Request for Stay – DOJ Stalls For More Time Before Forced Production of Comey Memos…

In the ongoing battle for the unredacted Comey Memos, and David Archey Declarations describing those memos [Backstory Here], today the DOJ filed a motion for a stay (full pdf below) against the forced production of the documents (previously ordered by Judge Boasberg).

Hat Tip Techno Fog – As a likely result of this DOJ motion, Judge Boasberg will issue a deadline on production. Whether that deadline will be 14 days or until the end of the appeal deadline (60 days from August 12) is still unknown.

[Backstory for those unfamilar] In the background of what was The Mueller Investigation, there was a FOIA case where the FBI was fighting to stop the release of the Comey memos.  Within that courtroom fight Mueller’s lead FBI agent David Archey wrote a series of declarations to the court describing the content of the memos and arguing why they should be kept classified.

The FOIA fight shifted; and the plaintiff, CNN, argued for public release of the content of the FBI agent’s descriptions, now known as the “Archey Declarations”.

After a lengthy back-and-forth legal contest, on June 7th Judge James E Boasberg agreed to allow the FBI to keep the Comey memo content hidden, but instructed the DOJ/FBI to release the content of the Archey Declarations.  On August 2nd the DOJ/FBI changed their position and claimed national security, “sources and methods” would be compromised by the release of the Archey Declarations.

On August 12th Judge Boasberg completely rejected the DOJ and FBI argument.

On August 13th the DOJ told CNN their compliance on production of the documents was pending their decision to appeal the August 12th judicial order.

On August 14th CNN filed a motion requesting Judge Boasberg to order immediate compliance from the DOJ with the release.

So today, August 26th, the DOJ is requesting a “STAY” of judicial order unless and until all legal appeals to a higher court are exhausted.  Here’s the motion:

The issue at hand is tangentially related to the current Inspector General carve-out report, through the aspect of the Comey Memos.

We are currently anticipating a report from the OIG related to former FBI Director James Comey, his writing of the memos, and the leaking of some of those memos to the media via his friend Daniel Richman.  {LINK}

No-one knows the number of memos that James Comey has written.  [We may get that answer in the IG report.]  There are nine memos written by James Comey surrounding contact and conversations with President-elect and then President Trump (2016/2017).

However, based on the court declarations by Mueller’s former lead FBI investigator David Archey, it sounds like there are many more memos than anyone currently understands; including memos about the investigation of candidate Trump, that were written during the “Crossfire Hurricane” investigation 2016 and 2017, that describe investigative details, sources, operations and code-names of intelligence assets used in the investigation.

The Comey memos are not just about his contact with Donald Trump as a candidate, president-elect or president.   The media keeps downplaying the memos as a few notes taken by the former FBI director, but all of the background information suggest the assembled writing is something more akin to a personal diary.

My strongly researched suspicion is that James Comey kept detailed private notes of what was happening during the operation(s) against Donald Trump and his campaign team, both during the campaign and after the election when President Trump took office.  Just take a look at how David Archey described the content and you can see those notes, now called memos, were in addition to FD 302 reports being filed by FBI officials.

Why James Comey would keep detailed notes beyond what was being officially recorded in the FBI 302 reports is likely a question to be answered within the pending inspector general report.   There’s a lot of sketchy non-transparent stuff going on amid all of this….

The United States Department of Justice Civil Division, Federal Programs Branch, is fighting this court ordered release.  The DOJ Assistant Attorney General for the Civil Division is Jody Hunt. That name might be familiar to you because Jody Hunt was Jeff Sessions former chief-of-staff.

We previously anticipated Jody Hunt being involved with this current case; the DOJ and FBI attempt to block release of the memos and declarations.   However, we have recently been informed that Jody Hunt was recused from the case by DOJ lawyers during the time when the Mueller investigation was ongoing.

According to the latest information we can gather, DOJ Asst. Attorney James Burnham  replaced Jody Hunt for all oversight issues in this court battle.

