BIG PICTURE – White House Responds to Speaker Pelosi Unconstitutional Impeachment Effort – (Full pdf and background)…

Speaker Nancy Pelosi and her Lawfare allies can change House rules (they did). Pelosi and Lawfare can also change House impeachment rules (they did). Pelosi/Lawfare can change committee rules (they did); and in doing so they can remove House republicans from the entire process… Which They Did.  However, what Lawfare and Pelosi cannot change is The U.S. Constitution, which they are desperate to confront.

Speaker Pelosi’s ‘Lawfare House rules‘ and/or ‘Lawfare impeachment rules‘ cannot supersede the constitutional separation of powers.

Nancy Pelosi cannot decree an “official impeachment inquiry”, and as a consequence nullify a constitutional firewall between the Legislative Branch and Executive Branch.

All of that said, there is a distinct difference between a congressional subpoena intended to compel generic testimony, and a congressional subpoena intended to compel impeachment testimony.

Attempting to compel testimony that crosses through the separation of powers; and goes even further in an attempt to penetrate the firewall around executive privilege; requires the House -or a committee therein- to carry “Judicial Authority“.

“Judicial Authority” is not absolute authority, but rather a legal reference and framework that forms the basis for an impeachment ‘compulsion demand‘ (or subpoena) by the House.  Judicial Authority is the House saying they have a legal basis to make a demand.

The reason judicial authority is necessary, is because creating Judicial authority, via the Legislative Branch full chamber vote, gives the Executive Branch access to appeal any legislative demand via the Judicial Branch (federal courts).

Repeat for emphasis:

…The reason judicial authority is constitutionally required, is because creating Judicial authority, gives the Executive Branch a process to appeal any legislative demand via the Judicial Branch (federal courts)….

Absent the creation of judicial authority the House has not created a penalty for non-compliance.  However, absent a penalty for non-compliance the Executive Branch has no process to engage an appellate review by federal courts.   This is the purposeful trick within the Pelosi/Lawfare road-map.

Speaker Pelosi’s current Lawfare-inspired road-map (House and committee rule changes therein) attempts to construct a path to impeachment that avoids asserting House “judicial authority”; because they fear losses from a Judicial Branch ruling.  Those who constructed the road-map are also concerned about outright blocks by the courts in their proceedings.

This process issue was argued by Lawfare member Douglas Letter today during a hearing on the topic of the House Judiciary Committee gaining access to Weissmann/Mueller’s grand jury evidence.  [Expanded Here]

Here’s the bottom line: “Judicial Authority”, granted by a full House vote, gives the House of Representatives more authority in their impeachment construct.  However, “judicial authority” also grants the Executive Branch a path to appeal via the Judicial Branch.

Because the Lawfare/Pelosi roadmap intends to subvert judicial authority, it is destined by design to end up running head-first into a constitutional problem; specifically separation of power and executive privilege.  That predictable constitutional issue will end up with arguments to The Supreme Court.  THAT is why the Democrats have been working for months to delegitimize the Supreme Court.

Please let me repeat for emphasis.  The Lawfare impeachment road-map is designed to conflict with the constitution.  It is a necessary -and unavoidable- feature of the plan, not a flaw.  Pelosi and the Lawfare group know they are creating a constitutional crisis; that is why the background attacks against the Supreme Court were started months ago.

Understanding this, here’s the White House response:

It is an intentional shell game to distract the country from their own corruption as the details leak out daily. I don’t believe in painting a whole class of people with a broad brush based on their profession i.e. lawyers, lawyer politicians or lawyer lobbyists but, well, you get it. Corruption is endemic to the process and no one will introduce legislation with teeth to end it. As for Gowdy, I think he’s a plant by the Uniparty.

The ideals of Freedom, Independence, and Self-Reliance. This President, more than any other in my lifetime, is championing the belief that we are all equal, that we are all to be respected, and that we are all to be dealt with equitably. President Trump’s economic plan, both macro and micro, does absolutely nothing for particular individuals…. it is beneficial to all Americans. Beneficial to every single one of us, regardless of whatever group(s) others try to divvy us up in to.

    I made a few observations when this first emerged on the previous Schiff/Jordan reply thread. Will not repeat, only summarize:

    This WH response is cast in the ‘proper’ political spheres: unprecedented process (many Nadler quotes), denial of due process (many SCOTUS refs), dishonest (Schiff made up Ukraine call).

