving, which is also the day at 5 pm our illustrious chinese governor was further implementing more illegal laws including mask stuff. I was entering the store at 3 pm and they tried to give me a mask and I kept waling as usual and these employees started screaming at me that I had to wear a mask and I kept walking and this one woman came running right up to me screaming and I said mandate does not start until 3 pm and she tried to protest and I kept walking. I stocked up on a few things and checked out and have not gone back and don’t miss it.

I’m with you Chip, I’m adding Costco to the list after two different 20-something employees ordered me to pull up my mask farther (it was already completely covering my nose and mouth), one of them was behind plexiglass to boot. I’m so sick of the petty tyranny I could scream, and so disappointed in 90% of Americans who basically gave in without a whimper. I’ll write to let Costco know why I’m not renewing, but I doubt they care.
Most of my shopping has gone to the small towns surrounding me, they don’t have as much so I’m actually saving money??
We have been buying groceries in a small town grocery near us.
This small town is in a county that is mask free and lockdown free and has a family owned grocery that is well stocked.

I was just about to post something like this, CEO’s are not doing the social media for Walmart.
I saw their reply. Standard corporate nonsense. I addressed it in my email to them in fact. I pointed out that no employee of mine would be accessing personal social media while on the clock regardless. Though we no longer have employees, because unlike Walmart, COVID put us out of business.
They also make no mention of what their position is, and given the corporate climate over there and how difficult they make it for American businesses to get product lines into Walmart stores, I highly doubt their position is on the side of voter integrity.

They said that they did not send it, but that someone in their social media department did and they apologized to Sen. Hawley. As is all too often the case, people react before seeing what the management response is. In a company as big as Walmart it would be very easy for an employee to post something in the company name that now the company has to live down.
If that is the case then they needed to fire the employee and make it public.
Until then its just smoke and mirrors.

Years ago I worked for a man that did business with Walmart. He was probably one of the few that managed to get WM by the short hairs. Walmart had to come to us in NY. The one time we went to Bentonville, we stayed at the Holiday Inn in Springdale and made them drive 30 minutes to us.
I will never forget the VP of WM talking about their philosophy regarding vendors. He said that they love to roll out the red carpet and make a new vendor feel super important. Then they slowly increase demand until the vendor is consumed with providing product to WM, so much so that they start losing their other customers. At that point this VP said “once we’ve got them by the balls, we squeeze until we have gotten every last drop of blood”. “Then we go get another vendor”. Screw Walmart and their “social media team.

Walmart, one of America’s largest retailers, apologized on Wednesday for “mistakenly” calling GOP Senator Josh Hawley a “#soreloser” on Twitter.
“The tweet was mistakenly posted by a member of our social media team who intended to publish this comment to their personal account,” Casey Staheli, Walmart’s senior manager of national media relations, told Newsweek.
“We have removed the post and have no intention of commenting on the subject of certifying the Electoral College,” Staheli added. “We apologize to Senator Hawley for this error and any confusion about our position.”

I absolutely agree with *almost* everything you wrote.
However, many of us keep writing, “70 million”, “74 million”, “75 million”, etc., in reference to the number of Trump voters.
The tricky part is that the machines were “flipping” votes from Trump to Biden.
So,…
We do not really know HOW many people actually voted for Trump; judging by the rally sizes of each candidate –it was probably WAY more than just 70-something million.

Walmart apologized to GOP Sen. Josh Hawley on Wednesday after a tweet from its official account called the Missouri lawmaker a “sore loser.” The retailer blamed a member of its social media team for the since-deleted snarky tweet, saying the employee had intended to send it from their personal account.
Maybe Walmart could send Josh Hawley a nice very large donation to his campaign for re-election like right now.
I do not know when he is up for re-election but a nice big donation by Walmart would smooth the apology and make it more real for me, a former customer.
And I mean a real big one.

I have never stepped into a Walmart my entire life, We once got a 200 gift card to Walmart and I sold it for 150.00. I have been supporting local stores and and have not bought a thing from Amazon either…
Does anyone remember this PBS Frontline episode from 2004, Is Walmart Good for America? Back when PBS cared somewhat. I’ve never thought Walmart patriotic or anything, they were the ringleaders driving everyone else to China to be able to compete. My shopping there has been very limited to nil the past two decades.

Isn’t the Social Media Team the same one that corresponds with the public? Good lord…we’re not idiots Walmart. It was an error all right, one that will have lasting effects.

Whenever we buy from Walmart or Amazon, we are part of the problem. I just saw a Fox guest defending both companies specifically, while the anchor smiled and agreed. Other companies have issues too, but along with Facebook and Google, these are the most destructive. We have to stop looking at these companies as American “sucesss stories.” They destroyed many good businesses, towns, and lives to get where they are.

What a horrible situation this ideology creates. Its Walmart. Shopping for crying out loud. But ‘someone’ on their team couldn’t help themselves from using Walmarts official twitter account (big points to be scored from fellow cultists) and I’m sure the Walmart apology will be posted soon.
I’m sure the Walmart employee was willing to take one for the team. I have rarely shopped Walmart, especially because of their CCP products and use of mostly self-checkout registers.
… and I won’t be entering their nasty stores again!