        Comey made it clear, very early on, that the President didn’t realize the DOJ and FBI were not his to judge and/or lead. He said he never once had contact with Obama and that was the appropriate relationship Trump was not respecting. He was shocked to have been invited to dine alone with President Trump. Actually, Comey and his cohorts considered the FBI and DOJ the Fourth Branch, but not subject to Congressional oversight.

  2. The entirety of this matter must be completely understood only through full reference to the complete legal shrewdness of this one Mister James Comey, at least in reference to providing multiple layers of legal protection to himself. Each one is a different layer of the same onion.

    This particular layer is intended to be revealed at the depth at which one might expect to uncover “the actual thoughts of the perpetrator.” In this layer of defense, Comey (1) prepared his own “confessions” to take the place of whatever an investigator might actually have uncovered; and then (2) devised a way to ensure that this was what the public would see. He did this by, first, cloaking “his confessions” in secrecy, then, ensuring that “the Reader’s Digest version” (conveniently authored by someone other than himself) would be (literaly … courtesy of CNN)
    front-page news.”

    In other words: “an irresistible honey-pot.”

    By this means, he would strive to establish that “he was guilty(!), and everyone in America knew it.” Which would, of course, mean that no Juror in America could be said to presume that he was not guilty. Which would, of course, mean that he could not be tried for anything at all, because no Juror could be found that would presume that he was not guilty.

    The only thing that he needs is for a Court to release it – before he could possibly be indicted on any Federal charges, and ideally before any Grand Jury could be convened. He simply needs to control the narrative.

      CNN complies with Sir Comey…Andrew McCabe can now tell the story directly to the public. Ether favorably or unfavorably, depending on whether these two are STILL in the same scamp or not.

        Agree. Comey’s “diary” is his defense and insurance policy. I assume he can prove that these notes were written contemporaneously and that most of them were shared with a select few in the FBI. They provide the rationale for this attempted coup and could implicate many others, including the WH, in this plot.

        I am puzzled why Barr’s DOJ is fighting the release. Is it because they are part of an ongoing criminal investigation? Has CNN been tipped off or being used as a vehicle by Comey, McCabe, Clapper, or Brennan to get their story out there now before the IG report and Durham investigation are released? McCabe’s recent actions of fighting his firing claiming inappropriate influence by the WH on the IG (Strzok claiming the same thing) and accepting a job with CNN as an analyst could signal that he and Strzok don’t want to be the fall guys for the attempted coup. They were just the “errand boys” to use Patrick Byrne’s turn of phrase. CNN is the voice of the Resistance and Deep State. CNN knows what is in the Archey memoranda.

          If they are evidence, Barr can seize them as evidence although they would probably be self-incrimination. What Comey wants to do is control the narrative, and to thereby poison the well of potential jurors. Many a mob boss did the same by publishing stories in the Chicago Tribune in advance of any trial. Everybody read “the Trib.”

          “Your honor, all charges against my client should be dismissed with prejudice because the Grand Jury and/or the Jury was biased against him.”

          It could happen. “Guilty as hell and he knows it, but he’s walking out the front door because he said it.” And then, “because CNN said it.”

            I’m beginning to understand why POTUS might not want their immediate release. Election year, campaign for Dems already in gear, half a nation looking for reasons to buttress their contention POTUS shouldn’t be in the Oval and looking to convince a few more % of people of his “bad character, ” and the nation as a whole not yet EDUCATED about the coup.

            If you were someone tasked with telling the story of the attempted coup of a Presidential candidate, a POTUS-elect, and an elected POtuS, would you START w/ Comey or someone else?

            If Barr really is a good guy, he knows the story has to be told in a unified, cohesive way and starting w/ a guy whose diary makes him out to be someone protecting America from an obstructionist POTUS is not a good start.

            • POTUS is remaining “100% hands-free” concerning their release. No, the Prosecutors are the one who are very-rightly fighting it. They obviously don’t want the “perps” to poison the Jury waters.