    But IMO it deliberately pulls the most powerful counterpunch, as already highlighted by CTH: the ‘inquiry letter “subpoenas”’ have no judicial teeth. That simple fact destroys the whole attempted ‘obstruction’ fabrication as this chess match moves along. A future PDJT checkmate.

        But I am well beyond seeking appreciation here or anywhere. Three decade plus long successful careers in one lifetime, 13 issued US patents in four different subject matter areas. Two great kids and now three potentially greater grandkids. No one deserves or needs more…altho I do wish we could find a Doc capable of finally treating my significant others anaphylactic shock induced anxiety disorder.
        I am mostly working on that myself recently. Med school stuff isn’t that complicated if you do not have to know anatomy, already know the cause, symptoms, and diagnosis, and do not intend to practice yourself.

        My involvement here at CTH is purely and only because PDJT is saving my country and Sundance is calling the ‘game’ play by play. Sort of like my previous climate engagement.

        If anybody started out by being a potentially privileged swamp creature, it was me with three Harvard degrees, all with honors. Turns out I was always a Deplorable. Just now woke.

          Hi Ristvan. That is a rare diagnosis indeed. I think you should place at least a phone call and discuss if you should visit with your loved one at the Mayo Clinic In Rochester MN with this doctor: Thanai Pongdee, M.D.
          Allergist-Immunologist
          He specializes in different types of anaphylaxis and can definitively rule out the other ones and then do something specifically for your case. Because he has such a broad understanding of this immune system reaction, I bet he will be interested in the case.

      This is another reason why the Democrats in the House of Representatives are sure to pass articles of impeachment against President Trump.

      If Pelosi and the Lawfare group know they are creating a constitutional crisis with their impeachment road-map, then passing actual articles of impeachment is the surest and most effective means for that crisis to quickly gain a full head of steam..

      It’s only a matter of deciding which procedural approach can bring a bill of impeachment onto the floor for a vote of the full House while bypassing the traditional impeachment process, thus guaranteeing the question will end up in the Supreme Court.

      Their objective is to foment a long-running media-driven impeachment circus which keeps their accusations against President Trump in the headlines and which paints his legal team as cynically using the courts to avoid a trial in the Senate.

      The Democrats are playing an exceptionally dangerous political and legal game with their impeachment road-map. But they’ve already passed the event horizon, and it’s now impossible for them to pull back.

    The last time the Dems were facing the possibility of a 5-4 conservative SCOTUS majority thwarting their scheme (winning a 2016 contested swing state vote tally with a victory in the 3rd or 6th district court of appeals) a justice died of a “heart attack” while on a democrat’s ranch and while the county coroner was away. That justice’s death left a 4-4 Court that couldn’t overturn an appeals court decision. Don’t think they didn’t game that out, or that they haven’t gamed this out. The conservative justices would be wise to decline any invitations to go pheasant hunting. Wet work, indeed.

    The coverage of this in the MSM should be priceless – how can they cover POTUS’ objections without covering the many salient facts they have avoided mentioning so far, for example the lack of a House vote, and the inability of the Executive to participate? How will they will find a way to say the President finds the process invalid, without saying WHY?

    BTW, the President’s letter omits what I think is an argument that would resonate well with the average citizen. This is the Dems holding the inquiry in the Intel Committee rather than the Judiciary. I have read that this was to facilitate holding the hearings behind closed doors, allowing the Dems to refuse to release transcripts, but freeing them to leak juicy tidbits!

    Don’t forget the NYMag wrote an article earlier this year about the case for impeaching Justice Thomas for lying to get on the Supreme Court and how women’s voices were silenced back then. The left wants to delegitimize the current Supreme Court by saying Thomas and Kavanaugh both lied about sexual assaults and both should be impeached. My guess they will bring this up again at some point in time. Democrats and msm want to impeach anyone they disagree with!

            Fair point, but I still find the IG’s lack of investigative rigor to be noteworthy, since “Biden” was specifically mentioned on the call. If that is the connection, it should ABSOLUTELY have been disclosed and considered in evaluating the credibility of the initial complaint.

            But I agree – “Biden” freaked them out much less than ‘Crowdstrike’. They’ve had him take a dive once before, so they know he’ll do it again.