              “That diary” is obviously the work-product of a defendant, and … a known liar. He had no credible reason to “suddenly take it upon himself to keep a diary” unless he intended to build for himself yet another onion-layer of legal defense. Now that things have “gone from bad to worse” for him, he’s trying to deploy it. And the prosecutors, who know full well what he is up to, are trying to at-least delay it.

              There must be a reason … there must be a time-line … for this delay. There must be a shoe waiting to drop, and Comey and his defense team must know exactly what it is.

I try my best to follow what has been said & what has been done & by whom, but much like Obama used to tell anyone who listen, “I just found out about it in the media, like you.” But what are you going to do when Comey’s C.Y.A bullshittery is made public, we’re told that they are 100% factual because Jimbo is a great, patriotic American & the meany-weeny President is out to get Jimbo because he is such a great, patriotic American – besides, why would the gubiment try so hard to stop the release of them if they were anything but the absolute truth?               At the rate we are going, with the only real information coming from Judicial Watch FOIA requests that produce a single memo after a year of filings, we will never know what happened. This is a disgraceful episode. The President has the power to issue an order to everyone in the executive branch to immediately provide full information on the Russia collusion investigation so that everything can be made public by next week. But that won’t happen. We are being played. The goal is delay delay delay. They think we are stupid. But clearly, if the President wanted us to know what happened he could have done what he promised – full declassification. He didn’t fulfill his promise.

      You can see for yourselves what these declarations currently look like and partially say

      They’re rather vague and I highly doubt Archey quoted Comey….
      especially a Comey CONFESSION of a crime.

      Namely because Archey made these declarations TO A JUDGE.
      “Your honor please please keep the Comey Memos HIDDEN because Comey confessed to crimes”
      is probably NOT the best “declaration” to make to a judge to convince him to HIDE THEM.

All before Horowitz and his massive tome come out-by that time the public will have made their mind up, quickly and based on the first to hit the media-which is typical of the public.         The Comey material would be exhausted upon the public through every possible pore, where it would be presented as “unvarnished, unquestionable Truth.” (And of course, “evidence of Obstruction of Justice by President Trump,” but you already knew that was coming …)

      So it appears the only way ANYONE sees Comey’s memos now is if Barr pries them from Wray’s weasel-like paws.

    • No, I don’t think so. If you accuse a government officer of a felony crime and convict that person, even in election season, you’ve done nothing wrong. The matter of an attempted coup and the general matter of abuse of government powers (which, in my opinion, ought not exist anyway) is timely and must be settled. The President is still the President and he wants justice to be served. And yet, as you notice, he is being very careful that he is not the one pushing it directly.

      • By delegating [limited and specific …] declassification authority to “William Barr as an individual” and for this specific purpose, Trump enabled Barr to provide materials to a Grand Jury. If these happen to be materials that “even all of us here(!) do not know yet anything about and do not suspect,” the case would be quite solid that the Grand Jury was not biased.

        And, if the President kept his hands completely clear, he is defended against the otherwise-inevitable charge that he is “obstructing justice” by “throwing his enemies under the bus through the use of his awesome and singular prerogatives.”

        I think many people are overestimating the “lethality” of getting the redacted portions of the Archey Declarations released alone.

        Here’s a just a sample of what Archey DECLARES is IN the Comey memos:

        “information about whether the FBI initiated coverage through the Foreign Intelligence Surveillance Act (FISA) on a particular individual”

        “information about the president’s foreign policy decision-making”

        These ARE Archey’s Declarations.

        Real compelling stuff.

        He “declares” in generalities NOT SPECIFICS
        It’s highly doubtful that Archey INCLUDED quotes directly from Comey’s memos in a declaration TO A JUDGE that ALONE would be evidence of criminal wrongdoing on Comey’s part.

        Don’t get me wrong…..I WANT to see the redacted declarations as they most certainly INDICATE things.
        And can be connected to information FROM OTHER SOURCES.
        But in and of themselves…..they WILL be VAGUE in what they INDICATE
        Just like the ones we can see NOW.

    Here’s a simple litmus test to help “evaluate” AG Barr IMO…………

    Ask him yes or no, has he or any DOJ Attorney spoken to Assange this year about how Wikileaks got the DNC emails?

    A DOJ managed Special Council after 2.5 years told the world it was the Russians who hacked the DNC Server while we have all seen the Ratner video and the lawsuit/claims by Ed Butowsky, which absolutely dispute the SC findings.

    So, if you are an AG who is only after the truth, so this can never happen again, would not one of your absolute MUST DO’s, be to interview/depose Assange???

    Or better yet ask if the DOJ ever confiscated the DNC Server and had their forensic team inspect it vs just accepting the word from a 3rd party via a letter.

    A simple yes or no answer, Mr. Barr.

      • He is only the second person in American history to serve as Attorney General twice. He didn’t need the money. He didn’t need the notoriety. He knew that he was stepping into “an extremely politically-charged situation.” So, why in the hell would he do it? I think that there was only one reason. A very good reason. “It’s payback time” for the American system of justice, which for much too long has been under the control of criminals.

        I’m completely in the dark, just like everyone else. I have no idea what’s on the other side of that black curtain. Sometimes I get very cynical too.

    We are all madder than hell over what happened. Problem is, how much was truly criminal, as in provable violations of US Code? These people were pretty sloppy but most were lawyers.Look how much the Clintons have gotten away with for decades, tho I acknowledge they didn’t get serious scrutiny.

    Given the long standing, like forever, precedent that no president has ever pursued criminality of a previous president (a professional courtesy each one expects from the next), anything Barr might do MUST be airtight. Especially in this highly charged 50/50 partisan country we now find ourselves living in with the left having the added muscle of street mobs and the media supporting them.

    I can’t help but feel/hope at this point that anything Barr is hiding is being kept back for a higher purpose.

    I could be wrong, since as Sundance has pointed out, the DOJ has not claimed “ongoing investigation” on the Archey material.

    I am waiting until the IG report is released before I throw in the towel. I don’t believe in borrowing trouble tho I also don’t consider myself a glass half full girl.

    We need to hang loose at this point and keep our fingers crossed….as we make sure our powder is still dry

    The goal is to delay until it can be reasonably argued it is “too close” to the 2020 election. First pit stop target is the Thanksgiving through New Years Day break in Judicial action when little occurs. Then the target moves to May/June of 2020. Given the opportunity to file various motions to reconsider, the appeal, (extraordinary) appeal motions, rehearing en banc if losing, etc., this should be a piece of cake. Besides, once it can be argued to a court the election is a “mere six months away” it’s all over.

    The FBI has already successfully delayed for several months complying with the June 2019 order. This will continue. We have already lost, we just don’t know it. And I’m pretty sick and tired of constantly losing.

      the sheer number of individuals necessary to complete these tasks and then subsequently keep mum boggles the imagination. Also, many in Congress have seen all of the “evidence” which allegedly shows criminal behavior at the highest levels in FBI, CIA, NSA etc. yet they blithely carry on with their careers – how is this possible?

        I think that progress on the justice issue is inextricably linked to PTs chances of re-election.

        He would be taking a risk by not pursuing justice before the election. If he loses, any chance of justice is gone forever.

        Before the midterms, I believed that focusing on the economy and winning the midterms was paramount, and waiting until after the midterms to pursue justice made sense.

        We may not have had a chance in the midterms regardless, considering the number of Rs who just quit, but I now think there is no justification for that strategy anyway.

        Our access to justice was greatly hampered by losing the House. It would be permanently squashed if we lose the Presidency.

        The President needs to throw us a bone. Some movement towards justice for the greatest scandal in US history has to be made for him to have the best chance at 2020.

    1) how long did Epstein last WITHOUT all the cats let out of his bag?

    2) does anyone remember Barr’s preliminary statement on the Epstein report? Anyone remember how the press lost it’s mind because they needed the thing so they could flop their narrative out there first?

    3) anyone remember how someone leaked to the press that indictments were coming down prior to release of the Mueller report, and Barr made them correct that by sending Peter Carr out to refute it?

    4) why would Barr tell a Senate committee that he thought spying occurred?

    5) why did Durham and Co. go to Europe to shake out the Mifsud component?

    6) why would the DOJ reopen the Clinton email stuff?

    This thing is so big, with so many players, and so damnng, for so many perps, that my personal belief is that the dam breaks all at one time. None of this plug a leak here and there, patch this, prop up that. In addition, there is enough out there that makes the thing impossible to cover up and DOJ/FBI/Government still maintain any credibility or authority. All these individual cases where FOIA is being upheld by judiciary are probably making it more complicated for Barr to line everything up in order.

    One more question: is there anyone out there who really believes Trump was gonna let these fu€kers get away with this sh!t after he has reminded us repeatedly that it can never happen again to another president?

    Which President? Obama? Are they trying to hide the extent of Obama’s “nonpublic interactions” with “specific foreign governments and officials,” and his resultant personal involvement in authorizing/commanding certain actions targeting candidate and/or President-elect Trump?

    Trump? Are they trying to hide details concerning the identities and activities of various moles embedded in the State Department or elsewhere in the foreign policy apparatus who were tasked with monitoring Trump’s foreign policy deliberations, and reporting back to Comey, Yates, Boente, McCabe, Strozk, etc on anything the moles deemed evidence of a “tilt” toward better relations with Russia?

    To me Barr’s conduct to date is somewhat of a conundrum. During his confirmation hearing he was willing to state the obvious that “spying” had occurred, he just wanted to know if it was predicated or not and he said he would answer Grassley’s letter, two points for our side. But when Mueller finalizes his report and submits it to his office he actually allows this piece of garbage to be published in it’s entirety. In the aftermath we find out that he asks (orders) Mueller to highlight any Grand Jury testimony, so that it can be quickly redacted from the same and yet the report as submitted to his office contains no such highlights. So, rather than admonish the SC’s office he writes a summary to give his office some breathing room and then takes on the task of determining what needs to be redacted before the report is released. According to the law he could have written a formal letter outlining the conclusions of the M report and left it at that, but he does not. Even worse he fully appreciates how poorly that report is written as well as the intent behind Vol. 2 and yet he allows this too to be published knowing full well it does not comport to the laws governing the SC’s office.
    I can easily envision two scenarios behind these actions. 1) He knows how badly the report is written and he wants to expose the SC’s bias and inept investigation to the public. or 2) He knows this is garbage, he knows it violates the law on multiple levels and that it’s purpose is to damage the President and he’s ok with that.
    I’ve watched his interviews, examined his actions with a microscope and listened to SD’s opinions on Barr for months now and I can only come to one conclusion. That Barr recognizes how politically charged this situation is, that he appreciates how divided the nation is, he knows that no matter what he says or does the Dems will condemn any action he takes, and that the press is not on his side or even the side of Lady Justice. He knows he’s walking a judicial and political tightrope with the fate of our country riding on his back and one misstep could result in chaos in the streets. He’s willing to take on the Dems because he knows they’re full of it “did you bring your handcuffs?”.
    For now I’m going to give him the benefit of the doubt and see how this all shakes out.

      “A special counsel’s work product” is ordinarily secret, delivered only to the Attorney General and his staff. What better way to show the world what a legal impostor this thing was? Particularly with regards to “Volume 2,” this hunk-of-trash bears no resemblance whatsoever to an actual, legitimate, Special Counsel Report. What better way to demonstrate this, than to publish it? Now, every lawyer in the country has good reason to say, “hey, you must be joking, right?”
